Letter to the Editor: I agree with Jonathan Shapiro’s letter oflast week. I’ve seen nothing from either the Republicans orthe Democrats in this town that would make me want to votefor them.I’m tired of insider deals for the same few names of engineersand developers who get variances for eyesore developmentsthat don’t bring good jobs to to the area (I’ve seen them atPlanning Board and Zoning meetings over and over again). I’mangry that our sewer plant has been so poorly handled thatyou can literally smell the waste all over town. I want to knowwhat can be done to stop the blight or worse (remember theHoney Bee “salon”?) on Columbia Turnpike. And what aboutour Master Plan? Who’s going to adhere to that? None of themseem to be doing that so far.I heard about a third party that’s putting East Greenbushresidents first. TOWN/UNION SETTLEMENT AGREEMENTS

MOST UNSETTLING

It has come to our attention that on May 11, 2015, SupervisorKeith Langley signed four proposed settlement agreementsbetween the Town of East Greenbush and the Civil ServiceEmployees Association (CSEA), the union that represents thetown’s public-works employees, without being duly authorizedby the town board to sign the agreements on behalf of thetown. Although three of the agreements clearly stated thatthey are “subject to approval by the Town Board,” the termsof the agreements were carried out by Supervisor Langley inthe absence of adopted town-board resolutions authorizinghim to do so. Not only were the required resolutions neveradopted by the town board, we were never made aware ofthe agreements until we stumbled upon them more than twomonths after the supervisor signed them. Since we took officein January 2014, Supervisor Langley has refused toacknowledge us as elected officials. Although his willfuldisregard for us has been persistent, he has now escalatedthis behavior by attempting to bypass the entire town board inthe approval of town business. When we questioned him aboutthis matter at the July town board meeting, he denied anyknowledge of it and then said he wasn’t prepared at that timeto discuss it. We are now investigating the likelihood of otherinstances in which he has acted alone without proper town-board authorization. As elected officials, members of the townboard, including the supervisor, are responsible for, amongmany other things, the approval of agreements. While thesupervisor is a voting member of the town board who presidesover its meetings, he is still only a single board member andcannot act alone on behalf of the entire town board. Oncedecisions have been made by the town board via its adoptedresolutions, it is the supervisor’s duty to carry out thosedecisions. A town supervisor who ignores, and actsindependently of, the town board is in violation of the law.More importantly, a town supervisor who refuses to recognizethe members of the town board is in violation of his oath ofoffice to faithfully and impartially discharge the duties of theoffice to the best of his ability. YOUTH & RECREATIONThe North Greenbush Youth and recreation programs continueto provide quality youth activities for the children of the townof North Greenbush. Over the past five years attendance atour town summer camp has increased by 70% with over 200children attending daily. We are very excited about thecontinued improvements and enhancements to our program.Our children’s days are filled with fun and games, swimmingand swim lessons, kayaking, arts and crafts, sporting activitiesas well as several area field trips.The increase in attendance reflects the youngster’s and theirfamily’s satisfaction with the program. In addition, our annualrevenue for the program has increased from $20,000 to over$90,000. This year the summer camp program is nearly selfsupporting and is saving our taxpayers approximately $80,000/year.The North Greenbush Youth and Recreation committee alsoworks closely with the North Greenbush Youth Make A DifferenceInc. organization in bringing you our North Greenbush Summerconcert series, annual 5K road race, town fair, and other specialevents for our children. The 5k race that includes a free milerun for our youth will be held this year on Sept. 11, as part ofour town fair which will run from September 11th through the13th.You may also have noticed the ongoing park improvements atthe Williams Road Little League complex. We have relocatedthe playground and plan on expanding it this year. We havealso, with the help of the The North Greenbush Highwaydepartment, added parking areas and allowed for additional T-ball, softball, and baseball fields. Completion is expected thisfall.I would also like to ask that if anyone is interested in gettinginvolved with any of the Youth and Recreation activities andimprovements in our town that they please contact our buildingdepartment at town hall.

Furthermore, we will suggest changes in the wordingto clarify ambiguous sections and to make the sections more“Resident Friendly”. THE PROPOSED NEW ZONING LAW for

TOWN of SAND LAKEOn the 22nd of July, a significant number ofresidents attended a Public Hearing at TownHall to register their concerns about the proposednew Zoning Law. Many more residents watchedthe proceedings on closed circuit television.Only one person spoke in favor of adoptingthe new law unchanged.It was obvious to those in attendance and thoseat home that this new law is very unpopular for

many reasons. In the opinion of virtually all of the attendees, manyof the intrusive sections of this proposal must be either changed oreliminated. However, it appears that some members of the Board areundeterred in their effort to adopt this law without any significantmodifications.The overwhelming consensus of the spectators was that they feltthis grand revision of the old zoning code was written in secret andthat there appears to be a rush to enact it into law without dueconsideration of the valid concerns of the Town residents.Furthermore, they felt that the new law was overly intrusive in itsscope and arbitrary in its method of enforcement and that the oldlaw was working just fine. It should amend from time to time toupdate it to represent the changing needs of the Town. Why throwthe baby out with the bathwater? In short, “If it ain’t broke, don’tfix it!”Moreover, the audience had little faith that those members of theBoard who are most favorably inclined to adopt this new proposal,would actually take the time and effort to assess the publicly statedobjections and would only pay lip service to the logical and well-grounded criticisms of the Public by making only one or twomeaningless revisions while keeping in place the most unacceptableand unsatisfactory provisions. Many speakers took the time toresearch their specific complaint so that they offer substituteprovisions backed by statistics and not rhetoric.In addition, there was widespread concern that if the Board tasksthemselves with the sole responsibility of revising the new proposedzoning law, then how receptive would they be to additional re-writes of their changes at the next Public hearing? By the sametoken, how objective can they be if they now had the soleresponsibility of evaluating and then voting on their own changes?It is a conflict of interest at best and hubristic at worst.One popular idea was that the Board appoints a Blue RibbonAdvisory Panel of distinguished Town residents. This Panel must bedevoid of political affiliations and should be composed of Townresidents, not consultants from Saratoga who are experts in a differinglifestyle. The Panel should also be representative of the variouszoning constituencies such as Residential, Agricultural, Commercial(Business) and Natural Resources (Mining) so it can strike a balanceof interests that compose our Town.The Panel would seek oral and written proposed changes,modifications, additions and/or deletions by a series of PublicHearings accompanied by a time frame for which written proposalsmust be submitted. The notifications of the hearing dates and thecutoff date for the submission of written proposals would be publishedin the Advertiser and displayed on the Town web-site. The proposalswould be referred to the constituency experts for their reviewbefore coming to the whole Panel for a vote on whether the proposalshould be recommended for adoption by the Board.The Panel would submit all proposed amendments to the Boardwith a positive or negative recommendation. The Board wouldnow be of possession of all the suggested revisions from the Panel.The Board would then vote all the amendments up or down. I fullyrealize this will take a toll on the Board members time, but, isn’t thatwhat they signed up for when they chose to run for office? Sincewhen is representing our interests measured by the clock?There is no urgency in adopting this new zoning law, what matterthat it takes a few weeks or a month longer. The object of theexercise is to get it right! Since all residents will have to liveunder this new law for as long as they abide in the Town, why

PART TWOLetter to the Editor: You might think, as I did, that if youregistered as an independent you were, well, independent ofany political party, and could vote in any primary. Most likelyhowever, you are actually a member of the IndependenceParty (Daily News, 12/9/13). This party, like most, frequentlyendorses Republican or Democratic candidates. Our EastGreenbush Supervisor, registered in the Independence Party,ran on the Republican and Conservative lines. Two currenttown board members ran on the Republican, Conservative,and Independence Party lines. There is nothing illegal aboutthis, and the traditional wisdom in town is that the sure way towin is get on three party lines. The logic is simple. The moreyour name appears on the ballot, the more people are likely tovote for you.Political parties get on the ballot by securing 50,000 votes in agubernatorial election. Folks might assume that each of theparties stands for different things, but at the local level this israrely the case. It is well known in East Greenbush that politicaloperatives in the Democratic and Republican parties register inthe Independence Party, or Working Families Party, forexample. This gives them a chance to sign petitions for theircandidate, who is trying to run in two or more parties. Forthese minor parties, it only takes a few signatures to get onthe ballot. Because of this, some people vote in the primary ofa different party.I had no idea that this is how things work here.There are really only two political factions in this town,Democrats and Republicans, and they don’t represent anybodybut themselves. As most people who have lived here know, nomatter who is in office, it is business as usual for the benefit ofa few well connected people.Unti l now that is. Finally, THERE ACTUALLY IS ANINDEPENDENT PARTY. GoToGuide Events will be conducting our 3rdAnnual Firefly5 Festival and Twilight Run on August1, 2015. This event will raise money for the Food

Pantries for the Capital District. The Food Pantries for theCapital District is a coalition of 52 food pantries in Albany,Rensselaer, and Saratoga Counties. They provide funding,delivery, coordination of services and food drives, andeducation and training to their member food pantries.Membership and all services are free to member food pantries.The event is taking place at Westfall Village in Averill Park. Therace starts at 7:00 pm for walkers and 7:30 pm for runnersand is being timed by Finish Right Timing. Westfall Village islocated approximately 1 mile east of the 43/150 intersection inWest Sand Lake. Registrations are now being accepted andwill be accepted until 7:00 pm. Pre day of race participants willreceive neon commemorative t-shirts.The festival starts at 4pm with bounce houses, face painting,dancers, and multiple food and drink vendors. Two local bandsare scheduled to perform – up and coming Rearview at 4:30pm and local favorite Schmooze at 7:00 pm. A zumba run warmup will begin at 6:30pm.Many runners create teams and try to out do each other withcostumes. Runners generally cover themselves in neon clothing,LED lights, crazy costumes, glow paint and glow sticks. Aftereach participant crosses the finish line, awards are given tothe top 3 finishers (male and female) and a costume contest isheld. YOUTH MAKE A DIFFERENCE 5K RUN

North Greenbush Youth Make aDifference, Inc. (“NGYMAD”), a localnot-for-profit corporation, will behosting its third annual 5k race onSaturday, September 12th. The racekicks off at 10am in front of the North

Greenbush Town Hall. The entry fee is $25 per person ifregistered in advance or $30 on the day of. The 5k is one of thelargest fundraisers for NGYMAD. In addition to the 5k race,NGYMAD also offers a 1 mile kids race for all kids 10 and underbeginning at 9:30am. The kid’s race is sponsored by NGYMADand is free to all entrants. Each child will receive a shirt andmedal. St. Mary’s Church once again graciouslypermitted use of their parking lot for the children’s activitieswhich were supervised by members of the Village of Nassaupolice department, officers Dan Colonno, Al Restifo, NickMonuteaux, Ken Fuchs, and Officer in Charge Tom Jones.Thanks to officer Mike Miller from the Schodack policedepartment for setting up the course. Ross and Kelly Phoenix,members of the Nassau Ambulance Company, gave children achance to explore the inside of the ambulance. Fred McCaggfrom the Town of Nassau Youth Committee assisted withpublicity and the town also loaned traffic cones for the event.Donations from the Albany Traumatic Brain Injury Instituteallowed several participants to ride their bicycles home wearingnew, safe helmets; and Stewart’s Shop’s donated certificatesfor free ice cream cones. A huge thank-you to members andfriends of the Village Youth Committee, Lori Clark, Susan Forte,Judy Ziller, and Guy Forte (Village Trustee and Public SafetyCommissioner) for all their dedicated work. New York State requires political candidates to make required

disclosure of contributions and expenses. It’s the law.

In recent years, state lawmakers and other elected officials

have run afoul of campaign finance law and paid a penalty.

Again, it’s the law.

So why is East Greenbush Supervisor candidate Mike

Poorman apparently violating state law by failing to make a

required campaign finance filing due to the New York State

Board of Elections on July 15?

Campaign finance filings are required when funds are raised

or spent on a campaign. In recent weeks, there have been

several advertisements placed by Mr. Poorman in local

publications at what can be assumed a considerable expense.

Yet he failed to make the required filing and disclosure on

July 15 to the New York State Board of Elections as required.

Again, it’s the law.

By comparison, Supervisor Keith Langley’s campaign

committee made the July 15 filing and disclosure as required

by law. It’s the law and Supervisor Langley’s campaign

followed the law.

An explanation is owed to the people of East Greenbush by

Mr. Poorman. Perhaps he can use one of his numerous

advertisements and paid columns to make an explanation.

A Town Supervisor is responsible for managing millions in

public money on behalf of the taxpayers and ensuring vital

services are provided. A failure to provide a campaign

disclosure report required by state law seems to undercut

any claim Mr. Poorman has to be able to do the job of

Supervisor and chief fiscal officer.

How can residents trust someone like Mr. Poorman to

manage East Greenbush when his campaign cannot follow

the basic requirements of state law? It’s a very important

question, because the law is the law.

IS IT WORTH DOING?Letter to the Editor: Lately there have been articles in TheAdvertiser regarding ambulance service in Poestenkill. This isvery concerning and is not a new problem. Over two yearsago, Town Leadership acknowledged this fact and directedRensselaer County to dual dispatch Mohawk Ambulance Service(MAS) on all EMS calls in Town. That helped but did not eliminatethe problem, which is getting rapid patient care and timelytransportation to the hospital. A year ago, the Fire CompanyAmbulance Service was stopped and MAS became the primaryAmbulance in town. The Fire Company began Basic Life SupportFirst Response (BLSFR). For the most part, this does get helpto the patient sooner but does not solve the problem of patienttransport. Since the request for dual dispatch was put in place,MAS has reduced the number of Ambulances based in thecounty. Couple that with the high level of calls handled by MASout of their Brunswick Station and you can predict delayedtransport, as was mentioned in previous articles in TheAdvertiser.The town leadership has gathered statistics regardingresponse times for calls in the town. But those numbers areonly a snapshot of the real situation. For example, the firstset of data showed that ten percent of the responses byMAS were excessive in response time. A business leader toldme that he is advising friends that if they have a medicalemergency, they should load them in a car and drive them toSand Lake. Town residents have driven to North Greenbush orSand Lake to get help. Is this the level of service that our townleaders think is adequate?Poestenkill is now the only town in this county that does nothave a locally based ambulance service. I know that electedofficials are concerned about rising taxes, but don’t theresidents and visitors to our town deserve adequateEmergency Services? Are you satisfied with things the waythey are? The Brunswick Children’s Academy is a unique play-basedpreschool that was founded in September 2014 by AmyKiley. Kugler’s Red Barn Furniture and Gift Store

is located in a historic barn in Albany

County. The barn originally housed dairy

cows and horses in the 1930’s when the

proprietor’s parents purchased the property

in the late 1930’s. Mr. Kugler (Al’s father)

operated a successful antiques business

in the barn for many years.

In 1977, Al and Karen Kugler opened Kugler’s Red Barn selling

unique country, traditional, Shaker and primitive furniture and gifts. It

has since continued to grow and change with the years. The annex

was added in 1988 that increased the store’s size. One thing that

hasn’t changed is the store’s policy to bring unique, quality furniture

and gifts to its customers.

To this day the store is family run. Scott Henderson, Karen’s son,

manages the business. Al and Karen stay actively involved in the

day to day business as well. The family and employees are committed

to a high level of customer service and personal attention.
