The purpose is toacknowledge the construction of an enclosed frame porch to the rear of theexisting single family detached dwelling at 139 Lake Promenade in the City ofToronto (Etobicoke York).

10.3 CITY OF VAUGHAN 1618 RIVERSIDE BOULEVARDTo construct, reconstruct, erect or place a building or structure and temporarilyor permanently place, dump or remove any material, originating on the site orelsewhere on Part Lot 32, Concession 1  Part Lot 100, Plan NO. 3765, (18Riverside Boulevard), in the City of Vaughan, Don River Watershed. Thepurpose is to recognize the construction of a 35.19 sq. m. (378.78 sq. ft.)pergola structure at the rear of an existing single detached dwelling within aRegulated Area of the Don River Watershed. The described works were carriedout without TRCA permits or municipal permits. As such, the applicant has paiddouble the permit application fee amount for this permit "after-the-fact'. Theproperty is located on lands known municipally as 18 Riverside Boulevard, inthe City of Vaughan.

10.4 CITY OF VAUGHAN 19350 VELLORE WOODS BOULEVARDTo construct, reconstruct, erect or place a building or structure and temporarilyor permanently place, dump or remove any material, originating on the site orelsewhere on Part Lot 16, Concession 5  Block 224, Plan 65M-3498, Block 85,Plan 65M-3446, (350 Vellore Woods Boulevard), in the City of Vaughan, DonRiver Watershed. The purpose is to undertake works within TRCA's regulatedarea of the Don River Watershed in order to facilitate the construction of a 13.7sq. m. (147.72 sq. ft.) covered patio and 7.4 sq. m. (80 sq. ft.) shed andrecognize an existing  27.1 sq. m. (291.7 sq. ft.) deck. A portion of the workswere constructed without TRCA or Municipal permits. As such, the applicanthas paid double the application fee as required for a permit "after-the-fact" inassociation with the violation of Ontario Regulation 166/06. The subjectproperty is located on lands known municipally as 350 Vellore WoodsBoulevard, in the City of Vaughan.

10.5 TOWN OF CALEDON 2280 JAMES STREETTo construct, reconstruct, erect or place a building or structure on Lot 41, 42,43, Plan BOL-7, 80 James Street, in the Town of Caledon, Humber RiverWatershed. The purpose is to undertake works within TRCA's Regulated Areaof the Humber River Watershed in order to facilitate the construction of a 9.7 mby 4.8 m (32 ft by 16 ft)  detached garage located at the rear of an existingdwelling associated with a municipal building permit.

10.6 TOWN OF RICHMOND HILL 24LESLIE ELGIN DEVELOPMENTS INC.To site grade and temporarily or permanently place, dump or remove anymaterial, originating on the site or elsewhere on Part 27, Part Lot 28 Lot ,Concession 3  Block 10, Plan 65M-3997, (10961 and 11121 Leslie Street), inthe Town of Richmond Hill, Rouge River Watershed as located on the propertyowned by Leslie Elgin Developments Inc.. The purpose is to undertake workswithin a TRCA Regulated Area of the Rouge River Watershed to facilitate theconstruction of a new sanitary sewer and manholes crossing under LeslieStreet through the combined use of trenchless technology and open cut insupport of OMB approved draft plan of subdivision 19T(R)-04009.

10.7 STANDARD DELEGATED PERMITS 27Standard Permits, including Emergency Infrastructure Works permissions, areimplemented by Planning and Development Division staff and are receivedmonthly by the Executive Committee.  Standard Permits , including EmergencyInfrastructure Works permissions, are subject to the authorization of designatedstaff appointed as Enforcement Officers, as per Authority Res.#A198/13,#A199/13 and #A103/15, respectively.  All standard and emergencyinfrastructure works  are non-complex permissions consistent with TRCAapproved policies and procedures and issued for a time period of two years ofless.

Section III – Items for the Information of the Board TO: Chair and Members of the Executive Committee Meeting #13/14, Friday, January 13, 2017 FROM: Carolyn Woodland, Senior Director, Planning, Greenspace and Communications RE: VOLUNTARY PROJECT REVIEW OF WORKS UNDERTAKEN BY

ORGANIZATIONS EXEMPT FROM ONTARIO REGULATION 166/06, AS AMENDED

____________________________________________________________________________ KEY ISSUE To report on progress of the TRCA Voluntary Project Review protocol established in 2014, regarding works undertaken by organizations exempt from Ontario Regulation 166/06, as amended – Toronto and Region Conservation Authority Regulation of Development, Interference with Wetlands and Alteration to Shorelines and Watercourses. RECOMMENDATION IT IS RECOMMEDED THAT the staff report on projects reviewed through the Toronto and Region Conservation Authority (TRCA) Voluntary Project Review (VPR) process from 2014 through 2016 be received. BACKGROUND In 2014, the TRCA fee schedule provided an option for organizations exempt from TRCA’s regulation, including but not limited to Crown corporations, railway companies and the telecommunication industry, to apply for TRCA review under the Voluntary Project Review process. These organizations are exempt from the Conservation Authorities Act Section 28 regulatory approval process and permits are not required. However, TRCA is concerned that infrastructure projects exempt from TRCA’s regulation are not meeting the tests of our permitting process, and as such, provincial and conservation authority interests including, but not limited to, flooding management, erosion hazard, impacts to watercourses and natural heritage systems may not be adequately addressed. To address this concern, in the interest of both public safety and best management practices, TRCA developed a process whereby the exempt party may voluntarily request TRCA to review and comment on detailed design activities associated to confirm that TRCA policies and procedures are being addressed. Once TRCA concerns are satisfied, a Voluntary Project Review Letter is provided by staff advising that TRCA objectives and requirements as set out in The Living City Policies and Ontario Regulation 166/06, as amended, have been satisfied. While TRCA works with multiple user groups in the environmental assessment and detailed design review stages of various projects, to date, only Metrolinx has committed to the VPR process. Metrolinx has formally committed to providing TRCA with detailed design and technical reports, and to working with staff in a streamlined and expeditious manner for all projects in order to ensure their projects meet the five tests of TRCA’s regulation including, flooding, erosion, conservation of land, pollution and dynamic beaches. Using the leadership of Metrolinx as an example, TRCA continues to seek a similar level of engagement with all other organizations exempt from TRCA’s regulation on a continual basis.

Item 9.1

Since the inception of the VPR process in 2014, TRCA has reviewed multiple projects related to both Metrolinx GO and Light Rail Transit (LRT), and issued 12 VPR letters. Details are provided below. 1. CFN 48976 – GO Transit Barrie Passing Track Phase 1 – issued on September 17, 2014 The purpose of the project was to construct and upgrade culverts at two locations on a section of the Barrie rail corridor south of Regional Road 7 at Tributary #2 (unnamed) and north of Regional Road 7 at Tributary #3 (unnamed) in order to facilitate and accommodate the construction of passing tracks, in the City of Vaughan and the Don River watershed. The proposed works involved the construction of a new headwall at each culvert and a culvert extension for widening of the track bed to accommodate the new passing track. Staff concerns regarding flood management, erosion hazards and impacts to watercourses and natural heritage system were addressed. 2. CFN 48977 – GO Transit Barrie Passing Track Phase 2 – issued on September 19, 2014 The purpose of the project was to construct a double track segment including the complete replacement of the existing culvert located on a section of the Barrie rail corridor north of Langstaff Road, in the City of Vaughan and the Don River watershed. Staff concerns regarding flood management, erosion hazards, pollution, impacts to the watercourse and natural heritage system were addressed. 3. CFN 54839 - Eglinton Crosstown Light Rail Transit (ECLRT) Watermain Relocation –

issued on January 26, 2016 The purpose of the project was to relocate a segment of an existing watermain on the north side of Eglinton Avenue West and west of Black Creek Drive, in the City of Toronto and the Black Creek subwatershed. The proposed works involved relocating the watermain on the north side of the road and installed within the roadway south of this watermain and reconnecting it to the same watermain continuing east. The watermain relocation formed part of the early utility relocations required to facilitate earthworks for the construction of the proposed Mount Dennis Station. Staff concerns regarding erosion hazards, pollution, impacts to the watercourses, valley corridor, natural heritage systems and conservation concerns were addressed. 4. CFN 55276 – Eglinton Crosstown LRT – EMSF Boreholes and Test Pits – issued on

January 26, 2016

The purpose of the project was to undertake geotechnical investigation (boreholes) within the valley lands at the Eglinton Maintenance and Storage Facility (EMSF), located at 3500 Eglinton Avenue West and just west of Black Creek Drive, in the City of Toronto and the Black Creek subwatershed. The geotechnical investigations were undertaken in advance of and to support the design of the proposed works on the EMSF site including the Light Rail Guideway and tracks, stormwater management pond, service road, parking lots and other components of the EMSF site. Staff concerns regarding erosion hazards, pollution, impacts to the watercourses, valley corridor and natural heritage system were addressed.

5. CFN 55324 - Eglinton Crosstown Light Rail Transit (ECLRT) – Tunnel Works at the

West Launch Shaft and West Twin Tunnel (Keele Street to Yonge Street) – Permit issued on January 13, 2012, and VPR Letter issued on February 1, 2016

Item 9.1

The purpose of the project was to continue the tunnel works at the Launch Shaft 1 (LS-1) to complete works as per the contract requirements for the 6.5 m diameter twin tunnels of the Eglinton Scarborough Crosstown Rapid Transit (ESC), near Keelesdale Park and east of Black Creek Drive, in the City of Toronto and the Black Creek subwatershed. The project limits included areas east of Black Creek Drive to just east of Bicknell Avenue. Staff concerns regarding flood hazards, erosion hazards, pollution, impacts to the watercourses, valley corridor and natural heritage system were addressed.

6. CFN 52941 – Stouffville GO Rail Corridor Expansion – Phase 1 – issued August 5,

2015

The purpose of the project was to undertake phase 1 works of the Stouffville GO Rail Corridor Expansion including the advance track layout and grading works for double tracking of the Stouffville Corridor, starting from just north of the existing Agincourt GO Station at Sheppard Avenue East (Mile 55.44), in the City of Toronto, to north of Kennedy Road and Steeles Avenue East (Mile 52.25), in the City of Markham and the Highland Creek watershed. Staff concerns regarding flood hazards, erosion hazards, pollution, impacts to the watercourse and natural heritage system including aquatic and terrestrial species and habitats, and conservation concerns were addressed.

7. CFN 55323 – Eglinton Crosstown Light Rail Transit (ECLRT) – East Twin Tunnels

(Yonge to Brentcliffe) – Permit issued September 13, 2013, and re-issued VPR Letter March 7, 2016

The purpose of the project was to continue tunnel works at the Launch Shaft 3 (LS-3) to complete works as per the contract requirements for the 6.5 m diameter twin tunnels of the Eglinton Crosstown Light Rail Transit (ECLRT), located approximately 150 m east of Brentcliffe Road, in the City of Toronto and the Don River watershed. Construction works at this location consisted of site set up, assembly and launch of the tunnel boring machines (TBMs). The construction staging site was also used to receive the tunnel liners and the spoils from the TBM during tunnelling and the spoils collected and trucked away to a waste disposal facility. Staff concerns regarding erosion hazards, pollution, impacts to the watercourse, valley corridor and natural heritage system including aquatic and terrestrial species and habitats, and water management were addressed.

8. CFN 55517 – Eglinton Crosstown Light Rail Transit – Stage 1 Vegetation Clearing and

Grubbing – issued April 7, 2016, and revised November 24, 2016 The purpose of the project was to undertake Stage 1 – vegetation clearing and site preparation activities related to the development of the Eglinton Maintenance and Storage Facility (EMSF), located at 3500 Eglinton Avenue West (former Kodak Lands) and Municipal Lands located north of Eglinton Avenue and west of Keelesdale Drive, in the City of Toronto and the Black Creek subwatershed. Staff concerns regarding flood hazards, erosion hazards, pollution and impacts to the valley corridor and natural heritage system were addressed.

9. CFN 55574 – Humber River East Abutment – issued August 12, 2016 The purpose of the project was to undertake stabilization of the river slopes and remediation of erosion and scour along the Pier 1 of the Metrolinx Humber River Bridge located just south of Highway 401, in the City of Toronto and the Humber River watershed. The proposed works involved remedial works including erosional mitigation measures at the pier and slope toe enhancement/protection works of the valley slope under the bridge. Staff concerns regarding erosion hazards, flood hazards, pollution, impacts to the watercourse, valley corridor and natural heritage system including aquatic and terrestrial species and habitats, and conservation concerns were addressed. 10. CFN 55805 – Cedarvale Park Storm Sewer Connection – issued November 1, 2016

The purpose of the project was to complete the connection between the existing two storm sewers at Cedarvale Park to decommission the portion of storm sewer currently located under Eglinton Subway Station in order to facilitate the development of Cedarvale Station, in the City of Toronto and the Don River watershed. The proposed works involved entering the storm sewer via an existing manhole and demolition of the wall. The demolition waste was removed via the manhole and disposed offsite and all disturbed areas within the park reinstated and restored. Staff concerns regarding erosion hazards and pollution concerns were addressed. 11. CFN 55909 – Eglinton Crosstown Light Rail Transit – Concrete Box Tunnel Launch

Shaft 1 – issued August 15, 2016

The purpose of the project was to prepare the existing shaft site, excavate and clear existing debris, and to construct a concrete box tunnel within the existing Launch Shaft 1 (LS-1) located on the south side of Eglinton Avenue and east of Black Creek Drive, in the City of Toronto and the Black Creek subwatershed. Staff concerns regarding flood hazards, erosion hazards, pollution, impacts to the watercourse, valley corridor and natural heritage system including aquatic and terrestrial species and habitats, and water management were addressed. 12. CFN 56617 - 407 ETR Patrol Yard Expansion - 6200 Steeles Avenue West – issued

November 25, 2016 The purpose is to expand the existing 407 ETR patrol yard at 6200 Steeles Avenue West, in the City of Vaughan and the Humber River watershed. Works include: a new access driveway off Steeles Avenue, a private entrance ramp from the yard onto Highway 407 West and Regional Road 27 north – south ramp, a realignment of Albion Creek to facilitate the new ramp and expansion of the patrol yard, a new salt storage building, and a new maintenance building. Staff concerns regarding flood hazards, impacts to the watercourses and natural heritage system including aquatic and terrestrial species and habitats were addressed. FINANCIAL DETAILS Fees are paid for the review of all VPR projects in accordance with either the current TRCA Administrative Fee Schedule for Environmental Assessment and Infrastructure Permitting Services or based on service level agreements with partner organizations.

166/06, AS AMENDED Development, Interference with Wetlands and Alterations to Shorelines and Watercourses

____________________________________________________________________________ KEY ISSUE: Pursuant to Ontario Regulation 166/06, as amended, written permission from the Authority is required for: a) straightening, changing, diverting or interfering in any way with the existing channel of a river, creek, stream or watercourse, or for changing or interfering in any way with a wetland; b) development, if in the opinion of the authority, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development. A permit may be refused through a Hearing Process, if in the opinion of the Authority, the control of flooding, erosion, dynamic beaches, pollution or the conservation of land is affected. RECOMMENDATION THAT permits be granted in accordance with Ontario Regulation 166/06, as amended, for the applications which are listed below: PERMIT APPLICATIONS 10.1 - 10.6 ARE MAJOR APPLICATION - REGULAR

CITY OF MARKHAM 10.1 12 STATION LANE To construct, reconstruct, erect or place a building or structure, change a building or

structure so that it alters its use or potential use, increases its size or increases the number of dwelling units and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Lot G, Plan 335, (12 Station Lane), in the City of Markham, Rouge River Watershed. The purpose is to construct an addition to an existing dwelling within a Regulated Area of the Rouge River watershed at 12 Station Lane in the City of Markham.

The permit will be issued for the period of January 13, 2017 to January 12, 2019 in accordance with the following documents and plans which form part of this permit: • Drawing A.1, Basement Plan & Front Elevation, prepared by Gregory Design Group,

received by the TRCA December 15, 2016; • Drawing A.2, Ground Floor Plan & Rear Elevation, prepared by Gregory Design

Group, received by the TRCA December 15, 2016; • Drawing A.3, Second Floor Plan & Sections, prepared by Gregory Design Group,

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The purpose of this application is to construct an addition to an existing dwelling within a TRCA Regulated Area of the Rouge River watershed in an established residential neighbourhood within the City of Markham. The subject property is located entirely within the Regional Storm Flood Plain and within the Unionville Special Policy Area. The proposed addition is located within a generally flat, manicured rear yard area. In accordance with TRCA's Living City Policies, the proposed addition has been adequately floodproofed to the Regulatory Flood Elevation of 175.26 m.a.s.l and will be able to withstand water flow velocities expected during the Regional Storm Event. Furthermore, basement windows on the existing dwelling are to be removed and will also be flood proofed to the Regulatory Flood Elevation. No new windows are proposed for the new basement area. TRCA staff have advised the applicant that additional residential units within the Special Policy Area can not be supported. As confirmation, the applicant has provided written correspondence which states that the proposal does not involve the creation of additional residential units. As such, TRCA staff are generally satisfied that the proposed works are in keeping with TRCA and Provincial Policy. No significant vegetation removals are required as part of this project, and as such, there are no anticipated flooding, ecology, or geotechnical concerns anticipated with this proposal. Control of Flooding: The proposed addition and existing dwelling will be floodproofed to the Regulatory Flood Elevation. TRCA Water Resources Engineering staff are satisfied that the proposed works will not significantly impact the storage and conveyance of flood waters. Pollution: Sediment control fencing will be installed and maintained for the duration of construction to prevent the transport of sediment beyond the area of disturbance required for construction. Dynamic Beaches: Not applicable. Erosion: There are no geotechnical issues associated with this application. Conservation of Land: As a watercourse will not be impacted by the proposal, no fisheries concerns will result. There are no other natural features on or adjacent to the site that may be negatively impacted by the project. Plantings

The property is devoid of any significant vegetation, however all disturbed areas will be restored to the existing sodded / manicured condition.

Proposal: The purpose is to undertake works within a TRCA Regulated Area of the Rouge River Watershed. Located north of Elgin Mills Avenue, on Leslie Street, south of 19th Avenue in the Town of Richmond Hill, the applicant is proposing to construct a new sanitary sewer connection and manholes connecting to the Region of York main line under Leslie Street. The proposed works will utilize a combination of open cut and trenchless technology to undertake the works and to minimize any anticipated impacts to the adjacent watercourse, wetlands and Redside Dace habitat. The works are to provide sanitary services to the OMB approved draft plan of subdivision 19T(R)-04009. The applicant has obtained a permission to undertake the works within the road right-of way from the Region of York and TRCA has received email confirmation from the Ministry of Natural Resources with respect to the timing of the works to be completed between January 1 - April 1, 2017. As such, an extension to the fisheries timing window was not required by the MNRF with respect to the proposed works. Furthermore, as the works are to be completed within 2 weeks in January, TRCA does not anticipate any geotechnical or ecological issues with the proposed works. Control of Flooding: A portion of the open cut staging area for the works is located within the existing Regional Floodplain. The trenchless technology to be utilized for installation of the sanitary sewer under Leslie Street and adjacent to the Redside Dace habitat is to be undertaken through jack and bore. As such, no pressurized drilling fluid or FRAC out contingency is required. The works are proposed to be undertaken in January 2016 and is anticipated to be completed within 2 weeks, and as such, no impacts to the storage and/or conveyance of flood waters are anticipated. Pollution: Erosion and sediment control measures, including double heavy duty silt fence with straw bales will be implemented prior to construction and maintained for the duration of the works. Rock check dams will also be used with Filtrexx to protect existing roadside swales within the right-of-way in order to prevent construction generated sediments from migrating off site. All disturbed areas will by immediately stabilized post construction with a straw blanket covering the seed and mulch application. All erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction. Furthermore, a contingency plan has been provided on the plans in case of containment issues.
