1.0 INTRODUCTION

It is proposed to construct a boutique commercial development at 6-10 Peel Street, Collingwood. The development will include seven (7) levels of commercial space plus roof terrace and communal spaces for tenants including a theatrette at ground level.

The following request for information has been provided by City of Yarra:

An acoustic report prepared by a qualified acoustic engineer outlining specific noise attenuation measures to ensure that surrounding dwellings are not adversely impacted upon by noise from the proposed permit required use.

Marshall Day Acoustics Pty Ltd (MDA) has been commissioned to assess the proposed development and prepare a report suitable for inclusion in the town planning submission.

This report has been prepared in response to the above condition.

A glossary of acoustic terminology used within this report is provided in Appendix A.

3.0 SITE DESCRIPTION

The proposed development site is located at 6-10 Peel Street, Collingwood and is bounded by Peel Street to the south, Oxford Place to the north and Little Oxford Street and a public park to the east. Existing retail, commercial and mixed-use premises are located to the west and north-west.

Properties to the north and west appear to include residential tenancies. Properties to the south may also include residential components above commercial premises.

An aerial photograph showing the subject site and surrounds is provided in Figure 1.

The subject site and surrounding properties are zoned Mixed-use Zone (MUZ), Commercial 1 (C1Z) and Commercial 2 (C2Z).

The relevant planning scheme for the site and surrounds is shown in Appendix B.

4.0 DEVELOPMENT DESCRIPTION

The development will include seven (7) levels of commercial space plus roof terrace areas and communal spaces for tenants including a Theatrette at ground/level 1.

A basement level will also be included which houses core amenities and end of trip facilities.

The Ground Level layout is shown in Figure 2.

At this stage the size and type of external plant proposed at roof levels is unknown but is expected to include a small chiller, condensing units, air-handling units and exhaust fans.

5.0 EXISTING NOISE ENVIRONMENT

At the time of writing, it was not possible to undertake a detailed background noise survey at the site due to Covid-19 restrictions. Therefore, this assessment has been based on background noise measurements previously undertaken by MDA in the vicinity of the site. This is expected to be representative of the site and could be supplemented by further measurements at a later stage if required.

MDA has previously conducted attended background noise level measurements at 94 Cambridge Street, Collingwood on 20 November 2019 and 28 November 2019, approximately 150 m to the east of the subject site. The measured background noise levels are detailed in Table 2.

Given the proximity of Smith Street to the subject site at 6-10 Peel Street, It is expected that the background noise levels detailed in Table 2 are potentially conservative given the closer proximity of Smith Street to the subject site compared to that at 94 Cambridge Street. (i.e. a higher background noise level would result in a higher noise limit).

6.0 ENVIRONMENTAL NOISE CONTROL LEGISLATION, GUIDELINES AND STANDARDS

Noise emissions from the site have the potential to impact on the adjacent residential property and must comply with the requirements of State Environment Protection Policy (Control of Noise from Commerce, Industry and Trade) No. N-1 (SEPP N-1).

We have considered that noise from staff on the outdoor terraces could have the potential to impact on the adjacent residential properties. However, the terraces will only be accessed during normal office hours, by staff of the commercial tenants.

6.1 SEPP N-1

Within the Melbourne metropolitan area, noise from commercial activity, air-conditioning, ventilation, exhaust and refrigeration equipment from commercial premises is governed by State Environment Protection Policy (Control of Noise from Commerce, Industry and Trade) No. N-1 (SEPP N-1).

Compliance with SEPP N-1 is mandatory for all commercial premises in the Melbourne metropolitan area under section 46 of the Environment Protection Act 1970 (Act).

SEPP N-1 separates the day into three different time periods - day, evening and night which are defined in Table 3.

The SEPP N-1 noise limits for the proposed development site have been calculated in accordance with SEPP N-1 and are provided in Table 4. The noise limits are based on measured background noise levels in the vicinity of the site and zoning levels calculated from the latest City of Yarra Planning Scheme.

Compliance with the SEPP N-1 night-time noise limit will ensure compliance with the noise limits during the day and evening periods, however there may be some plant items that are only required to operate during normal office hours.

SEPP N-1 also includes corrections that apply to special audible character such as tonality, impulsiveness and intermittency.

6.2 Sleep disturbance

The Department of Environment, Climate Change and Water NSW published the NSW Road Noise Policy in March 2011, which compares a number of sleep disturbance criteria and states the following:

• Maximum internal noise levels below 50–55dB(A) are unlikely to awaken people from sleep.

• A noise level of 75-80dBA for one or two events per night is not anticipated to affect health and wellbeing significantly.

An open window provides an outside to inside noise reduction of approximately 10 dB. Based on these NSW EPA findings, a noise level of 60-65 dB outside an open bedroom window would be unlikely to cause awakening reactions.

Sleep Disturbance criteria would apply to noise from voices on the terrace between 2200-0700 hrs. It is expected that use of the terraces would be limited to building occupants and would not extend into the night period.

There is no on-site vehicle parking, therefore a sleep disturbance assessment of vehicle movements is not required.

6.3 Music noise control

Although primarily a commercial building, music and audio-visual noise associated with the theatrette has the potential to impact on the adjoining residential properties.

Music noise emissions from the site would be controlled by State Environment Protection Policy (Control of Music Noise from Public Premises) No. N-2 (SEPP N-2).

6.4 Industrial waste collection

EPA (Vic) Publication No. 1254, Noise Control Guidelines (Guidelines) provides the following recommendations for industrial waste collections:

• Refuse bins should be located at sites that provide minimal annoyance to residential premises

• Compaction should be carried out while the vehicle is moving

• Bottles should not be broken up at the collection site

• Routes which service predominantly residential areas should be altered regularly to reduce early morning disturbances

• Noisy verbal communication between operators should be avoided where possible.

The Guidelines recommend that collections should be restricted to the following times:

One collection per week

6:30 am-8 pm Monday to Saturday

9 am-8 pm Sunday and Public Holidays

Two or more collections per week

7 am-8pm Monday to Saturday

9 am-8 pm Sunday and Public Holidays.

We recommend that waste collections by private services at the proposed site should adhere to the recommendations and times provided in the Guidelines, outlined above.

7.0 PLANT NOISE CONTROL

As detailed above, noise from commercial plant must comply with the requirements of SEPP N-1.

A roof-top plant deck is proposed as shown in Figure 5 and we have assumed that a chiller, condensing units, air-handling units and exhaust fans may be included.

Specific details of the mechanical services equipment are not available at this time and would be determined in detail post-consent.

However, with appropriate equipment selection and positioning, the SEPP N-1 noise limits are expected to be achieved with practicable and readily available noise control treatments, which may include acoustic screens and ducted attenuators. Additionally, management controls such as limiting the operation of certain plant items during the night period may also be required.

8.0 ROOF TERRACES

As detailed above, external roof terrace areas are proposed at Level 3 and Level 6.

The roof terraces will only be accessed during normal office hours, by staff of the commercial tenants. On this basis the potential noise impact is considered minimal and could be ameliorated with managerial controls if required.

9.0 MUSIC NOISE CONTROL

The provision of music noise at the site is not expected to be a fundamental use. However, music noise associated with Audio-visual presentations in the Theatrette may have the potential to impact on the adjoining residential properties.

It is expected that noise breakout from the Theatrette can be adequately controlled by the provision of appropriate glazing and facade construction and management controls. These treatments can be determined during the Detailed Design stage of the project.

10.0 CONCLUSION

It is proposed to construct a boutique commercial development at 6-10 Peel Street, Collingwood. The development will include seven (7) levels of commercial space plus roof terrace and communal spaces for tenants including a Theatrette at ground level.

Marshall Day Acoustics Pty Ltd (MDA) has been commissioned to prepare a noise impact assessment report for the proposed development for submission to council to address the above requirement.

Design criteria have been developed taking into consideration the requirements of the applicable State Environment Protection Policies and relevant guidelines.

MDA has undertaken a preliminary assessment of the proposed plant location and it is expected that noise from roof-top plant can achieve the applicable noise limits with appropriate equipment placement and selection and the inclusion of practicable and readily available noise control treatment. Additionally, management controls such as limiting the operation of certain plant items during the night period may also be required.

Music noise associated with the Theatrette can be adequately controlled with appropriate design of glazing and building facade.

The roof terraces will only be accessed during normal office hours, by staff of the commercial tenants. On this basis the potential noise impact is considered minimal and could be ameliorated with managerial controls if required.

Waste collection should be undertaken in accordance with EPA (Vic) Publication No. 1254, Noise Control Guidelines (Guidelines).

In summary it is expected that noise emissions from the site can be controlled with careful design and conventional and readily available acoustic treatments.

APPENDIX A GLOSSARY OF TERMINOLOGY

dB Decibel The unit of sound level.

A-weighting The process by which noise levels are corrected to account for the frequency response of the human ear.

Hertz (Hz) Vibration can occur over a range of frequencies extending from the very low, such as the rumble of thunder, up to the very high such as the crash of cymbals. The frequency of vibration and sound is measured in hertz (Hz). Once hertz is one cycle per second. Structural Vibration is generally measured over the frequency range from 1 Hz to 500 Hz (0.5 kHz).

LA90 The A-weighted noise level equalled or exceeded for 90% of the measurement period. This is commonly referred to as the background noise level.

LAeq The equivalent continuous (time-averaged) A-weighted sound level. This is commonly referred to as the average noise level.

LAmax The A-weighted maximum noise level. The highest noise level which occurs during the measurement period.

Leff The effective noise level of commercial or industrial noise determined in accordance with State Environment Protection Policy (Control of Noise from Commerce, Industry and Trade) No. N-1 (SEPP N-1). This is the LAeq noise level over a half-hour period, adjusted for the character of the noise. Adjustments are made for tonality, intermittency and impulsiveness.

Octave band Sound, which can occur over a range of frequencies, may be divided into octave bands for analysis. The audible frequency range is generally divided into 7 octave bands. The octave band frequencies are 63 Hz, 125 Hz, 250 Hz, 500 Hz, 1 kHz, 2 kHz and 4 kHz.
