Text of Motions:

2nd/Hope Street Motion: The community has safety and accessibility concerns and finds the current station configuration and pedestrian access to the station to be unacceptable. The RCCLC recommends that Metro seek to address and resolve the community concerns regarding the 2nd Place at Hope Street station configuration/pedestrian access by giving bidders an opportunity to provide solutions via options to the base bid and include this information in an addendum to the current Invitation for Bid (IFB).

Financial District/Flower Street Motion 1: The RCCLC recommends that Metro inform and communicate to prospective bidders that Metro will consider proposals that would utilize open face tunnel boring machines, and that proposals utilizing an open face TBM will be seriously considered by Metro.

Financial District/Flower Street Motion 2: The RCCLC recommends that Metro and the Leadership Council host a town hall or community forum with prospective bidders to explore options to further minimize impacts on Flower Street.

Dan&proceeded&to&give&the&construc9on&overview&presenta9on&to&the&group,&which&consisted&of&an&ini9al&3e4&minute&construc9on&video&describing&ac9vity&on&Flower&Street,&and&updates&on&3rd&party&u9lity&work,&advanced&u9lity&reloca9on,&variances,&construc9on&sequencing,&and&procurements.&The&PowerPoint&presenta9on&and&construc9on&video&are&available&for&download&on&the&RCCLC&Dropbox.&

Throughout&the&presenta9on,&several&ques9ons&were&asked&by&the&community&about&the&variances,&exemp9ons,&and&holiday&moratorium.&All&ques9ons&and&answers&discussed&during&the&mee9ng&are&available&at&the&end&of&this&summary&in&the&ques9on&and&response&matrix.&

At&the&conclusion&of&the&presenta9on,&Dan&confirmed&that&he&would&like&to&have&the&opportunity&to&sit&down&individually&with&each&sta9on&area&commiPee&to&discuss&their&schedules&and&needs.&In&response&to&several&ques9ons&about&the&9meline&and&process&for&gran9ng&variances&and&exemp9ons,&the&representa9ve&from&Councilman&Huizar’s&office&announced&that&their&office&would&not&recommend&gran9ng&any&variances&or&exemp9ons&un9l&they&had&heard&from&the&community.&

Russ&stated&that&it&would&be&a&good&idea&to&get&a&general&sense&from&the&group&about&how&they&felt&in&terms&of&construc9on&9meline&vs.&variances,&exemp9ons,&and&the&holiday&moratorium.&He&stated&that&the&inten9on&in&gelng&this&feedback&from&the&group&would&be&to&give&Metro&a&general&sense&of&whether&the&community&preferred&minimal&disrup9on&and&a&longer&construc9on&9meline,&or&a&shorter&construc9on&9meline&made&possible&by&gran9ng&variances,&exemp9ons,&and&the&holiday&moratorium.&The&group&responded&that&they&did&not&feel&they&had&sufficient&informa9on&to&make&an&informed&decision&at&this&9me.&

Members&of&the&council&reiterated&that&they&would&like&to&see&realelife&comparisons&for&the&type&of&decibel&noise&levels&they&would&be&hearing&during&construc9on.&Ann&suggested&that&the&group&could&individually&discuss&the&variances,&rather&than&give&a&blanket&blessing&to&all&of&them,&and&that&it&would&be&easier&to&deal&with&them&one&at&a&9me.&Members&of&the&council&reiterated&that&the&sooner&Metro&provided&them&with&the&informa9on&requested,&namely&in&terms&of&noise&levels,&the&sooner&they&would&be&able&to&make&an&informed&decision&and&fulfill&their&advisory&role&to&Metro.&Throughout&the&discussion,&the&group&felt&that&they&did&not&have&enough&informa9on&on&what&the&specific&impacts&of&the&u9lity&reloca9on&and&construc9on&work&would&be&to&make&even&general&recommenda9ons&to&Metro.&

Bryan&Pennington,&Execu9ve&Officer&of&Project&Management&at&Metro,&stated&that&Metro&will&be&working&individually&with&each&sta9on&area&commiPee&to&learn&about&their&individual&preferences&and&requirements.&

Summary Ann Kerman, Interim Director of Communications at Metro, initiated the meeting by asking the RCCLC members and Metro staff in attendance to introduce themselves. Next, additional meetings attendees that were not members of the RCCLC or Metro staff introduced themselves to the room. Roger Rudick, Executive Co-Chair, indicated that the Executive Committee passed 3 motions that had originated in the station area committees. First, Suzanne Holly explained the motion that arose in the 2nd/Hope committee, which arose due to concerns over pedestrian connections between the planned station and Upper Grand. Suzanne Holly referenced a photo of elevation difference between the planned station area and upper grand, which showed that

pedestrian access would be limited to a wide street crossing, and a single elevator and set of stairs. Members of the council expressed concern that cars traveling around the “island” station area would be hazardous to pedestrians, as traffic in the area would consistently be heavy due to the surrounding venues (specifically the Walt Disney Concert Hall and under-construction Broad Art Museum). Russ Brown, Executive Co-Chair, took a vote on the 2nd/Hope motion to the full council, and the measure passed. Next, Roger Rudick brought up the Financial/Flower committee motion. He explained the motion arose due to the fact that stakeholders in this area wanted to allow contractors to submit bids to Metro to use open-face tunnel boring machines along Flower Street. Russ Brown gave an overview of the path of the TBM to the group, and explained some of the technical constraints that require cut and cover construction along Flower Street. Glen Berryhill then stated that the current Metro Design/Build RFP states that a closed-face TBM is mandatory, and that he believes contractors should be given the option to explore using an open-faced TBM. Roger Rudick asked if Glen would like to explain why there might be opposition to using open-faced TBMs, and Glen Berryhill responded by stating that he is aware that Metro is generally opposed to open-faced TBMs and that tie-backs in the street would preclude the use of and open-faced TBM on the project. Next, Michael Czarcinski expressed that the noise level in the street near the Westin Bonaventure hotel had exceeded 80 decibels, which exceeds the limits stated in the MMRP. He stated that there is no opposition from stakeholders to use a TBM down Flower Street, rather than cut and cover. Roger Rudick expressed to Michael Czarcinski that using an open-faced TBM may be more dangerous than a close-faced TBM. Glen Berryhill argued that the technique had been used in other cities with success, that he had seen Metro drawings that show tunneling underneath Flower Street, and that Metro has adopted a policy against open-faced TBMs, which is behind current technology. Disagreement arose between Roger Rudick and the Westin Bonaventure representatives as to the added cost of using an open-face TBM on the project. Russ Brown interjected to state that the Financial/Flower committee motion requests for language to be added to the RFP, via an addendum, that states that Metro will accept bids from Design/Build contractors using an open-faced TBM option. A question arose from a guest, asking if the City of Los Angles has looked at what the construction would cost the business in terms of lost revenue. He suggested that a holistic view of the health of Los Angeles as a City should be taken, and that loss of revenue to businesses should be balanced against the cost of using alternative construction techniques. At this point, many members in attendance expressed that they felt they did not have enough information to vote on the measure. Russ Brown stated that the technical information regarding using closed or open-faced TBMs was not necessary knowledge for the members, but rather that it was to advise Metro to give the Design/Build contractors options in their bid submittal. Ann Kerman also stated that the role of the RCCLC is as an advisory body to Metro, so that it is an appropriate topic and issue for the council to vote on. Russ Brown took the motion to vote – the motion passed the full committee, with 12 councilmembers voting “yes”, 1 opposition, and 1 abstention. Next, Russ Brown brought up the third motion, arising from the Flower/Financial committee, which contained a request to have town hall meetings with the prospective bidders on the Design/Build contract. Ann Kerman asked Yvette Rapose, Director of Construction Relations, if there was precedence for this within Metro. Yvette Rapose answered that there was some precedence, but that it typically had happened when a design/build contractor had been selected by Metro, and not before. The Westin Bonaventure representatives expressed that it would be important for the community to meet with the Design/Build contractors, because at the time the contractor is chosen many design decisions have already been

made. He urged the RCCLC and community members in attendance that it was important for the community to meet with the prospective bidders in advance of a contractor being selected. A guest in attendance brought up the fact that some of the Design/Build contractors were already taking their own initiative to hold town-hall type meetings with the community. Russ Brown explained that the Financial/Flower committee motion was different in the sense that it asked Metro to coordinate the meeting, not the private consultants themselves. Russ Brown took the motion to vote – the motion passed the full committee, with 11 councilmembers voting “yes”, no opposition, and 2 abstentions. Russ Brown then explained that the station/area committees meet once a month, and issues/motions arising in those committees are then brought to the Executive Committee. Once approved by the Executive Committee, they are brought to the full council. Olga Arroyo, Construction Relations Manager at Metro, then introduced herself to the group. She explained her role on the project and her recent activity of taking business profiles from businesses and buildings along the project alignment. Olga Arroyo then re-introduced Yvette Rapose, Director of Construction Relations, and Dan Comorre, Director of Construction Management, as fellow Metro staff that would be overseeing construction of the project. Russ Brown then checked with the group to ensure that everyone has been receiving electronic construction updates from Olga Arroyo. Next, an issue was brought up by the Westin Bonaventure representatives, addressing Olga Arroyo, that construction noise outside of their building had exceeded the MMRP limits. The Westin Bonaventure representatives stated that they had complained to Metro, and finally felt they had to take their complaints to the LAPD, as Metro had been nonresponsive. Dan Comorre ensured the representatives that Metro had an inspector on-site during construction to check the noise levels. A member of the public in attendance then questioned if there was a conflict of interest in having a Metro inspector on site to monitor Metro’s own activities. Dan Comorre responded that he disagrees with the illusion that Metro’s employees would act in a disingenuous fashion. Russ Brown then clarified to the group that all community queries or complaints would need to go through Olga Arroyo. Next, two noise complaints were brought up by committee members – one regarding the Mangrove site and another by the Westin Bonaventure representatives. Olga Arroyo noted both. In response to extended discussions about specific area topics, Russ Brown reminded the group that there are station/area committees that meet monthly to discuss these geographically specific issues. Next, Ann Kerman brought Yvette Rapose up to speak. Yvette stated that she is working on the Regional Connector, Westside Subway Extension, and Crenshaw Corridor projects for Metro. She gave an overview of a new educational program she is forming for the community groups for each of these projects, with the working title of “Living with Construction”. She shared her initial thoughts on the series, and stated that she is currently looking at a 4-part series to prepare communities for construction. The program would include information about the process of taking a project through the environmental phase into construction, the different Metro staff that works on the project during construction, and what the roles and expectations are during construction. She stated that her program would have the purpose of helping the community understand Metro’s internal process and departments that will be working on the large upcoming construction projects. When she finished her brief presentation, she asked for feedback from the community. After the presentation, one member of the community in attendance at the meeting stated that he thought it would be helpful to remind everyone that we are paying for Metro’s activities as taxpayers, and that the community should optimize the value of the project to see where it can benefit the community.

Glen Beryhill then expressed that he believed that the agenda for the RCCLC full council and committee meetings were governed by the Brown Act, and therefore required a public comment period. Shiraz Tangri expressed that they were not governed by the Brown Act, but that he believed the members would be supportive of adding a public comment section to the agendas. In response to Yvette Rapose’s presentation, Russ Brown stated that the council’s biggest concern was noise, and that they would like to see a presentation about noise specifically. Another member of the public asked when Olga Arroyo would come to his business and take a business profile – Olga said that she would speak to him after the meeting. Russ Brown then asked Yvette if she anticipated the modules would be once a month as part of the full council meeting. Yvette responded that her recommendation is to complete the modules before the contractor comes on board. Suzanne Holly said that more targeted topics would be more well-attended for the construction series, and recommended making the presentations shorter rather than longer. Yvette Rapose responded by stating that although desirable, that details of the construction plan would not be available until a design/contractor was chosen by Metro and approved by the Board of Directors. Ann Kerman then stated that the next meeting of the RCCLC would be on May 7th, 2013. Following this, a member of the public asked about access to RCCLC files through Dropbox. Ann Kerman explained that ultimately, the RCCLC files would be available for Metro’s website and that Dropbox had been being used as a temporary solution so that members would have access to important files. Ann reminded the group to contact Olga Arroyo with construction questions, and Olga gave her contact information (email address and phone number) to the group. Glen Berryhill then asked the Co-Chairs if they wished to discuss the advertisement that came out in the Downtown News about a “meet the contractor event” – Roger Rudick explained that the event was not sponsored by Metro and that the Design/Build contractor had organized the event on their own, without Metro’s assistance, input, or knowledge. Joe Hernandez from Lee Andrews Group then introduced himself to the room, and explained that his group was responsible for placing the ad, and that he was working with one of the Design/Build contractors. Russ Brown stated that the meeting hadn’t been communicated to the group, and in the future it should be. Yvette Rapose reminded the group that the advertisement did not go through Metro, so that the RCCLC would not have received notice from Metro about the event. Glen Berryhil then stated that contractors performed similar outreach during the procurement phase for the design of the 6th Street bridge downtown, and that such outreach was not without precedent. Ann Kerman concluded the meeting by thanking everyone in attendance. RCCLC Overview This was the sixth meeting of the Regional Connector Community Leadership Council (RCCLC). Ahead of the meeting, invitations were extended to over 2,300 individuals, representing organizations and stakeholder groups identified along the alignment and adjacent to station areas.
