 PURPOSE:

This report provides for Council decisions with respect to appointments to the Parcel Tax Roll Review Panel and the authorization to proceed with a notice of the Parcel’s sitting for consideration of “Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015”and “PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016.”  POLICY / REGULATORY ANALYSIS:

The Community Charter requires that after work is completed on a local area service project and before a parcel tax is imposed with respect to the project for the first time, a pre-notification process take place for those properties being assessed the City’s parcel tax. As a result of this process, the Parcel Tax Roll Review Panel that has been established considers any complaints respecting the parcel tax roll and authenticates the roll in accordance with legislation. Project work is now complete in relation to “Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015” and “PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016”. Copies of these Bylaws are attached for reference as Appendix “A” and “B” to this report. The parcel tax roll has been prepared by the Financial Services Division and accordingly, a Parcel Tax Roll Review Panel must now be appointed by City Council. Parcel Tax Roll Review Panels have traditionally held sittings in the Council Chambers commencing at 12 noon.

The Community Charter requires that after Council has established the Panel, advance public notice of the time and place of the sitting of the Panel must be published in a newspaper once each week for two (2) consecutive weeks.  

RECOMMENDATIONS  

THAT Council: 1. APPOINT three (3) of its members to serve as the Parcel Tax Roll Review Panel for the subject Bylaws,

“Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015” and “PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016”;

2. ESTABLISH March 8, 2018, at 12:00 p.m. in Council Chambers, City Hall, as the date, time and place for the sitting of the Parcel Tax Roll Review Panel; and

3. DIRECT Administration to publish advance notice of the time and place of the Panel’s sitting in accordance with section 94 of the Community Charter.

CONCLUSION:

Arrangements have been put in place for the establishment of a Parcel Tax Roll Review Panel for consideration of “Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015” and “PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016”. It is recommended that Council appoint three (3) of its members to serve on the Panel and establish March 8, 2018, at 12:00 noon in City Hall Council Chambers as the time and place for the Panel’s sitting. PURPOSE: For Panel decision with respect to authentication of the parcel tax roll related to “Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015” and “PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016”.   DISCUSSION: On April 27, 2015, Council adopted “Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015” and the following year on October 27th Council adopted “PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016”. Work is now complete for both local area service projects and the City may proceed with levying the property owners with the parcel tax for their share of the costs as outlined in the Parcel Tax Rolls. Statutory requirements for public notice and notification to property owners who are subject to the parcel tax for these projects, has been completed and the Parcel Tax Roll has been available for public inspection in City Hall during its regular office hours since February 21, 2018.

RECOMMENDATION:

THAT the Parcel Tax Roll Review Panel: 1. Receive for information the report dated March 1, 2018 titled “Parcel Tax Roll Review Panel for

Consideration of Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015 and PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016”; and

2. Confirm and authenticate the Parcel Tax Roll for “Ridgeview Sanitary Sewer Extension Local Area

Service Bylaw No. 8662, 2015” and “PG Pulpmill Road Erosion Protection Local Area Service Bylaw No. 8743, 2016”, by signing the Certificates attached as Appendix C to this report.

The Community Charter outlines that a complaint may be made on one or more of the following grounds: (a) there is an error or omission respecting a name or address on the parcel tax roll; (b) there is an error or omission respecting the inclusion of a parcel; (c) there is an error or omission respecting the taxable area or the taxable frontage of a parcel; or (d) an exemption has been improperly allowed or disallowed. Further, complaints must not be heard by the Parcel Tax Roll Review Panel unless written notice of the complaint was made to the Corporate Officer at least 48 hours prior to the time that the Review Panel sits. As of March 1, 2018, no complaints have been received. If no complaints are received by the above deadline, the remaining requirement of the Parcel Tax Roll Review Panel under the Community Charter is to confirm and authenticate the Parcel Tax Roll for each local area service project by way of a certificate. Following authentication of each Parcel Tax Roll, notice of the Panel’s decision will be mailed to property owners subject to the tax as well as the complainant, if the complainant is not the owner.   CONCLUSION: Provided no complaints are received by the deadline noted above, it is in order for the Parcel Tax Roll Review Panel to confirm and authenticate each Parcel Tax Roll by signing the Certificates attached to this report. RE: Notice of Parcel Tax Roll Review Panel Sitting for Consideration of a Parcel Tax related to

“Ridgeview Sanitary Sewer Extension Local Area Service Bylaw No. 8662, 2015”

Project work is now complete in relation to “Ridgeview Sanitary Sewer Extension Local Area Service Bylaw

No. 8662, 2015”, a copy of which is enclosed for reference. Bylaw No. 8662 pertains to the installation of a

sanitary sewer main extension in the Hart Highlands Area as a Local Area Service (LAS) along Ridgeview Drive,

as shown on Appendix “A” attached to the Bylaw.

The Community Charter requires that after work is completed on a local area service project and before a

parcel tax is imposed with respect to the project for the first time, a pre-notification process take place for

those properties being assessed the City’s parcel tax. This letter is being sent to all property owners within the

local area service area to provide you with the required notification.

The parcel tax roll has been prepared by the Financial Services division and accordingly, a Parcel Tax Roll

Review Panel must consider any complaints respecting the parcel tax roll, and authenticate the roll in

accordance with legislation.

The Parcel Tax Roll Review Panel will hear complaints and make corrections to the parcel tax roll only on one of

the following grounds:

There is an error or omission respecting a name or address on the parcel tax roll;

There is an error or omission respecting the inclusion of a parcel;

There is an error or omission respecting the taxable frontage of a parcel; or

The total taxable cost of the Ridgeview Sanitary Sewer Extension Local Area Service project is $468,088.64

(four hundred and sixty eight thousand eighty eight dollars and sixty four cents) and the proportion of the cost

of the local area service to be subject to the local service tax is 100%. The parcel tax has been determined by

dividing the total construction cost of the local area service by the number of parcels included in the local

service area, as outlined in section 6 of the Bylaw, as follows:

The local area service costs, as calculated in section 6 of the Bylaw, plus financing costs, will be borne by the

owners of parcels within the local area service boundary and will result in an annual charge being levied over a

twenty (20) year period commending in 2018, unless the parcel owner elects to commute payment, (i.e. make

a lump sum payment in full) in accordance with section 9 of the Bylaw.

Section 9 of the Bylaw stipulates that an owner of a parcel within the local service area may pay the parcel tax

determined pursuant to section 6 of the bylaw as follows:

(a) by making payment in full no later than thirty (30) days after the authentication of the parcel tax roll by

the parcel tax roll review panel; or

(b) by annual payments over a period of twenty (20) years, with an interest rate of 3% per year.

No. 8743, 2016”, a copy of which is enclosed for reference. Bylaw No. 8662 pertains to the construction of

works as a local area service for the purposes of providing erosion protection along affected properties on PG

Pulpmill Road, as shown on Appendix “A” attached to the Bylaw.

The Community Charter requires that after work is completed on a local area service project and before a

parcel tax is imposed with respect to the project for the first time, a pre-notification process take place for

those properties being assessed the City’s parcel tax. This letter is being sent to all property owners within the

local area service area to provide you with the required notification.

The parcel tax roll has been prepared by the Financial Services division and accordingly, a Parcel Tax Roll

Review Panel must consider any complaints respecting the parcel tax roll, and authenticate the roll in

amongst the three (3) affected properties based on each property's percentage of frontage. Frontage

(a) by making payment in full no later than thirty (30) days after the authentication of the parcel tax roll by

the parcel tax roll review panel; or

(b) by annual payments over a period of twenty (20) years, with an interest rate of 3% per year.

If you wish to have a complaint heard by the Parcel Tax Roll Review Panel, you must give written notice of

your complaint to the Corporate Officer at least forty-eight (48) hours before the time set for the sitting of the

Parcel Tax Roll Review Panel at 12:00 p.m., March 8, 2018. In other words, we must receive the written

notice of your complaint by 12:00 p.m. on March 6, 2018. Complaints may be submitted as follows:
