B E I T E N A C T E D by the H i g h C o m m i s s i o n e r for P a l e s t i n e , w i t h the advice of the A d v i s o r y C o u n c i l thereof : —

1. T h i s Ord inance m a y be c i ted as the M u n i c i p a l Cour t s S h o r t t i t l e • (Amendment ) O r d i n a n c e , 1939, and s h a l l be read as one w i t h the M u n i c i p a l Courts O r d i n a n c e , hereinafter referred to as the p r i n - Cap. 97. c i p a l O r d i n a n c e .

2. Sect ion 4 of the p r i n c i p a l Ord inance sha l l be amended by the delet ion of the expression " i n A r t i c l e s 254 to 265 inc lus ive of the O t t o m a n P e n a l Code , o r " appear ing i n subsection (1) thereof.

Amendment of section 4 of the principal Ordinance.

O B J E C T S A N D R E A S O N S .

Sect ion 4(1) of the M u n i c i p a l Courts O r d i n a n c e (Chapter 97) provides that the jur i sd i c t i on of m u n i c i p a l courts sha l l cover the offences specified i n A r t i c l e s 254 to 265 inc lus ive of the O t t o m a n P e n a l Code , or specified i n any of the Ord inances set out i n the schedule to the p r i n c i p a l O r d i n a n c e . T h e O t t o m a n P e n a l Code was re pealed b y the C r i m i n a l Code O r d i n a n c e , 1936. T h i s O r d i n a n c e accord ing ly deletes f r o m section 4(1) the above reference to i t . I t is in tended , s imul taneous ly w i t h the enactment of th i s O r d i n a n c e , to amend the schedule to the p r i n c i p a l O r d i n a n c e (by an order made under section 4(2) thereof) by the inser t i on of reference to those sections of the C r i m i n a l Code O r d i n a n c e w h i c h replace or most near ly correspond to the above A r t i c l e s of the O t t o m a n P e n a l Code.
