All potential buyers must register for the sale prior to placing a bid.Registration information may be submitted in person at our reception desk,by fax or through our website at www.freemansauction.com. We will requireproof of identification and residence and may require a credit card and/or abank reference. By registering for the sale, the buyer acknowledges that heor she has read, understood and accepted Freeman’s Terms and Conditionsof Sale.

A Buyer’s Premium will be added to the successful bid price and is payableby the buyer as part of the total purchase price. The Buyer’s Premium shallbe: 25% on the first $75,000 of the hammer price of each lot, 20% on theportion from $75,001 through $1,500,000, and 12% thereafter.

All items in the catalogue are subject to the 8% Pennsylvania andPhiladelphia sales tax. Dealers purchasing for resale must register their taxnumbers on current PA forms. Forms should be submitted to our ClientServices office on the second floor.

All item descriptions, dimensions and estimates are provided for guidanceonly. It is the buyer’s responsibility to inspect all lots prior to bidding toensure that the condition is to their satisfaction. If potential buyers areunable to inspect lots in person, our specialists will be happy to preparedetailed Condition Reports on individual lots as quickly as possible. Theseare for guidance only, and all lots will be sold “as is” as per our Terms andConditions of Sale.

At the sale Registered bidders will be assigned a bidder number and given apaddle for use at the sale. Once the first bid has been placed, theauctioneer asks for higher bids in increments determined by the auctioneer.To place your bid, simply raise your paddle until the auctioneeracknowledges you. The auctioneer will not mistake a random gesture for abid.

By phone A limited number of telephone lines are available for bidding byphone through a Freeman’s representative. Phone lines must be reserved inadvance. Requests must be submitted no later than 24 hours prior to thescheduled start of the sale.

In writing Bid forms are available in the sale room and at the back of thecatalogue. These should be submitted in person, by mail or by fax no laterthan one hour prior to the scheduled start of the sale. The auctioneer willbid on your behalf up to the limit.

On the internet A fully-illustrated catalogue is available on-line atwww.freemansauction.com. Registered bidders may leave absentee bidsthrough the web site and will receive email confirmation of their bid.Freeman’s is not responsible for errors or failure to execute bids.

Payment is due within ten (10) working days of the sale. Lots purchased willnot be released until we have received full payment. Payment may be madein cash, by check, money order, or debit card. Payments by check must clearthe bank before goods will be released.

Deliveries will not be made during the time of the sale unless otherwiseindicated by the auctioneer. All items must be paid for and removed withinten (10) working days of the sale. Purchases not so removed may be turnedover to a licensed warehouse at the expense and risk of the purchaser.

Responsibility for packing, shipping and insurance shall be exclusively thatof the purchaser. Upon request, Freeman’s will provide the purchaser withnames of professional packers and shippers known to us.

NOTE:Frederick Gutekunst was born in the Germantown section of Philadelphia. Whilestudying to be a druggist, he became interested in photography and after masteringambrotypes and daguerreotypes, with the help of his brother, he opened a studio at706 Arch Street in 1856. Gutekunst photographed many notable personalities of thelate 19th century, including poets, presidents and Civil War generals such as Grant,Sherman and Longstreet, earning him the title “The Civil War Photographer.” Inaddition to his portraits, Gutekunst photographed many scenes in and around thePhiladelphia, Bucks County and Delaware areas, the battlefield of Gettysburg and theCentennial International Exhibition of 1876 (including a widely reproducedpanorama). By 1882, Gutekunst was reported to be the leading photographer inPhiladelphia. In 1893, Gutekunst opened a large portrait studio at 1700 North BroadStreet, which is a mere eight blocks from 17th & Dauphin, the area pictured in 5 ofthe photographs in this lot.$2,500-3,500

All property offered and sold (“property”) through Samuel T. Freeman & Co, (“Freeman’s”) shall be offered and sold on the terms and conditionsset forth below which constitutes the complete statement of the terms and conditions on which all property is offered for sale. by bidding at theauction, whether present in person or by agent, by written bid, telephone, internet or other means, the buyer agrees to be bound by these termsand conditions.

11No “buy” bids shall be accepted at any time forany purpose.

12Any pre-sale bids must be submitted in writing toFreeman’s prior to commencement of the offer ofthe first lot of any sale. Freeman’s copy of anysuch bid shall conclusively be deemed to be thesole evidence of same, and while Freeman’saccepts these bids for the convenience of biddersnot present at the auction, Freeman’s shall not beresponsible for the failure to execute, or, toexecute properly, any pre-sale bid.

13A Buyer’s Premium will be added to the successfulbid price and is payable by the buyer as part ofthe total purchase price. The Buyer’s Premiumshall be: 25% on the first $75,000 of the hammerprice of each lot, 20% on the portion from$75,001 through $1,500,000, and 12% thereafter.

14Unless exempted by law from the payment thereof,the buyer will be required to pay any and all federalexcise tax and any state and/or local sales taxes,including where deliveries are to be made outside thestate where a sale is conducted, which may besubject to a corresponding or compensating tax inanother state.

15Freeman’s may, as a service to buyer arrange tohave purchased property posted and shipped atthe buyer’s expense. Freeman’s is not responsiblefor any acts or omissions in packing or shipping ofpurchased lots whether or not such carrierrecommended by Freeman’s. Packing and handlingof purchased lots is at the responsibility of thebuyer and is at the entire risk of the buyer.

16In no event shall any liability of Freeman’s to thebuyer exceed the purchase price actually paid.

17 No claimed modification or amendment of thisAgreement on the part of any party shall bedeemed extant, enforceable or provable unless itis in writing that has been signed by the parties tothis Agreement. No course of dealing and nodelay or omission on the part of Freeman’s inexercising any right under this Agreement shalloperate as a waiver of such right or any otherright and waiver on any one or more occasionsshall not be construed as a bar to or waiver of anyright or remedy of Freeman’s on any futureoccasion.

18These Conditions of Sale and the buyer’s, theConsignor’s and Freeman’s rights under theseConditions of Sale shall be governed by, construedand enforced in accordance with the laws of theCommonwealth of Pennsylvania and Consignorand Buyer agree to the exclusive jurisdiction of thePhiladelphia, Pennsylvania Court of CommonPleas and the United States District Court for theEastern District of Pennsylvania.

all Property shall be paid for and removed by thebuyer at his/her expense within ten (10) days ofsale and, if not so removed, may be sold byFreeman’s, or sent by Freeman’s to a publicwarehouse, at the sole risk and charge of thebuyer(s), and Freeman’s may prohibit the buyerfrom participating, directly or indirectly, as abidder or buyer in any future sale or sales. Inaddition to other remedies available to Freeman’sby law, Freeman’s reserves the right to impose alate charge of 1.5% per month of the totalpurchase price on any balance remaining ten (10)days after the day of sale. If Property is notremoved by the buyer within ten (10) days, ahandling charge of 1% of the total purchase priceper month from the tenth day after the sale untilremoval by the buyer shall be payable toFreeman’s by the buyer; Freeman’s shall charge1.5% of the total purchase price per month for anyproperty not so removed within 60 days after thesale. Freeman’s will not be responsible for anyloss, damage, theft, or otherwise responsible forany goods left in Freeman’s possession after ten(10) days. If the foregoing conditions or anyapplicable provisions of law are not compliedwith, in addition to other remedies available toFreeman’s and the Consignor (including withoutlimitation the right to hold the buyer(s) liable forthe bid price) Freeman’s, at its option, may eithercancel the sale, retaining as liquidated damagesall payments made by the buyer(s), or resell theproperty. In such event, the buyer(s) shall remainliable for any deficiency in the original purchaseprice and will also be responsible for all costs,including warehousing, the expense of theultimate sale, and Freeman’s commission at itsregular rates together with all related andincidental charges, including legal fees. Payment isa precondition to removal. Payment shall be bycash, certified check or similar bank draft, or anyother method approved by Freeman’s. Checks willnot be deemed to constitute payment untilcleared. Any exceptions must be made uponFreeman’s written approval of credit prior to sale.In addition, a defaulting buyer will be deemed tohave granted and assigned to Freeman’s, acontinuing security interest of first priority in anyproperty or money of, or owing to such buyer inFreeman’s possession, and Freeman’s may retainand apply such property or money as collateralsecurity for the obligations due to due toFreeman’s. Freeman’s shall have all of the rightsaccorded a secured party under the PennsylvaniaUniform Commercial Code.

10Unless the sale is advertised and announced as“without reserve”, each lot is offered subject to areserve and Freeman’s may implement such reservesby bidding through its representatives on behalf ofthe Consignors. In certain instances, the Consignormay pay less than the standard commission ratewhere Freeman’s or its representative is a successfulbidder on behalf of the Consignor. Where theConsignor is indebted to Freeman’s, Freeman’s mayhave an interest in the offered lots and the proceedstherefrom, other than the broker’s Commissions, andall sales are subject to any such interest.

1Unless otherwise indicated, all Property will beoffered by Freeman’s as agent for the Consignor.

2Freeman’s reserves the right to vary the terms ofsale and any such variance shall become part ofthese Conditions of Sale.

3Buyer acknowledges that it had the right to makea full inspection of all Property prior to sale todetermine the condition, size, repair or restorationof any Property. Therefore, all property is sold“AS-IS”. Freeman’s is acting solely as an auctionbroker, and unless otherwise stated, does not ownthe Property offered for sale and has made noindependent investigation of the Property.Freeman’s makes no warranty of title,merchantability or fitness for a particular purpose,or any other warranty or representation regardingthe description, genuineness, attribution,provenance or condition to the Property of anykind or nature with respect to the Property.

4Freeman’s in its sole and exclusive discretion,reserves the right to withdraw any property, atany time, before the fall of the hammer.

5Unless otherwise announced by the auctioneer atthe time of sale, all bids are per lot as numberedin the printed catalogue. Freeman’s reserves theright to determine any and all matters regardingthe order, precedence or appropriate increment ofbids or the constitution of lots.

6The highest bidder acknowledged by the auctioneershall be the buyer. The auctioneer has the right toreject any bid, to advance the bidding at his absolutediscretion and in the event of any dispute betweenbidders, the auctioneer shall have the sole and finaldiscretion either to determine the successful bidderor to re- offer and resell the article in dispute. If anydispute arises after sale, the Freeman’s sale recordshall be conclusive in all respects.

7If the auctioneer determines that any opening or laterbid or any advance bid is not commensurate with thevalue of the Property offered, he may reject the sameand withdraw the Property from sale.

8Upon the fall of the hammer, title to any offeredlot or article will immediately pass to the highestbidder as determined in the exclusive discretion ofthe auctioneer, subject to compliance by the buyerwith these Conditions of Sale. Buyer thereuponassumes full risk and responsibility of the propertysold, agrees to sign any requested confirmation ofpurchase, and agrees to pay the full price, plusBuyer’s Premium, therefore or such part, uponsuch terms as Freeman’s may require.

9No lot may be removed from Freeman’s premisesuntil the buyer has paid in full the purchase pricetherefor including Buyer’s Premium or hassatisfied such terms that Freeman’s, in its solediscretion, shall require. Subject to the foregoing,
