Title Surety Bond• A Title Surety Bond is guarantee of performance of a

specific obligation or contract.• A bond is issued by an insurance company and

guarantees damages in the event that another individual claims ownership of the vehicle.

• A bond is similar to your personal auto insurance in that it is offering coverage in the event that a claim is made, except in the case of a bond, the coverage is for the certificate of title.

Title Surety Bond• The Surety Bond can be obtained by any company that

issues bonds and is licensed to issue a surety bond in the state of Alabama.

• Primarily, the cost of the bond depends on the amount of the bond coverage (face value).

• Other factors, including the applicant’s credit score.

• Bond Term of three (3) years.

An Overview of the Bond Process• Apply, on the surety bond portal, to receive a bond

application, Form (MVT 10-1A).

• Submit the bond application and proof of ownership.

• When application is approved, a bond form (MVT 10-1) is sent to the applicant, via email.

• Take the bond form (signed/sealed by the insurance company) to a Designated Agent to apply for Certificate of Title with the bond as the primary supporting document.

Bond Checklist • Ensure that bond is completed on a state bond form (MVT 10-1).

• Ensure that the (MVT 10-1) is complete: The bond number is printed at the top of the bond. The name of the Surety appears The bond execution date is on the bond The insurance company agent’s name and signature appear The Principal’s (owner’s) name and signature appear.

• Ensure that the Insurance Company provides a Power ofAttorney with the bond. This is mandatory.

• Ensure that the bond effective date is not older than 90 days.

• Ensure that the bond effective date and the date of the Power ofAttorney agree.

During fiscal year 2017, ADOR collected over 7.6 million dollars in reinstatement fees, and that this figure was more than double the 3.4 million dollars collected during fiscal year 2016. The 7.6 million was collected during the fiscal year that spanned from October 2016 to September 2017, and the 3.4 million was collected during the fiscal year that spanned from October 2015 to September 2016. The insurance research council reported that based on 2015 data, Alabama has reduced it’s uninsured rate to 18.4 percent. Prior to starting online verification, in April 2, 2011 the IRC reported that Alabama had an uninsured rate of 22 percent. * The increase in reinstatement fees and the reduction in the uninsured rate is a sign that we are moving in the right direction in identifying uninsured drivers and collecting reinstatement fees which hopefully will encourage compliance.

Issues were identified with some records that were in DS-Deferred Suspension status. These errors included records not having an end suspension date (which notifies the user when the registrant can reinstate their registrations) or records automatically changing to the wrong status. The MLI Fax/Email numbers are no longer operational as of late march. Registrants who want to contact us must now use the Revenue’s support site. They would simply click “submit” a request, choose Registration (Insurance, Tags, Records, etc.) and they can submit their questions there. So usually you all are advising registrants in the case of “ID-insurance denied” to have their insurer send proof on company letterhead via fax/email…that should now be sent to the support site.

Read header Bullet 1 – New five year IRP plates were issued beginning with January renewals – January 1, 2017 Bullet 2 – As detailed in memo (2018-11) dated October 22nd, new IRP accounts would need to be assigned a January renewal date for collection of ad valorem taxes. This applies to all new accounts during the period of November 1, 2018 through Oct. 31, 2019. The reason we do this each year is to ensure IRP regs. are evenly staggered throughout the registration year. Bullet 3-Remember we put out memo 2014-19 offering clarification on how to determine the proper renewal month for IRP vehicles. The main thing is to determine if the registrant already has an IRP account and so already has an assigned renewal month. So you want to ask this question of a person trying to pay ad valorem taxes on an IRP vehicle. If they are just purchasing a new vehicle, the ad valorem taxes should be paid through the renewal month already established for their IRP account. Their other vehicles and registration receipts will indicate the renewal month. Or you can search the state registration system by PRIMARY TAG TYPE – Apportioned - IRP. Bullet 4 – beginning January 1, 2016 Charter buses operated interstate now should obtain IRP registration. Memo 2015-20 was sent out dated Sept. 22, 2015. As detailed in this memo, the IRP was amended to remove the exemption for buses used to transport chartered parties as of 1/1/16 so charter bus companies were informed to convert their bus registrations to an IRP registration prior to their renewal month in 2015 if they conduct interstate operations. Their other option would be to obtain trip permits – if they only occasionally would travel out of state. (if asked- Pursuant to Section 40-12-246.1, Code of Alabama 1975, charter buses and motorcoaches must provide the special common carrier of passengers business operating license (BOL) in lieu of the ad valorem taxes. Department Administrative Rule 810-4-1-.07 provides that the special common carrier of passengers BOL must be obtained annually and is a prerequisite to registration. The BOL start date for IRP vehicles will be assigned in the same manner as ad valorem taxes for IRP vehicles, which is the first day of the month following the renewal/expiration month. The BOL on charter buses and motorcoaches will be apportioned based on the Alabama mileage percentage; similar to ad valorem taxes on trucks and truck-tractors.
