QUESTION OF PRIVILEGE OF REP. TIANGCO

REP. TIANGCO. Mr. Speaker, I rise on a question ofpersonal and collective privilege that involves the integrityand independence of the House of Representatives.

In the early morning of Sunday, December 11, 2011, Ireceived word that there are moves to cause the impeachmentof Chief Justice Renato Corona. I dismissed it as mere gossip.However, as the day went on, these rumors became louder,worse, quite disturbing since rumor has it that the entireimpeachment process will be done in just one day. Again, Iset it aside, convinced that even assuming the rumor has aring of truth to it, the integrity of the leadership of the Housewill not allow this.

Further later, I was advised through text that an all-Majority caucus would be conducted at 2:30 p.m. of December12, 2011. Taking into account the rumors, I was hard-pressed,hoping that the RH Bill was what will be discussed in thecaucus and not the impeachment of Chief Justice RenatoCorona. But I could not convince myself. I had this gut feelingthat the agenda was the impeachment.

Reflecting on these rumors, I was psyching myself thewhole night and the whole morning yesterday to blindly votein favor of impeachment for three basic reasons: number one,I do not want my constituents to suffer from the non-releaseof my PDAF if my conscience dictates me not to vote for theimpeachment; number two, it would be useless to vote “no”if ever that was what my conscience dictates since I alreadyknow that the “yes” will have the numbers anyway; andnumber three, and more importantly, I am well aware of thevast powers of the President of the Philippines under ourConstitution and our laws. I do not want to catch the ire of

the President, especially a President with a huge popularityrating. With the vast powers of the President, life can bemiserable for you.

Yet, at the start of the Majority caucus on the 12th ofDecember 2011, without being given the chance to read theimpeachment complaint, I was shocked to hear the openingstatement of the leadership of the House at the all-Majoritycaucus, saying: number one, that because of the allegedassociation of Chief Justice Renato Corona with his patron,the former President GMA, he is an obstacle to the goodplans of the President. The only thing, to do therefore, is totruly remove the Chief Justice through impeachment; numbertwo, that the Chairman of the Committee on Justice wouldexplain the grounds for impeachment; and number three, thatwe were clearly given two choices: to sign or not to sign.

Liliwanagin ko ho, wala hong pilitan. Kung matatandaanko iyong eksaktong sinabi naman ni Speaker, ang sabi niya,iyong gustong pumirma, pumirma; iyong mga ayaw pumirma,huwag pumirma. Pero ang hindi ko ho nagustuhan ay iyongsinabi noong pang-apat na this is non-debatable and noquestions will be entertained. In fact, two colleagues stoodup at tinanong nga kung pupwede. Pagkatapos noon, Ithought right there and then that we were just a rubber stampCongress. Pagkatapos nating i-rubber stamp ang dalawangbudget, ngayon naman, ito namang impeachment, a collegialBody that just relinquished the integrity of its institution andits independence to a co-equal branch.

I was expecting the Speaker, as the leader of the House,to protect the integrity of the House in effecting this railroadimpeachment process or considering the speed at which itwas implemented, should I say, “runaway impeachmentprocess”. How can you vote for impeachment without havinghad the chance to even read the Articles of Impeachment,much less, verify the facts and merits of the case? I cannotunderstand the speed at which the entire process waseffected. Why the haste in a matter of hours? Why can wenot give him due process, a basic right protected by no lessthan the fundamental law of the land?

Again, lest I be misunderstood, hanga ako sa atingPangulo na hinahangad ang matuwid na daan para sa bansanatin. I know for a fact that the President himself is an exampleof one who follows the law of the land. I saw him twice on theroad. Ako ho ang “go,” siya ho ang naka-stop. At dahil alamkong iyon ho ay convoy ng Presidente, huminto ho ako,sinenyasan ko ho iyong kanyang convoy na mauna na, ngunithindi ho talaga tumakbo iyong kanyang convoy hanggangnoong nag-green light. This is a testament that the Presidentdoes not want to abuse his power. So, it seems inconsistentthat the President who follows basic traffic rules would notwant due process to be followed.

The President is a former Congressman. Do you thinkthat if P-Noy were still a Congressman now, he would sign animpeachment if it were done in the same manner that it wasdone yesterday? I am not defending the Chief Justice. I haveto give credit to the spin doctors. They have done a verygood job in playing the GMA card. Ang PR diyan ay angbumoto pabor kay Chief Justice, o ang hindi bumoto para saimpeachment ay kasama sa mga protektor ni GMA, iyan hoang PR lagi riyan. Admittedly, with due respect to the formerPresident, her popularity would be no match to the popularity

of P-Noy. That is the reason why that is the card that isalways being played.

For the record, I will not and cannot try to protect GMA.I have never been a GMA ally. I have been against GMA fromher first day in office to her last day in office. This is notabout P-Noy vs. GMA. This is about the integrity andindependence of the Supreme Court and other co-equalbranches of government.

So, today, I rise to defend the integrity and independenceof the House of Representatives. Dati ang sabi nila sa akinkung galing ka sa local government, you will get bored in theHouse. But on the contrary, I have come to love this placeand love my job; and I will do everything to defend thisinstitution and its integrity.

Again, I do not want trouble with the most powerful manin the country. If the President wants GMA to be jailed for heralleged sins, I am one with him. But in pursuing justice, itmust be done in a manner that does not destroy our institutionsor more importantly the co-equal status granted by theConstitution.

To the Speaker, Speaker Belmonte, I am honored andgrateful that despite being a neophyte, you have given methe chairmanship of the Committee on Metro ManilaDevelopment. It also saddens me since I am a good friend ofyour children, but this matter before us now transcendsfriendship. Iyong mga kaibigan ko riyan na nagsasabingmaghintay ako ng isa pang araw, pag-isipan kong mabuti atisipin ang aking kabutihan, maraming salamat sa inyongmabuting payo sa akin.

I am a neophyte Congressman and I do not know whetherthis decision is politically correct or not, but I am sure that Iwill be able to sleep—makakatulog ako nang mahimbingmamayang gabi because I will do what my consciencedictates.

Since in my opinion the leadership cannot protect theintegrity and independence of this beloved institution, thenI resign from the Majority and relinquish all positionsassigned to me. Effective immediately, I declare myself anindependent Member in accordance with the rules of theHouse.
