REP. GARIN (J.). Mr. Speaker, I rise on a matter ofpersonal and collective privilege in relation to myobservations on how the current health system is deteriorating.

QUESTION OF PRIVILEGE OF REP. GARIN (J.)

REP. GARIN (J.). Mr. Speaker, distinguished colleagues,I rise on a matter of personal and collective privilege thisafternoon on an issue that gravely concerns me, not onlybecause I stand as a living witness to how dreadful anexperience it is, but more so, I am concerned about its impactif left unattended to.

Next slide please.Allow me to cite our health services. Has it evolved into

something that is already considered a commercialcommodity? Many of us have taken these for granted becausewe look at the delivery of health care services as somethingthat should be accessible. But being accessible, Mr. Speaker,distinguished colleagues, does not mean to say that it will beaccessible, available, but not reliable. Allow me to relate toyou a series of chronological events that happened as to mybasic experience three days ago.

Next slide, please.On Friday, March 16, 2012, about seven thirty in the

morning, I decided to pass by my health clinic which islocated at the SM North EDSA. I actually brought alongmy husband who just came from a very successful renaltransplantation last December 8. When he was having hislaboratories checked, I decided to have myself checkedtogether with him.

On March 16 of the same day, at around eight o’clock inthe evening, I received an email containing the official resultsof the tests done. Much to my surprise, except for a few expectedresults, the x-ray—the results of my radiological exam, whichis a chest x-ray—revealed a very disturbing result. Hence, onMarch 17, and that was the next day, I made a call to my healthclinic asking for some clarification. The person in chargeresponded and attested to the veracity and reliability of theirlaboratory results. I was told that the results have been verifiedand they were indeed correct. I insisted on further verification

of the results but was told that there were a lot of pending workin the diagnostic center and they could look into this matterafter a few hours or later in the evening.

Next slide, please.On the same day at around noontime, having received

information that they would not verify the results of the testingdone on yours truly simply because they have not yet verifiedthem, I sent an email, somehow a complaint, to the company.At around 2:00 p.m., on the same day, when I startedintroducing myself as a doctor, I received an apology by emailand another official x-ray result was sent.

Let me go further to make this understandable to mycolleagues and the public.

Next slide, please.This is a copy of the x-ray result that was given to me.

So it had my name with a very shocking result because I wasentirely normal but the radiological report said that “the lungsare hyperaerated, with streaky infiltrates in both upper lobes;the heart is not enlarged but the aorta is atherosclerotic, thediaphragm is flattened, right costophrenic sulcus is blunted,and the bony thorax is intact.” Looking at the radiologicalreport, as a medical doctor, I was bothered by the statementthat there are streaky infiltrates in both upper lobes because Iknow that it signifies a long chronic infection and a probabilityof tuberculosis. Much more, I was very much apprehensiveover the report that my diaphragm has been flattened becauseit signifies a very serious pulmonary condition.

Further, it stated that the right costophrenic sulcus is blunted.Meaning to say, either there is water or air somewhere in mylungs that needs to be immediately treated. The impressionshowed minimal pulmonary tuberculosis of both upper lobeswith undetermined activity signs of pulmonary emphysema,pleural thickening on the right and atheromatous aorta.

Mr. Speaker, distinguished colleagues, I did not want toaccept the results but I told myself that if, indeed, this issomething that has happened to my lungs, it is somethingthat I should accept. On the other hand, I wanted furtherverification because I was surprised to note that in the result,I was labeled as male instead of female and my age of 39years old became 63 years old. So, again I called the clinicand further explained that I am entirely asymptomatic. I amnot a smoker, I am not an alcoholic drinker and admittedly Iwas sent another x-ray result.

Next slide please.The next x-ray result, which was still under my name,

showed that both lung fields are clear, heart is not enlarged,the diaphragm, the sulci and the bony thorax are intact, andthe impression was that of normal chest findings.

Next slide, please.Mr. Speaker, distinguished colleagues, let us spot the

differences. Of the two x-ray results, given to me on the sameday, first was a notable change in age of 39 years old versus63 years old. When I verified this with the clinic—which hasa lot of branches at Shangri-La, at SM and other hugeestablishments—I was informed that the first result wasreliable; however, there might be mistyping of my age. Ifurther went deeper into saying that the case number isdifferent and I wanted to retrieve my actual x-ray plate sothat I can have somebody read it and verify it.

Third, I was labeled male instead of female. Mr. Speaker,distinguished colleagues, I really do not know but I hope nobodyamong us will admit that I look more male than female.

Fourth, the radiologic technologist was Gretchen de Jesus inthe first result, and the second result had a certain Cayetano Giron.I was only checked once and I only saw one radiologic technologist.

Fifth, the radiologist in the first result was a certain Dr.Joseph Abanilla while the second result had the signature ofa certain Dr. Antonio Kho Jr.

Next slide, please.Mr. Speaker, may I go back to the previous slide. I am

sorry. Mr. Speaker, distinguished colleagues, admittedly I wasextremely disturbed with the results.

Previous slide, please.Okay. I was extremely disturbed with these huge and major

differences, not much for myself, but for two major reasons:First, my husband, who recently underwent renal

transplantation, has been exposed to his highly infectious wife,if the results were indeed true.

Second, if my gut feeling that there was a mix-up ofresults was correct and that my plate was swapped with thatof another patient, I was more apprehensive and highlyconcerned for that patient who was also a walk-in patientwho presumed that he had a normal x-ray result because myplate was read as his x-ray, and his x-ray was read as my x-ray. I was very much concerned, Mr. Speaker, distinguishedcolleagues, because questions were raised on whether thisperson can be traced, whether they are going to call thisperson, whether corrective measures will be done and, mostimportantly, whether that patient has extra money for a secondx-ray or a second round of laboratory and other ancillaryservices?

An apology by email is somehow acceptable for me, butis it enough to cure the symptom and not the disease itself? Isthis an isolated case or the probability of happening is usualbecause of a commercialized delivery of health care services?

Mr. Speaker, distinguished colleagues, at first, on theone hand, I thought I will let this pass because an apologywas sent to me by email; but on the other hand, I look at thisas something deeper. It is a reflection of how manyentrepreneurial people have converted the delivery of healthcare services into a commercial commodity.

Next slide, please.So, the questions that need answers are, first, has health

care provision evolved into a highly commercialized service?Mr. Speaker, distinguished colleagues, when I read the

laboratory results, I was thinking not only of the vast effectthat my husband may have been exposed to, being with meand having me by his side during the preoperative and thepost-operative procedure; but more so, I was concerned formy daughter, for others who have been exposed to me. Thisagony is something that should not happen to other people. Ithappened to me and I can tolerate that but this should stopand should not happen to others.

Second, who is there to protect our patients especiallythose with minimal medical knowledge? It was an entirelydifferent case on my part, Mr. Speaker, distinguishedcolleagues, because I understand medical terminologies. I dounderstand what the term “sulcus” means. I understand whathappens when an angle is diminished and, further, Mr.Speaker, I fully understand the effects of emphysematouslungs. But if these results were given to somebody who doesnot have the medical knowledge or who will be spending alot for medications and other ancillary procedure, is it notunfair for this patient?

Third, what does a doctor’s signature mean? When Iinquired as to the result—and this is very important for allof us to look into—I was informed that the result wasverified, it was correct, it was reliable and it was read severaltimes.

Mr. Speaker, distinguished colleagues, with two differentresults, having two different doctors, duly signed and certifiedas authentic, reliable and verified, I have now this big questionon my mind. What does a doctor’s signature mean? Becauseonce a doctor puts his signature on a result, it simply meansthat you have personally examined the patient and you havedone your job. But, Mr. Speaker, distinguished colleagues, itis apparent that we now have—I hope I am wrong on thiscase—“signatures for sale”. What do I mean by “signaturesfor sale”? These would be blank forms, signed by doctors,released to laboratories where the doctor’s signature is beingbought for a certain fee and the results are merely placed bytechnicians. Is this the kind of health care that we would liketo have for our people? I am sure nobody amongst us willagree.

Next slide, please.With this last slide, are companies meticulous in choosing

healthcare providers simply because we can easily be swayedby false advertisements?

Fifth and very important, are there measures in place tocorrect the damage done especially for walk-in patients whomthe laboratory cannot trace anymore? I left my mobile number,I left my residence number, I left my email address at theclinic, but all I received was an apology by email. How aboutthe out-of-pocket cost for repeat examinations? Who will bespending for this? Is it the patient or is it the healthcareprovider who has been remiss in their functions and hasconverted the delivery of healthcare services into somethingthat is entirely commercialized?

Sixth, and the very most important question, by whichwe can contribute to our own peace, is this situation beinglooked into by the Department of Health and the ProfessionalRegulation Commission?

Mr. Speaker, distinguished colleagues, I decided to standon a matter of personal and collective privilege to relay anexperience that I would never like to happen to anybody else.It gave me one whole day and a sleepless night that made mevery anxious, not to mention the fact that my biggest concernis that if it happened to me, how sure are we that it is nothappening to our constituents?

With these reasons, and with the concurrence of our Dep.Majority Leader, I would like to move that the Committee onHealth, specifically the Subcommittee on Oversight, look intothis matter because this should be corrected. We, as doctors,have sworn to always put the health and the lives of ourpatients foremost in our minds. With this, I say “no” tocommercialization of medical practice, “no” to signatures forsale, and “no” to doctors who will just sign blank laboratoryforms and have the results simply read. I say “no” because inmaking health care services available, we forgot that reliabilityand veracity should be foremost in our minds because, at theend of the day, we are here to serve our people.

This Representation is of the position that said Act, with all duerespect to this Chamber, has been taken up with undue haste,covert and in secrecy from its stakeholders, constituencies, andwith disregard for the consultative nature of the legislative process.

Mr. Speaker, in our session last 15th of February this year,this Representation stood up and manifested the sameopposition and my reservations with utmost caution againstHouse Bill No. 5689. I am again registering this manifestationand opposition to said bill which was passed on ThirdReading.

The Constitution is clear, Mr. Speaker:

Each legislative district shall comprise, as faras practicable, contiguous, compact, and adjacentterritory. Each city with a population of at least twohundred fifty thousand, or each province, shall haveat least one representative.

However, Mr. Speaker and my dear colleagues, thisprovision does not exist in vacuum. We are in a representativedemocracy where the operational principle and propositionof the government is that there shall be proportionalrepresentation of our people. Our basic Charter does not allowand disengages itself from situations where in governance,some are more equal than others.

Mr. Speaker, the city of Meycauayan, the municipalitiesof Obando, Marilao, San Ildefonso, San Rafael, San Miguel,Angat, Doña Remedios Trinidad, Sta. Maria and Norzagaraywere not properly consulted on the proposal of this measureto chop and join localities into new congressional districts ofthe Third, Fourth and Fifth District of the province of Bulacan.

Granted that this redistricting or reapportionmentmeasures do not create a new entity in our local governments,however, the aggregation itself must be the product ofintelligent thought, deliberative processes and consultativedemocracy that are hallmarks of this legislative process.

Hindi po kinunsulta ang mga mayors. Sila po ay kinausapnamin at wala po silang alam tungkol dito sa redistricting na ito.

Mr. Speaker, absent is the full, proper and effectiveventilation of all the issues involved, I am saddened by thedevelopment that instead of empowering our people, thecourse taken by this House Bill No. 5689 was to rob theconstituencies involved, blind of their enfranchisement underthe law and the Republican system of our government.

The Supreme Court said in Aldaba vs. Comelec, GR No.188078, dated 15 March 2010:

Unquestionably, representation in Congress isno less important than the creation of localgovernment units in enhancing our democraticinstitutions, thus, both processes should be subjectto the same stringent standards.

Mr. Speaker, as a guide in acting upon measures affectingour constituencies, like the instant House bill, the LocalGovernment Code is very instructive and sheds much import on thematter. Section 2, letter (c), and Section 27 provide, and I quote:

SEC. 2. x x x(c) It is likewise the policy of the State to require

all national agencies and offices to conduct periodicconsultations with appropriate local governmentunits, non-governmental and people’s organizations,and other concerned sectors of the community beforeany project or program is implemented in theirrespective jurisdictions.

SEC 27. Prior Consultations Required.–Noproject or program shall be implemented bygovernment authorities unless the consultationsmentioned in Sections 2(c) and 26 hereof are compliedwith, and prior approval of the Sanggunian concernedis obtained x x x.

Hindi ko po malaman kung may iprinisinta itongSanggunian na resolution or ordinansa na inaaprubahan angredistricting na ito.

Mr. Speaker, House Bill No. 5689, therefore, begs thequestion: “Why cannot we extend the duty to discuss withstakeholders the matter of reapportionment?” Kae-elect palamang po sa kanila ay binabawasan na nila ang kanilangpaglilingkuran. After all, in the general scheme of ourgovernment, Mr. Speaker, the people are our ultimate sourceof sovereignty. Precisely, we are the Representatives, theyare our principals, and we are their agents. Mr. Speaker, angtaumbayan po ang ating boss; hindi po tayo ang boss ngtaumbayan.

We cannot, through covert machinations, seize anddismantle the Republican system of our government andsubvert it to the sentiments of personal politics, without duedeference to the will of the people. Informed, well-thoughtof and fully-ventilated, and trust issues must be the vehicleof our exercise of congressional reapportionment.

REP. MARIANO. Ito ay may kinalaman lamang doonsa pag-iisyu ng warrant of arrest sa may dalawampu’tdalawang magsasaka at manggagawang bukid ng Hacienda

Luisita na lumabas noong Marso 19, taong kasalukuyan,2012, na inisyu ng Branch 1, Municipal Trial Court ng TarlacCity.

Ito po ay may kinalaman sa isinampang gawa-gawangkaso na grave coercion, occupation of real property at robberyng Rizal Commercial Banking Corporation. Ito po ay malinawna isang kaso ng kriminalisasyon or pagkikriminalisa sa mgamagsasaka at manggagawang bukid na kaanib ng Unyon ngMga Manggagawa sa Agrikultura o UMA at ng United LuisitaWorkers Union o ULWU.

At nauna pa po rito, noon naman pong Pebrero 20, taonding kasalukuyan, nagkaroon din ng karahasan na namansa Hacienda Luisita kung saan ang pinagsamang pwersa ngmahigit 100 security guards, 10 police personnel mula saTarlac Provincial Police at 15 sundalo ng Philippine Armyay walang pakundangang nagpaputok ng baril sa mgamagsasaka at manggagawang-bukid ng Hacienda Luisita nanagbabarikada. Ito po ay may 300 magsasaka nabenepisyaryo sa Barangay Balete dahil pinipigilan po nilaang pagbabakod ng bahagi ng lupain na ibinenta ng HaciendaLuisita, Incorporated sa Rizal Commercial BankingCorporation.

So, ito po iyong esensiya at laman ng aking nakasulatna manipestasyon at dahil nga po sa nakaraan nanagdesisyon ang Korte Suprema noong November 22, 2011na pumabor sa mga magsasaka at manggagawang-bukiddahil ipinag-uutos po ng nasabing desisyon ang total landdistribution sa magsasaka at manggagawang-bukid ngHacienda Luisita.

So, iyan po ang pinakaesensyal na laman ng akingtatlong-pahinang nakasulat na manifestation. At tulad po ngnabanggit ko kanina, ito po ay iminumungkahi ko na isumitena lamang para maging parte o bahagi ng CongresssionalRecord ng House of Representatives.

THE SPEAKER. The session is resumed.Well, my colleagues, it is hard to believe that starting

tomorrow, we will go on our break for the Lenten season.(Applause) At first, we were going to consult the Senate, pero

sabi namin, “no, we deserve that break”, kaya go na tayongayong gabi, starting tonight. (Applause)

You know, since we reconvened in January, we werefaced with two terrific tasks. Number one, the task that weordinarily have—to study, to discuss, to enact bills of nationalor local importance, and two, the added burden of initiating,managing and pushing through the impeachment process ofthe Chief Justice. These were the two tasks that were in ourhands. Insofar as legislation is concerned, although we haveto admit to ourselves that there were times when the focushad been on the impeachment trial, nonetheless, we performedvery well.

In fact, almost 50, actually 49, or maybe 50 bills ofnational importance, including many priority bills have beenpassed from last January up to now. (Applause) The localbills are equally numerous and important, and we dischargedour functions very well in this regard.

We have to admit that, really, the second assignmentthat we had during this period, the impeachment trial wasalso very daunting and really quite difficult. I myself whohad been there before, I know how difficult it is from thepoint of view of the people that we have sent them. So,tonight is really a time to say thank you to all of you withoutexception. Nagkasama-sama tayo rito and we have done it.(Applause)

To our Deputy Speakers, si Manong Pabling, kahit nasometimes nahihirapan, he is here together with the other,the younger Members of the Deputy Speakers group who arealways ready to help. Kaya maraming salamat sa inyong lahat.Thank you, kay Beng. Nandyan si Beng, si Boying, si Noli,si Mang Pabs, si Raul. At saka si Boying, of course, who ishere today.

We have had a transition in the Office of the MinorityLeader. So, to both the former Minority Leader and the presentMinority Leader, and all of them, maraming salamat dinbecause you are here. We cannot get anything done kung hinditayong lahat ay nagkakasama-sama. (Applause) And theCommittee Chairmen, walang umaga na nagdaan dito na hindimay mga komiteng nagmi-meeting. And I see from time totime, important people coming here—why? They were calledto give their reports or testimonies before our variouscommittees. So, maraming salamat sa mga Chairmen, ViceChairmen and members of the various Committees.(Applause)

Of course, let me make a special mention and thank youto the 18 people whom we sent to handle the prosecution inthat impeachment team. Eighteen women and men, they wereprosecutors; they were managers; they were the people whospoke for us. You know, maraming sinasabi about them butat the end of the day, let us admit it, the people and all of ushere or most of us here realize that they have done a dauntingjob, pero nagawa nila. Kaya thank you then to them.(Applause) At alam nyo, mahirap ito. I remember when I wasa member of the impeachment team, talagang wala kangnaiisip except to focus on it. And of course, the 188 Memberswho signed the impeachment complaint, 188 kayo, plus 13who also signed later. Let us put it on record, not a single one
