Law Practice

Patrick L. Benaroche is a senior partner and former Chair of the Employment and Labour

practice group of the Montréal office of Stikeman Elliott. With a background in organizational

Psychology, Patrick provides advice to major corporations on all aspects of Canadian

employment and labour law, with an emphasis on cross-border issues affecting a mobile

workforce. Patrick appears regularly before both civil and administrative tribunals on matters

relating to wrongful dismissal, workplace harassment and discrimination, non-competition

clauses and data privacy. He is often called upon by employers to advise on executive

employment contracts, termination packages, workplace policies, employment standards

and all matters arising from national and international employment relationships including

plant closures, corporate restructuring and mass terminations.

In addition to dealing with workplace health and safety issues, Patrick is well experienced in

management-labour relations, including union certification and decertification proceedings,

collective bargaining, grievance arbitration and management of strikes and lock-outs. He

also conducts workshops designed to facilitate employee/employer relationships in the

workplace and assists in the strategic planning of human resource management.

Patrick is a graduate of McGill University (B.A., B.C.L., LL.B.) and a member of the Quebec

Bar; he is also an officer of the Employment and Industrial Relations Committee of the

International Bar Association.

Having authored a number of publications and called upon to speak frequently at

employment law conferences, Patrick has been recognized in Who’s Who Legal: Labour,

Employment & Benefits 2016; PLC Cross-border Labour and Employee Benefits Handbook,

Shelley Brian Brown is an employment lawyer, specializing in employment law and employment related human rights law at Steinberg Title Hope & Israel LLP in Toronto. Prior to joining Steinberg Title he was legal counsel at the Prudential Insurance Company of America in Canada. He then became its Director of Human Resources and ultimately, Ethics Officer (Canadian Operations). In addition to numerous speaking engagements sponsored by the Law Society of Upper Canada. Shelley has spoken in Turkey to Canadian physicians/entrepreneurs as well as to classes at the University of Western Ontario and the Wharton School of Business in Philadelphia (Ethics in the Canadian Context). He has also been asked to comment on Weed in the Workplace for the Globe and Mail and Canadian HR Reporter. Carly Dunster is an associate at Turnpenney Milne LLP, practicing in all areas of labour and employment law, with a focus on workplace investigations. Prior to joining the firm, Carly articled at a prominent labour and employment firm in downtown Toronto, and worked in management and director positions in the non-profit sector. She has significant experience advising organizations on policy development and implementation, as well as facilitating effective training programs for employees and employers.

Carly received her Bachelor of Laws from the University of Windsor in 2006, and prior to that attended Queen’s University, where she received her Bachelor of Arts in History.

Barry B. Fisher

Barry B. Fisher is a mediator and arbitrator in Toronto. He was called to the Ontario Bar in 1979 and has been an ADR practitioner since 1987. His practice focuses on both labour matters as well as employment law matters. In 2011, Barry was awarded the Ontario Bar Association Award of Excellence in ADR. He is the author of the Wrongful Dismissal Database; an on-line database published by Carswell, designed to assist lawyers and human resource professionals in determining reasonable notice periods.

He is one of the most often chosen mediators for employment law cases under the Ontario Mandatory Mediator Program (now Rule 78). Barry is a frequent presenter at seminars and educational courses on issues relating to employment law, labour law and ADR. He is the past Chair of the ADR Section of the Ontario Bar Association and was formerly on the executive of the Ontario Labour Management Arbitrators Association and the Labour & Employment Section of the Ontario Bar Association.

Barry is also a frequent contributor on LinkedIn on employment law matters.

Christina Fuda Bio Christina is the Mental Health First Aid Coordinator at Ontario Shores. For the past two years she has trained over 1000 people from all different backgrounds and organizations to recognize and assist those living with mental illnesses. She has her Bachelor’s degree in Psychology, as well as her Master’s degree in Neuroscience from York University. Her published work can be found in the Journal of Vision. More recently she helped steer head a partnership between Ontario Shores and Ontario Power Generation to train 2000 of their people leaders to promote a mentally healthy and safe work environment for all OPG employees. Other organizations she has provided mental health training include Borden Ladner Gervais, The Beer Store, Greater Toronto Airports Authority, and OPP. She hopes to continue educating employees all across the GTA in an effort to decrease stigma and increase mental wellness for all her participants.

Toronto Employment Lawyer James Heeney is a partner at Robinson Heeney LLP. He provides advice to both employers and employees on all areas of employment law. James is driven to create a firm that focuses on integrity and attention to detail but which also provides advice which is cost effective and timely. He works diligently to ensure his clients make strategic and educated long term decisions. His employer side practice focuses on providing strategic daily advice and litigation support. He assists clients with employment agreements, policy manuals, terminations and human rights issues. James also has significant experience advising clients on drafting and litigating breaches of restrictive covenants.

In respect of the employee side of his practice, James routinely advises clients on issues relating to executive compensation, employment contracts, terminations and human rights.

James is an experienced workplace investigator having performed investigations in respect of all areas of employment law. James has experience performing complex investigations in both the unionized and non-unionized workplaces in which there is a need for both thorough and timely reporting.

Before founding Robinson Heeney LLP, James gained valuable experience practicing at a large national firm as well as a boutique employment law firm. James graduated from Queen’s University, and was called to the bar in 2004. James was named by the Canadian HR Reporter, a national employment law magazine, as a leading employment lawyer in Toronto.

James has significant experience performing speaking engagements, seminars and writing articles. Michelle S. Henry

Michelle is a Partner in the Toronto office of Borden Ladner Gervais LLP. She graduated from

the University of Toronto Faculty of Law in 2002. Prior to law school, Michelle received both

an Honours Bachelor of Arts (High Distinction) and a Masters of Arts in English from the

University of Toronto.

Michelle articled with BLG and then joined the Labour and Employment Group. She was a

partner at BLG until March 2012. In April 2012, Michelle joined Federal Express Canada as

Corporate Counsel. In October 2013, she resumed her practice as a Partner at BLG. Michelle

advises both private and public sector employer on various employment-related matters,

including disability management, restructuring, discipline, occupational health and safety

matters. She represents clients in litigation, including wrongful dismissal actions, injunctions,

human rights and other administrative tribunal proceedings. On the labour relations side,

Michelle acts on behalf of employers in grievance arbitrations, matters before Labour Relations

Boards, and in collective bargaining. She co-authored Dismissals in the Unionized Workplace,

published by Carswell.

Michelle also advises and acts on behalf of school boards, colleges, and independent schools in

various matters, including labour matters, court actions and applications, privacy law matters,

and issues pertaining to human rights. She has also acted as legal counsel to the School Principal

in suspension and expulsion hearings. More recently, she has acted as Independent Counsel to

the Panel of Trustees at expulsion and suspension hearings.

Michelle is a frequent speaker at client and professional seminars. Her professional and

community involvements include: Member of the Ontario Bar Association Council and chair of

the Pro Bono Committee; current member of Canadian Association of Black Lawyers’

Professional Development Committee; Co-Chair of the University Tribunal of the University of

Toronto; Vice-Chair of the Board of Director for LOFT Community Services; and Member of

Laila Karimi Hendry is a labour and employment lawyer in Hicks Morley’s Toronto office. She appears as counsel in all levels of court in Ontario and at the Human Rights Tribunal of Ontario.

Abdul-Basit Khan (“ABK”) practises in all areas of management-side employment and labour law and has substantial expertise defending employers in wrongful dismissal litigation and advising on all aspects of the employment relationship, including the enforceability of restrictive covenants, human rights considerations, labour relations issues and executive employment matters. Kumail maintains an active practice as a mediator primarily in the areas of

employment and human rights law. He has trained as a mediator at the Harvard Law

School’s Program of Instruction for Lawyers. In addition to mediating, he acts as a

third party neutral investigator and designs alternative dispute resolution systems for

organizations. Kumail was a part-time Vice-Chair at the Workplace Safety Insurance

Appeals tribunal (2007-2012), adjudicating disputes regarding workers’ compensation.

Kumail graduated from the University of Toronto Faculty of Law in 1997. He is the

President of the Co-operative Housing Federation of Toronto Charitable Fund and

Doug MacLeod – Biography

Since 1989 when he was called to the Ontario Bar, Doug MacLeod, Managing Partner of the MacLeod Law

Firm, has been practicing exclusively in the area of employment, labour and human rights law.

He has taught a number of courses at George Brown College including employment law, labour relations

and human rights law, and the Law Society of Upper Canada has certified him to provide Continuing Legal

Education programs to other lawyers on various employment law issues. Doug has obtained a certificate

from the University of Windsor, Faculty of Law, for successfully completing the Advanced ADR Program,

and he mediates employment disputes on a part-time basis.

Doug often writes and speaks on employment law issues on topics as diverse as: terminating employees

for social media postings, the implications of the sharing economy on Ontario’s labour laws, and an

employer’s obligations under the Accessibility for Ontarians with Disabilities Act.

In addition to providing legal advice, Doug is a trusted advisor to his clients. In this regard, he graduated

from Western University’s Ivy School of Business, runs his own business and he understands the non-legal

aspects of operating a business.

A. Jane Milburn, B.A. (Hons), LL.B.

Jane is the founding partner of Milburn & Associates and has focused her practice on employment law and commercial litigation since she was called to the bar in 1997. She regularly advises clients about employment terminations, written offers of employment, constructive dismissal cases and international assignments. She has a particular wealth of knowledge and experience in dealing with employment issues for executives in the financial services industry and has a high degree of familiarity with compensation and employment practices in that industry. She also has expertise advising clients in situations where discrimination, harassment or bullying arise.

Jane has appeared as counsel in all levels of court in Ontario and attends mediations and arbitrations on behalf of clients. Jane has appeared as a panel member on CBC Newsworld and she has spoken at conferences hosted by the Law Society of Upper Canada and the Ontario Bar Association. Jane has been interviewed by The Globe and Mail, The Lawyers’ Weekly, the National Post and other leading publications. She is a member of the Advocates' Society, Canadian Bar Association and Women in the Capital Markets. Andrew Monkhouse is the manager partner and owner of Monkhouse Law, a firm that specializes in employment, labour, human resources and disability insurance law. Working for both employees, independent contractors, and employers Monkhouse Law strives to get the optimal results for each client through skilled advocacy and expert research on each matter. Andrew has worked tirelessly for clients in civil litigation specializing in employment and human resources law. Prior to founding Monkhouse Law, Andrew worked for Canada’s

largest labour and employment firm and for the government of Canada. He has proudly advised and represented employees, as well as employers. Elaine Newman, Ba, LL.B., LL.M., called to the bar in Ontario in 1979.

Mrs. Newman is a very experienced full-time arbitrator and mediator,

specializing in labour relations, employment, and human rights matters. She

is a teacher, an author, and frequent speaker on labour, employment and

human rights issues.

Mrs. Newman served as Associate Director of the LLM program in Labour

Relations and Employment Law at Osgoode Hall Law School 2002 to 2008.

She was Lead Instructor for the Advanced Dispute Resolution Course at

Atkinson Faculty, York University for ten years, where she taught the Ethics

of Mediation course, and the Advanced Practicum course. She is a frequent

guest speaker at the Queen’s University Industrial Relations Centre, and is

Lead Instructor of the Queen’s University IRC Course entitled, “Strategic

Grievance Handling”.

Mrs. Newman is the author of the on-line course, “Practical Ethics for

Working Mediators”, a mandatory prerequisite to membership with the

ADR Institute of Ontario for all mediators working in the province.

Mrs. Newman’s textbook, Preventing Violence and Harassment in the

Workplace, is published by Lancaster House, 2012, Toronto.

Prior to becoming a full-time mediator in January of 2016 Connie was a partner at Blakes, a leading Canadian business law firm. Connie practiced commercial litigation for the first part of her career and then spent 17 years practicing employment law. In her litigation practice Connie represented clients in cases involving professional negligence, partnership law, the termination of long-term contractual relationships and insurance coverage. In her employment law practice she provided both advisory and advocacy services, advising on a myriad of compliance issues and representing clients in dismissal litigation and in disputes concerning the interpretation of contracts, restrictive covenants, fiduciary obligations, sexual and workplace harassment, and discrimination.

In 1997 she completed Osgoode Hall’s first part-time LL.M. program in Alternative Dispute Resolution. In 2002 she was certified by the Law Society of Upper Canada as a Specialist in Civil Litigation. Connie taught trial advocacy at Osgoode Hall Law School and Alternative Dispute Resolution at Queens’ Faculty of Law. For many years Connie was also a guest instructor at Osgoode Hall’s Intensive Trial Advocacy Workshop and at skills training programs offered by the Advocates’s Society.

Connie is the recipient of the 2015 Randall Echlin Mentorship Award and the 2012 Catzman Memorial Award for Professionalism & Civility. She has spoken at legal conferences on a wide range of topics, presenting papers or leading panels on, among other subjects, the conduct of workplace investigations, accommodation in the workplace and restrictive covenants. This past April Connie participated in a panel discussion on "Ethical Issues in Mediation", organized by The Advocate's Society. She has been the co-chair of the Law Society's Annual Employment Law Summit for the past 5 years.

Peigi Ross practiced at a large boutique labour and employment firm until 2003, when she became Employment Law Counsel to the Scotiabank Group of Companies. As a result of her experience at the Bank Peigi gained a unique insight into the practical needs and interests of an employer. Peigi joined Dunsmore Law in 2006. She has extensive experience in human resources management, collective agreement negotiations, arbitrations, adjudications, wrongful dismissal litigation, labour board proceedings, human rights, workplace investigation and executive compensation. Peigi bargains on behalf of various clients, conducts municipal interest arbitrations and has a significant practice involving the administration of collective agreements. She has also participated in numerous Human Rights Tribunal hearings and teaches accommodation to various employer groups. She trains employers on collective bargaining, collective agreement issues, employment standards and workplace compliance with Human Rights Code and Occupational Health and Safety matters. Carita has represented both employers and employees before the courts, federal and provincial labour boards, human rights tribunals, and other employment-related administrative tribunals. She acts in relation to matters involving wrongful dismissals, mass terminations and lay-offs, human rights applications, employment standards claims, and workplace health and safety.
