35.1.The Contractor shall indemnify and keep the Railway at all time indemnified and protectedagainst all claims and liabilities that may arise under Workmen's Compensation act, the FactoriesAct and payment of wages act and the rules made thereunder from time to time or under any other

labour or industrial Legislation made from time to time. The Contractor shall pay his labourersnot less than the wages paid for similar work in the neighbourhood or in the adjoining areas.

under the Workmen's compensation Act 1923, or the Fatal Accidents Act or any other statute inforce for the time being.

The Contractor shall take all precautionary measures in order to ensure the protection of his personnel moving about or working in the Railway premises, which shall conform to the rules

and regulations of the Railway. If and when in the course of the works, there is likely to be anydanger to persons ion the employment of llic Contractor due to running traffic while working inthe Railway siding and premises, the Contractor shall apply in writing to the RailwayAdministration will, however, decide as to whether it is necessary to post such Flagmen forvarious types of work and also the number of such men required to protect the gang or gangs of Contractor's staff working at site. The Railway Administration shall remain indemnified by theContractor, in the event of any accident occuring in the normal com of work, arising out of thefailfure of Contractor or his men to exercise reasonable precaution at all places of work whetheror not the Railway Administration has posted Flagmen at any particular site of work. TheFlagmen will! be appointed by the Railway Administration and no expense on this account will becharge to the Contractor.

Railway Act or the General and Subsidiary Rules in force on the Railway, in such a way that theydo not hinder Railway operation nor affect the proper functioning of or damage any Railwayequipment, structure o rolling stock except as agreed to by the Railway Administration, providedthat all damage and disfiguration caused by the Contractor to any Railway or public property mustbe made good by the Contractor a his own expense failing which cost of such repairs shall berecovered from the Contractor.

If safety of track, drainagre etc., is affected as consequence of works undertaken by theContractor, the Contractor shall take immediate steps to restore normal conditions. In case of delay the Railway Administration shall, after giving due notice to the Contactor in writing, takenecessary steps and recovered the costs from the Contractor.
