AGENDA POINT No. 03 : REVISION OF CHARGES FOR PLYING PRIVATE BUSES IN WELLINGTON CANTONMENT

Ref: 1. CBR No.7 dated 20.08.2009. 2. Test audit objection dated 02.02.2021.

To consider and revise the road maintenance charges levied on private buses plying in

Wellington Cantonment area.

Relevant papers are placed on the table.

Note: The Wellington Cantonment Board is collecting plying charges for mini buses utilising the route within Wellington Cantonment limit as resolved by the Board vide CBR No.7 dated 20.08.2009 (i.e) Rs. 15,000/- and the same have not been revised till date. In this regard, audit authorities are also insisting to revise the same. If the same has to be adhered, the Board must increase the charges. However, when compared to the adjoining municipality the present charge is comparatively high. Hence, the matter is referred to the Board for its consideration.

RESOLUTION No. 3: Considered and decided to revise the annual charges to Rs.18,000/- from the existing rates of Rs.15,000/- with effect from 01.04.2021 keeping in view the Covid-19 pandeID;iC ~ation.

AGENDA POINT No. 04: BUILDING APPLICATION

To consider and approve the building application received through mobile application vide No.BAP2000043 dated 23.02.2021 from Shri. A. Selvan, D.No. 111/387, Mountain Dew Colony, Wellington for proposed construction of RCC retaining wall and compound wall in GLRS No.298 part. The land in question is classified as B-2 patta and falls outside civil area. As per Section 238 of Cantonments Act, 2006, the Board is the competent authority to sanction or refuse the building plan.

Cantonment Engineer's Report: The above building application is in conformity with the requirements of the building bye-laws except building byelaws No.8 namely that 10 feet shall be left all round the building. It also fulfils the FSI restrictions imposed by the GOC-in-Chief, HQ, SC, Pune. There is no unauthorized construction and encroachment involved in the adjoining

defence land, in the above case.

RESOLUTION No.04: Considered and approved. The Board resolved to sanction the building applications without prejudice to civil rights and subject to Rules, Regulations and building bye-laws of the Board and also the FSI restrictions imposed by the General Officer Commanding - in - Chief, SC, Pune.

The sanction is available for two years from the date of sanction and the construction should be commenced within one year from the date of sanction. The sanctioned plan should be adhered to in every respect and no deviation without prior sanction be made failing which the appropriate action shall be initiated by the competent authority. ·· /'

AGENDA POINT No. 05: BUILDING APPLICATION

Mahendran, II/542, Cattle pound road, Boys company, Wellington for proposed construction of residential building and RCC ring well in GLRS No.289 part. The land in question is classified as B-2 patta and falls outside civil area.

As per Section 238 of Cantonments Act, 2006, the Board is the competent authority to sanction or refuse the building plan.

The Board decided to waive the condition imposed by building bye-laws No. 8 owing to paucity of land available in a hilly terrain such as Wellington. The power to waive the said condition under such circumstances rests with the Board as per provisions of building bye-law no. 8.

AGENDA POINT No.06: MONITORING OF DEVELOPMENT WORKS

Ref: CBR No. 16 dated 21.12.2016 CBR No. 12 dated 04.08.2018

To consider the necessity of engaging a technical evaluator to check the quality of work as per the direction of the PDDE, SC, Pune and as per existing protocol

Note: As per the direction of the PDDE, SC, Pune vide letter No. 8078/Budget/Cantt/ Gen/Vol.III/DE, dated 24.08.2016 for engaging a technical evaluator either from Central or State government agency to check the quality of work, for which the Board vide CBR 16 dated 21.12.2016 engaged M/s. Certification Engineers International Ltd., 17/2, Indra Colony, Behind Udhayam Theater, Chennai - 600 083 which is a Government of India undertaking and a subsidiary agency of Engineers India Limited to monitor the various works of Cantonment Board, Wellington. Since the Board has decided to execute the M&R works, it is decided to engage Mis. CEIL, Chennai to monitor the various works of Cantonment Board, Wellington. The same was also intimated to the PDDE, SC, Pune vide letter No. MOW/76/Engg dated 29.12.2016.

Hence the matter is placed before the Board for consideration.

RESOLUTION No.06: Considered and approved the services of Mis. CEIL, Chennai as third party supervisor on payment of 0.9% (without GST) of actual cost incurred for all M&R works for the current financial years as well as the ensuing financial years as being done during the previous years in case of M & R works and STP project. The rate earlier approved in within the CPW,P' norms.

AGENDA POINT No. 07: SUBMISSION OF BILL BY PMC REGARDING

Ref: Mis. YECPL letter No. YECPL/WCB/24 dated 14.02.2020.

To consider the bill submitted by Mis. YECPL, Navi Mumbai who has been engaged has

project management consultancy for the STP project.

Note: This office has engaged Project Management Consultancy for the STP project after following due process. Accordingly, work order has been issued to Mis. Yash Engineering Consultants Private Ltd., Navi Mumbai vide letter No. Spl.Grant-in-Aid/WTN/STP/289/Engg dated 29.05.2017 who was LI. The contract period was two years from 29.05.2017. The contractor of the STP project has delayed the commencement of the project which was awarded vide letter No.STPNol-I/107/Engg dated 05.03.2019 due to certain issues which was already known by the Board. The Board vide CBR No.1 dated 01.02.2020 have sorted out all the issues. In accordance to the Board resolution the contract have now commenced the project.

In this regard, the PMC has submitted requisition vide letter referred (1) above requesting this office to extend the contract period as per the provisions made in the agreement. Further, the firm has also raised additional bill amounting to Rs. 5,60,000/- towards consultancy charges carried out for 9 months i.e., after lapse of the contract period. The matter was also discussed with the Test Audit authorities during the discussion they have questioned the reasonability for their claim. On perusal of the bills, the claim could not be justified as per the tender schedule.

Hence, the matter is placed before the Board for consideration

RESOLUTION No.07: Considered and approved the requisition submitted by the PMC for extension of the contract period as per the provisions made in the agreement. Further, Board resolved to forward the same to the third party supervisors for consideration of the justification submitted by the PMC. The CEO also informed the Board that the GE, Wellington had been requested for his comments but a reply on the same was awaited. On receipt of confirmation of justification from the third party supervisors, necessary payment could be}'ti'ade if deemed fit

AGENDA POINT No. 08: UNAUTHORISED CONSTRUCTION MADE BY SHRI. J. KRISHNAMURTHY (OCCUPIER), HOSPITAL STREET, WELLINGTON - APPEAL UNDER SECTION 340 OF CANTONMENTS ACT, 2006

To note and consider the appeal submitted by Shri. J. Krishnamurthy, 3/343, Hospital Street, vide his appeal dated 12.02.2021 (wrongly mentioned as 12.02.20)

Note: It has been reported by the Cantonment Engineer that Shri. J. Krishnamurthy, Hospital Street has constructed unauthorisedlly a building covering the tiled roofing with zinc sheets,

superstructure by solid block masonry in cement mortar, flooring PCC and foundation RR masonry on other three sides connecting the existing building. Accordingly, the site has been inspected and found that the individuals have made an unauthorized construction to an extent of

428 Sq.ft. The land in question is classified B-2 patta and falls outside civil area bearing GLRS No. 92 (part). The matter has been referred to the Board to issue notice for demolition & the Board vide CBR No. 13 dated 19.11.2020 has deferred the subject matter to the subsequent Board meeting informing the Board that the same will be considered after carrying out site inspection by the committee appointed by the Board vide CBR No. 05 dated 19.11.2020.

Based on the above, the site has been inspected by the committee on 08.12.2020 and it

was confirmed that an unauthorized construction exists on site. The matter has once again been

referred to the Board and the Board vide CBR No. 02 dated 18.12.2020 considered and resolved to issue notice under section 248 and section 320 (in case the person not addressing the matter within the stipulated time) of the Cantonments Act, 2006. Accordingly, notice under section 248 of Cantonments Act, 2006 has been issued vide this office letter No. UAC/JK/249/Engg dated

12.01.2021. In response, the individual had submitted an appeal vide his application dated 12.02.2021. Hence the matter is placed before the Board for taking further course of action.

RESOLUTION No.08: Considered and resolved to forward the appeal submitted by the individual to the GOC-in-Chief, SC, Pune who is the competent authority to hear the appeal as per the provisions of Cantonments Act, 2006.

AGENDA POINT No.09: FRANCHISING OF INDOOR STADIUM SITUATED AT CANTONMENT PLAYGROUND WELLINGTON

To consider and approve to franchise the indoor stadium situated at Cantonment playground, Wellington.

Note: The Cantonment Board has erected an indoor stadium during the year 2012-2013. Further, due to increase of student's strength in the Cantonment school, the indoor stadium was utilized for accommodating the primary section temporarily. At present, the indoor stadium is lying vacant due to shifting of school children to existing school. Based on the request made by Vice President and Elected Members during the meeting held on 02.11.2020, the PCB instructed to prepare the indoor stadium for use by general public. Accordingly, the same was restored for use. Hence, it is suggested that the same be outsourced with the condition that the outsourcing agency should collect the minimum charges to be fixed the Board. In this regard, it is suggested that the outsourcing agency should maintain the court including provision of Net facility, electrical facility including maintenance of court paintings etc., along with applicable prevention measures to maintain the social distance due to COVID -19. Applicable fee may be fixed as Rs. 300/- per month. The tender document in respect of the same is placed before the Board for its consideration and approval.

RESOLUTION No.09: Considered and approved to outsource the indoor stadium to collect a sum of Rs. 200/- per person/month (Students) as maximum fee (excluding GST) and Rs. 350/- (excluding GST) as one time registration fee (non- refundable) by the highest bidder from the participants & a sum of Rs. 400/- per person/month (Non Students) as maximum fee (excluding GST) and Rs. 700/- (excluding GST) as one time registration fee (non- refundable) by the highest bidder from the participants as is being collected by the Sports Development Authority of Tamil Nadu, The Nilgiris unit at Indoor stadium, Ottupatarai. The PCB sought clarification regarding anticipated number of participants and also advised to make a proper agreement for the subject matter including maintenance of the Board's property. The CEO informed the Board that the anticipated number of participants would be ~po/oximately 50 per day.

AGENDA POINT No.10: FRANCHISING OF MONTHLY MARKET TWICE A MONTH AT CANTONMENT PLAY GROUND AT WELLINGTON

Ref: CBRNo. 16 dated 31.01.2018

To consider and approve to franchise the monthly market to be conducted twice a month on every 2nd Sunday and 41 Sunday of a month at Cantonment play ground at Wellington bazaar.

Note: The Board vide CBR referred above has approved for franchising of monthly market being held every month on the second Sunday at Cantonment Board play ground at Wellington Bazaar for the period from 01.02.2019 to 31.03.2021. However, due to the lockdown and precautionary measures to avoid transmission of COVID-19, this office had intimated the firm to stop the second Sunday market vide this office letter No. Monthly Market/65/Engg dated 30.03.2020 till further orders. In this regard, due to relaxations of lockdown, this office intimated the firm to submit their willingness to conduct the monthly market by following the due procedures imposed by the State/Central Government vide this office letter No. Monthly Market/70/Engg dated 03.11.2020. In turn, the firm intimated that by following the COVID-19 precautionary measures they are able to allot only 50% of shops and willing to pay only 50% of amount to the Cantonment Board. However, this office intimated that 50% of payment is not allowed as per the agreement vide this office letter No. Monthly Market/75/Engg dated 06.11.2020.

Further, it is informed that the franchising period is expiring on 31.03.2021. Hence, it is suggested to conduct the market twice a month i.e., on 2nd Sunday and 4th Sunday of every month to generate the revenue for the Board as well as regulating the movement of public by keeping in view of the COVID-19 situation. If agreed, a tender will be floated in the e­procurement website. The tender document is placed before the Board for its consideration and approval.

RESOLUTION No.10: Considered and approved to float the tender, in order to generate more revenue to the Board. Necessary clauses be included in the tender schedule mentioning that the rate should be called for per Sunday market and also to follow the SOP of the Covid-19 issued bf the Central I State Government from time to time.

AGENDA POINT No.11: UNAUTHORISED CONSTRUCTION

To note the unauthorized construction made by Smt. Prema (Occupier), property stands in the name of Smt. Soosaimary, Malayappan Cottage, Wellington in GLRS No. 160(part) to an extent of 601.97 sq.ft, land classified as B-2 stream land and to decide upon the further course of action.

Note: The individual has made unauthorized construction for which this office had issued show cause notice. As per the provisions of section 248 of Cantonments Act, 2006, the Board is the competent authority to issue notice for demolition. In case the individual further fail to comply with the same, the Board may approve the issue of notices under section 320 of Cantonments Act, 2006 for demolishing of the unauthorized construction.

RESOLUTION No.11: Considered and approved to issue notice under section 248 and in case of failure, notice under section 320 of the Cantonments Act, 2006 to the defaulter.

AGENDA POINT No.12: RE-AUCTIONING OF CANTONMENT BOARD STALLS

To note the action taken by this office to re-auction the vacant stalls and not taken by the successful bidders (highest and Second highest bidder) situated at opposite to MRC gate and Woodyard, Barracks.

Note: This office has proposed to re-auction the stalls which are vacant and not taken by the successful bidders (highest and Second highest bidder), accordingly public notice has been prepared to publish in e-portal for inviting tenders. However, since the MCC has come in force, the Cantonment Board Wellington has requested the District Collector, Udhagamandalam to advice whether the re-auction can be published or to be postponed till the announcement of result of the assembly Election of Tamil Nadu 2021. In this regard, it has been informed by the District Collector, Udhagamandalam, during the discussion held with CEO that no tenders to be published as per the MCC. Accordingly, the same will be postponed. Hence the matter is placed before the Board.

AGENDA POINT No.13: CLUBBING OF CANTONMENT BOARD SCHOOLS INTO ONE ENGLISH MEDIUM SCHOOL WITH CBSE SYLLABUS:

Ref: CBR No. 24 dated 28.12.2018 CBRNo. 17 dated09.02.2019.

To consider and decide further course of action after clubbing of Cantonment Board Schools into one English Medium school with CBSE Syllabus for providing quality education to the students of Wellington Cantonment Board residents.

Note: Keeping in view the needs of the students I parents and also with a view to provide quality and state of the art education to the Cantonment children, a Committee was formed vide this office Order No. 143 dated 28.11.2018 consisting Smt. N. Geetha Rao, Principal, Kendriya Vidyalaya, Aruvankadu as Chairperson to explore the feasibility of clubbing the Cantonment Board Schools into one school with CBSE syllabus. The clubbing of schools would help to streamline the education system of Cantonment Board schools and also help the children to have access to quality education. The report I recommendation of the Committee was placed before the Board & the Board vide CBR No. 24 dated 28.12.2018 during the due deliberation resolved to form a Committee to discuss the issue comprising of VP, CEO and Shri. R. Sivakumar, Elected Member to submit its recommendations.

The subject recommendation of the Committee was also placed before the Board & the Board vide CBR No. 17 dated 09.02.2019 approved the following:

(i) Clubbing of schools with uniform CBSE syllabus (ii) Maximum 45 no.s of students were accommodated in each section (iii) Classes from LKG to 5th std to be run in Chinna V andishola campus (iv) Classes from 6th to 10th to be run in High School campus in Wellington Bazaar (v) Tamil medium school being run in the building where the vocational training classes

are being run.

As per section 10(2) of Cantonments Act, 2006 every Board is a deemed municipality under clause (e) of Article 243P of the Constitution, the civil population of the Cantonment area is solely dependent upon the Cantonment Board for provision of municipal services, social welfare, public health, education etc., Based on the decision of the Board vide CBR No. 17 dated 09.02.2019, this office has approached the CBSE authority for obtaining affiliation for running secondary school in Wellington Cantonment area under CBSE syllabus, as per the requisition of this office the CBSE authority has granted an affiliation vide their letter No. CBSE/Affl/1980015/Govt Wing/2018/20988-90 dated 22.01.2018

Meanwhile, the CEO, Nilgiris District Educational department has inspected to our school and reported the following:-

1. The school has obtained affiliation from CBSE Board only for classes (VI to X) but the school consist of classes from LKG to X

2. Instead of the requirement of 28 class rooms only 11 class rooms are available. 3. Two staircase ways are required to go to the first floor 4. RESOLUTION No.13: Considered. The Board noted that while clubbing of schools has been a step in the right direction to provide better education to the children in Cantonment area & for streamlining the education system being followed by Cantonment Board schools, the Board noted that the huge expenditure on running of schools needs to be rationalised as well. The Board resolved that a cost benefit analysis needs to be undertaken given that providing primary education is the duty of the Board u/s 62 (xiv) & providing higher education is a discretionary function of the Board u/s 64 (v) of the Cantonments Act, 2006.

An observation regarding the subject matter has also raised by the test audit during the audit period vide Preliminary Slip No. 3 dated 21.01.2021 and the same was settled based on the detailed report given by this office.

The Board noted that even though the Tamil medium school is being provided with text books, note books and mid day meals, the Board still incurs an expenditure of Rs. 30.94 lakhs per annum which is quite cumbersome & also noted that 63% students are from outside Cantt limits.

Hence, the Board keeping in view of the above resolved that no more admissions would be permitted in the Cantonment Board High School keeping in view the vast expenditure & the provisions/duties/functions of the Board under the Cantonments Act, 2006. However, existing students be allowed to continue & complete their schooling from the Cantonment Board High School itself. The PCB also directed that a report be submitted regarding the staff engaged at the High School & efforts be made to curtail the same given the financial condition of the Board. The CEO informed that the excess teachers will be terminated based on the requirement & performance of the teachers under intimation to the Board.

The CEO also informed the Board that the office has floated a proposal & met the District Collector requesting to provide the Mid-Day Meals to children in the Cantonment Board Secondary School given their socio-economic status & the potential benefits the scheme shall have for our students. The progress of the same shall be notified to the Board.

The Board also noted that vide CBR No. 17 dated 09.02.2019 has decided to collect the Annual development fee of Rs.3000/- per child for classes LKG to Class V and Rs.4500/- per child for class VI to X from the children who are residing outside Cantonment limits. Further, they would be required to bear the expenses of uniforms, text books and note books as per actuals. Based on the approval of the Board a sum of Rs.23.41 Lakhs has been collected during the year 2019-2020 from the above said students.

The CEO has also explained the discussion between the CEO and the HMs, Cantonment Engineer, Office Superintendent regarding the points raised by the Chief Educational Officer. During the discussion, the HMs informed that the affiliation for conducting classes from I to X has already been obtained from the CBSE authority vide their letter No. CBSE I AffI I 1980015/Govt Wing I 2018 I 20988-90 dated 22.01.2018. It was also discussed that construction of additional class rooms could only be done as per the sanction of the MoD received under special grant-in-aid. It was also discussed that proper permission from the CBSE authorities be obtained for running the Primary section classes from LKG to V in the building located at Wellington Bazaar and the Secondary section classes from VI to X in the building located at Chinna Banishola. The other inputs regarding construction of additional staircase, additional toilets, ramps in class rooms and toilets for physically challenged students and Compound will be executed based on the availability of funds and budget sanction, which was agreed by the Board. • Delay in procurement of materials due to COVID - 19 & since this office issued

work orders only towards the end of the financial year when it was confirmed that funds would be available to expend for development works

• Huge quantum of works involved

• Shortage of manpower due to COVID - 19

• Due to heavy demand in river sand

After due deliberation, it was resolved that if the contractors are willing to extend the period of contract at the same rate, the remaining works could be completed by extending the time period during next financial year 2021-2022 keeping in view public interest.
