Director Generoli made a motion to approve the agenda, as amended. Director Banning seconded. The motion passed unanimously.

III. PRESENTATION: PROPOSED BALL FIELD DEVELOPMENT Director Generoli presented background information regarding the litigation between the Ken-Caryl Ranch Metropolitan District and the Plains Metropolitan District as it pertains to ballfield development. Director Generoli then presented a proposed plan for ballfield development at Bradford K-8 North.

IV. BOARD COMMENTS

Director Banning provided comments on the need for additional fields and growing field sports in the country and Colorado.

V. QUESTION AND ANSWER

The Board responded to questions from the audience related to the proposed ballfield development plan.

VI. COMMUNITY COMMENTS

The Board heard comments from many residents who opposed the ballfield development if field usage would be scheduled beyond the school day.

Director Generoli made a motion to go into Executive Session to discuss negotiation issues and advise negotiators regarding the Plains Metropolitan District litigation pursuant to C.R.S. 24-6-402(4)(e). Director Lehan-Milano seconded. The motion passed unanimously. The Board went into Executive Session at 9:14 p.m.

VIII. A MOTION TO COME OUT OF EXECUTIVE SESSION

Director Jensen made a motion to come out of Executive Session and resume the regular meeting. Director Esbenshade seconded. The motion passed unanimously. The Board resumed the regular meeting at 10:08 p.m.

ADVICE REGARDING THE PLAINS METROPOLITAN DISTRICT LITIGATION PURSUANT TO C.R.S. 24-6-402 (4)(b) and (e)

Director Banning made a motion to go into Executive Session pursuant to C.R.S. 24-6-402 (4)(b) and (e) to receive advice of legal counsel regarding a proposed Stipulated Supplemental Judgment between the Ken-Caryl Ranch Metropolitan District, the Taxpayers, and the Plains Metropolitan District, to determine the District’s position on the proposed Stipulated Supplemental Judgment, and to give direction to the District’s negotiators. Director Lehan-Milano seconded. The motion passed unanimously. The Board went into Executive Session at 3:39 p.m.

After the motion was made, seconded and passed unanimously, Attorney Shearer certified that all matters to be discussed in Executive Session would involve advice of legal counsel, and therefore it was not necessary to record the proceedings.

Members of the public were excused from the room. The Board and taxpayers for the

lawsuit remained. At 4:35 the taxpayers were also excused so the Board could continue to receive legal advice from council.

IV. A MOTION TO COME OUT OF EXECUTIVE SESSION Director Banning made a motion to come out of Executive Session and resume the

regular meeting. Director Generoli seconded. The motion passed unanimously. The Board resumed the regular meeting at 5:35 p.m.

Director Lehan-Milano made a motion to approve the minutes of the February 28, 2017 Board meeting. Director Esbenshade seconded. The motion passed unanimously.

V. COMMUNICATION ITEMS A. February Status Report

The Board asked to see the 2015 fitness center usage statistics at its April Board meeting.

B. February Check Registry / Vendor Purchase History There were no comments. C. January & February 2017 Financial Reports

The Board discussed the new format of the flash report and agreed it was more helpful than the prior format.

D. Board of Directors Meeting Minutes from Foothills Park & Recreation District & Plains Metropolitan District

There were no comments. E. February 2017 Foothills Invoices There were no comments. F. Ken-Caryl Ranch Open Space Committee Reports There were no comments.

VI. STAFF COMMENTS AND REPORTS Parks Supervisor, Pat Malloy, gave an update on the start of spring and finalizing

preparation in the parks for the summer season. District Manager Melissa Daruna gave an update on the new recreation director,

upcoming special events and summer program registration.

VII. DISCUSSION ITEMS A. Proposed Ballfield Development at Bradford K-8 North

President Lehan-Milano stated that the proposal to develop the ballfields at Bradford K-8 North has been tabled for the time being. Other options for resolving the ballfield development issue are being considered as part of the Plains Metropolitan District litigation settlement.

B. Potential Foothills Bike Park Project Director Lehan-Milano discussed a request from two residents to provide conceptual support for a collaborative bike park project with Foothills Park and Recreation District. The Board agreed that it the concept sounds interesting and the Board would be happy to learn more as details become available.

C. Elevation Contract Update The contract with Elevation Fitness will terminate effective July 3rd. Following the termination, the District will hire an in-house coordinator to oversee the fitness center.

D. Median Remodel Update The Parks Department has cleaned out and prepared four medians throughout the community for replanting in the coming weeks. Ongoing median remodeling will take place as resources are available.

E. Memorandum Regarding Community Communications Guidelines District Manager Melissa Daruna provided the Board with a copy of a memorandum she will be distributing to executive staff, providing guidance to promote communication with the public regarding District matters.

VIII. AUDIENCE PARTICIPATION A few residents provided feedback that they do not wish to see more prairie dogs

located on District property. A few residents provided feedback that they do not wish to see ballfields

developed at the Bradford K-8 North site.

Director Generoli made a motion to go into Executive Session to receive advice of legal counsel regarding Gallagher Amendment issues pursuant to C.R.S. 24-6-402(4)(b). Director Jensen seconded. The motion passed unanimously. Attorney

MATTER PURSUANT TO C.R.S. 24-6-402(4)(f) Director Banning made a motion to go into Executive Session to discuss a personnel

matter pursuant to C.R.S. § 24-6-204(4)(f). Director Lehan-Milano seconded. The motion passed unanimously. The Board went into Executive Session at 7:53 p.m.

KEN-CARYL RANCH METROPOLITAN DISTRICT STATUS REPORT FOR THE MONTH OF MARCH 2017

I. ADMINISTRATION/FINANCE/GENERAL OPERATIONS/HUMAN RESOURCES

• We welcomed our new Recreation Director, Kristen Peterka, back to Ken-Caryl Ranch. Her official

start date is April 3rd but she was able to start connecting with staff ahead of time.

• The new playground installation and site work took place at Dakota Lodge.

• District Dimensions was published electronically.

• Staff began working on the new splash pad features for the Community Center.

• Melissa Daruna notified Elevation Fitness that we will be terminating our contract effective July 3.

Staff began planning to hire an in-house fitness coordinator in July.

• Summer hiring continues in the Parks and Recreation Departments.

• Ordered and received LED replacement lamps for $6 each with Xcel Rebate program, (compared to

$20 each at Home Depot). Have begun to replace all 4’ T8 lamps with LED lamps in admin. offices,

bathrooms, basement and some on the recreation side.

• The circuit panel and light poles on tennis courts 1 & 2 were rewired to go from 240 watts down to

120 watts so we could convert the 12, 1000 watt metal halide lamps with ballasts to 175 watt corn cob

LED lamps. There were 3 bad ballasts on the courts and it cost less to convert all 12 to LED than it

would have cost to replace the 3 ballasts. The cost to run all 12 lights is now similar to the cost to run

just one of the old Metal Halide lamps.

• We will be converting the Centre Court lights to LED lamps next month since they turn on

automatically each night starting in April. This conversion will show the biggest savings in energy

costs.

• Long term Radon testing kits were installed in several rooms throughout the building. They will be

picked up and sent to the lab after a minimum of 90 days collecting air samples.

• Had a meeting with Chris Pacetti, Vanir Rep, and Joe from Western States Fire Protection to go over

routine maintenance for the dry fire system on the recreation side of the building.

• Replaced the Ken-Caryl flag on the flag pole.

• Cut and installed new lens cover for a light fixture in the Spruce Room.

• Performed daily walk-through inspections of facility. Made necessary repairs or scheduled repairs for

future date.

Community Center

• Replaced several burned out light bulbs throughout the building.

• Hung the rock climbing board on a beam in the Aerobics Room.

• Moved an electrical outlet from floor height to above countertop height in the Mastodon Room.

Purchased materials and built a cabinet/storage closet for the folding chairs. A countertop was added

so it can also be used as a serving area during rentals. This work was done in-house.

• Ordered tables for the Mastodon Room. Picked them up and brought them to the Community Center.

• Performed daily walk-through inspections of facility. Made necessary repairs or scheduled repairs for

future date.

Dakota Lodge

• The hot water circulating pump was turned to a horizontal position to meet the manufacturer’s

recommended installation. An Aqua-stat was added to the hot water line to prolong the life of the

circulating pump.

• Designed and ordered a reception desk for the Dakota Lodge lobby. Upon arrival we will install it,

move the fire extinguisher cabinet to a new location and have the desk tops installed.

Youth

• Purchased and installed a wire shelf hanging system for each closet in the Spruce and Columbine

Rooms.

• We had the carpet replaced in the Sunshine Room. To save money we used a piece of leftover

material from construction to replace a section of linoleum floor next to the new carpet that had holes

in it.

• Hung a section of artwork made by the children’s programs at Ken-Caryl in the hallway on the

recreation side of the Ranch House.

Pools

• Checked pool slide pit at Community Center Pool weekly to see how dehumidifier was working.

Bumped the slide motor to check for seizing.

• Per West Metro Fire Department, we moved several outlets that were below the maximum water level

to above the maximum water level in the pit for the pool at the Ranch House.

• Rewired a burned-out ballast in the pump room to take LED replacement lamps.

Bradford Park

• Did weekly checks of building to make sure no vandalism had taken place.

• Ordered and received new light fixtures for the Bradford Pool Building. New fixtures will be installed

in April by maintenance staff.

Tennis Building

• Inspected and scheduled repairs for future date.

Equestrian Center

• Performed walk-through inspections of facility.

II. PARKS DEPARTMENT

A. Fleet Maintenance

Vehicles

• Completed the 3000-mile services/90-day inspections on the following vehicles: #13, 21, 23, 26, 29,

35, 36, 37, 41 and 92.

• Updated vehicle registrations and tags.

• Replaced a leaking power steering pressure hose on Truck #34. Replaced the front brake pads and

turned the rotors. The cooling system was also flushed and the coolant was replaced.

• The PTO assembly was replaced on the Bucket Truck.

• Verified that all of the District’s vehicle identification numbers matched our records.

• Completed the annual preventive maintenance safety inspection and dielectric test on the Bucket

Truck.

• Modified the Turfco front-mount aerator to fit on our John Deere model 1445 and 1565 tractors.

• Replaced the leaking governor seal on a Toro ZTR mower.

• Cleaned and rebuilt the carburetor on the Stihl MS440 chain saw.

• Replaced the snapped traction engagement pin on the stump grinder.

• Completed the annual safety inspection of the shop lift.

• Completed the annual service of the golf cart, the John Deere 1565 tractor and mowing deck and two

sidewalk edgers.

• Welded an aluminum soccer goal support.

• Serviced the sprayer pump and engine on the water truck. Inspected the tank, mounting straps,

hoses, reels and fittings.

• Tuned-up and serviced a hand-held blower.

• Completed servicing the walk-behind aerator, the plate compactor and the Lincoln welder/generator.

• Shop personnel attended an equipment maintenance training class through the LL Johnson Co.

B. Turf/Horticulture/Forestry

• Pruned trees for sidewalk and mower clearance.

• Ground stumps and prepared areas for sod that will be installed in April.

• Created a shrub rejuvenation schedule.

• Parks foreman attended training for pesticide applicator license.

• Forestry Crew removed an Ash tree from Eagles Pointe sign area in preparation for the sign being

removed. The area was then prepared for sod.

• North Ranch Park and the upper portion of Greenbelt ‘W’ were aerated.

• Seeded areas at the Community Center and the upper portion of Greenbelt ‘W’.

• Installed crushed rock on the east side of Court #1 at the Community Center.

• Mowed Prairie Meadow Park, Ken-Caryl Ave. and the upper and lower portions of Amaranth Park.

• Cleaned the curb line along Valley Parkway of debris.

• Reattached insulation and vapor barrier, using the bucket truck, at the indoor arena at the Equestrian

Center.

• Moved and replanted plants on medians.

• Designed a Children’s Garden at the Community Center and began prepping the area.

• Installed a new homerun fence on Community Park west field.

• Filled in holes on Ranch House soccer fields.

• Put up all soccer goals with new nets.

• Re-installed all base anchors on the baseball fields.

• Laid out a new soccer field for the Rush Soccer League at the Community Park.

Fence Repair

• Replaced a post and a full section of privacy fence along Continental Divide Rd.

Entrance. Repaired a lateral line and 4 sprinkler heads that had been damaged by the fence

• Charged the mainline at Community Park and went through the zones. Made repairs to a 3” lateral

tee.

MASTER ASSOCIATION & METROPOLITAN DISTRICT

OPEN SPACE & PARKS USE RULES Ken-Caryl Ranch attracts many people with the beauty of its open space and parks. The accessibility of the open space, parks, and the many recreational opportunities it provides are significant factors that make Ken-Caryl Ranch unique from other planned developments. The Master Declaration identifies use of the Association property as a right of membership available to members in good standing. This is not an exclusive use however; therefore any encroachment (use that becomes exclusive) is in fact trespassing. Having an enforceable set of rules is critical to a successful resource management program and insuring open space user safety. Section 6.05 of the Master Declaration of Covenants, Conditions and Restrictions for the Ken-Caryl Ranch gives the Master Association the ability to create these rules, paragraph F states; F. Ken-Caryl Ranch Rules. To make, establish and promulgate, and in its discretion to amend or repeal and reenact, such Ken-Caryl Ranch Rules, not in contradiction of this Master Declaration, as it deems proper covering any and all aspects of its functions including the use and occupancy of Association Property. Without limiting the generality of the foregoing sentence, such Rules may set dues and fees and prescribe the regulations governing the operation of Association Property. Each member shall be entitled to examine such Rules at any time during normal working hours at the principal office of the Association. Therefore, the Ken-Caryl Ranch Master Association Board of Directors and Ken-Caryl Ranch Metropolitan District Board of Directors have adopted the following rules governing open space and parks use in an effort to maintain ecological integrity and to provide a positive recreational experience for everyone. These rules apply to all users of the open space, parks and accompanying parking lots.

1. Private open space properties are for the use of members and their guests only. Guests must have pass or be accompanied by a member. When guests are accompanied by a member, guests shall be within verbal or sight contact of the member. Trespassers will be prosecuted.

2. Except for authorized activities, all parks and open space areas are open from sunrise to sunset.

A. Use of all baseball diamonds, playgrounds and the Frisbee golf course at Ranch

House is prohibited after sunset. B. Use of all tennis courts is prohibited after sunset unless lighted in which case courts

will close at 10:00 P.M. C. Use of parks, greenbelts, and open space is allowed after sunset except as written

above and providing that they are not engaged in illegal activity, destructive or disruptive behavior. Examples of authorized activities permitted after sunset include walking, bicycling, jogging, star gazing, or camping in designated areas.

D. Visitors are welcome at the Ken-Caryl Ranch Equestrian Center from sunrise to sunset.

3. Except for authorized activities, use or occupancy of parks and open space during time

such lands are administratively closed to use is prohibited.

4. Domestic animals must be under the owners or handlers physical control at all times and be on a leash no longer than ten feet. Owner or handler will be responsible for any damages caused by their animal and must pick up and take out pet excrement after their household pets.

5. You are allowed to mow/trim up to a 10-foot swath in the open space parallel to your property boundary line to a height of no less than 6 inches. Mowing beyond that point is prohibited. Removal of woody vegetation greater than 1” in diameter at the base is prohibited unless you get advance approval (contact Open Space Department). Dumping or storage of material, anywhere in open space, is prohibited which includes grass clippings, dirt and other landscaping debris. No unauthorized alterations to the open space are allowed, which include landscaping, play equipment, decks, walls, fence, buried invisible pet fences, bird feeders/houses or the removal of plant material.

6. Unauthorized vehicles are prohibited which includes, but is not limited to E-bikes, motorcycles, motorized scooters and any other motorized vehicle.

7. Unauthorized collecting, taking, gathering, possessing, destroying, mutilating, defacing, damaging or disturbing any wildlife, natural feature, archeological item, vegetation, or any other object is prohibited.

8. Openly carrying, possessing or discharging of a device with a projectile is prohibited. This includes, but is not limited to firearms, B-B guns, pellet guns, paint ball guns, airsoft-type guns, archery equipment, and sling shots.

9. Possessing, igniting, or discharging fireworks or explosive devices is prohibited.

10. Open fires of any kind are prohibited. A. Exceptions include fires in designated areas only, including; Permanent picnic grills,

Bradford fire pit (by written permit only) and portable grills. Charcoal, wood or gas portable grills are allowed in the irrigated parks and greenbelts. Only gas or liquid

fuel portable grills and stoves are allowed in open space. Portable grills are not allowed on tables and must be 12 inches minimum off the ground.

B. It is prohibited to burn any material in a careless manner (fire must be completely contained in the fire pit or grill) or to leave any fire unattended or to fail to completely extinguish any fire or to violate the conditions of an imposed fire ban.

C. It is prohibited to illegally dispose of burnt charcoal or ashes. D. It is prohibited to collect firewood. E. Fire Bans: All fires including those in designated areas are prohibited when an order

banning fires is issued by either the landowner or Jefferson County Sheriff Department.

11. Depositing, burying, or burning any refuse, trash, litter, household or commercial garbage or trash including, but not limited to, brush, lawn trimmings, and tree branches except in designated receptacles is prohibited.

12. Except for authorized activities, swimming and wading in, floating or boating upon any body of water is prohibited.

13. Ice skating, ice fishing or walking upon any ice is prohibited.

14. Sound amplification and unreasonably loud noises that would disturb others is prohibited.

15. Glass containers are prohibited.

16. Camping must be authorized beforehand and is restricted to designated areas.

F. Camping is limited to 3 days and 2 nights at each site except when authorized by the Ranger Staff.

G. Each site is limited to one group of campers not to exceed 8 people, except for Dakota Lodge, and Bradford which areis limited to one group not to exceed 50 people.

H. An adult must be present at all times at Dakota Lodge and Bradford campsites. I. Camping at Dakota Lodge is permitted only when the Lodge has been reserved

through the Ranch House front desk. Use of the indoor facilities is required J. Camping at Bradford Open Space is permitted only when Bradford Open Space has

been reserved through the Ranch House front desk. K. Quiet hours are between 10:00 PM and 6:00 AM L. All trash must be packed out. Trashcans are available at Dakota Lodge and Bradford. M. Trees and plants may not be used to support clothes lines, tents, or any other camping

17. Hunting, trapping, or the release of any wildlife is prohibited, except by the Ken- Caryl Ranch Park Ranger staff when deemed necessary to protect overall ecosystem health.

18. Feeding or attempting to feed any wildlife is prohibited.

19. Technical rock climbing with the use of ropes or any other climbing hardware is

prohibited.

20. Interference with any Park Ranger, open space or parks employee while in the performance of his/her duties is prohibited. Interference shall include, but is not limited to, physical actions intended to aid a person who is resisting employees’ actions, or attempting to flee from an employee while he/she is discharging his/her duties, or giving false information to an employee.

21. Park Rangers have the right to request any member or nonmember to leave any park, open space, or facility when they do not meet standards of proper conduct, at Rangers discretion.

22. All organized events and groups in open space must be authorized in advance. All parks are open to group use unless permitted or reserved.

23. Hanggliders, paragliders, hot air balloons, helicopters or other piloted aircraft will not be permitted to use parks or open space property as a point of departure or landing.

24. Unauthorized operation of remote controlled or motorized aircraft (includes drones), or boats from, in, on or over any Association or District owned property is prohibited. However, operation of remote controlled aircraft (including drones) is allowed by permit only in Community Park’s air/land space.

25. It is not permitted to throw, strike, propel or otherwise operate flying or propelled objects of a potentially dangerous nature, including by way of example and without limitation, such items as model rockets, horseshoes, arrows, golf balls or rocks, except in areas designated for such use or as part of an authorized sport or recreational activity.

26. Horses must stay off hard surface trails except when equestrian trails intersect and it is necessary to reach the other side.

27. Any person fishing on any body of water must comply with the Colorado Parks and Wildlife’s Rules and Regulations regarding fishing.

28. Geocaches/Letterboxes are only allowed in irrigated public parks and greenbelts.

Pursuant to Section 3.08 of the Amended and Restated Master Declaration of Covenants, Conditions and Restrictions of the Ken-Caryl Ranch, the Board of Directors of the Ken-Caryl Ranch Master Association can invoke one or more of the following remedies after giving the owner Notice and Hearing;

1) Impose a special charge (fine) upon such owner of fifty ($50) for each violation. If the fine remains unpaid for a period of ten days or more, it may become a continuing lien against the property.

2) Suspend the right of such owner and his family, guests, licensees, lessees and invitees to use Association property for a period of not more than thirty (30) days for each violation.

3) Cause the violation to be cured and charge the cost to such owner. A continuing lien may be placed against the property for the cost to cure.

4) Seek injunctive relief from a court of competent jurisdiction to enjoin the violation.

ENFORCEMENT PROCEDURES • KCRMA Park Rangers duties include enforcing rules and regulations on private and public open space areas. The following guidelines outline the specific enforcement procedures for each area. • At Ranger discretion an alternate enforcement agency may be contacted to assist with rules enforcement at any time.

KEN-CARYL RANCH PUBLIC OPEN SPACE GUIDELINES FOR USE OF E-BIKES AS “OTHER POWER-DRIVEN

MOBILITY DEVICES” ON PROPERTIES OWNED OR LEASED BY THE KEN-CARYL RANCH METROPOLITAN DISTRICT

A. INTRODUCTION

1. These Guidelines (“Guidelines”) address the use of e-bikes as other power-driven mobility

devices (“OPDMDs”) by individuals with mobility disabilities on properties owned or leased by Ken-Caryl Ranch Metropolitan District (KCRMD) and managed by the Ken-Caryl Ranch Master Association (KCRMA). These properties are known as “Ken-Caryl Ranch Public Open Space” (Public Open Space).

2. The use of e-bikes as OPDMDs on Public Open Space is governed by 42 U.S.C. 126,

Subchapter II, Part A of the Americans with Disabilities Act of 1990, as amended (the “Act”), and 28 C.F.R. Part 35, as amended by the final rule published on September 15, 2010. These Guidelines specifically pertain to the provisions of Sections 35.101 through 35.150 of 28 C.F.R. Part 35 (the “Regulations”). The relevant provisions of the Act and the Regulations are included in the Appendix to these Guidelines (need to include).

3. An OPDMD is defined in Regulation §35.150 as “any mobility device powered by batteries,

fuel, or other engines––whether or not designed primarily for use by individuals with mobility disabilities––that is used by individuals with mobility disabilities for the purpose of locomotion, including golf cars, electronic personal assistance mobility devices (EPAMDs), such as the Segway® PT, or any mobility device designed to operate in areas without defined pedestrian routes, but that is not a wheelchair within the meaning of this section.” This Regulation also defines a “wheelchair” as “a manually-operated or power-driven device designed primarily for use by an individual with a mobility disability for the main purpose of indoor, or of both indoor and outdoor locomotion.”

4. KCRMD is required to “make reasonable modifications in its policies, practices, or

procedures to permit the use of [OPDMDs] by individuals with mobility disabilities, unless [KCRMD] can demonstrate that the class of [OPDMDs] cannot be operated in accordance with legitimate safety requirements that the public entity has adopted pursuant to § 35.130(h).” Regulation §35.137(b)(1). KCRMD is not required to make modifications that “would fundamentally alter the nature of [its] service, program, or activity” (Regulation §35.130(b)(7)); and the Regulations do not require KCRMD “to permit an individual to participate in or benefit from the services, programs, or activities of [KCRMD] when that individual poses a direct threat to the health or safety of others.” Regulation §35.139(a).

5. Regulation §35.137(b)(2) provides that the following assessment factors shall also be considered in determining whether a particular OPDMD can be allowed in a specific facility as a reasonable accommodation:

(i) The type, size, weight, dimensions, and speed of the [OPDMD]; (ii) The facility's volume of pedestrian traffic (which may vary at different times of the day, week, month, or year); (iii) The facility's design and operational characteristics (e.g., whether its service, program, or activity is conducted indoors, its square footage, the density and placement

of stationary devices, and the availability of storage for the [OPDMD], if requested by the user); (iv) Whether legitimate safety requirements can be established to permit the safe operation of the [OPDMD] in the specific facility; and (v) Whether the use of the [OPDMD] creates a substantial risk of serious harm to the immediate environment or natural or cultural resources, or poses a conflict with Federal land management laws and regulations.

B. APPLICATION OF THE REGULATIONS TO PUBLIC OPEN SPACE

1. KCRMD owns and leases approximately 1,078 acres of land containing approximately 3.6

miles of trails in unincorporated Jefferson County. The Mission of the private and Public open space areas contained in Ken-Caryl Ranch Open Space is to “preserve and restore native ecosystems, protect and promote natural biological diversity and provide a balance between the requirements of man and the capacity of nature”. Except to the extent necessary to allow for appropriate recreational use, Public Open Space remains in a natural condition to foster the Mission of the Ken-Caryl Ranch Open Space Program. The unregulated use of OPDMDs on Public Open Space would create a substantial risk of serious harm to the environment and natural resources of Public Open Space and would fundamentally alter the nature of the Ken-Caryl Ranch Open Space Program.

2. Another fundamental component of the Ken-Caryl Ranch Open Space Program is to provide

an outdoor, natural, and safe recreation experience for its users while protecting the natural environment. This aspect of the Program is expressed in the Facilitated Recreation section of the Ken-Caryl Ranch Open Space Comprehensive Management Plan: “attempt to balance the commitment to enhanced recreational opportunities with the capacity of the environment to sustain recreational use.” Trails have been located and developed to optimize user safety and outdoor experience and to limit natural resource damage. The types of mountainous terrain, habitats, and natural resources vary considerably throughout Public Open Space. Users face a multitude of risks on Public Open Space, such as those resulting from (1) rough, steep, and weather-impacted trails, (2) unimproved topographic hazards like cliffs, ravines, loose or falling rocks, and (3) user conflict due to, for example, high traffic, user speed differentials, narrow trail widths, and limited sight distances. The unregulated use of OPDMDs on Public Open Space would substantially increase these safety risks to all users and fundamentally alter the nature of the Ken-Caryl Ranch Open Space Program.

3. To fulfill the Ken-Caryl Ranch Open Space Mission and to ensure the safety of the Program’s users, the Ken-Caryl Ranch Open Space and Parks Use Rules and Enforcement Procedure do not permit motorized vehicles on Open Space lands; Rule #6 “ Unauthorized vehicles are prohibited which includes, but is not limited to E-bikes, motorcycles, motorized scooters and any other motorized vehicle”.

4. The purpose of these Guidelines is to provide a reasonable modification to Rule #6 by setting

forth the safety requirements and criteria for the use of e-bikes as OPDMDs on Public Open Space by persons with mobility disabilities.

C. SAFETY REQUIREMENTS AND CRITERIA FOR USE OF E-BIKES AS OPDMDs ON PUBLIC OPEN

Individuals with mobility disabilities may use e-bikes as OPDMDs on Public Open Space subject to the following safety requirements and criteria.

1. Except for rule #6 of the Ken-Caryl Ranch Open Space and Parks Use Rules and

Enforcement Procedure as modified by these Guidelines, the Ken-Caryl Ranch Open Space and Parks Use Rules and Enforcement Procedure apply to the use of e-bikes as OPDMDs. For example, e-bikes as OPDMDs may not be used in closed areas (See Rule #3); and the use of e-bikes as OPDMDs may not damage natural and/or cultural resources or wildlife habitat (See Rule #7).

2. An e-bike as an OPDMD must remain on trails. An e-bike as an OPDMD must be capable of

being turned around within the trail tread in a safe manner.

3. An e-bike as an OPDMD may be used on Cathy Johnson Trail, Columbine Trail and the Parcel A driveway.

4. An e-bike as an OPDMD must be electric powered. Only Class 1, pedal assist. Motor is

limited to 750 watts and top speed of 20mph.

9. An e-bike as an OPDMD must be operated at a safe speed. When other users are present on a trail, a safe speed for an e-bike as an OPDMD is deemed to be the average speed at which the other users are travelling on the trail. The maximum speed for an e-bike as an OPDMD when other users are present is 5 mph. When other users are not present the maximum speed for an e-bike as an OPDMD is 15 mph.

10. An e-bike as an OPDMD must have the capacity to safely negotiate trail features and

obstructions such as steps and other vertical displacements, water dams, loose gravel, and rocks.

11. KCRMD recommends that an e-bike as an OPDMD not be operated on trails at times of

heavy traffic. An e-bike as an OPDMD user may be informed by Ken-Caryl Ranch Open Space staff that specific trails at specific times are not available for e-bike as an OPDMD use due to heavy traffic.

12. Due to varying conditions on Public Open Space and to ensure safety and/or natural

resource protection, KCRMD recommends that an e-bike as an OPDMD user contact Ken-Caryl Ranch Open Space Staff at 303-979-1876, ext. 170 to confirm that an e-bike as an OPDMD is permitted on a particular trail.

13. E-bikes as an OPDMDs are not permitted in KCRMD indoor facilities.

14. By adopting these Guidelines KCRMD is not representing that Public Open Space is safe

for use by an e-bike as an OPDMD and it is not assuming any liability. Certain risks are inherent in the use of Public Open Space and all users must exercise reasonable care.

D. INQUIRY INTO DISABILITY

1. A Ken-Caryl Ranch Open Space employee or volunteer inquiring as to a mobility disability or use of an e-bike as an OPDMD on Public Open Space shall comply with the following:

a. The Ken-Caryl Ranch Open Space employee or volunteer shall not ask a person using an e-bike as an OPDMD questions about the nature and extent of the person's disability.

b. The Ken-Caryl Ranch Open Space employee or volunteer may ask a person

using an e-bike as an OPDMD to provide a credible assurance that the e-bike as an OPDMD is required because of the person's disability. The Ken-Caryl Ranch Open Space employee or volunteer shall accept the presentation of a valid, State-issued, disability parking placard or card, or other State-issued proof of disability as a credible assurance that the use of the e-bike as an OPDMD is for the person's mobility disability. In lieu of a valid, State-issued disability parking placard or card, or State-issued proof of disability, the Ken-Caryl Ranch Open Space employee or volunteer shall accept as a credible assurance a verbal representation, not contradicted by observable fact, that the e-bike as an OPDMD is being used for a mobility disability. A “valid” disability placard or card is one that is presented by the person to whom it was issued and is otherwise in compliance with the State of issuance’s requirements for disability placards or cards.

E. USE OF GUIDELINES

1. These Guidelines and the Appendix are available to the public on the Ken-Caryl Ranch

Community website. A person may also request a copy by phone (303-979-1876) or by mail (KCRMD, 7676 S. Continental Divide Road, Littleton CO 80127).

2. If a member of the public has a question concerning these guidelines he or she may contact

KCRMD at 303-979-1876. 3. KCRMD may supplement or amend these Guidelines and in that event KCRMD shall post

on its website the proposed Guidelines in advance of their adoption.
