GARRITY/WEINGARTEN/MIRANDA/BRADY – THE BASICS AND BEYOND NEWS AND TRENDS – HOW IT AFFECTS YOUR MEMBERSWill Aitchison

A review of recent developments impacting the law enforcement workplace. Particular focus will be placed on an officer’s rights in the disciplinary process, including a discussion of recent cases arising under the Garrity, Weingarten, Miranda and Brady rules as well as under statutory peace officer bills of rights. The presentation will include a review of wage and benefit settlement trends, the status of health care reform, litigation concerning pension plan reductions, and general fitness-for-duty issues.

THE STATE OF ORGANIZED LABOR NATIONALLY Dr. Elaine Bernard

Dr. Bernard served as Executive Director of the Labor and Worklife Program at Harvard University from 1989-2017. She has conducted courses on a wide variety of topics for unions, community groups, universities and government departments. Her current research and teaching interests are in the areas of international comparative labor movements and the role of unions in promoting civil society, democracy and economic growth.

A SCIENTIFIC EXAMINATION OF FORCE ENCOUNTERS: ACTION-REACTION DYNAMICS, SUSPECT PROVOCATION AND OFFICER RESPONSE Sgt. James Borden

This presentation is designed to clearly present, in a practical understandable fashion, the results of the most cutting edge research into the dy-namics of human behavior in life-threatening encounters. The goal of this presentation is to encourage law enforcement professionals to apply the important concepts revealed by this research when investigating, reconstructing, recalling or otherwise analyzing—or preparing for—use-of-force encounters. The integration of this information has been proven to enhance the accuracy and thoroughness of decisions made relative to behavior and performance during these incidents.

WORKERS COMPENSATION – MENTAL & PHYSICAL INJURIES & MODEL LEGISLATIONJeff Ment

Police officers, by the very nature of their jobs, are exposed to more stress and trauma in one day than most people will ever experience. Police officers regularly deal with the most violent, impulsive, and predatory members of society, put their lives on the line, and confront cruelties and horrors that the rest of society views from the sanitized distance of their newspapers and TV screens. The issue confronting us now is how do, or should, employers help take care of law enforcement officers. This session will explore the continually changing employer/insurer response to PTSD and other non-physical consequences for officers, We will discuss best practices, workers’ compensation, disability and model legislation.

OVERVIEW OF THE KEY CASES IN THE SIXTH CIRCUIT RELATING TO LAW ENFORCEMENTChief Judge R. Guy Cole, Jr., Sixth Circuit Court of Appeals

The Sixth Circuit and courts throughout the country grapple with tough questions about the intersection of law enforcement and the Constitu-tion. At the criminal-investigation stage, courts weigh questions about an accused’s Fourth or Fifth Amendment rights in investigations that have thwarted extortionists, terrorists, and child predators. At the incarceration stage, courts must decide whether an inmate’s treatment runs afoul of the Eighth or Fourteenth Amendments. This presentation will discuss the role of law enforcement throughout the process, whether defining the scope of an investigation to avoid stale information or bare-bones warrants, executing a search with attention to cybersecurity and terrorism threats, or ensuring that arrestees receive adequate medical attention and due process.

20/20 HINDSIGHT: BODY CAMERAS IN LAW ENFORCEMENTGwen Callender, Russ Carnahan, and Stew Matthews

This topic will include a discussion of the defense of University of Cincinnati Police Officer Ray Tensing from the lawyers who represented Officer Tensing during the two criminal trials on the charges of murder and voluntary manslaughter. The presentation will address our key issues in ne-gotiating body worn cameras from the attorney who negotiated the policy for Capital City Lodge #9 in Columbus, Ohio. In addition, the presen-tation will include the legal standard to be used when reviewing use of force that is captured on a body worn camera: when an officer should be permitted to review his body worn camera video and the pros and cons of body worn cameras.

BRADY/GIGLIO AND CONFLICT OF INTEREST IN LAW ENFORCEMENT CASESDoug Squires

The U.S. Supreme Court has made clear the obligations on law enforcement and prosecutors to disclose exculpatory and impeachment material to criminal defendants. However, how those obligations are met varies from jurisdiction to jurisdiction. This presentation explores the Constitutional foundation of Brady and Giglio rules and how courts interpret and apply them. This includes a discussion of the discoverability of police personnel files and what degree of reliability must be shown before an allegation of misconduct is discoverable. When conflicts of interests arise in the rep-resentation of a law enforcement client, prosecutors have many options including court involvement. Knowing when conflicts cannot be waived, whether they are potential or actual and other considerations are topics in the presentation.
