Summary:

The Kane County Board is the fiscal agent for the Mill Creek Special Service Area (MCSSA). The Mill Creek Special Service Area was created as part of the long term maintenance and service program for the select areas within the Mill Creek Subdivision. The responsibilities of the MCSSA include, among other things, helping to facilitate the cooperation of numerous administrative entities and assisting in the coordination of their various responsibilities as they apply to both the day to day and long term maintenance of the Mill Creek subdivision. The MCSSA is seeking the professional services of The Lannert Group, Inc., Geneva, IL for consultation in the assessment of the roles that different governing agencies retain in the maintenance of the Mill Creek subdivision. The consultant is familiar with the initial development of the subdivision and the original administrative bodies and the maintenance roles they were responsible for. The goal is to determine what the current maintenance program should encompass and what the appropriate division of those responsibilities should be amongst the various agencies. The total cost for this consulting service contract is not to exceed $23,500.00. Funding shall be paid from the Special Service Area Fund for Contractual/Consulting Services (520.690.730.50150) for the MCSSA.

AUTHORIZING A CONTRACT FOR MILL CREEK ADMINISTRATIVE ROLE ASSESSMENT & DEVELOPMENT PROGRAM - CONSULTATION SERVICES

WHEREAS, the Mill Creek SSA is seeking to secure the consultation services of The Lannert Group, Inc. of Geneva, IL ; and

WHEREAS, The Lannert Group, Inc. will provide assistance in assessment of administrative

roles and evaluation and identification of the different responsibilities that these parties hold in the maintenance of the Mill Creek subdivision; and

WHEREAS, an estimated cost of $20,000 with contingency funds of $3,500, with total

professional services not to exceed $23,500; and WHEREAS, appropriate funds have been budgeted and are available in the FY2016 budget. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman of

the Board is authorized to enter into a contract with The Lannert Group, Inc. of Geneva, IL for the assistance in assessment of administrative roles and evaluation and identification of the different responsibilities that parties hold in the maintenance of the Mill Creek subdivision, for a total cost of Twenty Three Thousand, Five Hundred Dollars ($23,500.00). Funding shall be paid from the Special Service Fund 520.690.730.50150.

Summary:

On November 16, 2015, New World Corporation merged with and into Tyler. Tyler being the sole survivor. Kane County having entered into several license and maintenance contracts with New World, desires to update the agreements with the name change of Tyler as the surviving company. Agreements include: * Standard Software License and Services Agreement (Finance) - September 11, 2006 * Additional Software License Agreement (Public Safety) - February 1, 2008 * Appendix 1 - Optional Agreement and Authorization for Procurement of Third Party Products and Services - February 1, 2008 * Additional Software License Agreement - September 18, 2008 * Letter of Understanding Regarding Standard Software Maintenance Agreement - October 18, 2010 Tyler as the successor-in-interest to New World has agreed to an addendum that will allow all existing contracts to continue with all rights and obligations of New World under the agreement. Information Technologies Department recommends that the County Board approve the Resolution authorizing the Kane County Chairman to sign and execute the addendum.

assume all rights and obligations of New World under the agreements.

The lowest responsive and responsible bidder for the project, including Base bid $65,224 and Alternate #1 ($14,872) was Cornerstone Partners Horticultural Services, St. Charles IL, for a total bid of $80,096. Alternate #1 is for the watering of 17 flower/plant beds throughout both the North and South sections of the Mill Creek subdivision. The watering service is for the months of May through September with watering scheduled for two (2) times per week intervals (44 occurrences total). Total cost of Alternate #1 is $14,872. Alternate #2 is for the watering of 17 flower/plant beds throughout both the North and South sections of the Mill Creek subdivision and is based on a per occurrence basis.

WHEREAS, bids have been solicited for Mill Creek SSA Landscape Maintenance Service; and

WHEREAS, the lowest responsive and responsible bidder, as per bid documents and

specifications, including; Base bid ($65,224) and Alternate #1 ($14,872) was Cornerstone Partners Horticultural Services, P.O. Box 745, St. Charles, IL 60174 for a total bid of $80,096; and

WHEREAS, Cornerstone has extensive working knowledge of the Mill Creek subdivision

and has provided excellent landscape maintenance services to Mill Creek SSA over the last 3

years; and

WHEREAS, funding shall be paid from the Mill Creek Special Service Area Fund 520.690.730.52120.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman is

hereby authorized to execute a contract for Mill Creek SSA Landscape Maintenance Service to Cornerstone Partners Horticultural Services of St. Charles, IL for the base bid amount of Sixty-Five Thousand, Two Hundred Twenty-Four Dollars ($65,224). In addition, authorizing the approval of Alternate #1 for Fourteen Thousand, Eight Hundred Seventy-Two Dollars ($14,872), for a total service contract cost of Eighty Thousand, Ninety-Six Dollars ($80,096).

CELEBRATING 15 YEARS OF PROTECTING FARMS AND FARMLAND IN KANE COUNTY

WHEREAS, Kane County has some of the finest soils and most productive farmland in the

world; and

WHEREAS, farmland is a valuable natural resource and an economically productive land

use; and

WHEREAS, Kane County enacted Ordinance No. 01-67 on April 10, 2001, Adopting and

Implementing the Kane County Agricultural Conservation Easement and Farmland Protection

Program, and it is the only county based farmland protection program in Illinois: and

WHEREAS, over 5,400 acres of land have been funded, approved and completed for

farmland protection using agricultural conservation easements for purposes of natural resource

protection, water supply, soil protection, land use and growth planning, protection of landscapes,

preserving scenic vistas, and preserving the historical, architectural, archeological and cultural

aspects of property.

NOW, THEREFORE, BE IT RESOLVED that Kane County honors all who have worked to preserve this land and look ahead to the next generation of Kane County agriculture.

An Intergovernmental Agreement between the County of Kane and the City of St. Charles was passed by Resolution #12-157 on June 12, 2012 for a City-run electronics recycling drop-off through the County contract.

Due to the increase in volume of electronics now being received making it logistically burdensome to the City, and because of statewide issues with the Electronics Recycling and Reuse Act which have destabilized the entire system, the City has given notice of termination of the program. This resolution seeks the terminate the IGA between the County of Kane and the City of Batavia mentioned above.

WHEREAS, as required by Section 4 Termination of the IGA, the City of St. Charles (City) provided notification of termination sixty (60) calendar days from the date of a letter sent by certified mail dated February 8th, 2016; and

WHEREAS, the drop-off at St. Charles Public Works is no longer feasible for the City, due to

many factors including the following; and WHEREAS, the revenue that was shared during the 2012-2014 time period is no longer

available due to defects in the law and so there is no longer any financial incentive for the City to support the additional labor and risk associated with the growing program; and

WHEREAS, the volume of electronics received, particularly large CRT televisions and

monitors, has grown exponentially contributing to overwhelm at the drop-off location; and WHEREAS, drop-offs are closing throughout the state due to defects in the Electronics

Recycling and Reuse Act, which set the manufacturer funded program goals far too low, which in effect has destabilized the entire industry statewide; and

WHEREAS, on June 12,2012 by Resolution 12-157, the Kane County Board authorized an

intergovernmental agreement with the City of St. Charles for the recycling of electronic equipment, and that program is now ending; and

NOW, THEREFORE, BE IT RESOLVED that by authorizing the County Chairman to sign

this resolution the Kane County Board hereby terminates the above mentioned intergovernmental agreement with the City of St. Charles for the recycling of used electronic equipment.

WHEREAS, the County of Kane is engaged in long range planning in the construction, demolition, and usage of government assets; and

WHEREAS, the County Board received a 5-Year Capital Project Update in December 2015;

and WHEREAS, it is in the best interests of the County of Kane to engage professional

architectural, construction management and engineering services to facilitate the completion of

those planned capital projects; and

WHEREAS, the County of Kane has a an excellent relationship for professional

architectural, construction management and engineering services with Cordogan Clark &

Associates; and

WHEREAS, the County Board approved utilizing Cordogan Clark & Associates at the

February 10, 2015, Board meeting for capital projects for the County.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that it hereby approves

retaining Cordogan Clark & Associates to perform professional architectural, construction

management and engineering services required to complete future capital projects for the FY2016

and FY2017 on an as needed basis per project.

BE IT FURTHER RESOLVED, by the Kane County Board, that the Chairman of the Kane County Board is hereby authorized and delegated the authority to execute all documents necessary to retain Cordogan Clark & Associates to perform those professional services recited above on an as needed basis per project.

specifications, was Urban Elevator Service, 4830 W. 16th Street, Cicero, IL 60804, for a total bid of $346,416.48; and

WHEREAS, there are also two allowances for miscellaneous electrical, fire service and

general work required for an allowance of $20,500; and

WHEREAS, an additional $20,000 allowance will be included for HVAC work required for the

project. All allowances shall be managed by Building Management Services; and WHEREAS, the total project cost will also include a 10% Contingency valued at $34,641.65,

Summary:

The County Information Technologies Department is responsible to maintain and

support County computers.

The purchase and lease of New World public safety software for the County has given

agencies the ability to share public safety data. As a result, it has become necessary for outside

agencies (policing and fire) to configure various computer devices that enable access to the

records management and computer aided dispatch.

The Information Technologies Department has neither been funded nor given the

responsibility to work on outside agency computers. The outside agencies shall be charged a

mutually agreed upon fee for a scope of work (setup, troubleshooting and maintenance) when

requesting the County to assist. These funds will be used to compensate County employees for

each unit of support performed outside of their normal required duties.

To accomplish this, we are asking that information Technologies Department be

permitted to invoice the agencies for the agreed upon scope of work, receive the funds into a

miscellaneous revenue account, transfer the funds into salary and compensate our employees

according to the units of support invoiced.

Summary:

The State of Illinois budget impasse has resulted in the suspension of Title IV payments which fund the Child Support division of the State’s Attorney’s Office. This has resulted in an outstanding receivable balance of $335,403 as of 1/31/2016 which has the potential to grow to $900,000 by the end of Fiscal Year 2016. The suspension of payments also resulted in a negative cash balance of $16,730 as of 1/31/16 that has the potential of growing to $587,000 by the end of Fiscal Year 2016. Since it is in the best interest of Kane County to continue operation of the Child Support Unit, an emergency line of credit not to exceed $310,000 was extended from the General Fund to the Title IV Fund in accordance with the emergency purchase provision of the Procurement Ordinance. This emergency line of credit now needs to be ratified by the County Board. This line of credit will be in place until June 30, 2016 and shall be repaid from Title IV payments when resumed by the State.

WHEREAS, the Child Support Unit of the Kane County State’s Attorney’s Office provides

legal representation to the State of Illinois Department of Healthcare and Family Services, pursuant

to a contractual relationship under the authority of 305 ILCS 5/10-1 and Title IV-D of the Social

Security Act; and for which an annual budget has been approved by the County Board; and

WHEREAS, the State of Illinois budget impasse has caused the suspension of Title IV

funding for the Child Support Unit of Kane County as of July 1, 2015 creating an outstanding

receivable balance of $335,403 and a negative cash balance of $16,730 as of 1/31/2016; and

WHEREAS, it is in the best interest of Kane County to continue operation of the Child

Support Unit and therefore requires a temporary source of cash until the state budget impasse is

resolved, in order to avoid the loss of federal and state funds due when the budget impasse is

resolved; and

WHEREAS, the total amount of cash required to sustain the cost of operation through June

30, 2016 is $310,000.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that a line of credit from the General Fund be extended to the Title IV Fund in an amount not to exceed $310,000 for the purpose of sustaining the cost of operation of the Child Support Unit of the State’s Attorney’s Office through June 30, 2016 with the understanding that the Title IV Fund will repay any outstanding balance on the line of credit from the General Fund from any proceeds from Title IV payments received from the state.

WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, provides that units of local government may contract or otherwise associate among themselves to obtain or share services and to exercise, combine or transfer any power of function in any manner not prohibited by law or by ordinance and may use their credit, revenues and other resources to pay costs related to intergovernmental activities; and

WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq, provides that any

county may participate in an intergovernmental agreement under this Act notwithstanding the absence of specific authority under the State law to perform the service involved provided that the unit of local government contracting with the county has authority to perform the service; and

WHEREAS, Stephenson County desires to enter into an intergovernmental agreement with

Kane County wherein Kane County will guarantee housing for five (5) Stephenson County minors at its Juvenile Justice Center with a per diem charge of $120.00 (one hundred and twenty dollars) per day, per minor; and

WHEREAS, the intergovernmental agreement with Stephenson County commences upon

the date of approval and acceptance by all parties hereto and will continue for a period of two (2) years from that date. This agreement may be amended with written consent of all parties hereto and, provided a need continues to exist, may be renewed thirty (30) days prior to the expiration date for a period not to exceed one (1) year for each renewal.

Bids have been solicited for the 3rd Street Courthouse Parapet Restoration Project at the 3rd Street Courthouse Facility, 100 S. 3rd. Geneva, IL. 60134. A total of eight (8) bids were received and publicly opened on February 25, 2016. The lowest responsive and responsible bidder for the Base bid is Otto Baum Company Inc. of Morton, IL 61550, for a total Base bid of $555,445. Alternate #1 is for additional Site Mobilization, if required. The total cost of Alternate #1 is $2,500. This Alternate will not be approved as part of the project. However, if additional mobilizations are required during the project, it will be funded through contingency dollars for the project. This project will also include a 20% Contingency valued at $111,089, for a total project cost of $666,534. The 20% contingency for this project is due to the inherent challenges that this restoration project poses relative to the potential for managing unforeseen conditions that are possible when dealing with a 115 year-old building. The Contingency amount will be held by Kane County and is not part of the contract. The original Board approved budget for this project was $400,000. This was an estimated budget that was established last year before testing of the structure was completed. Upon testing results, the scope of work increased to include flexible flashing through the entire flat surface of all the parapet walls. In addition, there are only two (2) manufactures of the Terra Cotta copings within the United States, which may have contributed into the additional costs for this project.

Summary:

Bids have been solicited for the 3rd Street Courthouse Parapet Restoration Project at the 3rd

Street Courthouse Facility, 100 S. 3rd. Geneva, IL. 60134. A total of eight (8) bids were

received and publicly opened on February 25, 2016.

The lowest responsive and responsible bidder for the Base bid is Otto Baum Company Inc. of

Morton, IL 61550, for a total Base bid of $555,445. This project will also include a 20%

Contingency valued at $111,089, for a total project cost of $666,534.

The 20% contingency for this project is due to the inherent challenges that this restoration project poses relative to the potential for managing unforeseen conditions that are possible when dealing with a 115 year-old building. The original Board approved budget for this project was $400,000. This was an estimated

budget that was established last year before testing of the structure was completed. Upon

testing results, the scope of work increased to include flexible flashing through the entire flat

surface of all the parapet walls. In addition, there are only two (2) manufactures of the Terra

Cotta copings within the United States, which may have contributed into the additional costs for

this project.

Implementation of this project will require a budget adjustment to the FY2016 Capital Improvement Budget in the amount of $266,534.

Summary:

The sheriff if responsible for appointing commissioners to the Merit Commission Board, with the

approval of the Kane County Board. The appointment of Paul McCurtain was submitted to the

Judicial/Public Safety Committee last fall and confirmed by the full board. Mr. McCurtain has

been unable to take his commission as of this date, due to health concerns. I have spoken to

Mr. McCurtain and he has agreed to step aside so another appointment can be made.

I am requesting that the Judicial/Public Safety Committee accept my nomination of Peter

Burgert to the Merit Commission. Mr. Burgert was previously employed by the Kane County

Sheriff’s Office and served for over thirty (30) years as a police officer, retiring with the rank of

Captain. He currently lives in Aurora and has time to commit to the duties of the Merit

Commission Board. Mr. Burgert is available to assume the responsibilities of commissioner on

the Merit Commission Board as soon as the sheriff receives approval from the Kane County

Board.

There are three Merit Commission members, each appointed to six-year terms with expiration

dates staggered every two years. To get back on the two-year expiration schedule,

Mr.Burgert's initial term will be for five years and expire in October 2020.

On October 9, 1991 the House of Representatives designated that each year the second full week of April would be dedicated to the men and women who serve as public safety telecommunicators. Edward Markey of Ohio addressed the House that day stating: "Every day, in all of our communities, dedicated public safety telecommunicators answer our calls for assistance. They dispatch our calls for help to local police and fire departments, facilitating the execution of emergency rescue and law enforcement operations in all of our districts. These public safety personnel serve as the vital links within our cities and towns, although rarely appreciated because they are not physically at the scene." America's public safety telecommunicators daily serve the public in countless ways without due recognition by the beneficiaries of their services. It is for that reason that this resolution is requesting the County Board to authorize and request a proclamation calling on the people of Kane County to observe the week with appropriate ceremonies and activities.

APPROVING ANNUAL ADOPTION OF THE KANE COUNTY 2040 TRANSPORTATION PLAN AND 5-YEAR TRANSPORTATION IMPROVEMENT PROGRAM (TIP)

WHEREAS, the Illinois Compiled Statutes (605 ILCS 5/5-301) requires the County of Kane annually update its 20-year long-range transportation plan; and

WHEREAS, pursuant to Kane County Resolution No. 12-101, the Kane County Board

adopted the Kane County 2040 Transportation Plan, which is a comprehensive long range transportation plan that identifies major multi-modal transportation projects that respond to existing deficiencies and projected development trends, provides guidance for transportation decisions and cooperative planning, increases system efficiency and personal mobility, and identifies resources to implement transportation projects; and

WHEREAS, proper management of the Kane County transportation system requires multi-

year planning to address the demand for new and improved transportation facilities and to properly maintain existing transportation infrastructure; and

WHEREAS, the 2040 Transportation Plan is comprised of three major elements - the 2040

Recommended Roadway Plan, the Kane County Bicycle and Pedestrian Plan, and the 2040 Transit Plan (adopted by the County Board July 12, 2011); and

WHEREAS, the FY2016-2020 Transportation Improvement Program is a working document

that provides a list of the major improvements anticipated within the next 5 years and serves as the annual update the 2040 Long Range Transportation Plan.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane

hereby endorses the FY2016-2020 Transportation Improvement Program and reaffirms and approves the previously adopted Kane County 2040 Transportation Plan which is hereby adopted for FY2016 as the County of Kane’s 20 Year Long Range Highway Transportation Plan pursuant to the provisions of the Illinois Compiled Statutes (605 ILCS 5/5-301) and that the Kane County 2040 Transportation Plan shall be filed with the Secretary of the Illinois Department of Transportation.

Summary:

The project requires right-of-way acquisition that will require removal of approximately 220 trees

to accommodate the roadway widening and bridge replacement improvements. The original

biological clearance and approval completed during Phase I Preliminary Engineering did not

address the Northern Long Eared Bat (NLEB) as it was not listed as a threatened species at the

time. The biological clearance is required to be renewed. As part of that review process IDOT is

requiring that a site assessment be conducted to determine if the trees and bridge structure

scheduled for removal are suitable NLEB habitat.

The project is currently scheduled for a November 2016 letting. Because the project will not be

cleared for letting until the assessment has been completed, WBK anticipates starting and

completing the assessment in the spring of 2016. To keep this project on schedule we are

requesting local funds to complete this work.

WHEREAS, pursuant to Resolution No. 14-156, the County of Kane appropriated Two Hundred Sixty Four Thousand Five and 73/100 Dollars ($264,005.73), (hereinafter the “appropriation”) and entered into a Phase II Engineering Services Agreement with Wills Burke Kelsey Associates, Ltd. for Phase II engineering services (hereinafter the “Agreement”) for the proposed improvement to the County Highway No. 78 (also known as Bliss Road) Bridge over Blackberry Creek (hereinafter the “Improvement”); and

WHEREAS, additional unforeseen engineering work is required to complete the Phase II engineering services for the Improvement; and

WHEREAS, in order to address the need for additional engineering services, the County desires to amend the Agreement, (a copy of which amendment is on file in the office of the Kane County Clerk), increasing the total cost of engineering services by an additional $5,637.27; and

WHEREAS, it is in the County’s best interest to extend the upper limit of the appropriation for the Agreement by an additional Five Thousand Six Hundred Thirty Seven Dollars and 27/100 Dollars ($5,637.27) from $264,005.73 to $269,643.00.

NOW, THEREFORE, BE IT RESOLVED, by the Kane County Board that the Chairman thereof is hereby authorized to execute an Amendment No. 1 to the Agreement with Wills Burke Kelsey Associates, Inc. for the Improvement increasing the total cost of engineering services therefor by an additional $5,637.27

Summary:

For several years, Big Rick Township has been working to rehabilitate the Hinckley Road over the West Branch of Big Rock Creek bridge. The work was completed in 2012. 80% was funded with Highway Bridge Program funds (HBP), a Federal Highway Administration (FHWA) program administered by the Illinois Department of Transportation (IDOT). The Township Bridge Program (TBP) is a State of Illinois funding program that provides up to 80% of the cost of a bridge rehabilitation or replacement project for eligible township road districts. For the 16 Township Road Districts within Kane County, the County administers the TBP funds on behalf of IDOT. Townships may use TBP funds as part of their local match for a HBP project. When using State TBP to match Federal HBP, a township road district pays 20% of 20%, or 4% with local funds. The Big Rock Township Highway Commissioner is requesting approximately $80,000 of TBP funds for Hinckley Road, which represents approximately 16% of the estimated project cost of $500,000. The County acts as administrator of these funds, wherein IDOT transfers these funds to the County, and the County transfers the funds to the Township. Staff requests authorization to disburse $80,000 of TBP funds, as available and received from the State, for this project.

WHEREAS, pursuant to Resolution No. 04-261, the Village and the County entered into an

agreement dated June 8, 2004 for access and improvements to Randall Road from Orchard Road to I-88 (hereinafter the “IGA”); and

WHEREAS, pursuant to Resolution No. 06-364, the Village and the County entered into a

First Amendment of the IGA (hereinafter the “First Amendment”) to eliminate the full access located approximately 2400 feet north of Oak Street and to address future landscaped median improvements; and

WHEREAS, pursuant to Resolution No. 11-287, the Village and the County entered into a

Second Amendment to the IGA (hereinafter the Second Amendment”) to allow for the permitting of a full access located approximately 2400 feet north of Oak Street subject to the Second Amendment and compliance with County permitting regulations; and

WHEREAS, at the request of the Village, the Village and the County again wish to enter into

a Third Amendment to the IGA (hereinafter the “Third Amendment”) (a copy of which is on file with the County Clerk's Office) to modify access to and from Randall Road; and

WHEREAS, the Third Amendment will facilitate the efficient movement of traffic and shall

provide for the safety of the motoring public. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof

WHEREAS, pursuant to a three party agreement previously executed with Kane County, Blackberry Township Road District and Union Pacific Railroad Company (UPRR), (Resolution No. 12-236) the County of Kane agreed to reimburse UPRR for all costs incurred by the UPRR in regard to the County’s Anderson Road Improvement, (hereinafter the “Improvement”)

WHEREAS, the County’s Improvement reimbursement to the UPRR is now estimated to be

Sixty Eight Thousand Five Hundred Fifty Two Dollars ($68,552.00); and WHEREAS, the County deems it prudent to add, in addition to the estimated

reimbursement, a contingency of ten percent ($6,855.20), for a total estimated Improvement reimbursement of Seventy Five Thousand Four Hundred Seven and 20/100 Dollars ($75,407.20) to pay for the County’s reimbursement obligation to the UPRR for its costs incurred in association with the Improvement.

WHEREAS, the County of Kane has developed right of way plans for the Longmeadow

Parkway Bridge Corridor, Kane County Sec. No. 94-00215-01-BR; and WHEREAS, Algonquin Meadows, L.L.C., the property owner of Longmeadow Parkway

Bridge Corridor Parcel No. 1LN0087 and 1LN0087PE, which are legally described in Exhibit “A” attached hereto (a copy of which is on file in the office of the Kane County Clerk), has offered to sell the property described as Parcel No. 1LN0087 and to grant a permanent easement upon the property described as Parcel No. 1LN0087PE to the County of Kane for the total amount of Sixty Four Thousand Four Hundred Fifty Dollars ($64,450.00).
