NDMC seeks police permission forAAP rally in Connaught PlaceNEW DELHI

With AAP set to hold a rally in Connaught Place'sCentral Park tomorrow, the NDMC today said it is mak-ing preparations and has approached Delhi Police forpermission and security arrangements for the event.

While police had earlier said that the request for secu-rity arrangements should have been made by the Delhigovernment and not through NDMC, it maintainedtoday that the permission is under process.

"After receiving a communication from DelhiGovernment we had written to DCP New Delhi regard-ing a NOC for the event and making necessary requiredarrangements to which they had replied that since it is aDelhi Government function, it should have been com-municated directly to police rather than routing throughNDMC," a senior civic body official said.

NDMC, however, communicated to police that sever-al functions have beem organised in past in the CentralPark following a similar procedure.

"Police then asked us for more details regarding thenumber of people attending, the media arrangements,parking facility needed, among other things. We sent thedetails today afternoon to them and they are working onthe same," the official added.

When asked about whether a permission has beengiven for the event, Vijay Singh, DCP New Delhi said,"The event is tomorrow and there is enough time. Theprocess is on."

Delhi Government has planned a mega event atCentral Park tomorrow where the entire Delhi Cabinetwill be present to highlight its achievements during last100 days before the public.

The NDMC official reiterated that these are routinematters and should not be seen in any negative light.

"All these are routine matters. The communicationsregarding preparations of such events should not beseen in any negative light," the official said.

Sisodia orders inspection of swim-ming pools in DelhiNEW DELHI

Delhi Deputy Chief Minister Manish Sisodia onSunday ordered inspection of all swimming pools in thenational capital, after a 13-year-old boy drowned in theswimming pool of a government school here.

"Inspect each and every swimming pool in Delhi,"Sisodia said, adding that the direction applies to bothgovernment and non-government swimming pools.

The Deputy Chief Minister, in a tweet, said theDistrict Magistrate (DM) and the Sub-DivisionalMagistrate (SDM) of the area will carry out the inspec-tion work.

Sisodia's decision came after Mukul Sharma, a Class-VIII student of DAV Public School in Dayanand Vihar,drowned in the swimming pool of a government schoolin East Delhi's Farsh Bazar area here.

The boy had gone to Delhi government-run BabuRam School to learn swimming along with his cousinVikas on May 22 when the incident took place.

Police have registered a case against the life guardspresent at the swimming pool for alleged negligence,which they said led to the boy's death.

"We have registered a case under Section 304(A)against two life guards - Bhaskar Kaushik and JaiSingh. Further investigations are underway," the policehad said.

Plans for 16-lane road to decongestDelhi trafficNEW DELHI

Plans are on the anvil for a Rs 5,000 crore 16-laneroad connecting Delhi with Ghaziabad and Noida on theoutskirts in a major bid to ease traffic congestion in thecapital.

A plan is also in the works to build a Rs 6,000 croreEastern Peripheral Expressway to provide signal-freeconnectivity between the national capital and neigh-bouring towns, says Union Minister Nitin Gadkari.

The work on the project for widening of NH-24 up toDasna in Uttar Pradesh (UP) to 16-lanes as part of theDelhi-Meerut Expressway package, will begin in threemonths.

"We are making a 16-lane highway on NH 24 fromnear ITO till Dasna. This will also ease traffic jams inDelhi and it will pass through the Akshardham temple.The work will start on this project in 3 months," RoadTransport, Highways and Shipping Minister Gadkaritold PTI in an interview.

The cost of the project could be in the range of Rs4,000 to Rs 5,000 crore, he added.

The widening of the road will start from near theYamuna Bridge on NH 24. The carriage way will go upto Dasna via UP-Delhi border and eventually tillMeerut, an official said.

The 16-lane project would include 6-lanes as express-way, which means it will be an access-controlled high-way.

The party legislatureswent into a huddle with thetop leadership in thisregard at Chief MinisterArvind Kejriwal's resi-dence here ahead of thetwo-day long 'emergency'session of Delhi Assemblystarting Tuesday and criti-cised the "infringement"on their rights.

Although the MLAsrefused to come on recordon whether the partywould move a resolutioncondemning the Centre'smove, sources indicatedsuch a step was likely to betaken.

The party has also keptthe legal route open asconfirmed by MLA AlkaLamba, who said, "If the

Assembly decides to go tocourt we would go to thecourt". "You can't run anelected governmentthrough the back doorusing the LG," she added.

Terming Assembly asthe "temple of democra-cy", AAP's Dwarka MLAAdarsh Shastri alleged,"BJP government is tryingto infringe on that rightand it is a violation of thesanctity of federal struc-ture by design."

In the meeting that lastedfor around an hour, theMLAs demanded that theybe given the chance tospeak individually on theMHA notification thatgives absolute powers tothe LG in appointment ofbureaucrats and issues ofpolice and publicorder.

"The Constitution doesnot give any power totransfer or appoint even aclerk to the Centre so theyhad to take the route ofissuing a notification. Ifthe CM does not have theright to appoint or sus-pend, then how is an elect-ed Government of Delhisupposed to fight corruptofficials?" ChandniChowk MLA Lambaasked.

Led by Kirori SinghBainsla, who had spear-headed a similar agitationin 2008, Gujjars assembledat Sikandara in Dausa earlythis morning to pay hom-age to 21 people who werekilled on the same day in2008 during the violentagitation.

members blocked the high-way at Sikandara. TheSawaimadhopur-Sheopurstate highway in Khandararea of Sawaimadhopurdistrict was also blockedlate last night where theGujjars are squatting,police said.

Traffic on both the high-ways has been diverted toother roads and police hasbeen deployed around thearea to maintain law andorder, police added.

"Several hundred peopleblocked the highway atSikandara this morningwhile the Sawaimadhopur-Sheopur state highway isalso blocked since lastnight," the police said.

As a last-minute effort, "I asked theHome Minister whether he was surethat nothing could be done," MrAbdullah sad. "He said no, as thepapers had been signed and the war-rant issued."

The Congress rejected the claims,with Mr Shinde saying Guru nothanged for political reasons.

Mr Abdullah said he had not com-mented on the matter so far as hewished to see how the UPA govern-ment handled the cases of assassinsof Rajiv Gandhi and Beant Singh. "Ihave seen other cases. Look how they

The plan to move Futenma, firstmooted in 1996, has become thefocus of anger among locals, whoinsist it should be shuttered and areplacement built elsewhere in Japanor overseas.

But both Tokyo and Washingtonhave repeatedly backed the plan,with Prime Minister Shinzo Abe lastmonth insisting it was "the only solu-tion".

The protestors on Sunday also

expressed opposition to Washington'sscheduled deployment of CV-22Osprey aircraft at US Yokota AirBase in Tokyo.

The Osprey is a hybrid aircraft withrotors that allow it to take off like ahelicopter and engines that can tiltforward, enabling it to fly like anaeroplane at greater speed than achopper.

Apart from the promise ofproviding a Congress-free India, the most fre-

quent leitmotif of Mr. Modi’selectoral campaign was that hewould usher in a new era forIndian federalism. Based on theidea that a state leader’s visionfrom below could transformIndia’s federal polity, the desireto make a perceptible if not spec-tacular change in the system ofgovernance appeared to be aconsuming passion. With oneeye on history and the other onpolitics, dramatic gestures andrhetorical flourishes havebecome a distinguishing featureof this style of governance.

Since he assumed power a yearago, most of these theatrics havebeen reserved for Indiansabroad, barring the memorableimages of Mr. Modi with his tur-ban aflutter against the backdropof the Red Fort. There heannounced the advent of a newera with the demolition of aniconic institution of theNehruvian model, the PlanningCommission. While thisannouncement was greeted withmixed feelings of regret andrelief, the crafting of its replace-ment took a full six months.When the new institution was onthe drawing board, the overrid-ing concern was that it should inno way resemble its predecessor.But that was easier said thanachieved.

Mr. Modi seeks to carve hisplace in history as the man whorighted the wrongs in history andgave back to Indians a sense ofpride in their country, a pride heclaims they did not have before.He seeks to transform Indiabeyond recognition, so that his-tory will record a ‘before’ and‘after’ so striking that the pastwould pale into insignificance.Hence, the National Institution

for Transforming India (NITI)Aayog, which is slowly unfold-ing as a half-baked clone of theinstitution it sought to replace.Visualised as a vehicle of thenew cooperative federalism, itwas initially projected as a thinktank that would shed the over-bearing financial allocations-cum-approvals role that so infu-riated Chief Ministers. What itscontribution to federalism willeventually be is still an openquestion, given its vast andvague charter. This is where theChairman’s vision comes in.

So what is Mr. Modi’s visionof federalism? On the one hand,what is projected is a patriarchaljoint family model presided overby a benevolent Centre. There isalso another model of Statescompeting to deliver better gov-ernance under a new dispensa-tion based on mutual trust andcooperation. However, Statesoften accuse the Centre of notpractising what it preaches,notably when it comes to fiscaldiscipline and downsizing gov-ernment.

Superimposed on the Aayog isa Council of Chief Ministers,akin to the NationalDevelopment Council, whichpresumably died a natural deathalong with the Commission thatwished it into existence. We nowhave a Plan (2012-17) up formid-term review. What shape ittakes in its remaining years, if itsurvives this exercise, will give aclearer picture of this newvision. Groups of ChiefMinisters are working on blue-prints for transforming India,notably with fewer centralschemes and greater autonomyfor the States.

True sharing of powers

If Mr. Modi is serious aboutcooperative federalism, there isnow a possible opening for abreakthrough in pruning centralministries, which have becomebloated on the back of central

schemes. Breaking the strangle-hold of New Delhi’s bhavans inareas where the States should beempowered will require bothvision and political will. For along time federalists have beendemanding that the Centre cutdown or totally wind up some ofthe ministries that deal with sub-jects in the State List. With fewerschemes in these areas, coopera-tive federalism demands that theresponsibility for managingthem also be shifted where itrightfully belongs, that is, theState and local levels.

It is significant that the legiti-macy of the two bodies that havebeen created to push forward thenew federalism idea is againrooted in a Union CabinetResolution rather than beinglocated in the Constitution. Theexisting and largely under-utilised Interstate Council, creat-ed under Article 263 and man-dated to deal with coordinationbetween States, has been totallyignored. This raises the questionof what the new vision of coop-erative federalism entails,beyond coordination.

Sharing of powers and respon-sibilities between the three levelsof government is a key elementof the concept, which involvesparticipative policymaking. Thisis particularly important in areasof concurrent responsibility,where the Centre has had a ten-dency to ride roughshod over theStates by occupying the commonlegislative space. A reform of theseventh schedule lists in thedirection of greater empower-ment of States would be consis-tent with the logic of increasedfinancial transfers and coopera-tive federalism. Locating theright level for making and imple-menting policy is a central fea-ture of the cooperative responsi-

bility matrix.

An idea which was added tothe initial amalgam of objectivesenunciated by Mr. Modi wascompetitive federalism, whereStates would vie with each otherto attract investments and alsohopefully provide better publicgoods and services. What hasbecome increasingly evident isthat the States are unevenlyequipped to engage in fair com-petition, since regional dispari-ties in the provision of basicneeds and social sector servicesare overwhelming. Moreover,there are vast differences in gov-ernance capabilities, and whilespecial category States, a la thePlanning Commission, may havewithered away with it, the needfor asymmetric federalismremains. Equity may not be cen-tral to the mandate of theFinance Commission, but nogovernment which espousescooperative federalism canafford to ignore it. Enhanceddevolutions across the board donot address this problem, whichrequires a new asymmetric fed-eralism framework that remainsto be defined.

As the NITI Aayog was find-ing its feet and the Union gov-ernment was preparing its firstfull budget, the 14th FinanceCommission gave a decisivepush towards greater devolutionof financial resources towardsthe States. It simultaneouslyoccupied the resource-allocationspace vacated by the PlanningCommission by transferring asubstantial portion of revenuesdirectly to the States. It thusshaped the direction in which thecentral government could nowmove towards cooperative feder-alism. However, instead of cut-ting down on its own expendi-ture, the Centre directed its axetowards key centrally sponsoredschemes in the social sector.Whether most of the States aresufficiently endowed with gov-ernance capabilities to absorband effectively spend the addi-

tional resources that have cometheir way is a moot point.Whether they will be able tokeep essential schemes runningremains also to be seen.

Respecting mandates

A key element in fosteringcooperative federalism is therespect for the mandate of elect-ed governments, even those runby opposition parties. In an erawhere the party system is frag-mented along federal lines, theneed is still felt to include Stateparties in federal coalitions, evenwhen technically not necessary.The way alliance partners aretreated thus becomes an impor-tant element in federal function-ing. A majority in Parliament isone thing; hegemony over thefederal polity quite another.

The 2014 State Assembly elec-tions showed that even long-standing allies are not immune tobeing at the receiving end ofcoercive tactics. They now seethe central majority’s expansion-ist ambitions as a threat to theirown continued existence. Underthese circumstances, cooperativefederalism with opposition-ruledStates becomes an altogethermore difficult proposition, giventhe absence of a viable workingrelationship. It was jeopardisedand poisoned at the outset by therefusal to recognise the legitima-cy of a parliamentary opposition.

Will Mr. Modi be rememberedfor the federalism he has vowedto introduce? The performancein his first year of office does nothold forth the promise of a sys-tem where power would bedevolved to the people throughan effective decentralisation anddevolution package going all theway down to local bodies of self-government. The federal princi-ple requires a genuine will toshare power, of which there islittle evidence even at the centrallevel. The ideas of partnershipand participation are crucial toits success, and concentration ofpower is the very antithesis of

Following a controversy sparked recently overremarks by some Members of Parliament on tobaccouse, a group of leading film-makers is seeking to

dilute the strong tobacco control measures undertaken bysuccessive governments. The film-makers have made a rep-resentation to the Information and Broadcasting Ministry towithdraw the stipulation that cinemas run a warning scrollwhenever smoking scenes appear on screen. The argumentthat showing the scrolls in the manner it is done affects thecreativity of the scenes is at best specious. Appearing at thebottom of the screen, the warning does not in any way affectany aspect of creativity. The World Health Organization hasstated that the “implementation of a comprehensive ban ontobacco advertising and promotion should not prevent legit-imate artistic expression”. But that cannot be an argumentagainst the use of the warning scrolls during smokingscenes. In a draft bill introduced in January 2015, the gov-ernment had proposed a few important measures to preventchildren from taking up smoking. One of them is to ban thedisplay of tobacco products at the entrance to or inside ashop. After all, much like banning tobacco advertisement inany form and other promotional activities by tobacco com-panies, removing tobacco products from plain view canhelp a lot in reducing their use by children. While it may bedifficult to enforce such a ban, that is not so for the warningscrolls in movies. There is a body of evidence to show thatwatching movies that have smoking scenes produces astrong impact on young and impressionable minds, encour-aging them to try out smoking. The U.S. Surgeon General’sReport of 2012 has made it clear that rating movies withsmoking scenes as ‘R’ (restricted) would lead to a reductionin smoking among the youth. Last year the SurgeonGeneral’s Report went a step further and said an 18 per centdrop in the rate of smoking by the youth could be effectedif all movies classified as ‘PG-13’ (parents strongly cau-tioned that some material may be inappropriate for childrenunder 13 years) eliminated smoking scenes. Even if thegovernment does not propose such laws, the least it coulddo is to maintain the status quo and not succumb to pressureon this count. The warning scroll is an effective way ofcommunicating the dangers of smoking and improvingawareness in general about the hazards of smoking. Thegovernment’s commitment to waging war against tobaccouse took a severe beating when it failed to introduce picto-rial warnings in an effective size on tobacco product pack-aging. Those in the 15-24 year group account for over 27per cent of tobacco consumption in India; withdrawing thestipulation to display the warning message will inevitablyincrease that proportion.

The tussle between the DelhiChief Minister, ArvindKejriwal and Delhi

Lieutenant Governor, Najeeb Jung,much in the news, raises several con-stitutional and legal issues on thescope and extent of their powers inthe National Capital Territory (NCT)of Delhi. The stand-off, especiallyover control of key bureaucraticappointments, was sparked by Mr.Jung’s appointment of IAS officerMs Shakuntala Gamlin as actingChief Secretary. This was opposedby Mr. Kejriwal on grounds that itfell beyond the scope of theLieutenant Governor’s powers to doso without the aid and advice of theMinisters.

A Home Ministry notificationissued by the Centre on Thursdaytilts the balance more in favour of theLieutenant Governor, indirectlyexpanding its own powers in theregion. Although the dispute iscoloured by highly partisan politicalcontestations, the issue is more amatter of constitutional and statutoryinterpretation.

The relevant laws

The laws relevant to understandingthe relation between the LieutenantGovernor and the Chief Minister inDelhi are Article 239AA of theConstitution, the Government ofNational Capital Territory of DelhiAct, 1991 (GNCT Act), the rules for-mulated under this Act (Transactionof Business Rules), and the relevantjudicial pronouncements. It needs tobe said that the precise contours ofthe sharing of powers between theLieutenant Governor and the Delhigovernment are a grey area. Yet, areasonable case may be made to sug-gest that the Lieutenant Governor’sdiscretionary powers do not extendto the appointment of the Chief

Secretary without the “aid andadvice” of the Chief Minister and hisCouncil of Ministers. Further, it willbe argued that the Home Ministrynotification may not stand the test ofconstitutionality, being ultra vires ofArticle 239AA of the Constitution.

As far as States are concerned, theChief Secretary is appointed by theChief Minister and the Ministers.The reasoning for this can be foundin these landmark Supreme Courtjudgments. E.P. Royappa (1974)states that “The post of ChiefSecretary is a highly sensitivepost…[Chief Secretary is a] lynch-pin in the administration and smoothfunctioning of the administrationrequires that there should be com-plete rapport and understandingbetween the Chief Secretary and theChief Minister. …” Similarly, SalilSabhlok (2013) says: “it may be nec-essary for [the] Chief Minister of aState to appoint a ‘suitable’ person asa Chief Secretary or the DirectorGeneral of Police…because both theState Government or the ChiefMinister and the appointee share asimilar vision of the administrativegoals and requirements of the State.The underlying premise also is thatthe State Government or the ChiefMinister has confidence that theappointee will deliver the goods, as itwere, and both are administrativelyquite compatible with each other. Ifthere is a loss of confidence or thecompatibility comes to an end…”These precedents clarify the ration-ale that the Chief Minister ought tohave the discretion to appoint ChiefSecretaries in the interest of asmooth functioning representativegovernment.

Delhi’s peculiar nature

While this justification for theChief Minister to appoint the ChiefSecretary may hold good for States,is it the same for Delhi? Delhi is a

peculiar case, neither being a State,nor a Union Territory. So, Article239, which deals with UnionTerritories, does not apply to Delhi.Instead, Delhi is governed byArticles 239AA and 239AB, intro-duced by a constitutional amendmentin 1991. The problem with the HomeMinistry notification is that while itconflates Delhi as a Union Territoryto suit its own interests, at othertimes, it treats it as a State. The cru-cial constitutional provision relevantto the issue is Article 239AA(4)which says: “There shall be aCouncil of Ministers…in theLegislative Assembly, with the ChiefMinister at the head to aid and advisethe Lieutenant Governor in the exer-cise of his functions in relation tomatters with respect to which theLegislative Assembly has power tomake laws, except in so far as he is,by or under any law, required to actin his discretion.” Two conclusionscan be drawn from reading the provi-sion: (a) the Lieutenant Governorwill have to take decisions basedonly on the “aid and advice” of theChief Minister in exercise of all mat-ters on which the LegislativeAssembly has power to make laws.Consequently, the LegislativeAssembly of Delhi has the power tomake laws on all matters in the StateList and the Concurrent List in theVIIth Schedule of the Constitution,except entries related to public order,police and land. (See, Article239AA(3)); and conclusion (b) theLieutenant Governor can act at hisown discretion only when there is aspecific law conferring this discre-tion on him. Section 41 of GNCT Actdeals with the discretionary powersof the Lieutenant Governor. There isno such law granting discretion tothe Lieutenant Governor for makingsuch appointments currently.

Based on these two conclusions,the question is this: whether theappointment of the Chief Secretary

falls under conclusion (a) whereinthe Lieutenant Governor appointsthe Chief Secretary on the “aid andadvice of [the] CM”; or conclusion(b) wherein the Lieutenant Governorappoints, at his own discretion, theChief Secretary, granted by a specif-ic law. The second conclusion isclearly not applicable here. Threefurther points have to be made. First,we need to understand what theintention of Parliament was in pass-ing the constitutional amendmentintroducing Article 239AA grantingspecial status to Delhi. The popula-tion of Delhi is large, and it is onlyfair that the people deserve a repre-sentative government serving theirinterests, similar to other States,except in matters concerning land,public order and police.

Given such an intention of the law-makers, for all practical purposes,from then on, Delhi has acted andfunctioned like other States. Whichis why the language used in Article163(1) pertaining to States readsidentical to that of Article 239AA(1)pertaining to Delhi, while that of theprovision relating to Delhi reads dif-ferent from the provision relating toall other Union Territories.Therefore, just as in other Stateswhere the Supreme Court has justi-fied that the Chief Secretary appoint-ments be made at the discretion ofthe Chief Minister, in Delhi as well,it is the Chief Minister who musthave the power to appoint the ChiefSecretary, by “aiding and advising”the Lieutenant Governor. Second,executive powers run coextensivelywith legislative powers. Finally, thephrase “aid and advice”, as used inArticle 239AA, has been interpretedby the Supreme Court in ShamsherSingh (1974) to mean that the aidand advice of the Council ofMinisters and the Chief Minister is“binding” on the Governor; it is notjust advisory.

Therefore, the following can bereasonably concluded based on ajoint reading of the observations:First, as per Article 239AA(4) readwith Section 41 of the GNCT Act,the Lieutenant Governor does nothave any discretion to appoint theChief Secretary and other such posts,nor is there any special law grantinghim this discretion; Second, theLieutenant Governor is bound by the“aid and advice” of the Council ofMinisters and the Chief Minister inall matters that concern theLegislative Assembly. Third, for allpractical purposes, the intention ofParliament was to treat the Delhigovernment as a representative gov-ernment. It would be disrespectingvoters and a travesty to grant auto-cratic powers to the LieutenantGovernor, an authority which doesnot have a “democratic legitimacy”in the strict sense. A democracy, bydesign, guarantees that it is the partyvoted into power that represents thepeople of Delhi.

Questionable notification

The Home Ministry’s notification,siding with the Lieutenant Governor,states that apart from public order,police and land, the category of“services” also falls within the scopeof the Central Government.Therefore, the Centre has decided totreat Delhi as any other UnionTerritory when it comes to appoint-ments by the Public ServiceCommission. This is ultra vires.Article 239AA gives the LegislativeAssembly of Delhi power on all mat-ters under the State List, and Entry41 of the State List includes StatePublic Service Commissions.

The Home Ministry notification —by reiterating that IndianAdministrative Service and IndianPolice Service personnel will be cho-sen by the Central Government fromthe Union Territories Cadre — is toconflate Articles 239 and 239AA,

denying the special status that Delhiotherwise has, and further denying itthe powers under Entry 41.

The act of Mr. Kejriwal and Mr.Jung rushing to meet the Presidentfor a decision on the dispute is justi-fied under Article 239AA(4).However, the Transaction ofBusiness Rules suggest that whenthere is a dispute between the ChiefMinister and the LieutenantGovernor, there must be an endeav-our to settle it through discussions,and only then must a referral bemade to the President. One can onlyhope that such endeavours were gen-uinely made. Finally, the act by theLieutenant Governor, cancelling orstaying the orders by the ChiefMinister, also seems to be illegiti-mate and excessive. Rule 23 of theTransaction of Business Rules statesthat all relevant proposals of theDelhi government “have to be sub-mitted” to the Lieutenant Governorthrough the Chief Secretary. Butnowhere does it state that theLieutenant Governor can reject orcancel such orders.

In the end, the politicisation of theissue as a struggle for power betweenthe Bharatiya Janata Party and theAam Aadmi Party is ultimately anattack on the ideals of representativegovernance. In the long run, regard-less of such adversarial legal techni-calities, there can be no compromisewhen it comes to cooperation, trustand coexistence between theLieutenant Governor, the DelhiGovernment and the Centre. Thepeculiar nature of Delhi mandatesthat these three institutions learn towork and dwell together in theirhome-city. A clear interpretation ofthe existing laws, in the larger inter-est of representative democracy,would suffice, as has been estab-lished. In sum, the question of state-hood for Delhi need not be raised toresolve the tussle.

The senior BJP leader said, "People mustunderstand that the Modi government hasinherited issues like Naxalism, cross-borderterrorism, a derailed economy and a policyparalysis."

"Within no time we have made a turn-around," he claimed.

Mr Naidu, however, identified high expec-tations from the NDA government as a majorchallenge.

"The major challenge before us is thatexpectations of the people are very high.They are expecting so much. They have thatconfidence in PM Modi. They have given thatmandate after 30 years. We need to live up tothe expectations of the people in each andevery sector," he said.

Mr Naidu noted that a lack of majority inthe Rajya Sabha posed another big challengeto the government as it resulted in theCongress blocking important legislations likethe Goods and Services Tax, a measure itsown government had initiated.

"...for example, GST. They (Congress) ini-tiated it. They blocked it as well. Real estatebill, they initiated it, they have blocked itnow. But, by our persuasion and by creatingenough public opinion (in favour of the legis-lations), I am sure that we will get these billspassed in Rajya Sabha as well," he said.

Trashing Rahul Gandhi's charge that theNDA government was encouraging "cronycapitalism", Mr Naidu hit back, saying it wasevident in coal blocks and 2G spectrum allo-cations undertaken by the UPA government.

"What is crony capitalism? Crony capital-ism was evident in coal allocation withouttendering. Rs. 1.84 lakh crore was looted infavour of crony capitalists. Then, crony capi-talism was evident in 2G spectrum, wherelakhs of crores of rupees have been looted.

"Ministers had to go to jail, industrialistshad to face criminal action. IAS officers hadto go to jail. That was crony capitalism," hesaid.

"Congress have, for all these years, prac-ticed only one thing. Words for the poor anddeeds for the rich. That is the hallmark of theCongress. That is how all these crony capital-ists have come to this level," the ministersaid.

Mr Naidu parried a quesition about whetherbig ticket schemes will be announced to markthe first anniversary of the Modi government,but said 'Kisan Channel', a dedicated channelfor farmers on Doordarshan, will be launchedon May 26.

"In foreign countries, vehicles use 85 percent of ethanol and 15 per cent petrol. Since,the condition of sugar factories isn't goodanyway, selling ethanol will benefit themimmensely. Also, we can use 100 per centethanol for cars, buses and trucks. This willalso reduce our import bills and pollution lev-els," he said. Chief Minister DevendraFadnavis on the occasion said while he was inCochin a few days back, he asked officialsconcerned to build a sea plane as an experi-ment that could ferry 90 people at a time,within six months. Mr Gadkari alleged thatagricultural growth rate in Maharashtra hasbeen in the negative due to corrupt practicesof the previous government.

He said that around 70 per cent of rainwater goes back into the sea as there is noproper information on how to conserve rainwater. "There is a lot of rainwater. Water canbe provided 24 hours for farming use. Weonly need to spread awareness on conservingwater," he said. The Minister urged BJPworkers to concentrate on unorganised sectorand ensure that they become a part of theinsurance schemes recently launched byPrime Minister Narendra Modi.

The port will be developed through a spe-cial purpose vehicle (SPV) which will investUSD 85.21 million to convert the berths intoa container terminal and a multi-purposecargo terminal.

Access to Afghanistan's Garland Highwaycan be made from Chahbahar port using theexisting Iranian road network and the Zaranj-Delaram road, constructed by India in 2009.

This would establish a direct road access tofour of the major cities of Afghanistan -Herat, Kandahar, Kabul, and Mazar-e-Sharif.

The port will be also used to ship crude oiland urea, saving India transportation costs. Itwill also cut transport costs and freight timefor India to Central Asia and the Gulf byabout a third. On May 6, a Memorandum ofUnderstanding (MoU) was signed by MrGadkari and Iran's Minister for Transport andUrban Development Dr Abbas AhmadAkhoundi after comprehensive talks betweenMr Gadkari and the Iranian leadership duringhis visit to the country.

Each selected city under the ambitiousscheme would get central assistance of Rs.100 crore per year for five years.

"The bodies were washed away in theChenab river and their bodies were recoveredfrom near Head Marala dam in Sialkot dis-trict of Pakistan," a police officer said.

After the bodies were not traced on theIndian side, message was conveyed to thePakistan authorities and they informed theIndian authorities after tracing the bodies.

"A flag meeting was held last nightbetween the Pakistan rangers and the BSF onthe Octroi post in Suchetgarh where thePakistani rangers after conducting properidentification of the bodies handed over thebodies to the Indian authorities," the officersaid.

The bodies were taken to the governmentmedical college hospital, Jammu, for post-mortem and later handed over to the kin forlast rites.

"The husband of the victim has been arrest-ed for abetting suicide and we have launchedan investigation into the case," the officersaid.

Germany's BNDintelligence agencysends mammoth

amounts of phone and textdata to the U.S. NationalSecurity Agency (NSA)each month, Die ZeitOnline reported, highlight-ing the scale of spyingcooperation which hasunleashed a political rowhere.

Critics have accusedChancellor AngelaMerkel's staff of giving thenod to the BND to help theNSA spy on Europeanfirms and officials. Theyalso say officials lied aboutthe prospects of a U.S.-German "no-spy deal"before the 2013 election.

Polls show the scandal isstarting to hurt popularMerkel whose office isresponsible for the over-sight of intelligence.

Citing confidential docu-ments, Die Zeit Onlinereported on Tuesday that ofabout 220 million pieces ofmeta data gathered per day,some 1.3 billion pieces permonth go to the NSA.

The data includes rawmaterial from phone callsand text messages whichshows contact details andtimes of activity but doesnot contain content. In par-

ticular, it sends raw materi-al on foreign communica-tion in crisis regions, saidZeit Online.

"It is questionable as towhether this practice iscovered by German laws,"wrote Die Zeit, citing aBND official responsiblefor data protection.

A spokeswoman for theBND declined to commenton the report. The agencyhas now halted its Internetsurveillance for the NSA,German intelligencesources said last week.

Privacy is a potent issuein Germany due to exten-sive surveillance byCommunist EastGermany's Stasi secretpolice and also by theGestapo in the Nazi era.

Revelations by formerNSA contractor EdwardSnowden about wide-spread espionage inGermany by the UnitedStates caused outrage inGermany when they sur-faced.

A Forsa poll on Tuesdayshowed that the oppositionGreens, who have led criti-cism of the governmentover German spying, hadprofited from the row,climbing 2 points to 12

percent while Merkel'sconservatives dropped 1point to 41 percent.

That follows an InfratestDimap poll last week thatshowed Merkel's approvalrating was down five

points to 70 percent in thewake of the spying scan-dal.

Merkel, who argues thatGermany has to work withthe NSA to fight terrorism,tried on Monday to deflect

criticism, saying her staffacted "to the best of theirknowledge and in goodconscience". Media reportshad said Washington neveroffered Germany a no-spyagreement as Merkel andsenior aides had said.

launched a new Android 5.0Lollipop-based budget handset in India,the Xolo Prime. Priced at Rs. 5,699, the smart-

phone is set to compete with theMicromax Canvas Spark, a recentlylaunched budget smartphone also run-ning Android 5.0 Lollipop. The XoloPrime is said to soon be available atretail outlets across in India.

The Xolo Prime is a dual-SIM sup-porting smartphone that features a

4.5-inch IPS display with(480x854 pixels) resolu-

tion and a pixel densi-ty of 218ppi. The

In the post-Snowdenworld, end-to-endencryption (E2EE) has

been a topic of concernwith respect to variousservices that involve com-munication. WhileWhatsApp late last yearadded end-to-end encryp-tion to its messaging serv-ice, there are still a fewservices that have still donot feature the same,which makes them suscep-tible to interception.

Google at a recentReddit AUA (Ask UsAnything) session whendetailing the current statusof its role in assisting theUS government in surveil-lance, disclosed it doesencrypt Hangouts conver-sations but remainedunclear on the use of end-to-end encryption. It later,separately clarified thatHangouts does not useend-to-end encryption.

Google's RichardSalgado, Director for LawEnforcement andInformation Security, andDavid Lieber, SeniorPrivacy Policy Counsel,were representing the firmat the Reddit AUA. Duringthe AUA session,Christopher Soghoian,

Principal Technologist atthe American CivilLiberties Union, asked,"Why has Google refusedto be transparent about itsability to provide wiretapsfor Hangouts? GivenGoogle's rather impressivetrack record regarding sur-veillance transparency, thetotal secrecy regarding thecompany's surveillancecapabilities for this prod-uct is quite unusual."

Salgado replied sayingHangouts conversationsare encrypted. He said,"Hangouts are encrypted intransit, and we're continu-ing to extend and strength-en encryption across moreservices."

Google later confirmedto Motherboard thatHangouts doesn't use end-to-end encryption. WithoutE2EE, it is possible forGoogle to intercept con-versations when requestedby law enforcement agen-cies and governments.With its current implemen-tation however, of encryp-tion in transit, ISPs andtelecom operators will notbe able to intercept conver-sations. Google specifiedto Motherboard that the'Off the Record' feature

only keeps messages out ofchat history, but the mes-sages are otherwise indis-tinguishable from regular,on the record ones.

E2EE is employed toprotect communicationbetween two parties (origi-nating party and intendedrecipient) without beingintercepted or read by thirdparties, including the com-pany offering theservice.The data isencrypted by the originat-ing party, and can only bedecrypted by therecipient.

The Mountain Viewgiant in the recent pastrevealed that worldwidegovernment requests foruser data rose 150 percentover five years. The com-pany however is unclearhow many of theserequests were forHangouts.

It's worth noting thatApple's iOS 8 featuresbuilt-in encryption thatprevents the companyitself from accessing dataon the devices without theowner's consent or pass-code. Apple's iMessageand FaceTime video chatservice also feature end-to-end encryption.

KOLKATAMumbai Indians' love affair with

Eden Gardens contiuned as theyclinched their second IPL title fol-lowing a crushing 41-run win overChennai Super Kings in a lop-sidedsummit clash, here tonight.

Mumbai Indians posted an impos-ing 202 for five as skipper RohitSharma (50) and Lendl Simmons(68) rattled up a 119-run stand offjust from 67 balls after being invitedto bat.

The Mumbai captain, who has anODI world record of 264 and also adebut Test hundred at the EdenGardens, yet again exploded at hisfavourite venue.

Sharma (6 fours, 2 sixes) andSimmons (8 fours 3 sixes) plundered19 boundaries in their partnership.

After Sharma and Pollard's dis-missal in consecutive balls, burlyWest Indies batsman Kieron Pollard(36) in the company of AmbatiRayudu (36 not out) led the side past200.

Before eat-ing (fruits) or cooking (vegeta-bles), wash them under running tapwater to get rid of any last traces ofpesticides.
