Sir, Kindly refer your letter no. nil dated 10th February, 2010 alongwith project

documents including Form-I, Pre-feasibility Report and draft ‘Terms of Reference’ as per the EIA Notification, 2006. It is noted that proposal is for the Red Pigments (40 MTPM) and Yellow Pigments (40 MTPM) Manufacturing Unit at Old Survey No. 81/2, Block No. 142, Village Dabhasa, Taluka Padra, District Vadodara, Gujarat by M/s Globex Laboratories (R & D) Ltd. Following products will be manufactured:

S.N. Products Capacity (MTPM) 1 Yellow Pigments (Powder/cake/dispersion /preparation) 40 2 Red Pigments (Powder/cake/dispersion /preparation) 40

Draft Terms of Reference (TOR) have been discussed and finalized during the 12th Expert Appraisal Committee (Industry-2) meeting held on 15th–16th July, 2010 for preparation of EIA/EMP. Following are the ‘TORs’:

1. Executive summary of the project 2. Justification of the project. 3. Promoters and their back ground 4. Regulatory framework 5. Project location and plant layout. 6. Infrastructure facilities including power sources.

7. Total cost of the project alongwith total capital cost and recurring cost/annum for environmental pollution control measures.

8. Project site location along with site map of 10 km area and site details providing various industries, surface water bodies, forests etc.

9. Present land use based on satellite imagery for the study area of 10 km radius. Location of National Park/Wild life sanctuary/Reserve Forest within 10 km radius of the project.

10. Details of the total land and break-up of the land use for green belt and other uses.

11. Site-specific micro-meteorological data using temperature, relative humidity, hourly wind speed and direction and rainfall is necessary.

12. List of raw materials, products alongwith the production capacities and list of solvents and its recovery plan.

13. Commitment for not using azodyes in the process should be given. 14. Detailed list of raw material required and source, mode of storage and

transportation. 15. Manufacturing process details alongwith the chemical reactions. 16. Design details of ETP, incinerator, if any alngwith control of Dioxin & Furan,

boiler, scrubbers/bag filters etc. 17. Details of water and air pollution and its mitigation plan 18. Ambient air quality for all the parameters including VOCs within the study

area of 5 km., aerial coverage from project site. Location of one AAQMS in downwind direction.

19. Ambient air quality modelling for plant. 20. Action plan to control ambient air quality as per NAAQES Standards notified by the

Ministry on 16th September, 2009. 21. One season site-specific micro-meteorological data using temperature, relative

humidity, hourly wind speed and direction and rainfall and AAQ data (except monsoon) for PM10, SO2, NOx including HC and VOCs.should be collected. The monitoring stations should take into account the pre-dominant wind direction, population zone and sensitive receptors including reserved forests. Data for water and noise monitoring should also be included.

22. An action plan to control and monitor secondary fugitive emissions from all the sources as per the latest permissible limits issued by the Ministry vide G.S.R. 414(E) dated 30th May, 2008.

23. Determination of atmospheric inversion level at the project site and assessment of ground level concentration of pollutants from the stack emission based on site-specific meteorological features.

24. Permission for drawl of 180 m3/day water from the CGWA/SGWB/concerned authority. Water balance cycle data including quantity of effluent generated recycled and reused and discharged.

25. Ground water monitoring minimum at 6 locations should be carried out. Geological features and Geo-hydrological status of the study area and ecological status (Terrestrial and Aquatic).

26. The details of solid and hazardous wastes generation, storage, utilization and disposal particularly related to the hazardous waste calorific value of hazardous waste and detailed characteristic of the hazardous waste.

27. Details of land fill as per CPCB guidelines 28. Location of secured land fill/TSDF alongwith design details. 29. Authorization/Membership details of the EICL, Umaraya for the disposal of

liquid effluent and TSDF, M/s NECL, Umaraya for the disposal of solid waste/hazardous waste.

30. Ground water monitoring around the land fill site 31. Risk assessment for storage for chemicals/solvents and phosgenes. 32. An action plan to develop green belt in 33 % area 33. Action plan for rainwater harvesting measures at plant site should be included

to harvest rainwater from the roof tops and storm water drains to recharge the ground water.

34. Occupational health of the workers needs elaboration including evaluation of noise, heat, illumination, dust, any other chemicals, metals being suspected in environment and going into body of workers either through inhalation, ingestion or through skin absorption and steps taken to avoid musculo-skeletal disorders (MSD), backache, pain in minor and major joints, fatigue etc. Occupational hazards specific pre-placement and periodical monitoring should be carried out.

35. Socio economic development activities should be in place. 36. Note on compliance to the recommendations mentioned in the CREP

guidelines. 37. Detailed Environment management Plan (EMP) with specific reference to

details of air pollution control system, water & wastewater management, monitoring frequency, responsibility and time bound implementation plan for mitigation measure should be provided.

38. EMP should include the concept of waste-minimization, recycle/reuse/recover techniques, Energy conservation, and natural resource conservation.

39. Name and location of the TSDF alongwith membership should be incorporated.

40. Total capital cost and recurring cost/annum for environmental pollution control measures.

41. Any litigation pending against the project and/or any direction/order passed by any Court of Law against the project, if so, details thereof.

42. Public hearing issues raised and commitments made by the project proponent on the same should be included separately in EIA/EMP Report in the form of tabular chart with financial budget for complying with the commitments made.

43. A tabular chart with index for point wise compliance of above TORs. The following general points should be noted:

(i) All documents should be properly indexed, page numbered. (ii) Period/date of data collection should be clearly indicated. (iii) Authenticated English translation of all material provided in Regional

languages. (iv) The letter/application for EC should quote the MOEF file No. and also

attach a copy of the letter. (v) The copy of the letter received from the Ministry should be also attached as

an annexure to the final EIA-EMP Report. (vi) The final EIA-EMP report submitted to the Ministry must incorporate the

issues in this letter. The index of the final EIA-EMP report must indicate the specific chapter and page no. of the EIA-EMP Report.

(vii) While preparing the EIA report, the instructions for the proponents and instructions for the consultants issued by MoEF vide O.M. No. J-11013/41/2006-IA.II (I) dated 4th August, 2009, which are available on the website of this Ministry should also be followed.

(viii) The consultants involved in the preparation of EIA/EMP report after accreditation with Quality Council of India (OCl)/National Accreditation Board of Education and Training (NABET) would need to include a certificate in this regard in the EIA/EMP reports prepared by them and data provided by other organization/Laboratories including their status of approvals etc. In this regard circular no F. No. J -l1013/77/2004-IA II(I) dated 2nd December, 2009 posted on the Ministry’s website http://www.moef.nic.in may be referred.

(ix) ‘Certificate of Accreditation’ issued by the QCI to the environmental consultant should be included.

These ‘TORs’ should be considered for the preparation of EIA / EMP report

for the Red Pigments (40 MTPM) and Yellow Pigments (40 MTPM) Manufacturing Unit at Old Survey No. 81/2, Block No. 142, Village Dabhasa, Taluka Padra, District Vadodara, Gujarat in addition to all the relevant information as per the ‘General Structure of EIA’ given in Appendix III and IIIA in the EIA Notification, 2006. The EIA/EMP as per TORs should be submitted to the Chairman, Gujarat Pollution Control Board (GPCB), Gujarat for public consultation. The GPCB shall conduct the public hearing/public consultation as per the provisions of EIA notification, 2006. You are requested to kindly submit the final EIA/EMP prepared as per TORs and incorporating all the issues raised during Public Hearing / Public Consultation to the Ministry for considering the proposal for environmental clearance within 2 years as per the MoEF O.M. No. J-11013/41/2006-IA.II (I) dated 22nd March, 2010. Role of Site Main Controller As soon as he is notified about the incident, the SMC, shall first visit the Incident site, review the

actions and proceed to the Emergency Control Center and take charge of the incident,

The SMC shall have over all responsibility for directing operations and calling outside help from Emergency Control Center,

SMC shall assess the situation quickly and find out the level of Emergency (L1, L2, L3) from the Incident Controller, FOR :

Level 1 - EMERGENCY: May be handled with the resources available within the factory premises.

Level 2 - EMERGENCY: On-Site Emergency plan should be activated

Level 3 - EMERGENCY: Action to be taken to operate the Off-Site Emergency plan with District Authorities.

Ensure that Key-Personnel are called-in,

Personnel Safety,

Plant, Property and Environment Safety,

Minimum loss of production.

Continually review & assess possible developments to determine most probable cause of events.

Direct the safe shut down of plants in consultation with the Incident Controller and Key-Personnel if necessary,

Check that all non-essential workers, visitors, contractors are evacuated to assembly points.

Give instructions to the Fire Fighting and rescue team,

If necessary for evacuation of the neighboring population,

Ensure that search for casualties within the affected area have been properly and timely rescued, first aid provided & arrange for hospitalization of victims and additional help if required.

Ensure that P&A In-Charge liaise with out-side agencies such as Police, Services, District Emergency Authorities, Collector and Dy. Director of Factories. Provide advice on possible effects to areas out-side the factory,

Arrange for up-to-date recording of Emergencies.

Do not restart the plant unless it is declared safe to start by competent authority.

Role of Incident Controller Incident Controller’s Primary duty is to take charge of the scene of Incident. His responsibilities / duties are as under:

Ensure on top priority, any victims are rescued as per EER, appropriate first aid provided and shifted to nearest doctor/hospital,

He may be required to take decisions whether to stop or continue any process and take technical decisions to control the incident and simultaneously inform / consult Senior Officer as per requirement.

Immediately assess the scale of emergency likely to exist i.e. L1, L2, or L3 and take action as per the emergency.

The Incident Controller will work under the directions of the Site Main Controller. However, till his arrival he may have to execute the following responsibilities:

Direct for evacuation of plant and other areas likely to be affected by the Emergency.

Ensure Key-Persons are called-in.

Direct all operations within the affected area with the following priorities:

Ensure the safety of personnel.

Minimize damage to Plant, Property and Environment.

Minimize loss of Material.

Other Emergency Services to be managed by the incident controller

1. Direct for search of casualties.

2. Evacuate Non-Essential workers to Assembly Points. 3. Brief the Site Main Controller and keep him informed about the developments.

Preserve evidences that will be necessary for subsequent inquiry in to the causes of the emergency and deciding on the preventive measures.

Role of Fire & Safety Services These services are to be provided by the Chief Fire & Safety Officer, Fire Safety Officer and Assistant Fire Safety Officer, whose roles are described.

Roles of Chief Fire and Safety Officer (CFSO) / Fire Safety Officer (FSO), in Order of Priority

1. He shall be the only person to direct the Fire Fighting and other Emergency Operations while other Fire & Safety officers shall assist him.

2. He shall keep in constant touch with Site Main Controller & Incident Controller and Key-Personnel. 3. If required, he is to get the help from: 4. State Fire Brigade located at _______ 5. Fire Station Phone No. is ______ 6. Mobilize Personal Protective Equipments and other Safety Appliances. Will direct crew members of

the scene of Emergency & arrange replenishment of equipments / Extinguishing media etc.

Role of Assistant Fire & Safety Officer (AFSO)

On being notified about the location of fire / gas leak, he is to immediately proceed to the scene of incident with crew.

He will position the Fire Tender at proper place depending upon the wind direction so as to ensure safety of the crew. For gas leak, he will start fogging/fine spray jet, and for HSD fire he will start foam,

Till the arrival of CFSO / FSO, guide the Fire Crew in Fire Fighting and rescue operation by giving clear cut instructions.

Ensure that the crew members are provided with proper Safety Equipments for tackling the Emergency.

Assessing the severity of the Incident, immediately report to Emergency Control Room.

Call for additional requirement such as vehicle, equipments, Extinguishing media or help from outside agencies.

Roles of Fire Crew Members

On hearing Fire Alarm / Emergency Siren, they shall immediately report to the Fire Control Room and proceed to the scene of the Incident and work under the direction of AFSO.

Fire Control Room Operator (Fireman)

1. Immediately inform to CFSO / FSO / AFSO about the incident and work as directed by them. Inform the main security gate.

2. See that pressure in Fire Hydrant System is maintained.

Role of Pollution Control Services – Head (Environment)

After declaration of Major Emergency (i.e. L2 or L3), by the Site Main Controller he will:

He will arrange for announcements to be made to the general public in case of Level-3 Emergency.

He will co-operate with the off site emergency controller i.e. local crisis group authorities, in evacuation and medical assistance programme.

He will arrange for the suitable treatment of wastewater and hazardous wastes generated by the emergency control activities

Role of Medical Services - Medical Officer 1. On being intimidated about the emergency, he will immediately contact the Site Main Controller.

2. He will render necessary treatment at the first-aid centre and nearby hospital(s). 3. If required, he will arrange for hospitalization and treatment of patients in outside hospitals. 4. He will mobilize extra medical assistance from outside, if necessary. 5. He will make arrangements for treating affected public (if any) with the help of the Head

(Environment)

Role of other medical staff

As directed by the Medical Officer.

Engineering Services - Maintenance In-Charge On hearing of the emergency siren, he will immediately contact emergency control room and

arrange for engineering services related to mechanical, electrical, instrumentation & automotive equipments such as crane, heavy vehicle, lifting M/C & NDT services as the situation demands.

He will arrange mobile equipment like Crane, Fork Lifts, and others, if required.

He will mobilize more maintenance staff for help if required for emergency engineering work.

Manager (Electrical)

He will mobilize more man-power if required for Emergency Electrical Work.

He will direct concerned personnel for providing extra lighting / isolating electrical supply as per requirements.

Manager / Superintendent (Instrumentation)

He will mobilize more-man power if required for emergency instrumentation work.

Welfare Services - Role of Welfare Officer He will co-ordinate the passing on of information to relatives of affected persons,

He will depute one person each, to all assembly points to carry head count of all personnel, and pass on the information to the Chief Emergency Controller,

He will arrange the presence of company representatives at the hospital(s) to look after the needs of the affected personnel,

He will prepare records of affected personnel noting their local and permanent address,

Arrangement of hot drinks / snacks / food as required will be carried out under his supervision.

Security Services - Role of Security In-Charge (Security Officer / Asst. Security Officer)

On hearing the emergency siren, he shall find out the location of the incident (fire / gas leak / spill / explosion) and inform the location of the same to the key personnel coming to the plant.

He will depute the security guards for manning gates and traffic control at the incident site,

He will prevent unauthorized entry in to the site

He will render assistance as demanded by the chief fire & safety officer or the fire & safety officer,

He will mobilize additional security force for help, if required,

He will direct ambulance(s) and emergency vehicle(s) to the scene of incident,

He will help evacuate persons within the scene of incident,

As directed by the site main controller, he may be required to operate the public address (PA) system for warning surrounding villages for evacuation.

Security Guards

On hearing the Emergency Siren, they will contact the security officer and work under his directions.

Replenishment Services - Role of Materials / Store Officer Arrangement of additional manpower for handling store items.

Issuing of items / equipments required during emergency.

Taking immediate action of emergency procurements & arrange additional man-power for local purchases, if required,

Co-ordination with Manager (Finance) for financial requirements.

Role of Mutual-Aid Members – Role of Mutual Aid Scheme Partner

(In case there is a mutual-aid scheme between MPL and surrounding industries in the vicinity).

1. On receiving the call they shall proceed immediately with fire crew & fire tenders,

2. They will be guided to the place of the incident by the main gate security guard, 3. The fire crew in-charge will report to the fire officer of the unit in which the incident has occurred, 4. The heads of the assisting fire brigades deputed by mutual aid scheme partners will ensure safety of

their crew members involved in emergency operations.

Internal Emergency Reporting Procedure and Communication The role of the first eye witness is important. The first eye witness may or may not be competent in facing emergencies, and accordingly, his actions will differ.

Trained first eye witness

If the first eye witness is a suitably trained or competent person, he will carry out the following on witnessing an abnormal incident:

1. Look at the wind sock and note the wind direction. He will then shout (preferably in local language):

“Fire, Fire …..” in case of a fire “Gas Leak, Gas Leak …..” in case of a gas leak 2. Ensuring his own safety, he will control the incident to the extent possible. This could be done by

carrying out first-aid fire fighting. 3. He will then inform the incident controller about the nature of the incident and actions taken so far. 4. With due safety to self and using appropriate PPE’s, if available, he will try to remove any accident

victim from the hazard zone.

Untrained first eye witness

If the first eye witness is not a suitably competent or trained person, he shall do the following on observing any abnormal incident:

1. Look at the wind sock and note the wind direction. He will then shout (preferably in the local language):

“Fire, Fire …..” in case of a fire “Gas Leak, Gas Leak …..” in case of a gas leak 2. He will then look for the nearest competent and trained person, about the incident. Alternately, he

will inform the incident controller through available communication channels or in person. 3. On receipt of incident report, the Incident Controller initiates action directly or through his team

members immediately near the incident site, and: To prevent the incident from turning into an emergency, initiates action by closing isolation valves,

and starting of first aid firefighting, or by preventing explosion of gas leak by fogging as appropriate, Calls firemen to take control of incident site, save human life, fight fire and prevent explosions, Directs all key personnel and essential workers to take up their responsibilities, Informs site main controller who on arrival, will declare an emergency.

Safe Assembly Points The safe assembly points for the site are as mentioned in Table 3.

Escape, Evacuation & Rescue (EER) Plan Escape

Non-essential personnel have to escape through safe escape route towards the nearest assembly point.

Evacuation

All non-essential personnel who have assembled at the safe assembly points have to be evacuated from the site, then noted down as part of head count and evacuated to temporary shelter outside, like nearest village school, panchayat office or other area as previously determined.

Rescue

On receipt of Incident information, any trapped personnel have to be rescued. This requires rigorous training. The rescuers must first ensure their own safety. There should be at least two rescuers for each victim to be rescued. The following procedure may be followed:

1. Preplan the rescue operation as to who will hold shoulders and who the legs of the victim 2. Ensure appropriate gas mask and other PPE is worn by each rescuer

3. See the nearest windsock and approach the site of victim from upwind. If no PPE is available near by, then take a deep breath, hold breath and approach

4. Undertake rescue operation swiftly and confidently 5. Check victims first needs 6. Impart first aid as appropriate, including CPR and oxygen breathing 7. Call for ambulance and shift victim to nearest doctor/hospital.

Mock Drill & Review Procedure The mock drill and review procedures are as follows:

Every one should synchronize his watch daily with the main clock at security gate to ensure the timings recorded by observers match with each other,

One mock drill is to be conducted once in a period of 6-Months,

The plan of mock drill should be known to Site Main Controller and Incident Controller and observers only,

Mock drill should be against one of the MCLS covered in the Report,

There should be at least two mock victims,

All the steps of DMP from available incident report raised by a trained or untrained observer to the all clear siren are to be rehearsed,

Observers to be set up at the Incident Site, at each Assembly point, ECC and First Aid Center.

Observers should record each activity with timings and head counts etc.,

All clear siren to be sounded only after head count tallies with gate entry list.

After all clear is sounded, all personnel belonging to Emergency Organization should assemble at the pre decided conference room for Mock drill review,

Review to be conducted to check effectiveness of DMP-Implementation in terms of the following:

The first witness’ incident call, Actions by Incident Controller to prevent Incident transforming in to Emergency, and subsequent

Offsite Plan Components Since there are no other major industrial or project activities in the entire Organic Coatings Project area, the offsite plan for the area is likely to include only Organic Coatings MCLS’ having offsite impacts. Table 7 gives these MCLS having offsite impact.
