Kindly refer yours No. PNR-I1Policy-fixation/20 12-13/2335-39dated 17-1-2013 on the subject captioned above. In this connection, Iam directed to forward the requisite clarification to the doubts raisedseriatim as. under-

I. FD has not issued any notification regarding implementation ofSRO-222 dated 10-7-2012 to the college teachers who aregoverned by the J&K Degree College (Adoption ofUGC RevisedPay) Rules, 2009. It is an amendment to Rule 10 of the J&KCivil Services (Revised Pay) Rules, 2009 and as such the collegeteachers who are governed by UGC rules are not entitled to thebenefits of SRO-222 dated 10-7-2012.

2. The benefit of increment for purpose of fixation of pay on1-1-2006 in the revised pay band is not admissible to thoseemployees whose increment though was due betweenFebruary, 2006 to June, 2006 but were promoted to higherscale before such increment actually fell due SRO-222 dated10-7-2012 provides one increment in the pre-revised pay scaleon 1-1-2006 for those who were due to get their annual incrementbetween February, 2006 to June, 2006. In the instant case theofficial had to get his annual increment on June, 2006 but theofficial was promoted to higher grade before such incrementactually fell due, as such the official is not entitled to the benefitsof SRO-222 dated 10-7-2012.

3. The· benefit of increment for purpose of fixation of pay on1-1-2006 in the revised pay band is not admissible to thoseemployees whose increment fell between February, 2006 toJune, 2006 but retired before the date the increment fell due.In the instant case the official had to get his annual incrementon June, 2006 but superannuated from the active service priorto June; 2006, as such it is obvious that the retired official isnot entitled to the provisions of SRO-222 dated 10-7-2012.

Subject :-Rationalisation of pension of pre-O 1-0 1-2006 Pensionsersand Family Pensioneres.

Government Order No. 57-F of 2013

Dated 11-03-2013.

In partial modification of the Government Order No. 86-F of2009 dated 15-04-2009, the following shall be inserted as proviso IIIafter proviso (i) & (ii) below Para to clause 3 (iv) (as inserted videG. O. No. 216-F of 2009 dated 24-09-2009) :-

(iii) (a) Provided that ·v. e. f. 1-1-2006, the full pension ofpre-2006 pensioners shall be further stepped up to50% of the sum of minimum of pay in the pay bandand the grade pay corresponding to the pre-revised payscale last held by the pensioner, as arrived at withrespect to the fitment tables annexed to the SRO-93of 2009 dated 15-04-2009.

(b) Provided that w. e. f. 1-1-2'006, normal family pensionof all the pre-2006 family pensioners shall be furtherstepped up to 30% of the sum of minimum of payin the pay band and the grade pay corresponding tothe pre-revised pay scale last held by the pensioner,as arrived at with respect to the fitment tables annexedto the SRO-93 of 2009 dated 15-04-2009. "

(c) A revised concordance table (Annexure) of thepre-1996, pre-2006 and post 2006 pay scales/paybands indicating the pension/family pension (at ordinaryrates) payable under the above provisions is enclosedto facilitate payment of revised pension/family pension.

(d) In case of Government servants who died while inservice before 1-1-2006 and in respect of whomenhanced family pension is applicable from 1-1-2013,the enhanced family pension will be 'stepped up to

50% of the sum of minimum of pay in the pay bandand the grade pay corresponding to pre-revised payscale last held by the Government servant asarrived at with respect to the fitment tables annexedto SRO-93 of 2009 dated 15-04-2009.

(e) In the case of a pensioner who retired before I- I-2006and in respect of whom enhanced family pension isapplicable from 1-1-2013, the enhanced family pensionwill be stepped up to the amount of pension as revisedin terms of Para (a) above. In case the pensioner hasdied before 1-1-2013, the pension will be revisednotionally in terms of (a) above.

(f) The revised pension in all cases will be reducedprorata where the pensioner had less than the maximumrequired qualifying service for full pension. However,it cannot be less than ~ 3500/- p. m.

(g) These orders will take effect from I- I-20 I3. Therewill be no change in the amount of revised pension/family pension paid during the period 1-1-2006 and31-12-2012, and, therefore, no arrears wi II be payableon account of these orders for that period. .

The following amendments are hereby made in the Annexure '2'to VR/GHS Scheme implemented vide Government Order No. 218-Fof 2007 dated 16-07-2007.

(0 I) Para 2, under the caption, 'Defin ition', shall be recast asunder->-

(I) The Golden Handshake Scheme (GHS) is to be givento employees of closed units, totally unviable, and alsoto the employees of units, having the prospect ofbecoming viable with some flab-shedding.

(II) The Voluntary Retirement Scheme (VRS) is open to allthe employees of the PSUs, subject to the approval ofthe Competent Authority.

(02) Sub-Para I, of Para 3 under the caption 'Eligibility', shallbe recast as under-

The employees must have been in regular service of thePSU continuously for not less than 10 years. 50% periodof service, rendered as work charged/DRW prior toregularization, will be reckoned only for determining theeligibility and not towards calculation of the VR/GHS

benefits, provided that the nature of engagement wasfultirne, continuous and uninterrupted.

(03) Clause I and clause '" of Para 5, under the caption,'procedure' shall be recast as under :-

(i) Each PSU shall identify surplus personnel, having notless than 3 years left-over service before the normal dateof superannuation in the case of units having the prospect"of becoming viable, and less than one year left overservice in the case of closed units, totally unviableincluding those identified by Kundal Committee with apredetermined time-frame and offer them GoldenHandshake indicating' the target date for availing thesame, failing which they would be liable to be disengaged,following the procedure prescribed under law. Suchexercise shall be completed in all respects, latest by30-06-2013, beyond which Golden Handshake Schemeshall cease to exist.

(iii) The' decision of the Competent Authority in theacceptance/rejection of the Voluntary Retirementapplication shall be communicated. to the employeewithin 90 (ninety) days of the submission of theapplication.

(04) Para 6, under the caption, 'Voluntary Retirement/Goldenl lnndshake Benefits', shall be recast as under-

A regular employee, who is allowed to retire voluntarilyby the Competent Authority or is given a GoldenHandshake, shall be entitled to the following benefits :~

(i) Ex gratia shall consist of 35 days' salary (Basic Pay+COLA/DA, if any, last drawn) for every completedyear of service rendered and 25 days' salary for thebalance period of service left till superannuation underthe PSU Rules, subject to the condition that it shallnot exceed, in any case, salary defined in 'the table

(05) Para 7, under the caption, 'Treatment of COLA', shall berecast as under-

The unreleased .instalments of COLA by corporations shallalso be deemed to have been released in respect of

. employees opting for VRS/GHS and defrayment of thesame will form part of VRS/GHS package. This would notentail any 'claim in respect of in-service employees. Inrespect of in-service employees, payment of COLA/DAshall be entirely dependent on the resource position of thecorporation whereas in respect of those opting for V RS/GHS and who havd already been brought under VRS/GHS,the financial support will flow from the Government inorder to make corporation viable and sustainable.

(06) Para 3 to 5, succeeding Para 7, shall be numbered 8, 9,10 and renumbered Para 8 under the caption, "Funding ofexpenditure on VRlGHS", shall be recast as. unde-

Funding of expenditure on VRS/GHS :

The expenditure, incurred by the PSUs on GHSIVRS, shall.be met from the subvention made by the State Government,as well as from the sale proceeds of the assets of PSUsof which 40% shall be, specifically, earmarked for meetingthe cost of VR/GHS cases: Such proceeds shall be creditedto the designated account, authorized to be opened for thesettlement of VR/GH cases. Where sufficient funds are notavailable with the corporations for meeting the cost of VR/GHS from. out of their own resources/40% of the saleproceeds of assets, budgetary subvention, only up to a

. maximum of~15 lakh in each case will be provided to meetthe differential requirement.

(07) Clause (i) of renumbered Para 9 under the caption,"competent authority" shall be recast as under-

The Competent Authority to sanction Voluntary Retirementis the Chairman-cum-Managing Director/Chairman, but.such a sanction may be issued only with the prior concurrenceof the Finance Department in each case.

(08) Clauses II, IV, VI and IX of renumbered Para 10 under'caption, "M iscellaneous" . shall be recast as under-

unviable, and the posts in the units having prospects ofbecoming viable, the incumbents of which have beengiven a Golden Handshake, shall also stand abolished.

(iv) Subject to prior clearance of all dues payable to thecorporation by the concerned.

(vi) Notwithstanding any of the aforesaid provisions, thescheme does not confer-any right on any employee to havehis/her request for Voluntary Retirement accepted by theManagement. The Competent Authority has the right/discretion either to accept or reject the request of anyemployee for Voluntary Retirement, keeping in view theservice record of the employee, the organizationalrequirement and any other relevant factors in this regard.Similarly, employees with -leftover service of less than oneyear in respect of closed units totally unviable, and lessthan 3 years in respect of units that have the prospectof becoming viable with some flab shedding, shall not bebrought under GHS, but shall continue to retire on their

~ normal dates of superannuation. The employees of closedunits in such cases shall be deployed to other functionalunits till such time they retire in the normal course.

(ix) Managements of the corporations shall be held accountablefor non-remittance ofCPF/CMPF amounts, both employees'and employers share, to the concerned Provident Fundauthorities on a regular basis. If need be, such requirementshould be the first charge on the Budgetary Support beingprovided by the Government.

(09) The following shall be inserted as Clause in Para' I0' underthe caption, 'Miscellaneous' and numbered as 'X'.

- (x) Cases settled in the .past will not be reopened.

SRO-226.-ln exercise of the powers conferred by proviso toction 124 of the Constitution of Jammu and Kashmir, the Governor

is pleased to direct that the following amendments be made in theJammu and Kashmir Civil Service Regulations, namely :-

Clause (w) of Rule 5 of the Jammu and Kashmir Civil Service(Defined Contributory Pension Scheme) Rules, 2('10, containedin Schedule XXIII of Annexure "A" appended to Article249-M(B), Chapter XIX-AA under the caption 'DefinedContributory Pension Scheme' shall be deleted and after clause(v) of the said rule the following shall be added as Rule 6 :-

"Rule 6. Withdrawal Guidelines-

i. In case of retirement (superannuation), if the subscriberwishes to nominate more than one person as his/her nominee,the subscriber shall fill up the additional nominee formi. e. Form 101-GS (and mention the details of the additionalnominees) with a remark in the nominee section of the mainform (Annexure: Form JOJ-GS).

ii. In case of death, if more than one nominee is present, allthe nominees shall fill up separate forms i. e. Form103-GD and submit the same through the associated DTOto CRA. In case the number of nominees present in the CRASystem, is different from the number of nominees fromwhom the forms are received, the nominees shall present alegal heir certificate for claiming the accumulated NPSproceeds (Annexure: Form J03..-GD).

iii. In case of Premature Exit (resignation), if-the subscriberwishes to nominate more than one person as his/her nominee,the subscriber shall fill up the additional nominee formi. e. Form 102-GP (and mention the details of t~e additional

SRO-235.-ln exercise of the powers conferred under provisoto section 124 of the Constitution of Jammu and Kashmir, theGovernor is pleased to make the following rules :-

I. Short title and commencement.- These rules shall becalled the "Jammu College of Engineering and Technology (Adoptionof AICTE Revised Pay Scales) Rules, 2013".

II. These rules shall come into force on the first day ofJanuary, 2006, with the effective date of implementation being1st August, 2009.

The revised pay and revised rates of Dearness Allowance underthese rules shall come into force from 1-1-2006 with effective dateof implementation on 1-8-2009. The revised rates of aJl otherapplicable allowances such as HRA and the non-compounded advanceincrements shall take effect from 1-8-2009.

III. Application.-These rules shall apply to the employees ofthe Government Jammu College of Engineering and Technology,Jammu, who, on 1-1-2006, were holding the same posts in substantiveor officiating capacity, or, but for their deputation or posting outsidetheir parent cadre, would have held, in substantive or officiatingcapacity. the permanent or temporary posts of-

(i) Assistant Professor ;

(ii) Selection Grade Lecturers (for in-service as on 1-1.2Q6)6);

(iii) Associate Professor; and

(iv) Principal :

Provided that, with effect from the date of commencement of,I these rules, the revised hierarchical/organizational 'structure of the

IV. Definition.-In these rules, unless the context otherwiserequires,-

(a) "Basic Pay" means the pay, as defined in note belowArt. 27 (aa) of the J&K CSRs ;

(b) "College Teacher" means a Lecturer, Lecturer (Sen ior Scale),Lecturer (Senior Grade), Assistant Professor, AssociateProfessor and Professor and Principal of the College, on orafter 1-1-2006';

(c) "College" means the Jammu Government College ofEngineering and Technology, Jammu;

(d) "Existing Scale" means the pay scales, prescribed under the"Jammu College of Engineering and Technology Teachers'Revised (Pay) Rules, 2006" ;

(e) "AICTE Pay Scale" means the pay scales, prescribed by theAll India Council for Technical Education and adopted by theGovernment of India, w. e. f. 1-1-2006.

V. Structure of pay scales.-The following shall be the revisedpay structure for the employees of the Jammu College of Engineering andTechnology, w. e. f. 1st January, 2006, based on the pay scales,recommended by the AICTE and adopted by the Government of India :-

Provided that the revised hierarchy of the faculty, as per the foregoingprovisions, shall be adopted in the college first, subject to such recruitment,promotion and selection processes, as have been prescribed for the purposeby the AICTE/MHRD.

VI. Drawal of pay in revised scale.-A JCET CollegeTeacher shall draw pay in the Revised AICTE Pay Band, applicableto the post to which he is appointed or is deemed to have beenappointed, in the manner prescribed under these rules.

VII. College Teachers appointed from 1-1-2006 to the dateof issue of these rules.-JCET College Teachers, appointed as suchfrom 1-1-2006 up to the date of issuance of these rules, shall be,retrospectively, placed in the Revised AICTE Pay Scales (as perRule V, w. e. f. the date of their appointment as such) ..

VIII. Fixation of pay in the AICTE pay scales.- The payfixation formula, recommended by the 6th Central Pay Commission,as accepted by the Central Government, shall be adopted for TechnicalTeachers of the College.

The fixation of pay of the above existing incumbents, who werein position, as on 1-1-2006, in various categories of posts, shall becarried out in terms of the fitment tables annexed to SRO-284 dated3rd September, 2009.

IX: Increments.-

(i) Each annual increment shall be equivalent to 3% of thesum total of pay in the relevant pay band and AcademicGrade Pay (AGP), as applicable for the stage in the payband

(ii) Each advance increment shall also be @ 3% of theslim total of pay in the relevant pay band and AcademicGrade Pay (AGP), as applicable, and shall be non-compounded;

(iii) The number of additional increment(s), on placement atthe higher stage of AGP, shall be as per the existingscheme of increments on promotion from 'a lower pay bandto a, higher pay band. However, there shall be noadditional increment for movement from the pay band ofRs. 15,600-39,100 to the pay band of Rs. 37,400-67,000.

X. Determination of admissibility and payment of otherallowances, relatable to pay/pay revision arrears.-Payment ofother allowances/pay revision arrears shall continue to be regulatedon the same lines as admissible to the State Government Employees.

XI. Incentives for Ph.D.lM.Phii. and other higherqualifications.-

(i) Five non-compounded advance increments shall beadmissible at the entry level of recruitment to person,possessing the degree of Ph.D. awarded in the relevantdiscipline by a Statutory University, following the processof registration, course-work and external evaluation, asprescribed by the UGC ;

(ii) M. Phil. Degree holders, at the time of recruitment to theposts of Assistant Professor, shall be entitled to two non-compounded advance increments ;

(iii) Those possessing a Post-graduate Degree in a professionalcourse, such as M. Tech./M. E. in the relevant branch/discipline, recognized by a Statutory University, shall alsobe entitled to two non-compounded increments at the entrylevel;

(iv) Teachers who complete their Ph. D. Degree, while inservice, shall be entitled to three non-compoundedincrements, if such Ph. D. is in the relevant branch/discipline and has been awarded by a University, complyingwith the process, prescribed by the UGC for enrolment,course-work and evaluation etc. ;

(v) However, teachers in-service, who have been. awardedPh. D. at the time of the coming into force of this scheme,

or, having been enrolled for Ph. D. have alreadyundergone course-work, if any, as well as evaluation, andonly notification in regard to the award of Ph. D. isawaited, shall also be entitled to the award of three non-compounded increments ;

(vi) Teachers, who already have a Ph. D. Degree, shall availthe benefit of three non-compounded increments, only ifthe University, awarding the Ph. D. has been notified bythe AICTE to have complied with the process, prescribedby the Commission for the award of Ph. D. in respectof either course-work or evaluation, or both, as the casemay be ;

(vii) Teachers who have not yet been enrolled for Ph. D.shall, therefore, derive the benefit of three non-compoundedincrements on award of Ph. D., while in service, ifsuch enrolment is with a University, recognized by theU. G. C. ;

(viii) Teachers, who acquire an M. Phil. Degree or an M. Tech.!M. E. Degree in a relevant branch/discipline or in aprofessional course, recognized by a Statutory University,while in service, shall be entitled to one advance increment;

(ix) Notwithstanding anything in the foregoing clauses, thosewho have already availed of the benefit of advanceincrements for possessing Ph. D.!M. Phil.lM. Tech. at theentry level, under the earlier scheme, shall not be entitledto the benefit of advance increments under this scheme;

(x) For posts at the entry level, where no such advanceincrements were admissible for possessing Ph. D.!M. Phil.under the earlier scheme, the benefit of advance incrementsfor possessing Ph.D.!M. Phil. shall be available to onlythose appointments, which have been made on or afterthe corning into force of this scheme -;

(xi) Teachers, who have already availed of the benefit ofadvance increments, as per the existing policy for acquiringPh. D.!M. Phil. while in service, would not be entitledto the benefits under this scheme.

XII. Career Advancement Scheme.-

Assistant Professors, Associate Professor and Professors

(i) Persons. on their appointment in the college, shall bedesignated as Assistant Professors and placed in the payband of Rs. 15600-39100 with AGP of Rs. 60001-.Lecturers, already in-service in the pre-revised scale ofRs. 8000-13500, shall be re-designated as AssistantProfessors with the AGP of Rs. 60001- ;

(ii) An Assistant Professor with completed service of 4 years,possessing Ph. D. Degree in the relevant discipline, shallbe eligible for moving up to the AGP of Rs. 70001- :

(iii) An Assistant Professor, possessing an M. Phil. Degree ora Master's Degree in professional courses, shall beeligible for the AGP of Rs. 7000, after the completionof five years service as Assistant Professor ;

(iv) An Assistant Professor, who does not have a Ph. D. oran M. Phil. Degree or a Master's Degree in professionalcourses, shall be eligible for the AGP of Rs. 70001-, onlyafter the completion of six years' service as AssistantProfessor;

(v) The upward movement from the AGP of Rs. 60001- tothe AGP of Rs. 70001- for all Assistant Professors shallbe subject to their satisfying other conditions, as laiddown by the AICTE ;

(vi) The incumbents on the posts of Lecturers (Sr. Scale),i. e. the pre-revised scale of Rs. 10,000-15,200, shall bere-designated as Assistant Professors, and their pay shallbe fixed at the appropriate stage in the Pay Band ofRs. 15600-39100, based on their present pay, with AGPof Rs. 70001-

(vii) An Assistant Professor, with completed service of fiveyears at the AGP of Rs. 7000, shall he eligible, subjectto other requirements laid down by the AICTE. to moveup to the AGP of Rs. 8000/- ;

(viii) Posts of Associate Professors shall be in the Pay Bandof Rs. 37400-67000, with AGP of Rs. 9000/-. Directlyrecruited Associate Professors shall be placed in the PayBand .of Rs. 37400-67000, with an AGP of Rs. 9000/-,at the appropriate stage in the Pay Band in terms of theconditions of appointment;

(ix) Incumbent Lecturers (Selection Grade)/Assistant Professors,who have completed 3 years in the current pay scale ofRs. 12,000-18,300 on 1-1-2006, shall be placed in PayBand of Rs. 37,400-67,000, with AGP of Rs. 9000/-, andshall be re-designated as Associate Professors ;

(x) Incumbent Lecturers (Selection Grade)/ Assistant Professors,who had not completed three years in the pay scale ofRs. 12,000-18,300 on 1-1-2006, shall be placed at theappropriate stage in the Pay Band of Rs. 15,600-39, I00with AG,P of Rs. 8000/-, till they complete 3 years ofservice in the grade of Lecturer (SG)/ Assistant Professor,and, thereafter, shall be placed in the higher Pay Bandof Rs. 37,400-67,000, with AGP of Rs. 9000/-, and shallbe re-designated as Associate Professors ;

(x i) Lecturers (SG)/ Assistant Professors in-service at present,shall continue to be designated as Lecturers (SG)/ AssistantProfessors in the Pay Band of Rs. 15,600-39, I00, withAGP of Rs. 8000/-, until they are placed in the Pay Bandof Rs. 37,400-67,000, and re-designated as AssociateProfessor in the manner described at (x) ;

(xii) Assistant Professors, completing 3 years of teaching inthe AGP of Rs. 8000/-, shall be placed in the Pay Bandof Rs. 37,400-67,000, with AGP of Rs. 9000/-, and areto be designated as Associate Professors ;

(xiii) Associate Professors, completing 3 years of service inthe AGP of Rs. 9000/- and possessing a Ph. D. Degreein the relevant discipline, shall be eligible to be appointedand designated as Professors in the Pay Band ofRs. 37,400-67,000, with AGP of Rs. 10,000/-, subject tothe other cond itions of academ ic performance, as laiddown by the AICTE. No teachers, other than those witha Ph. D. shall be promoted/appointed or designated asProfessor;

(xiv) The pay of a directly recruited Professor shall be fixedat a stage not below Rs. 43,0001- in the Pay Bandof Rs. 37,400-67,000, with the applicable AGP ofRs. 10,0001- ;

(xv) For initial direct recruitment at the level of AssociateProfessors and Professors, the eligibility conditions inrespect of academic and research requirements shall besuch as may be or have been prescribed by the AICTEthrough Regulations and or laid down by the AICTE ;

(xvi) Appointments to the post of Principal shall be based onthe conditions of eligibility, laid down by the AICTE fromtime to time. The post of Principal shall be in the PayBand of Rs. 37,400-67,0001-, with AGP of Rs. 10,0001-,plus a Special Allowance of Rs. 30001-.

XIII. Promotion to the post of PrincipaI.-The post ofPrincipal, JCET, shall be filled in the Pay Band of Rs. 37,400-67,000,with AGP of Rs. 10,0001-, by selection from amongst the TechnicalProfessors, having at least five years' service as Professor.

XIV. Workload and teaching norms.-(1) The college shallstrive to arrange teaching work six days a week for thirty weeks inan academic session. This shall be achieved by constantly improvisingthe academic calendar in order to adjust the length of vacations,number of holidays and the examination schedule.

(2) It shall be mandatory for College Teachers to be availablein the college for at least five hours a day on each working day andthe workload of a college Teacher shall not be less than forty hoursin a week.

Delegation of Powers.-Delegation of powers in respect oftransfers, sanction of leave etc. shall be exercised in the correspondingrevised pay bands by the authorities to whom these p.owers standdelegated at present.

Xv. Overriding effect of the rules.-In all cases, where thepay of the College Teachers is regulated under these rules, theprovisions of the Jammu and Kashmir Civil Services Regulations,regulating pay and allowances, shall not apply to the extent they are

inconsistent with these rules. For leave, TA, pension and other servicerules, the College Teachers shall be governed by the JK CSRs.

XVI. Repeal and savings.-On the commencement of theserules, the relevant provisions of "The Jammu College of Engineeringand Technology Teachers' Revised (Pay) Rules, 2006" issued videNotification SRO-61 of 2007 dated 05-03-2007, as amended fromtime to time, and all other rules and notifications corresponding tothese rules, which were in force immediately before the issue of theserules, shall, in so far as they provide for any of the matters corvainedin these rules, cease to operate :

Provided that any order issued or action taken under the saidexisting rules and/or notifications, issued thereunder, shall be deemedto have been issued or taken under the corresponding provisionsconta ined in these rules.

In terms of proviso to Rule 7 of SRO-64 of 1994 dated24-03-1994 it is ordered that the Finance Department shall also beauthorised to engage Casual or Seasonal Labourers from time to timeon minimum need basis on muster rolls for payment of wages.

All such engagements shall further be subject to the followingconditions :-

(a) In case the need for engagement is felt, which is outsidethe purview of a scheme/project, the same should be carefullyassessed. The need based requirements shall be met out ofthe DRWs regularized as Helpers, if available in thedepartment, by way of internal adjustment only withoutbringing any additional burden on the scarce resources ofthe State.

(b) No l'll~agement or appointment order shall be issued III

respect of Casual/Seasonal Labourer.

(c) The Administrative Department shall have to determine ineach case as to what minimum number of Casual/SeasonalLabourer is required to be engaged, for what length of time,and against which project/scheme by debit to which thewages shall be paid.

(d) The Administrative Department will further determine thesource of payment of their wages, whether debitable tooriginal work or maintenance component and ensureavailability of Budgetary allocation.

(e) Skilled/trained labourers in identified trades shall be givenpreference in local areas for engagement of Casual/SeasonalLabourers. The wages of the labourers so engaged wou Idbe paid @ Rs. 150/- per day.

SRO-274.-ln exercise of the powers conferred by provisoto section 124 of the Constitution of Jammu and Kashmir, theGovernor directs that the Jammu and Kashmir Civil ServiceRegulations, 1956 and the Jammu and Kashmir Civil Service (Leave)Rules, 1979, shall be amended as under :-

(I) In the J&K Civil Service Regulations Volume-I.-"Theproviso to Article 44-A, shall be deleted."

(II) In the J&K Civil Service (Leave) Rules, 1979.-

1. Rule 67 shall be recast as under-

"Rule 67.-( I) During study leave availed outside India,a Government servant shall draw leave salary equal to thepay (without Allowances other than Dearness Allowance)that the Government servant drew while on duty with theGovernment immediately before proceeding on such leavein addition to the Study Allowance admissible under theprovisions of rules 68 to 73.

(2) (a) During study leave availed in India, a Governmentservant shall draw leave salary equal to the pay (withoutAllowances other than Dearness Allowance) that theGovernment servant drew while on duty with theGovernment immediately before proceeding on such leave.

(b) Payment of leave salary at full rate under clause (a)shall be subject to furnishing of a certificate by theGovernment servant to the effect that he/she is not inreceipt of any scholarship, stipend or remuneration inrespect of any part-time employment.

(c) The amount, if any, received by a Government servantduring the period of study leave as scholarship or stipend

or remuneration in respect of any part-time employmentas envisaged in sub-rule (2) of Rule 67 shall be adjustedagainst the leave salary payable under this sub-rule subjectto the condition that the leave salary shall not be reducedto an amount less than that payable as leave salary duringhalf pay leave.

(d) No Study Allowance shall be paid during study leavefor courses of study in India.

(e) All the departments shall ensure that only the genuineand deserving cases avail of the benefit under these rulesand shall accordingly lay down further guidelines specific,to their departments."

2. After rule 67, following shall be added as rule 68, 69,70, 71 and 72 :-

"Rule 68; (I) A Study Allowance shall be granted to It

Government servant who has been granted study leave forstudies outside India for the period spent in prosecutinga definite course of study at a rccognised institution orin any definite tour of inspection of any special class ofwork as well as for the period covered by any examinationat 'the end of the course of study ;

(2) Where a Government servant has been perm itted toreceive and retain, in addition to his leave salary anyscholarship or stipend that may be awarded to him/her froma Government or Non-Government source or any otherremuneration in respect of any part-time employment .

(a) No Study Allowance shall be admissible in casethe net amount of such scholarship or stipend orremuneration (arrived at by deducting the cost offees, if any, paid by the Government servant fromthe value of the scholarship or stipend orremuneration) exceeds the amount of StudyAllowances otherwise admissible.

(b) In case the net amount of scholarship or stipendor remuneration is less than the. Study Allowance

otherwise admissible, the difference between thevalue of the. net scholarship or stipend or any otherremuneration in respect of any part-timeemployment and the Study Allowance may begranted by the authority competent to grant leave.

(3) Study Allowance shall not be granted for any periodduring which a Government servant interrupts his/hercourse of study to suit his/her own convenience ;

Provided that the authority competent to grant leave or theHead of the Mission may authorise the grant of StudyAllowance for a period not exceeding 14 days at a timeduring such interruption if it was due to sickness.

(4) Study Allowance shall also be allowed for the entireperiod of vacation during the course of study subject tothe conditions that :-

(a) the Government servant attends during vacationany special course of study or practical trainingunder the direction of the Government or theauthority competent to grant leave, as the case maybe ; or

(b) in the absence of any such direction, he/sheproduces satisfactory evidence before the Head ofthe Mission or the authority competent to grantleave as the case may be, that he/she continuedhis/her studies during the vacation ;

Provided that in respect of vacation falling at theend of courses of study it shall be allowed for amaximum period of 14 days.

"

(5) The period for which Study Allowance may be grantedshall not exceed 36 months in all.

Rule 69 ; The rates of Study Allowance shall be the sameas are allowed by the Government of India to its employeesfrom time to time in the respective countries.

Rule 70 ; (I) Payment of Study Allowance shall besubject to the furnishing of a certificate by the Governmentservant to the effect that he/she is not in' receipt of anyscholarship, stipend or any other remuneration in respectof any part-time employment

(2) Study Allowance shall be paid at the end of everymonth provisionally subject to an undertaking in writingbeing obtained from the Government servant that he/shewould refund to the Government any over paymentconsequent on his failure to produce the required certificateof attendance or on his/her failure to satisfy the authoritycompetent to grant leave about the proper utilization ofthe time spent for which Study Allowance is claimed,

(3) (a) In the case of a definite course of study at arecognised Institution, the Study Allowance, shall bepayable by the authority competent to grant leave, if thestudy leave avai led of, is in a country where there is noIndian Mission and the Head of the Mission in other caseson claims submitted by the Government servant from timeto time supported by proper certificate of attendance,

(b) The certificate of attendance required to be submittedin support of the claims for Study Allowance shall beforwarded at the end of the term, if the Government servantis undergoing study in an Educational Institution, or atintervals not exceeding three months if he/she is undergoingstudy at any other lnstitu- n.

(4) (a) When the programme of study approved doesnot include, or does not consist entirely of such a courseof study, the Government servant shall submit to theauthority competent to grant leave direct or throughthe Head of "Ie Mission a diary showing how his/hertime has been spent and a report indicating fully thenature of the methods and operations which have beenstudied and including suggestions as to possibility ofadopting such methods of operations to conditions obtainingin India,

(b) The authority competent to grant leave shall decidewhether the diary and report show that the time of theGovernment servant was properly utilized and shalldetermine accordingly for what periods Study Allowancemay be granted.

Rule 71 ; No allowance of any kind other than theDearness Allowance and Study Allowance (whereadmissible) shall be admissible to a Government servantin respect of the period of study leave granted to him/her.

Rule 72 ; (I) .If a Government servant resigns or retiresfrom service or otherwise quits service without returningto duty after a period of study leave or within a periodof three years after such return to duty he/she shallrefund :-

(i) the actual amount of leave salary, Study Allowanceand other expenses, if any, incurred by theGovernment ; and

(ii) the actual amount, if any, of the cost incurred byother agencies such as Foreign Governments,Foundations and Trusts in connection with thecourse of study, together with the interest thereonat rates for the time being in force on Governmentloans from the date of demand, before his/herresignation is accepted or permission to retire isgranted or his/her quitting service otherwise :

Provided that nothing contained in this rule shallapply :-

. (a) to a Government servant who after return toduty from study leave is permitted to retirefrom service on medical grounds ; or

(b) to a Government servant who after return to,duty from study leave is deputed to serve inany statutory or autonomous body or Institution

under the control of the Government and issubsequently permitted to resign from serviceunder the Government with a view to hispermanent absorption in the said statutory orautonomous body or Institution in the publicinterest.

(2) (a) The study leave availed of by such Governmentservant shall be converted into regular leave standing athis/her credit on the date on which the study leavecommenced ; any regular leave taken in continuation ofstudy leave being suitably adjusted for the purpose andthe balance of the period of study leave, if any, whichcannot be so converted be treated as extraordinary leave.

(b) In addition to the amount to be refunded by theGovernment servant under sub-rule (1) he/she shall berequired to refund any excess of leave salary actuallydrawn over the leave salary admissible on conversion ofthe study leave.

(3) Notwithstanding anything contained in this rule, theGovernment servant may, if it is necessary or expedientto do so either in public interest or having regard to thepeculiar circumstances of the case or class of cases byorder, waive or reduce the amount required to be refundedunder sub-rule (I) by the Government servant concernedor class of Government servants.

3. Rule 73 shall be recast as under.-

"Rule 73 ; Authority competent to sanction study leave shallbe as under :-

(1) The concerned Administrative Department shall becompetent to sanction the study leave under these ruleswithin the State.

(2) The General Administration Department on therecommendations of the Administrative Departmentconcerned and with the consent of the Finance Department

may grant study leave under these rules for purpose ofstudy outside the State within India.

(3) Cases for study leave outside India will be sanctionedby the Government on the recommendations of thecommittee prescribed for the purpose and with theconcurrence of the Finance Department."

Where in any case the amount of pony charges actuallypaid may be higher than what is admissible at the ratesprescribed above, the Government employee may chargeactual expenses against proper receipt which shouldamong other things give the details such as distancecovered, station from and to travelled and date of traveletc. A certificate of a Revenue Officer not below the rankof a Tehsi Idar of the area visited regarding the correctness

of the rates charged should be obtained by the concernedemployee. In addition to actual expenses incidental equalto one daily allowance will be admissible if the periodinvolved in journey on. anyone day is 12 hours or moreand half dai Iy allowance where it may be less than 12hours.

Note :-Where a Government servant travels in his own conveyance,the mileage allowance shall be regulated as under :-

(a) Motor Car Rs. 101- per K. M.

(b) Motorcycle/Scooter/Moped Rs. 05/- per K. M.

Provided that the reimbursement of thr expenditure on thisaccount shall be restricted to the cost of air travel betweenany two points of travel."

VI. In Article 320-A, for the words "With effect from1-12-1998, officers whose basic pay is more thanRs. 10,000/- per month shall be .entitled to travel by air ontour within the State", the words "Officers whose Grade Payis Rs. 5,400/- and more shall be entitled to air travel byeconomy class on tour within the State" shall be substituted.

VII. For Article 320-B, the following shall be substituted :-

"Officers whose Grade ray is Rs.7,600/- and more shall beentitled to air travel by economy class on tour while travellingoutside the State from Srinagar/Jammu to Delhi and viceversa and officers with Grade Pay of Rs. 10.000/- andabove and those in pay scale of HAG + and above shallbe entitled to travel to any station outside the St~tc bythe same class. However, the Chief Secretary, the FinancialCommissioners, the Director General of Police, the PrincipalSecretaries to the Government and the Additional D'rectorsGeneral of Police shall be entitled to Business/Club Classtravel on international flights.

Notel:--In case of urgency in the interest of public service aGovernment servant who is not entitled to travel by air,may do so, within or outside the State, with the sanctionof the concerned Administrative Department.

VIII. For the existing Note 3 below Article 320-B, the followingshall be substituted :-

I. "Note 3.- All the mileage points earned by Governmentemployee on tickets purchased for official travel shall beutilized by the concerned department for other official travelby their officers. Any usage of these mileage points forpurpose of private travel by an officer will attractdepartmental action. This is to ensure that the benefits outof official travel, which is funded by the Government,should accrue to the Government."

II. After Note 3 below Article 320-B, the following shall beadded as Note 4 :-

"Note 4.-AII the Travelling Allowance claims, wherejourney has been performed by air, shall be supported withthe boarding cards in addition to the Air Tickets."

IX. For Article 320-D, the following shall be substituted

"Government servants eligible to travel by air within theState shall be entitled to actual standard fare and thereimbursement of insurance premium for a sum ofRs. 50,0001- paid to Insurance Companies in case of alljourneys by air.

Provided that the reimbursement of extra luggage chargesby air in case of carriage of Government records (by air)shall be admissible subject to production of freight voucherand furnishing of a certificate of the countersigning authoritythat the extra freight was paid for carrying the Government

In addition to above, a Government servant shall be entitledto D. A. on the day of air travel as under :

(i) If absence from Headquarters 1,4 Daily Allowanceon the day of departure orarrival does not exceed 6 hours

(ii) If absence from Headquarters Y2 Daily Allowanceon the day of departure orarrival does not exceed 12 hours

(iii) If absence exceeds 12 hours Full Daily Allowance.

Government Instruction No. I.-It occasionally happens thaton a day when an officer is scheduled to travel by air irorn Srinagarto Jammu or vice versa the flight is cancelled but the Governmentservant's presence at the destination is necessary and the departuremay not possibly be postponed or rescheduled. On such occasionsthe officer should share a taxi with others by taking a single seatand he will be entitled to fare actually paid subject to the maximumof air fare which he would get but for the cancellation of flight.

Government Instruction No. II-When an air seat is notavailable, a Government servant who is entitled to travel by air, maytravel by sharing a taxi and charge actual taxi charges paid subjectto the ceiling of the air fare which he would have otherwise got."

X. Article 328-A shall be deleted.

XI. In Article 331, the existing Note I shall be renumbered as 'Note'and the Note 2 thereunder shall be deleted.

XII. For Article 335, the fol' .ving shall be substituted

Exception.- The temporary establishment of the Forest Departmencharged to head "A" Conservancy and Works beexempted from the operation of Note I to this Article.

Note 2 :- A Government servant who under the orders of thecompetent authority has to prolong his halt during tourshall be paid boarding and lodging charges at the fullrate for the first 30 days, at 14th of the full rate for thenext 20 days and at Y2 of the full rate thereafter ;provided that the total No. of days in a year for whichboarding and lodging charges are drawn docs not exceed90 days.

Note 3 :-A Government servant" who' while on tour in India isallowed free boarding and lodging at the expense of theGovernment or the State visited, is not entitled to drawany reimbursement on this account. Where board orlodge alone is allowed free of charge, the official maybe allowed ~ of the boarding and lodging chargesordinarily admissible to him.

Note 4 :-Government servants on tour within the cities of Srinagar/Jammu and anywhere outside the State may be allowedreimbursement of travel charges actually incurred up tomaximum indicated below subject to the condition that theofficer shall not make free use of the conveyance of theGovernment Department/State Corporation etc. or the staffcar of the Resident Commissioner or Trade Agency fortravel within the city/destination of tour, which fact shallbe certified by the concerned on the claim of reimbursement-

XlV. In Article 339 :-

Subject :-Clarification of 2nd Proviso to Rule 10 of Revised PayRules, 2009 issued vide SRO-93 dated 15-4-2009.

Doubts have been expressed by various administrative departmentsregarding the appl ication of 2nd Proviso to Rule 10 of Revised PayRules 2009 issued vide SRO-93 dated 15-4-2009. The issue has beenexamined in the Finance Department and it is clarified as under-

"That in terms of 2nd Proviso to Rule 10 oi'SRO-93 dated15-4-2009 an employee who reaches the maximum of the payband shall be placed in the next higher pay band after oneyear of reaching such a maximum. At the time of placementin higher pay band, the Government servant shall he alloweone increment on the pay in Pay Band+ Grade Pay attachedto the post on which he/she has reached maximum of the payband.

Moreover, for the purpose of entitlement to in situ promotions,it should be treated as one of the promotions".

Accordingly all the Administrative Departments arc requested tocommunicate the above c1arificatory instructions to all the Heads ofDepartments to settle such cases.

Whereas District and Session Judges/Selection Grade Districtand Session Judges of the J&K State approached the Hon'bleHigh Court by way of SWP No. 529/92 titled "T. N. Bhat & OthersVIs State & Others" with the prayer that they have been given lowerpay scales of Rs. 3700-5000 and Rs. 4500-5700 in 1992, against theold pay scales of Rs. 3150-4500 and Rs. 3300-5050 (appearing atS. No. 23 & 25 respectively of the schedule to the SRO-75/1992)instead of the appropriate pay scales due to them as per thestatus enjoyed i. e. Rs. 4500-5700 and Rs. 5100-6300 respectively(S. No. 25 & 26 of the appended schedule).

Whereas the Hon 'ble High Court vide its judgment dated17-4-1996 quashed the fixation of their pay scales as Rs. 3700-5000and Rs. 4500-5700 appearing at S. No. 23 & 25 of the schedulerespectively and directed the respondents to treat them to have alwaysbeen in the pay scale appearing at S. No. 25 & 26 of the scheduleto the notification SRO-75 dated 30-3-1992 i. e. Rs. 4500-5700 andRs. 5100-6300 respectively, right from the date of its issuance, withall the consequential benefits to them including the payment of arrearsfor the past.

Whereas the said judgment was implemented by the StateGovernment and issued SRO-163 dated 13th June, 2005.

:'Whereas, thereafter, certain Superintending Engineers of various

departments also filed a writ petition on the same analogy bearingSWP 1608/92 (Santokh Singh & others VIs State) praying for samegrades as have been granted to District and Session Judges videSRO-163 dated 13th June, 2005. Hon 'ble High Court disposed of thewrit petition with the directions to the respondents to grant thepetitioners the pay scales of Rs. 4500-5700 w. e. f. 01-04-1987 in

accordance with SRO-75 dated 30-03-1992 at par with District andSession Judges. The State Government filed LPA, which was dismissedby the Hon'ble Court confirming the order of the Learned SingleJudge dated 17-05-2001 with further direction to the respondents topay the benefits payable to the petitioners along with interest at therate of 6% per annum from their due date. Subsequently the StateGovernment filed SLP which too was dismissed by the Hon'bleSupreme Court of India. Further a review petition was also filed whichwas also dismissed by the Hon'ble Supreme Court of India.

Accordingly the matter has been considered by the StateGovernment, keeping in view all the relevant aspects and ramificationswith a view to implementing the orders of the Hon'ble High Court.In view of the foregoing sanction is accorded to the grant of the payscale of Rs. 4500-5700 revised to Rs. 14300-18300 and further revisedto Pay Band 4 of Rs. 37400-67000 + Grade Pay of Rs. 8700, in favourof the petitioners (Superintending Engineers) namely Shri SantokhSingh, Shri V. K. Raina, Shri P. N. Gupta & Shri Gajan Singh,notionally from 1-4-1987 and monetari Iy from 1-4-1990 at par withthe scale held by the District and Session Judges.

Subject :-Applicability of minimum pay/stepping up of payclarification-regarding.

It has been observed that the Govt. employees promotedafter 1-1-2006 and pay fixed in their cases in terms of Rule 13 ofSRO-93 dated 15-4-2009 are getting lesser pay than the employeeswho are directly appointed after 1-1-2006 and get their pay fixed interms of the provisions of Rule 8 of SRO-93 dated 15-4-2009 as recastvide SRO-266 dated 31-8-2009. The issue was examined and it wasdecided to refer the matter for clarification to the Govt. of India.The Ministry of Finance, Government of India, vide No. F. No. 26017/15912009-Ad.lI(A) dated 5th March, 2012, have clarified the issuethat stepping up of pay of senior promotees with reference to suchof their directly recruited juniors appointed on or after 1-1-2006 canbe allowed subject to certain conditions.

2. In consonance with the above clarification issued by theGovernment of India, it is accordingly clarified that the pay of theseniors promotees shall be stepped up with reference to the directlyrecruited juniors appointed on or after 1-1-2006, subject to thefollowing conditions :-

(a) Stepping up of the basic pay of seniors can be claimedonly in the case of those cadres which have an elementof direct recruitment and in cases where a directlyrecruited junior is actually drawing more basic pay thanthe seniors. In such cases, the basic pay of the seniorswill be stepped up with reference to the basic pay of theirdirectly recruited juniors from the date the junior directrecruit is actually drawing higher basic pay than thesenior; provided they belong to the same seniority listfor all purposes.

(b) Further, Government servants cannot claim stepping up oftheir revised basic pay with reference to entry pay in the

revised pay structure for direct recruit 'appointed on or,after 1-1-2006 as laid down under Rule, 8 of J&K Ci\T'iI'Services (Revised Pay) Rules 2009, if their cadre doesnot have an element of direct recruitment, or in caseswhere no junior is drawing basic pay higher than them.

(c) Stepping up of pay of the seniors shan not be applicablein cases where pay of direct recruits has been fixed ata higher stage on account of grant of advance incrementsetc. at the time of recruitment.

Provided that the Government may revise the maximum healthcover ceiling, thefamily unit size to be covered, extend the policyto any group/category of employees and also to the pensionersincluding pensioners of State owned Corporations. theamount of the premium to be paid or other terms and conditionsincluding renewal of the policy under the GovernmentEmployees Mediclaim Policy from time to time. "
