The Grey County Planning & Development Department indicated in a letterdated November 23, 2017 that provided positive comments are receivedfrom the local Conservation Authority, and MDS requirements are met,County Planning staff have no concerns with the subject application.
The Saugeen Valley Conservation Authority indicated in a letter datedNovember 27, 20L7 that it has come to the attention of SVCA staff thathabitat of endangered or threatened species may be located on or adjacentto the subject property. It is the responsibility of the applicant to ensure theendangered and threatened species policy referred to in the PPS has beenappropriately addressed. The property owner is requested to contact theMinistry of Natural Resources & Forestry for information on how to addressthis policy. The letter concludes that all of the plan review functions listed inthe Agreement have been assessed with respect to this application, andtherefore, the application for Consent is acceptable to the SVCA staff.
The Municipal Planner indicated in his Planning Report dated December tt,20L7 that the proposed farm split is clearly in conformity with the CountyOfficial Plan and the West Grey Zoning By-law, and is consistent with theProvincial Policy Statement. As such, the requested severance should begranted.
Mark Szabo, son of applicant, Wanda Szabo, noted the request from theSVCA to contact the MNRF about endangered or threatened species. TheClerk and Planner mentioned an individual with a pending severanceapplication recently contacted Jody Scheifley, Management Biologist, withthe MNRF about the endangered or threatened species issue. Mr. Schiefleyinformed this individual that he will need to conduct a self-assessment of hisproperty during bird breeding season (June-July) to determine if there is anyevidence of threatened or endangered species. The Clerk and Plannerindicated this will create uncertainty on how to deal with future planningapplications.

The SVCA letter concludes that all of the planreview functions listed in the Agreement have been assessed with respect tothis application, and therefore, the application for consent is acceptable toSVCA staff.
The Municipal Planner indicated in his Planning Report dated December 11,20t7 that the proposed lot addition fixes an encroachment problem involvingthe existing well associated with the residential dwelling. It also squares offthe subject property in a more appropriate manner and would facilitate apossible commercial development on this enlarged parcel in the future.This severance has considerable merit and should be approved.

Scheifley, Management Biologist, of the Ministry of Natural Resources &Forestry, for information on how to address this policy. The SVCA also notesthat a small portion of the southeastern corner of the property is subject tothe SVCA's Development, Interference with Wetlands and Alterations toShorelines and Watercourses Regulation (Ontario Regulation 169/06, asamended). This Regulation is in accordance with Section 28 of theConservation Authorities Act R.S.O, L990, Chap. C.27, and requires that a
person obtain the written permission of the SVCA prior to any "development"within a Regulated Area or alteration to a wetland or watercourse. Ifdevelopment or alteration including construction, reconstruction, conversion,grading, filling or excavation is proposed within the Approximate ScreeningArea on the proposed retained parcel, the SVCA should be contacted, aspermission may be required. The letter concludes that all of the plan reviewfunctions listed in the Agreement have been assessed with respect to thisapplication, and therefore, the application for Consent is acceptable to theSVCA staff.
The Ministry of Transportation Ontario (MTO) in a letter dated December 4,20t7 indicated that the subject application is not expected to result in an
increase to highway access in terms of number of access or trafficgeneration. Therefore, MTO is supportive of the proposed severance (lotaddition).
The Municipal Planner indicated in his Planning Report dated December 11,20t7 that the proposed lot addition does not involve any agricultural landand conforms to the Grey County Official Plan. The proposal is alsoconsistent with the Provincial Policy Statement. This severance has merit andshould be give favourable consideration.
The Committee requested the Clerk to forward the SVCA letters to allapplicants with planning applications that the SVCA requested the propertyowner to contact the MNRF about threatened or endangered species, inorder to ensure they are aware of their responsibility.

Purpose of Application:
The purpose of this Consent application is to sever 3.1 hectares of vacant land
and merge that parcel with the adjacent 2.33 hectare lot containing a dwellingand accessory building; and, to retain a 1.8 hectare property.
No new lot would be created as a result of this lot addition
Subiect Lands
The subject property is located along the east side of Grey Road 28, east ofHanover
Approximately 1.45 hectares of the 4.9 hectare property is forested. The balanceof this vacant parcel appears to be cash-cropped.
Adiacent Lands
Being in such close proximity of Hanover, this area of West Grey is representedby a mix of urban and rural type land uses including a large, residential lot to thesouth (to which the severed parcel will be merged), a church further south, theHanover Drive-ln Theatre to the north, residential lots and a private club fudhernorth, and agricultural uses to the east and west.

Official Plan Conformitv :
The subject lands fall within the Hanover / West Grey Secondary Plan, whichforms part of the County of Grey Official Plan. This Secondary Plan was recentlyestablished through a joint effort involving West Grey and the Town of Hanover,
and occurred after the Town had demonstrated that sufficient land did not existwithin the Town's boundaries to accommodate certain types of development overthe long term. Most of the lands within the Secondary Plan area, including thesubject property and the adjacent lot benefitting from the lot addition, have beendesignated 'Highway Commercial'. According to the Secondary Plan, this land
use designation is intended to:
"...provide opportunities for new commercial uses which are not suited to locatewithin the downtown of Hanover due to their size and/or nature, and which do notcompete on a functional basis with Hanover's downtown."
Permitted uses shall include, but are not limited to: automotive uses; restaurants;motels; hotels; bulk sales establishments; garden centres; theatres; places ofentertainment; and, building supply outlets, grocery stores, wholesale outlets,pharmacies, retail stores, or combination thereof, provided such uses occupy aminimum of 929 square metres of floor area and existing agricultural uses.
The proposed lot addition, which has the effect of changing the size of twoexisting lots from 4.9 hectares and 2.33 hectares to 1.8 hectares and 5.43hectares respectively, would not appear to undermine the intent and purpose ofthe'Highway Commercial' designation.
Provincial Policv Statement Conformitv :
The Provincial Policy Statement (PPS) directs urban type land uses to thedesignated settlement areas. This area of West Grey is now considered to be adesignated settlement area as a result of the Secondary Plan's recent approval,
At some point, the subject property and the adjacent lands along Grey Road 28will be developed or re-developed for commercial purposes in accordance withthe 'Highway Commercial' policies. The proposed lot addition would not appearto undermine future commercial development on these lands.
Zoninq Bv-law Gonformitv:
The subject property is zoned 'C2-325-h' (Highway Commercial Exception withholding suffix). A variety of commercial uses are permitted within this zoneincluding large retail stores, large wholesale outlets, beer stores, commercialnursery, boat sales, trailer sales, etc.

The 'minimum lot area' and 'minimum lot frontage' requirements are 2000 squaremetres and 30.5 metres respectively. Both the retained parcel and the adjacentlot benefiting from the severance will comply with these minimum standards.
A detached dwelling is not listed as a permitted use in this zone; however, theexisting use would qualify as a legal non-conforming use.
The proposed lot addition would appear to conform to the Zoning By-law,
Conclusion and Recommendation:
The proposed lot addition conforms to the County Official Plan policies and is
consistent with the Provincial Policy Statement. The requested severance can
be given favourable consideration.
This Report was prepared before all of the agency comments had been received
and prior to the Public Meeting. lt is possible that comments received after the
writing of this Planning Report could warrant a reconsideration of theaforementioned recommendation.

Dear Mr. Davidson,
This correspondence is in response to the above noted application. We have had an
opportunity to review the application in relation to the Provincial Policy Statement (PPS)
and the County of Grey Official Plan (OP). We offer the following comments.
The purpose and effect of application 813.2017 is to sever a portion of a highway
commercial lot and add it to an abutting existing highway commercial lot.
Schedule A of the County OP designates the subject property as 'Highway Commercial'
following the decision of OPA 122. County mapping has not yet been updated to reflect
these designation changes. Under the revised policies for this area as outlined by OPA
122, permitted uses include agricultural uses existing at the time of the approval. The
overall intended use of these lands is not stated to change. Should the use change of
the retained parcel, the new proposed use shall be compatible with existing and future
permitted land uses on the adjacent lands and be consistent with the 'Highway
Commercial' designation provisions.
Appendix B of the OP identifies 'significant Woodlands' on the subject property. Policy
2.8.4(1) states, no development or site alteration may occur within Significant
Woodlands or their adjacent lands unless it has been demonstrated through an
Environmental lmpact Study, as per section 2.8.7 of this Plan, that there will be no
negative impacts on the natural features or their ecological functions. The proposed site
alteration is within the identified significantwoodland; therefore, County planning staff
recommend comments are received from the local Conservation Authority.

Page2December 18th,2017Furthermore, Appendix B of the OP identifies 'other identified wetlands' near the subject
property. Policy 2.8.6(6) & 2.8.6(7) states no development or site alteration is permitted
within other identified wetlands or the 30 metre adjacent lands. ln this case, proposed
site alteration exceeds the adjacent lands. County planning staff have no concerns.
County Transportation Services have discussed the re-location of the existing field
entrance to the retained lot for access and approved the proposal. County
Transportation Services requires road widening (17' or 5.182 m) on the frontage of the
severed and retained parcels free and clear from all liens and encumbrances. The
County requests a 5.18 metre road widening be deeded to the County, as a condition of
consent should the subject application be approved. Prior to clearing the condition of
consent, it shall be ensured that the County has provided written confirmation to the
municipality that the 5.18 metre road widening has been transferred to the County of
Grey. There are no objections to the severance.
Provided positive comments are received from the local Conservation Authority, and
road widening is deeded to the County, County planning staff have no concerns with the
subject application.
The County requests notice of any decision rendered with respect to this file.

Saugeen Valley Conservation Authority (SVCA) staff has reviewed the application for consent and the proposed
zoning by-law amendment in accordance with the SVCA's mandate, the SVCA Environmental Planning and
Regulations Policies Manual, Approved May 15, 2017, and the Memorandum of Agreement between the SVCA
and the Municipality of West Grey relating to Plan Review. The purpose and effect of the application for consent
is to sever a portion of a restricted rural lot and add it to an abutting existing restricted rural lot. The purpose
and effect of the proposed zoning by-law amendment is to implement a condition of consent (if approved) to
the subject lands from 43 (Restricted Rural Zone) to A3-383 (Restricted Rural Exception Zone). The rezoning will
recognize the deficient lot area of the enlarged parcelcreated by severance (lot addition)and the lot frontage
and area of the retained parcel. The application for consent and the proposed zoning by-law amendment are
acceptable to SVCA staff, and the following comments are offered.
Natural Hazards
ln the opinion of SVCA staff, the property is not affected by any natural hazard features.

Sienificant Woodlands
Significant woodlands are identified as per Appendix B Constraint Mapping of the Grey County OP on the
proposed severed portion ofthe property, as well as the abutting lot proposed to consist ofthe enlarged parcel
created by the severance. ln addition, the lands adjacent to the east/southeast of the property are considered
significant woodlands. The Grey county oP states that no development or site alteration may occur within
Significant Woodlands or their adjacent lands unless it has been demonstrated through an Environmental lmpact
Study (ElS) that there will be no negative impacts on the natural features or their ecological functions'
The Op also allows for the waiving of the requirement for the preparation of an ElS. ln the opinion of SVCA staff,
impacts to significant woodlands are not anticipated as part of this proposal and the preparation of an EIS to
address impacts to significant woodlands is not warranted at this time.
Habitat of Endangered Species or Threatened Species
It has come to the attention of SVCA staff that habitat of endangered species or threatened species may be
located on or on the lands adjacent to the property. Section 2.1.7 of the Provincial Policy Statement (PPS 2014)
indicates that development and site alteration shall not be permitted in habitat of endangered species or
threatened species, except in accordance with provincial and federal requirements. lt is the responsibility of the
applicant to ensure the endangered species and threatened species policy referred to in the PPS has been
appropriately addressed. Please contact the Ministry of Natural Resources and Forestry (MNRF) for information
on how to address this policy. MNRF inquires in Grey County can be directed to Jody Scheifley, Management
Biologist, phone : 5!9-37 t-8471, ema il : [email protected].
SVCA Regulation
The property is not subject to the SVCA's Development, lnterference with Wetlands and Alteration to Shorelines
and Watercourses Regulation (Ontario Regulation t69106, as amended).
Conclusion
All of the plan review functions listed in the Agreement have been assessed with respect to the applications. The
application for consent and the proposed zoning by-law amendment are acceptable to SVCA staff.

This correspondence is in response to the above noted application. We have had an
opportunity to review the application in relation to the Provincial Policy Statement (PPS)
and the County of Grey Official Plan (OP). We offer the following comments.
The purpose and effect of the subject application is to sever a rural lot and retain a rural
lot.
Schedule A of the County OP designates the majority of the subject property as 'Rural'
Rural consent policy 2.3.4(2) states: all consents for new lot development shall be no
smaller than 0.8 hectares in area, and a maximum density of two lots may be
considered (plus the retained lot), by the consent process, per 40 hectares. For a 60
hectare parcel, a maximum density of 3 lots may be considered (plus the retained lot),
by the consent process. The original Township lots were 60 hectare (150 acre parcels)
Considering this, the subject consent application would not exceed the defined densityfor this parcel.
Schedule A of the County OP designates roughly 3.43 acres of the 151 acre property as'Agriculture'. Consent policies on agricultural lands are fairly restrictive, although in thiscase, the Rural consent policies will be consulted since the proportion of Agriculturallands represents a minute fraction of the overall subject property. As well, as a result ofthe land severance, the agricultural lands will remain part of one parcel and will not be
divided. lt seems as though these lands are not currently being used for farming

Page2December 20t^,2017purposes. No active farm lands are being removed from operation as part of this
consent application.
Schedule A of the OP also designates a portion of the subject property as 'Hazard
Lands'. Policy 2.8.2(3) outlines no buildings or structures are generally permitted within
the 'Hazard Lands' designation as these lands typically have inherent environmental
hazards such as flood susceptibility, erosion susceptibility, poor drainage, etc. Countyplanning staff recommend comments are received from the local Conservation Authority
to determine a potential building envelope on the severed parcel outside the hazardous
lands.
Appendix B identifies 'other identified wetlands' and 'significant woodlands' on the
subject property. Policy 2.8.6(6) states, no development or site alterations are permitted
within 'other identified wetlands' or within their adjacent lands unless it has been
demonstrated that there will be no negative impacts on the natural features or on theirecological functions. Furthermore, policy 2.8.4(1) outlines, no development or site
alteration may occur within significant woodlands or their adjacent lands unless it has
been demonstrated through an EIS that there will be no negative impacts on the natural
features or their ecological functions. The proposed location for land severance seems
to coincide with the location of the wetlands and woodlands. County planning staffrecommend comments are received from the local conservation authority prior
development occurs on the subject property.
Schedule B of the County OP identifies an 'Aggregate Resource Area' on asoutheasterly portion of the subject property. Policy 2.7 .3(6) states non-farm lot creation
shall not be permitted within lands identified as Aggregate Resource Area on Schedule
B. The retained parcel is the parcel that has identified aggregate and will remain farm
size as a result of this land severance. County planning staff have no concerns.
Section 5.3 of the OP, along with section 1.6.6 of the PPS speak to ensuring newdevelopment can be adequately serviced with water and sewer, or on-site private
services. Prior to development on the subject property, it shall be ensured adequateservicing can be provided.
Section 2.1.3(5) of the OP requires new land uses comply with the Minimum Distance
Separation (M DS) formulae.
County Transportation Services has no objections. This is not a county road and this
development would have no impact to the existing County Road. TransportationServices would suggest and recommend that the municipality obtain a 17 foot or 5.18 m
widening on both the retained and severed parcels as a conveyance and add it to theexisting road allowance. This road is a potential future county road corridor asmentioned in the Transportation Master Plan and Draft of the new County Official Plan.

requirements are met, and the severed parcel can be adequately seryiced, Countyplanning staff have no concerns with the subject application.

Natural Heritage
ln the opinion of SVCA staff, the significant natural heritage features affecting the subject property include:Significant Woodlands, Fish Habitat, and potentially the Habitat of Endangered Species and ThreatenedSpecies. lt is also noted that Other ldentified Wetlands exist on the property.

Sisnificant Woodlands

The Grey County OP states that no development or sitealteration may occur within Significant Woodlands or their adjacent lands unless it has been demonstratedthrough an Environmental lmpact Study (ElS) that there will be no negative impacts on the natural features ortheir ecological functions.
Fish Habitat
The tributary of the Beatty Saugeen River that flows through the southeastern portion of the property is
considered to be fish habitat by SVCA staff. Section 2.1.8 of the Provincial Policy Statement (PPS 2014)indicates that, among other things, development and site alteration shall not be permitted on the adjacentlands of fish habitat unless the ecological function of the adjacent lands has been evaluated and it has beendemonstrated that there will be no negative impacts on fish habitat or on their ecologicalfunctions.
Other ldentified Wetlands
Other identified wetlands are also shown on the Appendix B Constraint Mapping of the Grey County OP, andexist on both the proposed severed and proposed retained parcels. Section 2.8.6(71of the Grey County OP
states in part that no development or site alterations are permitted within the adjacent lands to otheridentified wetlands unless it has been demonstrated that there will be no negative impacts on the naturalfeatures or on their ecological functions.
Environmental lmpact Studv (ElS)
ln the opinion of SVCA staff, a potential building envelope exists on the proposed severed parcel where futuredevelopment could occur without impacting the natural heritage features mentioned above, or their ecologicalfunctions. The building envelope acceptable to SVCA staff has been shown on the enclosed SVCA mapping(dated November 23,2017). ln accordance with Section 2.8.7 (2llof the Grey County Official Plan, SVCA staff is
of the opinion that the requirement for the preparation of an Environmental lmpact Study (ElS) can be waived,provided future development on the proposed severed parcel is restricted to the recommended buildingenvelope.
As a recommended Condition of Consent, SVCA staff is of the opinion that the building envelope for theproposed severed parcel should be formally established through the Planning Acf process. lt is also theopinion of SVCA staff that development outside of the building envelope should be restricted using a holdingprovision or other appropriate planning mechanism, until an acceptable EIS is completed, or the requirementfor the preparation of an EIS is waived.
Habitat of Endansered Species and Threatened Species
It has come to the attention of SVCA staff that Habitat of Endangered Species and Threatened Species may belocated on or adjacent to the subject property. Section 2.1,7 of the Provincial Policy Statement (PPS 2014)indicates that development and site alteration shall not be permitted in habitat of endangered species orthreatened species, except in accordance with provincial and federal requirements. lt is the responsibility of

the applicant to ensure the threatened and endangered species policy referred to in the PPS has beenappropriately addressed. Please contact the Ministry of Natural Resources and Forestry (MNRF) forinformation on how to address this policy. The Owen Sound office MNRF Management Biologist for GreyCounty is Jody Scheifley (5L9-371-847L, [email protected]).
Please be advised that SVCA staff is not able to speak to provincial and federal requirements as they relate toSection 2.1.7 of the PPS, and that the above SVCA staff opinion that an EIS is not required at this time does nottake into account the Habitat of Endangered Species and Threatened Species that may be on or near thesubject property.
SVCA Regulation
Portions of the property are within the Approximate Screening Area associated with the SVCA's Development,lnterference with Wetlands and Alterations to Shorelines and Watercourses Regulation (Ontario RegulationL69/06, as amended). This Regulation is in accordance with Section 28 of the Conservation Authorities ActR.S.O, 1990, Chap. C. 27, and requires that a person obtain the written permission of the SVCA prior to any"development" within a Regulated Area or alteration to a wetland or watercourse.
"Development" and Alteration
Subsection 28(25) of the Conservotion Authorities Acf defines "development" as:
a) the construction, reconstruction, erection or placing of o building or structure of any kind,b) any chonge to a building or structure that would have the effect of altering the use or potentiol use of
the building or structure, increasing the size of the building or structure or increosing the number ofdwelling units in the building or structure,
c) site groding, ord) the temporary or permanent placing, dumping or removol of ony moterial, originating on the site or
elsewhere.
According to Section 5 of Ontario Regulation L69/06, as amended, alteration generally includes thestraightening, diverting, or interference in any way with the existing channel of a river, creek, stream orwatercourse, or the changing or interfering in any way with a wetland.
To determine where the SVCA's areas of interest are located associated with our Regulation, please refer tothe SVCA's online mapping program, available via the SVCA's website at http://eprweb.svca.on.ca. Should yourequire assistance, please contact our office directly.
Permission for Development
lf development or alteration including construction, reconstruction, conversion, grading, filling or excavation isproposed within the Approximate Regulated Area on the subject property, the SVCA should be contacted, aspermission may be required.
The majority of the building envelope for the proposed severed parcel is outside of the SVCA ApproximateRegulation Screening Area. A permit from the SVCA will only be required for development within the building

Purpose of Application:
The purpose of this consent application is to sever an 83 hectare lot containing adwelling and accessory buildings, and to retain a 79 hectare lot.
Subiect Lands:
The subject property comprises four parcels of land that have merged on title.
This odd-shaped 162 hectare lot has frontage along Provincial Highway and 18th
Sideroad WGR.
The property consists of several cropped fields and various pockets of scrub andforested lands. The Rocky Saugeen River traverses the site, and runs throughboth the severed and retained parcels. A dwelling, barn and accessory buildingare located on the severed parcel, with access from 18tn Sideroad WGR.

Adiacent Lands:
This area of the Municipality is represented by a mix of agricultural land, forestedareas and a relatively large number of non-farm residential lots.
Official Plan Gonformity:
The subject lands are designated predominantly 'Rural' on Schedule A to theCounty of Gr.ey Official Plan. The river and its floodplain are designated 'HazardLands', as is another small area on the severed parcel. ln addition, the mostwesterly portion of the subject property is designated 'Agricultural'.
The 'Rural' severance policies permit lot creation at a density of three lots(including the retained parcel) per original 40 hectare Crown parcel or two lotsper original 20 hectare Crown parcel. The subject lands comprise a combinationof parts of original 40 hectare parcels and parts of original 20 hectare parcels.
Given that the proposed severance follows one of the original lot lines, the lotdensity of any original Crown lot will not be increasing, and therefore theseverance is considered to comply with the density policy of the Official Plan.
Schedule B of the Official Plan identifies an 'Aggregate Resource Area' on
various parts of the severed and retained parcels. The creation of non-farm lotsis generated prohibit within this area, with "non-farm lots" being described asproperties comprising less than 20 hectares. Both the severed and retainedparcels greatly exceed 20 hectares in size, and therefore this policy does notapply to the proposed severance.
Appendix B of the Official Plan identifies the large amount of forested lands onthe subject property as 'Significant Woodland'. Most of the forested lands arealso shown as an 'Area of Natural and Scientific lnterest' (ANSI). Furthermore, a
small area of the site is identified as an 'Other Significant Wetland'. A dwellingand accessory buildings already exist on the severed parcel, and therefore thesedevelopment constraints are not an issue for that parcel. On the vacant retainedparcel, there appears to be approximately four hectares of land outside of the'significant Woodland' and 'ANSI' and their respective 120 metre buffers toaccommodate development in the future without having to undertake anEnvironmental lmpact Study,
Section 5.2 County Roads and Provincial Highways states that new entrancesalong Provincial highways shall be subject to the approval of Ministry ofTransportation (MTO). ln this regard, MTO must confirm that access to thesevered parcel can be obtained along Highway No. 6 before the severance canbe granted.

Provincial Policv Statement nformitv:
The Provincial Policy Statement (PPS) gives consideration to limited lot creationwithin on rural lands. The PPS also protects natural heritage features such as
Significant Woodlands and ANSI's. The proposed severance would appear tocomply with these policies, as explained earlier in this Planning Report.
The PPS also includes the following policy:
"Planning authorities shalt not permit development in planned corridors that couldpreclude or negatively affect the use of the corridor for the purpose(s) for which itwas identified."
ln this regard, it is necessary to have a favourable comment from MTO beforeconsidering this severance application.
Zoning Bv-law Conformitv:
The subject property is zoned predominantly 'A2' (Rural), with areas of 'NE'
(Natural Environment) and'A1' (Agricultural).
The 'minimum lot area' and 'minimum lot frontage' requirements of the 'A2' zoneare 20 hectares and 122 metres respectively, and the'minimum lot area' and'minimum lot frontage' requirements of the 'A1' zone are 40 hectares and 122
metres respectively. Both the severed and retained parcels meet the minimumstandards of the more restrictive 'A1' zone.
Conclusion and ndation:
Provided confirmation is received from MTO that access from Provincial Highway6 can be made available, the proposed severance would appear to conform tothe County Official Plan and the Provincial Policy Statement.
The County raised a concern in this letter dated December 20,2017 regarding a
different matter. The Rocky Saugeen River dissects the retained parcel andtherefore there does not appear to be any access to the farm land at the rear ofthis parcel without traversing the severed parcel. The County is recommendingthat the issue of long term access to these lands be addressed, and West Greystaff concurs with that recommendation.
This Report was prepared before all of the agency comments had been receivedand prior to the Public Meeting. lt is possible that comments received after the

Dear Mr. Davidson,
This correspondence is in response to the above noted application. We have had an
opportunity to review the application in relation to the Provincial Policy Statement (PPS)
and the County of Grey Otficial Plan (OP). We offer the following comments.
The purpose and effect of the subject application is to sever an agricultural/rural lot and
retain an agricultural/rural lot.
Schedule A of the County OP designates the majority of the subject property as 'Rural'.
Rural consent policy 2.3.4(2) states: all consents for new lot development shall be no
smaller than 0.8 hectares in area, and a maximum density of two lots may be
considered (plus the retained lot), by the consent process, per 40 hectares. ln this case,
the subject property is 162 hectares, and the proposed area for the severed parcel will
be 83 hectares, and the proposed area for the retained parcel will be 79 hectares. The
original Township lots that make-up the larger consolidated 162 ha parcel consist of a
combination of 40 ha and 20ha parcels. Through review of each individual parcel, the
current lot density is not surpassed. Because the proposed severance is along one ofthe original lot line, there would be no additional lots created; therefore, density would
not be increased. County planning are satisfied with the application conforming to the
above noted policies.

Policy 2.1.4(1) states, a consent for one lot may be permitted provided the original farm
parcel is a minimum of 40 hectares and no lot creation has been provided for in the
past. One option for a consent would be:
a) One lot severed to create a farm parcel of generally 40 hectares in size,
provided the development criteria of Section 2.1.3 has been satisfied.
ln this case, both the severed and retained parcels will exceed 40 hectares in size;
therefore, County planning staff have no concerns.
Schedule A of the OP also designates a portion of the subject property as 'Hazard
Lands'. Policy 2.8.2(3) outlines no buildings or structures are generally permitted within
the 'Hazard Lands' designation as these lands typically have inherent environmentalhazards such as flood susceptibility, erosion susceptibility, poor drainage, etc. Countyplanning staff recommend comments are received from the local Conservation Authority
to determine a potential building envelope on the retained parcel outside the hazardous
lands.
Appendix B identifies 'other identified wetlands' and a 'river' running through both the
retained and severed parcels. Policy 2.8.6(6) states, no development or site alterationsare permitted within 'other identified wetlands' or within their adjacent lands unless it
has been demonstrated that there will be no negative impacts on the natural features oron their ecological functions. Policy 2.8.6(5) states, no development shall be permitted
within 30 metres of the banks of a river.
Furthermore, Appendix B identifies 'significant woodlands' on the subject property.
Policy 2.8.4(1) outlines, no development or site alteration may occur within signiflcantwoodlands or their adjacent lands unless it has been demonstrated through an EIS thatthere will be no negative impacts on the natural features or their ecological functions.
Appendix B also identifies an 'area of natural and scientific interest (ANSI)' on the
subject property. Policy 2.8.6(3) states, no development or site alteration may occurwithin Areas of Natural and Scientific lnterest or their adjacent lands unless it has been
demonstrated through an EIS that there will be no negative impacts on the natural
features or their ecological functions.
County planning staff recommend comments are received from the local conservationauthority in order to address the above noted natural features.
Schedule B of the County OP identifies an 'Aggregate Resource Area' on various parts
of the subject property. Policy 2.7 .3(6) states non-farm lot creation shall not be
permitted within lands identified as Aggregate Resource Area on Schedule B. The

Page 3December 20th,2017retained and severed parcels will remain farm size; therefore, County planning staff
have no concerns.
Section 5.3 of the OP, along with section 1.6.6 of the PPS speak to ensuring new
development can be adequately serviced with water and sewer, or on-site private
services. Prior to development on the severed parcel, it shall be ensured adequate
servicing can be provided.
Section 2.1.3(5) of the OP requires new land uses comply with the Minimum Distance
Separation (MDS) formulae.
Of a general planning nature, County planning staff are concerned about access to the
westerly portion of the retained parcel. These lands are separated by a river that
traverses both the retained and severed parcels. Presumably, access to a portion of the
retained parcelwas historically gained through a portion of the severed parcel, abutting
concession 2 WGR. Provided long-term access to these lands has been considered,
County planning staff have no concerns.
Provided positive comments are received from the local conservation authority, the
severed parcel can be adequately serviced, and MDS requirements are met, County
planning staff have no concerns with the subject application.
The County requests notice of any decision rendered with respect to this file.

Natural Hazards
ln the opinion of SVCA staff, portions of the subject property are designated Hazard Lands in the Grey CountyOfficial Plan (OP), and portions of the subject property are zoned Natural Environment (NE) in the municipalityof West Grey Zoning By-law No. 37-2006. ln general, no new buildings or structures are permitted within theHazard Lands designation orwithin the NE zone.ln the opinion of SVCAstaff the Hazard Lands designation and
the NE zone generally reflects the hazardous lands as originally plotted by SVCA staff.

Natural Heritage
ln the opinion of SVCA staff, the significant natural heritage features affecting the subject property include:
Significant Woodlands, potentially Significant Wildlife Habitat, a Life Science Area of Natural or Scientific
lnterest (ANSI), Fish Habitat and the potential habitat of endangered species and threatened species. SVCA
also notes that Other ldentified Wetlands are shown on the subject property and on the adjacent properties.
Sisnificant Woodlands
Significant Woodlands are identified on the Appendix B Constraint Mapping of the Grey County Official Plan
(OP)and are located in portions of the subject property as wellas adjacent lands. Section2.8.4 of the OP
states that no development or site alteration may occur within Significant Woodlands or their adjacent lands
unless it has been demonstrated through an Environmental lmpact Study (ElS)that there will be no negative
impacts on the natural features or their ecological functions.
Sienificant Wildlife Habitat
While there is no County-wide mapping of significant wildlife habitat, it has come to the attention of SVCA staffthat significant wildlife habitat may be located on or adjacent to the property. The Grey County OP states inpart that development and site alteration shall not be permitted within significant wildlife habitat, unless it has
been demonstrated that there will be no negative impacts to the habitat or its ecological functions.
Area of Natural or Scientific lnterest
The Rocky Saugeen River Life Science ANSI is located on the subject property and on the adjacent lands. The
Grey County OP states in part that development and site alteration shall not be permitted within ANSI or theiradjacent lands, unless it has been demonstrated that there will be no negative impacts on the natural featuresor their ecological functions.
Fish Habitat
The Rocky Saugeen River and associated tributaries located on the subject property and adjacent lands are
consideredfishhabitatbySVCAstaff. Section2.l.8oftheProvincialPolicyStatement(PPS20l.4)indicatesthat, among other things, development and site alteration shall not be permitted on the adjacent lands of fish
habitat unlessthe ecologicalfunction of the adjacent lands has been evaluated and it has been demonstratedthat there will be no negative impacts on fish habitat or on their ecological functions.
Other ldentified Wetlands
According to the County of Grey OP Appendix B Constraint Mapping, Other ldentified Wetlands exist on thesubject property and on the adjacent lands. The Grey County OP states in part that development and sitealteration shall not be permitted within Other ldentified Wetlands, unless it has been demonstrated that therewill be no negative impacts on the natural features or on their ecological functions.

Environmelrtal lmpact Studv (ElS)
ln accordance with Sectio n 2.8.7 (2) of the Grey County Official Plan, SVCA staff is of the opinion that the
requirement for the preparation of an EIS can be waived with regards to this application, as the preparation ofan EIS would serve no useful purpose for the protections of the natural heritage features mentioned above.
Sjenificant Hqbilg! of Endaneefed Spqcies and Threatened Species
It has come to the attention of SVCA staff that habitat of endangered or threatened species may be located on
and adjacent to the property. Section 2.1.7 of the Provincial Policy Statement (PPS 2014) indicates thatdevelopment and site alteration shall not be permitted in habitat of endangered species or threatened species,
except in accordance with provincial and federal requirements. lt is the responsibility of the applicant to ensure
the endangered and threatened species policy referred to in the PPS has been appropriately addressed. Please
contact the Ministry of Natural Resources and Forestry (MNRF) for information on how to address this policy.

SVCA Regulation
Portions of the subject property are within the Approximate Regulation Screening Area associated with theSVCA's Development, lnterference with Wetlands and Alterations to Shorelines and Watercourses Regulation(Ontario Regulation 169/06, as amended). This Regulation is in accordance with Section 28 of the Conservation
Authorities Acf R.S.O, L990, Chap. C. 27. This Regulation requires that a person obtain the written permission
of the SVCA prior to any "development" within a Regulated Area or alteration to a wetland or watercourse.
"Devejgpment" and Alteratjon
Subsection 28(25) of the Conse rvation Authorities Acf defines "development" as:q) the construction, reconstruction, erection or plocing of a building or structure of any kind,
b) ony chonge to a building or structure that would hove the effect of oltering the use or potential use ofthe building or structure, increosing the size of the building or structure or increasing the number ofdwelling units in the building or structure,
c) site grading, ord) the temporary or permanent placing, dumping or removol of any moterial, originoting on the site or
elsewhere.
According to Section 5 of Ontario Regulation t69106, as amended, alteration generally includes thestraightening, diverting, or interference in any way with the existing channel of a river, creek, stream orwatercourse, or the changing or interfering in any way with a wetland.

Purpose of onlication:
The purpose of this Consent application is to sever a 1.96 hectare, vacant rural
lot and to retain a 35 hectare rural lot.
Backqround:
This application was initially considered by the Committee on March 13,2017 butwas deferred because the Environmental lmpact Study (ElS) had not adequatelyaddressed the development's potential impact on the natural heritage features onthe property.
A second Consent application involving the existing dwelling was considered atthe March meeting and was approved at that time.
Update:
An addendum to the Environmental lmpact Study has since been completed tothe satisfaction of the Saugeen Valley Conservation Authority (SVCA). ln aletter dated December 20,2017, the SVCA advised that the intended lot creationis acceptable provided the recommendations of the EIS are adhered to and tree

clearing is limited to 0.4 hectares and such clearing occurs only between April 1
and August 15.
Conclusion and mendation:
This severance proposal now conforms to all relevant policies of the CountyOfficial Plan and the Provincial Policy Statement, and therefore can be given
favourable consideration.
The recommendations of the Environmental lmpact Study and SVCA must be
implemented through a site-specific Zoning By-law Amendment.

Saugeen Valley Conservation Authority (SVCA) staff has reviewed Natural Heritage Environmental lmpactStatement (ElS), prepared by LRG Environmental, Revised May,2OI7, as well as the supplementaryinformation submitted to the SVCA on November 28,2017, which included field inventories conducted by John
Morton of AWS Environmental Consulting.
Please be advised that the EIS and supplementary information is acceptable to SVCA staff. Provided the LRG
Environmental recommendations are adhered to, Application for Consent B0t/2017 is now acceptable to SVCA
staff.
ln addition, provided tree clearing for development does not exceed L acre (0.4 ha), and no tree cutting andvegetation removal occurs between April L to August 15, it is acceptable to SVCA staff that the Holding Symbol(-h) be removed by the Council of the Corporation of the Municipality of West Grey from the "A2-370-h" forthe lands to be severed as part of Application B0t/20I7.

Hello Mark,Please find attached a copy of the data and information collected during spring and summer of 2017 year to supplementthe EIS submitted in May, 2017,lo support the Severance application for Mr. Ron Torry for a second lot severance. The
inventories were carried out by Mr. John Morton, of Shallow Lake. John is a very experienced field biologist and his
qualifications are provided in his report.
The extensive inventories did not reveal any significant natural heritage features that would prevent the severance orresidential development on the second lot, as per report and email below.

For Site 1: No other significant features other than Significant Woodland, with no identifiable significant ecological
functions identified. So development could go ahead in compliance with the PPS and Official Plan policies, but you must
constrain the development to limit tree canopy covering loss. MNRF forestry standards, which I routinely use and
County/CA accept, is to constrain the clearing area (Building Envelope) not to exceed 0.4ha or Lac for tree loss. A
clearing at or below this size will not cause wind throw to surrounding woodland and does not impact breeding birds
etc. Also Note, that under the Federal Migratory Birds Act, no tree cutting or vegetation removal should occur betweenApril 1 to August LSth otherwise applicant/developer would be in violation of this act, as its documented Woodland
Breeding Bird Habitat, another mitigative condition you should add in.
