Mitigation - Where unavoidable construction impacts to the environment occur,

mitigation is the action to replace the loss of wetland and aquatic resource

functions in a watershed.

Projects to provide mitigation may also be required for non-wetland habitat

such as dry bottomland hardwood forests.

Compensatory mitigation, refers to the restoration, establishment,

enhancement, or in certain circumstances preservation of wetlands,

streams or other aquatic resources for the purpose of offsetting

unavoidable adverse impacts.

Habitat being mitigated for through mitigation banks or acquisition of real

estate and construction of mitigation are as follows: Bottomland Hardwood

– Dry & Wet; Fresh and Intermediate Marsh; and Brackish Marsh.

Water Resources Development Act (WRDA) 1986, Section 906, as amended

• Mitigation is a project feature of the Lake Pontchartrain and Vicinity (LPV) project.

• LPV was authorized by the Flood Control Act of 1965.

Additional applicable authorities are:

• Public Law (PL) 84-99: emergency repairs performed by Task Force Guardian;

• 3rd Supplemental, PL 109-148;

• 4th Supplemental Inner Harbor Navigation Canal (IHNC) work, PL 109-234.
