RESOLUTION TO ADOPT RULES OF PROCEDURE

FOR THE SMITHFIELD TOWN COUNCIL

RESOLVED: To establish Rules of Procedure for Town Council Meetings, as follows:

SECTION 1. The order of procedures herein contained shall govern deliberations and theconduct of meetings of the Town Council.

SECTION 2. meetings of the Town Council shall be conducted on the first andthird Tuesdays of each month. Meetings shall take place at the SmithfieldTown Hall, unless the Town Council President designates a differentlocation.

SECTION 3. Special meetings may be called at any time by the President of the Council orby three (3) or more members, subject to availability of a quorum and withnotice to each member at least forty-eight (48) hours in advance (forty-eight(48) hours notice is waived in the case of an emergency).

SECTION 4. meetings of the Council, a majority of its members shall constitute aquorum for the transaction of business. Votes made at all meetings shall berecorded by the Clerk or Clerk Pro Tempore. No action of the Town Council,except for filling vacancies or compelling attendance of absent members inaccordance with Sections 2.07 and 2.11 of the Charter, shall be valid orbinding unless adopted by the affirmative vote of three (3) or more membersof the Council.

SECTION 5. All meetings of the Council shall be presided over by the Council President, orin his or her absence, by the Council Vice President; in the absence of both, aPresident Pro Tempore may be appointed by the members in attendance at themeeting.

SECnON 6. Town Clerk shall serve as the Clerk of the Town Council, or in his or herabsence, the Deputy Clerk. In the absence of both, the Council shall appoint aClerk Pro Tempore for the official recording of Council business at allmeetings of the Council.

SECTION 7. The order of business at all meetings of the Council and for those specialmeetings open to the public, shall be as follows:

(1) Call to order by the presiding officer;(2) Prayer and Salute to the Flag;(3) Emergency evacuation and health notification;(4) Presentations;(5) Consider approving minutes of previous meetings;(6) Consideration of all items on the agenda;(7) Opening of meeting for comments from the public;(8) Adjournment

(Public Hearings shall be held In the sequence in which they appear on theagenda unless a majority of the Council members in attendance at themeeting decide otherwise).

No person, not a member of the Council, shall be allowed to address thesame ̂ agenda item while in session without permission of the presidingofficer. Public comment on any matter shall generally be limited in thediscretion of the presiding officer to the comment period reserved forinterested citizens and to the public discussion period on a particular agendaitem, if one is authorized by the presiding officer. Speakers shall identifythemselves by name and address.

Motions made at any session shall be reduced to writing if so requested byany other Council member. Resolutions shall be reduced to writing in allcases and entered into the official minutes of the meetings kept by the Clerkof the Council.

Motions to reconsider any matter previously resolved by vote shall beentertained only from a Council member who voted with the majority at thetime of the initial decision at the next regular Council Meeting afterappropriate notice of the motion to reconsider.

The Clerk shall keep a correct record of all Council meetings, and, at therequest of any Council member, on any vote taken shall record verbatim anydissenting opinion rendered.

All questions of order shall be decided by the presiding officer. Any Councilmember may appeal such a procedural ruling to the full Council for a finalruling. All questions of procedure not provided for in these Rules shall bedecided by reference to Robert's Rules of Order, Newly Revised.

The presiding officer may, at his or her discretion, call upon any memberto take the chair temporarily for the purpose of allowing said formerpresiding officer to make a motion on any issue.

It shall be the duty of each Council member to vote on all matters put to theCouncil; except when a Council member has a personal or financial interestin the matter, whether direct or indirect, he or she shall recuse from such

vote.

SECTION 15. All meetings of the Council, except those exempted by the open meetings law,shall be conducted publicly, and no ordinance, resolution, rule, regulation,order, or directive shall be adopted at any session except a regular or specialmeeting that has been properly noticed.

SECTION 16. A motion to adjourn, or to recess for a stated period of time, shall always bein order and shall be entertained by the presiding officer.

SECTION 17. The rules and procedures of this Resolution maybe altered, amended, ortemporarily suspended by the affirmative vote of three (3) or more membersof the Council.

SECTION 18. In order to conduct Town Council investigations and inquiries pursuant toCharter Section 2.09 or to compel the attendance of an absent Councilmember pursuant to Charter Section 2.11 (c), the Council may authorize itsPresident or Vice President to issue subpoena(s) commanding the presence ofwitness(es) or an absent Council member at any meeting of the Council. ACouncil member failing to comply with a duly authorized subpoena shall besubject to censure by a majority vote of the remaining Council members.

SECTION 19. The Town Manager shall forward the Council Meeting Agenda to all Councilmembers by the Friday preceding a regular Council meeting for review.

SECTION 20. It shall be the duty of the presiding officer at any Council Meeting to:

(1) Call the meeting to order;(2) Keep the meeting to its order of business;(3) Re-state each motion made and require a second to that motion before

allowing discussion;(4) Control discussions to assure order by:

Re: LUCAS Chest Compression System Purchase

Dear Town Council Members.

Attached is the quote for a LUCAS Chest Compression System to place on our Rescue #3. Thisunit provides for consistent chest compressions during CPR and has been proven more effectivethan manual CPR compressions. Patient survival rights have been increase through the use ofchest compression systems. Information about the device and the quoted price are included withthis memo.

We had previously purchased a LUCAS device, which is in service on our Rescue #1. Thedepartment's goal is to have a LUCAS device on each of our three rescues.

The attached quote is from Physio-Conirol, Inc. at a cost of $13,728.12.

This purchase is a sole source vendor as it is only available through Physio-Control. Inc. Inaddition, the previously purchased LUCAS device was from Physio-Control. Physio-Control,Inc. is also a vendor on the RI State Master Pricing Agreement.

The funds to purchase the LUCAS device will come from the donation received from the Estateof Clarissa M. H. Patterson.

GREENVILLE PUBLIC LIBRARY

EGRESS AND ENTRANCE AND PARKING LOT PROJECT

The Greenville Public Library is one of two public libraries in the Town of Smithfield,which has a population of 21,700. The Library was incorporated in 1882 for the purposeof providing library services to the Town. The original building was located on theGreenville Common near St. Thomas Church. A new facility was built on the presentsite in 1956 with two additions added, one in 1966 and the latest in 1991.

Annual operating revenues are derived from association dues, contributions, local taxappropriations, interest in investments, late fines, grants, and the State of Rhode Islandin the form of grant-in-aid. The largest revenue appropriation comes from the Townof Smithfield, which funds 73% of the total library operating budget.

The Library served 110,908 walk-in patrons in the year 2015-2016.

The Library held 640 programs for children, teens, and adults in the year 2015-2016.

The Library had 6,140 people attend programs in the year 2015-2016.

The Library sees an average of between 300-500 hundred people a day.

Children has the most programming with Story-hours, and topical programs. They alsouse our tutoring services, either through Bryant Univ. or through private tutoring sessionsthat meet here.

Teens use the Baker's After-School Center every afternoon, and also have private tutoringsessions here.

Young Adults (20 - 40) use the library services such as scanning, faxing, some computersuse, along with attending programs, and using our 3-D printer. This group also makessignificant use of our quiet study rooms.

Older Adults (50 and over) use the traditional services of borrowing books, but also useare services for electronic training, such as with laptop computers, ipads, and cell phoneinstruction.

The Smithfield Fire Department conducted an inspection of the building. Theyprovided us with our occupancy limits which are as follows: 40 in the recital room,70 in the adult room on the first floor, 41 in the Baker's After-School Center, and50 in the Children's Room. The total occupancy for the building is 201.

The Library property has 44 parking spaces. This number at times in inadequate forthe number of people that we may have in the building at any given time, especiallywhen we have programs going on. We are seeking to add an additional 51 parkingspaces, which will bring the total to 95.

Currently the library building is on one lot and the parking spaces are on other lots.Parking is an accessory use and should be on the same lot as the main use, i.e. library.

A Special Use Permit is what we will need to begin the project.

The Library currently owns the property on 9 Pleasant View Ave. The mortgage forthis property is held with the town. The balance on that mortgage is $158,858.49, andanother loan is out for $68,334.64 which was used for consulting fees for a pastproject. This property will be used to provide the second egress and entrance to andfrom Pleasant View Ave.

The Library will be applying for a grant from the Champlin Foundations once everythingis in order. They are requesting that the town agree to the zoning changes, potentially somefinancial buy-in and that the project be shovel-ready before we apply for a grant.

BACKGROUND:

Last year the Town of Smithfield, on behalf of the R1 Municipal Purchasing AgentAssociation, went out to bid for Unleaded Gasoline and Diesel Fuel for 2017.At the December 16, 2016 meeting of the RI Municipal Purchasing Agent Association itwas unanimously voted by the body to accept a one (1) year renewal of the bids that weresubmitted as part of the Town of Smithfield's RFP for Gasoline and Diesel forParticipating Municipalities Co-operative Purchasing. The one (1) year renewal will allowany member municipality to choose from the list provided by the RI Municipal PurchasingAgent Association that best serves their community.

RECOMMENDATION:

It is the recommendation of this department that a one year extension be granted forUnleaded Gasoline to Santa Buckley Energy, Ltd of Bridgeport, CT for plus $0.0409 andfor Diesel Fuel to Superior Plus Energy Services of Providence, RI for plus $0.0321 pergallon. These factors will be applied to the lowest daily prices published by the Oil PriceInformation Services (OPIS).

MOVED: That the Smithfield Town Council authorizes the Public Works Director toenter into a one year agreement extension with Santa Buckley Energy, Ltd., of Bridgeport,CT for the purchase of Unleaded Gasoline for plus $0.0409 and with Superior PlusEnergy Services of Providence, RI for the purchase of diesel fuel at plus $0.0221.
