IMPORTANT:

entertained. The tender in physical form is to be submitted in single copy only. (The price bid

is not to be submitted with the physical documents).

2. Any deviation found in Data/Details/Documents in on line offer (e-tendering) and physically submitted

documents (Tender document fee, EMD, Vendor Registration, Technical and commercial documents

etc.) of bidder, offer of the same bidder will not be considered and no any further communication in

the matter will be entertained. Physical copy is for reference only and tender will be evaluated on

Data/Details/Documents of the “on line” offer. For any discrepancy between online & physical

bid, online bid is considered as final.

3. It is mandatory for all the bidders to submit their tender documents by both forms viz. on-line (e-

tendering) and physically in schedule time. If tender documents submitted in only any one form, say

either by online or physically, in that case the same tender will not be considered.

4. The bidders are required to fill up all the online appendices (annexure)/forms. This is intended for

transparency and speedy evaluation of the bids. Instead of simply confirming/attached in bid/refer

physical offer, the bidder shall fill in the particulars against appropriate place in respect of each line

appearing in each online annexure. Wherever required, bidder shall invariably have to submit

supporting authentic documents in the physical bid.

(In the absence of required details in the online annexure, the purchaser has every right to evaluate the bids accordingly and bidder cannot raise any objection against any point during evaluation.)

5. Bidders are requested to remain in touch with the web site for any amendment/corrigendum or

extension of due date etc.

6. No tender shall be accepted/opened in case of receipt after due date and time of tender, irrespective

of delay due to postal services or any other reasons and the Corporation shall not assume any

responsibility for late receipt of tender.

7. The Earnest Money Deposit and tender fee will be accepted by Demand Draft on any Nationalized

Bank only situated at ANJAR drawn in favor of “GUJARAT ENERGY TRANSMISSION

CORPORATION LTD.” Tender without EMD and tender fee shall be rejected. Two separate demand

draft for Tender fee and EMD should be submitted with technical bid.

8. The GETCO reserves the right to award the work to one or more bidders, considering their technical

and financial capacity OR to reject any or all tenders or accept any tender without assigning any

reason thereof.

SECTION – I

SPECIAL INSTRUCTIONS TO TENDERERS

1. The tender should be submitted in original & Tender Notice no. may be quoted on envelop. Technical bid filled and sealed in to separate cover marked ’’Technical Bid”. Rates should be quoted online only.

2. The tenders may be sent by Registered Post/Speed Post only as to reach this office on or

before up to 16:00 hours. Due care should be taken to see that the tenders sent by post are posted well in advance to ensure the delivery by the prescribed date or even earlier.

Tenders which are received late after due date of receipt, will not be considered. 3. The tenderer who offers the lowest in percentage (%) i.e. lowest total amount will be

awarded/recommended for placement of order. Item wise lowest % / value will not be considered for placement of order.

4. Failure to furnish full and complete details or furnishing vague information will make the

tender liable for rejection. The tenderer is at full liberty to give information about his capacity and establishment to execute the work/contract.

5. The offer should be valid for a minimum period of 180 days from the date of opening of

Tender.

6. The Technical bid shall be opened on Dt. ----------at 16:00 hours in the office of Superintending Engineer (TR), GUJARAT ENERGY TRANSMISSION CORPORATION LTD, Transmission Circle, ANJAR (if possible).

7. The tenderer offering their “Technical Bid” against this specification should satisfy following

criteria. The proof of such criteria be submitted in the “Technical Bid”. 8. The tenders are to be submitted by the intending bidders with forwarding letter on their letter head

SECTION – II

GENERAL TERMS & CONDITIONS

01 VALIDITY :

The rates for the work quoted by the contractor will be valid for the period of SIX MONTHS from the date of opening of the tenders.

02 PAYMENT OF SECURITY DEPOSIT :

The contractor will have to pay the security deposit at 5% of the order value. On placing the order 2.5% will have to be paid by Demand draft drawn in fever of GUJARAT ENERGY TRANSMISSION CORPORATION LTD. Within seven days from the date of the issue of work order and remaining 2.5% will be recovered from list two running bills.The SD can also be paid by auto renewal FDR of any scheduled bank in the name contractor & not in the name of company, i.e it shall be GETCO A/C.

03 SIGNING OF AGREEMENT :

The contractor will have to sign agreement as per GETCO’s rule, in the prescribed Performa of the GETCO. The cost of the required stamp paper will have to be born by the contractor.

04 PAYMENT OF BILLS :

Normally one R.A.Bill will be paid every Month. However looking to the progress of the work it will be reviewed full way. The 90% cost of the work done will be paid to the contractor on his presentation of R.A. bills along with giving the material account and singing the joint measurement of the work done with our D.E.(TR/Const.) concerned. The bill should be submitted to the D.E.(TR/Const.) concerned with a copy to the E.E.(TR/Const.) concern. The final bill will be prepared by our D.E.(TR/Const.) concerned within about fortnight from the date of completion of the work by the contractor. The contractor have to submit the final bill with complete material account of the work contract to enable the D.E.(TR/Const.) for submission to E.E.(TR/Const.) for passing and payment thereof.

05 DEPARTURE FROM SPECIFICATION AND DRAWINGS :

Should be tenderer wish to depart from the specification in any respect, they should draw attention to such departure giving his reasons thereof and should get approved the case. However, in case of any clarification the decision of Engineer-in-charge will be final and binding.

06 AVAILIBILITY OF MATERIALS AND IDEAL LABOUR CHARGES :

Most of the materials are readily available and arrangements are made to procure the rest. However, the contractor should be prepared to carry out the work as and when the materials are received. No idle labour arises due to want of any materials will be allowed. However, this idle period will be counted for the period of assessing the limit for completing of work as mentioned in the work order.

07 Board does not accept any responsibility as regards to factory acts or any other acts. Rules

or regulations that have to be observed by the contractor for carrying out the work. 08 The contract will be governed by the General condition of works contract of the GETCO. A

copy of booklet will be available along with the tender, the contractor is deemed to have studied the same thoroughly before filling up the tenders.

10 PROGRESS OF WORK AND PENALTY: If it is found that the work is unsatisfactory or not progressing as per schedule, then any action be taken by the GETCO as may be deemed fit to see that work is completed at the risk and cost of contractor. If the work is not completed within the schedule period 1/2 % penatly per week of the balance value of the work subject to the maximum of 10% will be levied.

11 SPECIAL CONDITIONS OF THE CONTRACTOR : (a) The undersigned reserve the rights to reject any or all the tenders without assigning any

reasons thereof. (b) The tenderer should furnish the tender along with the details of past experience of such

erection works handled by him. (c) The tenderer will abide by any fulfill all the terms and provisions of the tenderer and

contractor for works as applicable and in case of any default there to the GETCO shall forfeit the deposit etc. and the money due in respect of completion of works through other agency on failure of tenderer to complete the work as required in the order.

12 BANK GAURANTEE OR SOLVENCY CERTIFICATE :

The successful contractor will have to produce Bank Guarantee or solvency certificate at the value 20% of the contractor value and shall have to execute the agreement on the stamp paper as may be required as per the rules of GETCO in force.

13 SPECIAL CONDITION OF CONTRACT : (a) Should this tender be accepted, I/We hereby agree to abide by and fulfill all the terms and

conditions of the Tender contractor for work’s as applicable and in default thereof to forfeit and pay GETCO the same sum of money due.

(b) The full value of the “Earnest Money Deposit’ paid herewith should be absolutely forfeited by the GETCO. Should I/We not deposit the full amount of specified security deposit.

15 TIME LIMIT :

The work will have to be completed within 4 months and tender have to complete the same within the time limit only. The time is the essence of this contract, the same will have to be adhered to the tenderer otherwise the penalty as per the GETCO’s rules will be recovered which should be noted.

16 SPECIAL NOTES: 1. The rate should be quoted both in words and figures as per units specified in the tender.

Should there be any discrepancy between the rate a quoted in words and figure, the rate quoted in words shall prevail. Further should there be any discrepancy between rates and amount the rates will prevail.

2. Quantities mentioned in scheduled are approximate and before ordering any materials prior

permission from the Deputy Engineer in-charge shall be taken and nothing extra will be paid for the material collected in excess.

3. Two books viz. tender and contractor for works and detailed specification for various Civil

Engineering works are available for reference in this office. The contractors quoting for this tender are deemed to have gone through both these books and same will be treated as binding upon them.

17. TERMS AND CONDITIONS REGARDING INDUSTRIAL LAW AND RELATED MATTERS

TO BE INCORPORATED IN THE TENDER DOCUMENTS:

1. WAGES TO BE PAID IN TIME BY THE CONTRACTOR. The contractor shall pay minimum of Rs. 25-15 per day or as may be specified here after or rates fixed under the minimum wages act whichever is higher. The wages of every contract labour employed by him under this contract shall be paid by him before the expiry of 7 days of the last day of the month in respect of which the wages are payable i.e. wages of a month have to be paid by him before the first week of the next month. The payment shall be disbursed in the presence of management representative during the work hours in factory premises and the contractor shall get the entries certified in the register of wages by the representative of the GETCO. Any default will result in cancellation of the contract forth with or else the contractor shall be punishable to the extent of Rs. 100-fine per each day.

2. The contractor shall give his telephone number and address to the GETCO so that incase of

labour trouble etc. the contractor can be contacted the contractor shall arrange to have his office the factory premises and the contractor keep himself present through the working hours.

3. LABOURS LAWS:

(a) Person below the age of 18 years shall not be employed for this work.

(b) No female worker shall be employed in the night shift between 7p.m. to 6 a.m..

(c) Contractor shall maintain a valid labour lenience under the contractor Labour(Relation and abolition) Act for employing necessary manpower to required by him in the absence of such license the contract shall be liable to be terminated without aligning any reasons thereof.

(d) The contractor shall at his own expenses comply with all labour laws and keep the

GETCO indemnified in respect thereof. Some of the major liabilities under various labours and industrial laws which the contractor shall comply which are as under.

(1) Payment of contribution by way of employer’s contribution towards provident payment fund Family Pension Scheme, Deposit Scheme deposit liked Insurance Scheme administrative charges etc. at the rates made applicable from time to time by Government of Gujarat/Government of India or other statutory authority.

(2) Payment of deposit in respect of each contract labour at the rates of Rs. 30/- with the

office of the Commissioner of the labours per the contract labour (Regulation and Abolition Act)

(3) License fee as prescribed under the contract Labour (Regulation and Abolition) Act

rules formed there under depending upon the number of workmen employee be the contractor.

(4) Paid leave facility and wages as per provision of the factories Act and the rate of one

day for every 20 days of working. (5) Identity cards as prescribed under the factories Act. With photo affixed there to the

same for identification. (6) Payment of retrenchment compensation Notice pay other liabilities as per industrial

disputes Act any payment to the contractor’s employees arising out of any claim of disputes under the industrial disputes Act 1947 or any other labour laws.

(7) Payment of compensation in case of accidental injury. (8) Provision of charge if the female labours employed are more than 30 members. (9) Maternity leaves as per the provision of the Maternity benefit Act.

4. PROVIDENT FUND AND FAMILY PENSION SCHEME: The contractor shall submit along with his bill(month wise) statement regarding deduction against employees provident fund and family pension scheme in respect of each concerned employees provident fund and family pension scheme at the rate of Rs. 8.33% (or at the rate made applicable by the Government form time to time) of the wages the contractor’s contribution and his workers contribution towards provident fund and family pension scheme shall be deposited by the contractor with Regional provident Fund commissioner, Ahmedabad.

5. DEPOSIT LINED INSURANCE SHCEME: The contractor shall have deposit ½% of the wages in respect of a employees who is member of the Provident fund as the contribution to the deposit link insurance scheme with Regional Provident Fund Commissioner, Ahemadabad.

6. ADMINISTRATIVE CHARGES:

Administrative charges for maintaining provident Fund Administrative A/c shall be deposited by the contractor with Regional Provident fund Commissioner, Ahmedabad at the rate applicable.

7. PAID LEAVE FACILITY: Paid leave facility at the rate of one day for every twenty days worked by the contractor labour shall be provided by the contractor to his workers. He shall maintain leave Record,

Leave cards for individual labourer which shall be duty verified and approved/certified by the authorized officer of the GETCO.

8. Workmen’s Compensation Fund and Employer’s Liabilities Insurance. The contractor shall cover all his employees under workmen’s compensation Fund and under the liability insurance.

9. The contractor shall employ adequate number of experienced staff at site for daily supervision and for maintenance of various registers and records required under the law and contract. No payment for supervision shall be admissible under the law and contract. No payment for supervision shall be admissible.

10. CONTRACT TO INDEMNITY THE BOARD:

The contractor shall identify the GETCO and every member office and employees of GETCO also Engineer-in-charge and his staff against all actions proceeding claims, demands costs and expenses what so arising out of or in connection with the matter referred in here in above elsewhere and against all actions proceedings claims demands cost and expenses which may be made against the GETCO of Government for or in respect of or for manse of his obligation under the contract documents. The GETCO shall not be liable for or in respect of or in consequence of any accident or injury to any workmen or other person in the employment of any accident or injury to any workmen or other person in the employment of the contractor or sub-contractor and the contractor shall indemnity any keep indemnified the GETCO against all such damage and compensation so ever in respect thereof or in relation thereof.

11. WORKMENS COMPENSATION AND EMPLOYER INSURANCE: Insurance shall be affected or the entire contractor’s employee engaged in the performance of this contract if any of the work is subject the contractor shall require the sub-contractor to provide workmen’s compensation and employee. Liability Insurance for the letter’s employees unless employee are covered under the contractor’s insurance.

12. The GETCO reserves the right to terminate this rat contract at any time during its tendency without giving notice of termination or any reasons thereof.

13. The GETCO will be entitled to deduct directly from the bills to be paid to the contractor any sums payable by you and which sums the GETCO is required to pay as a principal employer on account of your default in respect of all liabilities referred to in above clause.

14. SAFETY CUM INDEMNITY BOND

(On Non-judicial Stamp paper of value not less than Rs. 100.00) KNOW ALL MEN BY THESE PRESENTS that we, _______ by this SAFETY CUM INDEMNITY BOND Executed on this _____________ Day of _________ 2013. I/We Having Registered Office _______________________________(herein after called “THECONTRACTOR” which expression shall mean and includes my /our heirs, executors, administrators and legal representatives, successors and permitted assigns) do hereby binds myself/ourselves and also our company/firms after having the power to bind by this promise and undertaking in favour of the Gujarat Energy Transmission Corporation Limited (GETCO), Vadodara a State Transmission Utility under The Electricity Act, 2003 having its registered office at Sardar Patel Vidyut Bhavan, Race course, Vadodara.( hereinafter called as GETCO, which expression

shall mean and include its legal representative, administrators assigns) has agreed under the terms and conditions of the contract no.______ dated_______made between __________ and ___________for the contract of the ____________value of Rs. __________ interalia on production of Safety Cum Indemnity Bond. We do hereby undertake and agree to Indemnify and keep Indemnified GETCO from time to time to the extent of Rs.______ Rupees________only against any losses or damages, costs, charges and expenses caused to or suffered by reason of the CONTRACTOR while Project, R&M, O&M work including work carried out by outsourcing agency, failing to take proper care or not complying the guidelines given hereunder as per Annexure-A and instructions which may be given from time to time during the continuance of the contract and we further undertake to unconditionally pay the amount claimed by the GETCO on demand and without demur to the extent aforesaid. Whereas the CONTRACTOR has/have been awarded to execute the job/works under order no._____, dated ______ for _________ issued by the GETCO after having observing necessary formalities, the details of which is described in the order no.______ dated ______ and whereas the said job/works will be /likely to be done in places covered under Employees’ State Insurance Act,1948 (ESI) and /or the Workmen Compensation Act,1923 and /or other laws relating to the Labour Management and Welfare Act. (Respective Amendments) And whereas according to the condition of the Contract the CONTRACTOR is under obligation to execute this Safety cum Indemnity Bond before the commencement of actual execution of work Now the indenture witnesses that I/We the CONTRACTOR do hereby undertake to follow the guidelines as per Annexure-A prepared by the GETCO. Further we the CONTRACTOR agree that the GETCO shall be sole judge of and as to whether there has been any breach of the guidelines as per Annexure-A of this bond and as to the extent of the loss, damages, costs, charges and expenses caused to or suffered by the GETCO. We the CONTRACTOR further agree that our liability under this bond shall not be discharged because of the change in the constitution of the GETCO or for the extension of the time limit or for any other reason. We the CONTRACTOR further agrees to the given terms and conditions

a. That the CONTRACTOR undertakes /undertake to indemnify and keep harmless the GETCO from all claims, actions, proceedings and risk, damage danger to any person whether belonging or not belonging to the. CONTRACTOR.

b. That the CONTRACTOR shall keep harmless the GETCO from all claims, compensation, damages any proceedings in respect of any of its employee / workmen under the Workmen Compensation Act or any other laws for the timebeing in force.

c. That, if during the course of execution of work as stated in the contract order mentioned hereinabove issued by the OBLIGEE, it is found that the CONTRACTOR has not complied with guidelines as per Annexure-A or terms and conditions / formalities within the meaning of Employees’ State Insurance Act,1948 (ESI) or Workmen Compensation Act 1923 or any other laws relating to the Labour Welfare for the time being in force, and also has not observed the safety norms in accordance with the law prevailing at the place of work/job to the satisfaction of the GETCO, the GETCO shall have the right to stop the execution of work/job and the period of such stoppage shall not be taken into account for the calculation of the total period of completion of work for which the CONTRACTOR is responsible to complete the work/job and it will be deemed that discontinuance was due to default of the CONTRACTOR .

d. That, if any time, due to exigency, GETCO as the Principle Employer, becomes liable to pay any such compensation mentioned hereinabove, whether on failure of the CONTRACTOR or for any other reason, the GETCO shall have the right to recover the said amount from any amount receivable by GETCO or any bank guarantee deposited or anything payable whether in connection with this contract or other contract by the CONTRACTOR to the OBLIGEE.

e. That the CONTRACTOR is/are aware and accept that for the persistent or repeated violation of any guidelines as per Annexure-A and terms and conditions mentioned in this Safety cum Indemnity Bond, GETCO shall have right to terminate the contract of work issued to the CONTRACTOR .

f. In case if any safety related fatal Electrical / Mechanical accident occurred to any employee of agency or outsider due to negligence or non-compliance of GETCO safety norms then in addition to the compensation and liability as per statutory requirement, contractor / agency is hereby agreed to pay the penalty amount as given below: Sr. No Amount of Contract in Rs. h. This Safety cum Indemnity Bond shall continue and hold good until it is released by the GETCO in Writing on the CONTRACTOR’s application after the Contractor has discharged all his obligations under the order mentioned hereinabove and submitted a “NO DEMAND CERTIFICATE” from the GETCO under the said order. The Safety cum Indemnity Bond shall be valid for a CONTRACT PERIOD and renewable thereof (Claim Period).

i. This Safety cum Indemnity Bond and the guidelines as per Annexure-A herein contained are in addition to And not by way of limitation or substitution for any other guarantee, indemnities Hereto before given to the GETCO by the CONTRACTOR and this indemnity does not Revoke or limit such indemnities or guarantees. HT/LT line or tap line crossing under each span of line of the work. b. Isolation point of each line crossing. c. Each line crossing & isolation point under each span must be discussed and noted in maintenance register with sketch.

Following safety guidelines are mandatory for all contractors operating in GETCO premises for Electrical, non-electrical & civil works. 1. The contractors must provide advance planning of work to concerned in-charge of substation in writing. 2. Before starting any work whether switch yard, “permit to allow to work” must be taken from control room in-charge. 3. Utilizing Electrical / non-electrical equipments, safety rules must be implemented. 4. If the work is to be carried out on Sunday or public holiday, the necessary permission must be taken in advance, requesting in writing.

Contractor’s supervisor and GETCO Supervisor must ensure all isolations physically with adequate earthing technically prior to give clearance to gang leader for taking up job. While execution of stringing work, the identified line crossing must be isolated / de-energized and written clearance should be obtained from concerned DISCOM supervisor. The isolation of Tap line must be physically seen and verified by Contractor and GETCO supervisor. At D.O. fuse junction contractors person should be posted to ensure that no person restore D.O. supply while work is under execution Contractor’s supervisor must ensure that concern officer take LCP for EHV line and

SECTION – III

COMMERCIAL TERMS & CONDITIONS 1. Bidders who are authorized dealers of approved principal supplier and who have executed

such works successfully of jobs are entitled to obtain the Tender only. 2. Only those Vendors who have applied for registration with GETCO, H.O. Vadodara will be

issued the tenders upon production of the receipt of payment of registration fees. 3. Copy for valid registration with RPFC with PF code no. should be submitted along with the

tender without fail. 4. The quantities of work to be carried out will be according to the required site conditions. The

amount of works executed will be calculated at the rate given in the schedule of order. 5. The contractor shall be responsible for the breakages/losses and theft of materials from site

and the appropriate cost will be recovered from the contractor for any damage/loss to the GETCO’s equipments.

6. As regards damages to the materials/equipments and worker of the Contractor, the

contractor will only be responsible and the Contractor is liable to pay compensation as per the “WORKMAN COMPENSATION ACT”.

7. The Tenderer has to produce experience Certificate of the requisite order value along with

the tender. Offers without the same will be liable for rejection.

8. The competent authority can delete any item in the schedule of Tender if he feels that the rate quoted by the Contractor for that particular estimate are abnormally high.

9. The successful tenderer will have to pay the security deposit of 5% value of the work contract.

10. The contractor will be covered by the GETCO’s general conditions working contract. 11. The GETCO does not bind itself to accept the lowest of any tender. The undersigned

reserves the right to reject/accept any tender without assigning any reason whatsoever.

12. The payment shall be made against the work carried out as per the actual requirement. & I.T. will be ducted as per prevailing rules.

13. The party has to carry out the work immediately and the sub-order will be issued by the concerned EE (TR)/ (Const.)

In the event of any damage, theft, loss, pilferage, fire etc. contractor will be responsible to lodge, pursue and settle all the claims with the insurance company for all items, materials and the corporation shall be kept informed about it. Contractor shall replace the lost/damaged materials/items promptly irrespective of the settlement of the claims by underwriter and ensure that the work progress is as per agreed schedule. The loss, if any, such replacement will have to be borne by the contractor and Board will not entertain any claim/representation in this regard. However it will be contractor’s responsibility to insure the entire project till the line is taken over by the Board.

13. Terms & conditions of Welfare cess

• As per the Welfare Cess Act, the welfare cess @ 1% is applicable on supply and erection items for

supply, erection, testing & commissioning of substation, transmission lines, EPC/Turnkey projects

and civil works.

• Contractor shall get registered under Welfare Cess Act before commencement of work. Office of the

Factory Inspector is authorized at present as a registering authority.

• The welfare cess@1% is considered in the price schedules so, the bidders are requested to quote

accordingly.

• GETCO shall pay the welfare cess by way of reimbursing to contractors on production of

documentary evidence of payment.

• The contracts for which supply or part supply of material are in the scope of GETCO, then

contractors shall deposit welfare cess on estimated cost of supplied items to GETCO on progressive

basis of utilization. As this part of welfare cess is on GETCO account, the same shall be reimbursed

to the contractor on receipt of request letter along with documentary evidence of payment. For

calculation of welfare cess on supply part, valuation as per MR shall be taken and informed to the

contractor for payment. This will be over and above the A/T value.

The modality of payment/ reimbursement of welfare cess will be as under.

• On receipt of A/T, the contractor / bidder will get them registered under Welfare Cess Act and

submit the documentary evidence to the concern office.

• Before release of payment of first R.A.Bill, the contractor has to submit the documentary evidence

of registration. Only thereafter, the bill will be processed for payment.

• Before release of payment of subsequent R.A.Bills, the contractor has to submit the documentary

evidence of payment of welfare cess of previous R.A.Bill.

payment of welfare cess of previous R.A.Bill as well as of this final bill.

• If the R.A.Bill happens to be first and final bill, then before release of payment, contractor has to
