THE BIR AND the Home DevelopmentMutual Fund (HDMF) have agreed towork together to support the use ofeBIRForms in the Pag-IBIG Fund'sprovident and housing loan programs.

The agreement was made througha Memorandum of Understanding(MOU) signed by BIR CommissionerKim S. Jacinto-Henares and HDMFChief Executive Officer (CEO) DarleneMarie B. Berberabe on May 12, 2014at the BIR National Office.

Under the MOU, the BIR shall al-low the HDMF to file the tax returnsof Pag-IBIG Fund members, borro-wers and developers (or HDMF cli-ents) and to remit the taxes payableby them, on their behalf, using theeBIRForms or other modes of pay-ment (e.g. mobile payment, debit sys-tem, etc.).

For this purpose, HDMF must se-cure proper written authorization from

its clients for the said filing of tax re-turns and remittance of tax payments.

The HDMF shall also be respon-sible for the submission to the BIR ofits clients' complete documents for theprocessing and issuance of their Cer-tificate Authorizing Registration (CAR).The HDMF can also secure, on behalfof its clients, the CAR from the BIR, ifduly authorized for the purpose.

for HDMF clients where they can begiven assistance in the computation ofrelated taxes, submission of documentsand verification of status of Pag-IBIGaccounts, for the issuance of their CAR.

The signing of the MOU was wit-nessed by DCIR Lilia C. Guillermo andHDMF Deputy CEO Acmad Rizaldy P.Moti. Also in attendance during the sign-ing ceremony were DCIR Nelson M.Aspe and other BIR and HDMF officials.

TO AVOID REVENUE losses related toproperty transfer transactions, the BIRhas developed a new web-based systemcalled Electronic Certificate AuthorizingRegistration (eCAR).

The eCAR System was initially rolledout on May 19, 2014 in Revenue DistrictOffices (RDOs) under RR 1-Calasiao,Pangasinan. The system was developedin collaboration with the Land RegistrationAuthority (LRA) to automate the manualprocesses in the preparation of CertificateAuthorizing Registration (CAR), and tobuild a reliable database for the pre- andpost-audit of one-time transactions.

Prior to the development of the eCARSystem, a Memorandum of Agreement(MOA) between the BIR and the LRA hasbeen signed on September 25, 2013 to

ensure that no transfer of real property iseffected unless the BIR has issued a CARcertifying that such transfer has beenreported and the taxes due thereon, if any,have been paid by the taxpayer.

The MOA specifically provides thatthe LRA-Register of Deeds (LRA-RD) willnot register any taxable instrument norissue a Transfer Certificate of Title unlessthe CAR presented by the taxpayer isverified/cross-checked with BIR data.

With the rollout of the eCAR System,the generation of CAR was automatedand the cross-checking of data was madeeasier through the online transmission,receipt and storage of data in a BIR-LRAshared database. The system likewiseprovides accurate and near real-timeeCAR data that includes tax paymentsposted in the Integrated Tax System, whichis a requirement before an eCAR can be

issued by the BIR.The CARs that will be generated by the

eCAR System has a bar code that has acorresponding reference number repre-senting the system-generated eCAR numberand transaction number, which will beindicated at the back of each page of sale/exchange/transfer of property documents.This will enable the LRA-RD to verify theauthenticity of documents presented tosupport the transfer of properties.

With the said security feature, theproliferation of fake/spurious CARs as wellas the transfer of real properties or personalproperties even without the issuance ofCAR will now be a thing of the past.

"With the eCAR System in place, it ismuch easier now for us in the BIR, as well

as for the LRA and other concernedgovernment offices, to uncover fake/spurious CARs, including those withunlawful insertion of entries and otherirregularities. This will lead to the timelypayment of correct taxes," said DCIRNelson Aspe of the Operations Group.

In line with the implementation ofthe eCAR System, the BIR has issuedRevenue Memorandum Circular (RMC) No.40-2014 on May 15, 2014 prescribing theuse of BIR Form No. 2313-R and BIR FormNo. 2313-P for transactions involvingtransfer of real properties and of personalproperties, respectively, in BIR offices wherethe eCAR System has been rolled out.

COMMISSIONER KIM S. Jacinto-Henares has recommended to FinanceSecretary Cesar V. Purisima the issuanceof regulations to prescribe the policiesand guidelines in the monitoring of ser-vice fees being charged by self-employedprofessionals.

Under Revenue Regulations (RR)

following the provisions of existingrevenue issuances. Upon rollout of theeCAR System in the said offices, allmanually-issued expired CARs that are notyet presented to the LRA-RD will bereplaced by eCARs on or after the rolloutdate of the system.

The LRA-RD shall not acceptmanually-issued CARs upon the rollout ofthe eCAR System in the concerned RDO/LTAD. However, manually-prepared CARsissued within one (1) year before the rolloutdate are still valid for presentation bytaxpayers to LRA-RD as long as they are inthe list of CARs provided by the RDO/LTAD to the LRA-RD.

No. 4-2014 issued on March 20, 2014,self-employed professionals are nowrequired to submit to the BIR an affi-davit indicating the rates, manner ofbillings and the factors they considerin determining their service fees.

The said affidavit shall be submittedto the Revenue District Office (RDO)/Large Taxpayers District Office (LTDO)having jurisdiction over them upon

registration and payment of their an-nual registration fee on or before January31 every year.

Self-employed professionals arealso required to register their books ofaccounts and official appointmentbooks with their respective RDO/LTDObefore using the same in their practiceof profession/occupation/calling.

monthly sales reported in said ma-chines.

The eAccReg System is an en-hanced electronic accreditation and re-gistration facility developed to automatethe issuance to establishments of permitsto use CRM/POS machines and otherbusiness machines before they can beused in business operation.

Part of the enhancement done on theeAccReg System is the streamlining ofprocedures and simplification of require-ments for the issuance of said permits.Once enrolled into the eAccReg System,taxpayers can now print their Certificateof Accreditation and Final Permit to Usetheir business machines.

The eSales System, on the otherhand, automates the monitoring andreporting of the gross monthly sales per

registered business machine, therebymaking it easier for the BIR to closelymonitor taxpayers' monthly sales.

Once a business machine has beenaccredited and registered with the BIRusing the enhanced eAccReg System,a system-generated Machine Identifi-cation Number (MIN) shall be issued.Taxpayers with MIN-issued businessmachines are required to report to theBIR, through the eSales System, theirmonthly sales every 8th day (for tax-payers whose last digit of the 9-digitTIN is even number) or 10th day (fortaxpayers whose last digit of the 9-digitTIN is odd number) of the month fol-lowing the month of sales. The submis-sion of monthly sales reports by tax-payers via the eSales System can bedone through e-mail, website and shortmessaging system (SMS or texting).

To be able to access the enhanced

and integrated eSales/eAccReg System,designated authorized users and/or au-thorized representatives of taxpayer-ap-plicants/machine suppliers are requiredto submit a duly notarized letter to theBIR to be able to enroll in the systems'Account Enrollment facility. The said let-ter shall be submitted to the concernedRevenue District Office/Large TaxpayerDistrict Office/Large Taxpayers Assis-tance Division/Excise Large TaxpayersRegulatory Division.

All taxpayers/suppliers are requiredto enroll their respective authorizedusers/representatives prior to the use ofthe enhanced and integrated eAccRegand eSales Systems. Account enrollmentapplication shall be on a one (1) autho-rized user per Taxpayer IdentificationNumber (TIN) basis, or one authorized userin behalf of multiple Branches, whicheveris applicable/convenient to the taxpayer.

The official appointment booksshall contain the names of their clientsand the date/time of their meeting(s).Likewise, their sales invoices and offi-cial receipts (VAT or non-VAT) shouldalso be registered first with the BIRbefore they can be issued and used inany transaction.

In cases when no professionalfees are charged by the professionaland paid by the client, a BIR-registeredreceipt, duly acknowledged by the lat-ter, shall be issued showing a discountof 100% as substantiation of the "pro-bono" service.

However, said deadline was ex-tended by the BIR to May 31, 2014 togive self-employed professionalsample time to comply with the said re-quirements. The said extension wasprovided under Revenue Memoran-dum Circular No. 32-2014 issued by theBIR on May 5, 2014.

THE BIR IS embarking on theenhancement of its website/portal following the provi-sions of Administrative Or-der (AO) No. 39 issued byPresident Benigno S. AquinoIII on July 12, 2013.

Said AO mandates allgovernment agencies to mi-grate their websites to theGovernment Web HostingService (GWHS) of the DOST-Information and Communica-tions Technology Office(ICTO) within one (1) yearfrom the effectivity of the AO.

Another requirement ofthe AO is for all governmentwebsites to have a uniform"look and feel" following thePhilippine Uniform WebsiteContent Policy (UWCP) setby the National Digital Ser-vice Coordinating Group.

A Project Team, headedby DCIR Nelson M. Aspe (asExecutive Sponsor) and OIC-

ACIR Marilou L. Del Rosario(as Project Sponsor), wascreated per Revenue SpecialOrder No. 258-2014 to workon the said enhancement.

The Team, comprised ofContent Managers from vari-ous BIR offices and techni-cal personnel from the Infor-mation Systems Group (ISG),convened on May 20, 2014at the BIR Executive Confe-rence Room for the projectkick-off meeting. The meet-ing was spearheaded byDCIR Aspe and was gracedby DCIR Lilia C. Guillermo.

In his opening remarks,DCIR Aspe discussed exten-

sively the background of theproject. He mentioned thatthe project is one of the re-form projects of the BIR iden-tified under Revenue Memo-randum Order No. 29-2013.

Unlike many projects inthe BIR, the Enhancement ofthe BIR Website/Portal Pro-ject has no hired contractorthat will work on its delive-rables. Per Memorandum Cir-cular No. 2014-002 issued bythe DOST-ICTO, the capitalexpenditures for additionalservers and other equipment,licenses, consulting ser-vices, training and other ex-penses related to the GWHS,

Per memorandum issuedby Commissioner Kim S.Jacinto-Henares dated April7, 2014, the three (3) repre-sentatives shall be membersof the RPEB, which was crea-ted in accordance with therequirements of Republic ActNo. 9335, otherwise knownas the Attrition Act of 2005.

In addition to being mem-bers of the RPEB, the First andSecond Level Rank-and-File

Representatives shall also actas members of the NSB whoshall participate during thescreening of candidates forvacant positions in their res-pective level (Salary Grade 10& down, for the First Level andSalary Grade 11 & Up, for theSecond Level). They shallserve for a period of two (2)years effective on June 2, 2014.
