Delhi Commission for Women on Thursday issuedsummons to DCP North and SHO of Kashmere Gatepolice station in connection with an attack on AamAadmi Party MLA Alka Lamba on last Sunday.

The DCW has asked both the police officials to appearbefore it on August 17, as per ANI.

Lamba suffered a minor head injury on Sunday after astone was pelted at her while she was interacting withhomeless people near Kashmere Gate during an anti-drugdrive. Teenager Jatin, who works at a sweet shop, wasarrested following Lamba's complaint.

Police said that Lamba, an MLA from Chandni Chowkconstituency, sustained simple blunt injury on her headand was discharged from hospital after being adminis-tered first aid. In her complaint to police, Lamba said thatJatin had lobbed a stone when she opposed the encroach-ment by some shopkeepers in the Kashmere Gate area.

"At the time of the attack, Lamba was outside ShivMishthan Bhandar, where Jatin works," IANS quoted DyCommissioner of Police Madhur Verma as saying.

Impounding illegally plying e-rick-shaws: Delhi govt to HC NEW DELHI

The AAP government today told the Delhi High Courtthat it is impounding all e-rickshaws which are plying inthe city on non-designated roads in violation of the rulesregulating them. Justice Manmohan was told that as perthe government's December 11, 2014, notification, e-rickshaws have been banned from plying or parking on236 roads in the city. The government said e-rickshawswhich are found running on these roads are impoundedas fining them was not a deterrent.

It also told the court that it was in the process of fram-ing a legislation to regulate e-rickshaws.

The submission was made in response to the court'squery whether e-rickshaws are permitted to ply or arethey still illegal despite the notification. The court askedthe government to place on the record its notificationbefore the next date of hearing on October 12. Accordingto the government notification, in New Delhi area e-rick-shaws have been restricted from plying on 77 roads.

It says e-rickshaws cannot also ply on 19 roads andlocations in central Delhi. Apart from central Delhi, 38roads in south Delhi and 23 in south-east have been iden-tified where such vehicles are prohibited.

Other roads where there is a ban on the battery-operat-ed vehicles are 12 roads in north Delhi, 15 in north-west,11 in north-east, 9 in east, 21 in south-west and 9 roadsin west Delhi. The central government had also notifiedthe Central Motor Vehicles (Sixteenth Amendment)Rules, 2014, which paves way for plying of 'special pur-pose battery operated vehicles'.

Delhi govt proposes free WiFi upto 1GBfor a monthNEW DELHI

Inching closer to the fulfilment of its WiFi promise, theDelhi government has proposed to provide free WiFiusage up to 1GB for a month. Ashish Khetan, vice-chair-man of Delhi Dialogue Commission, said that the gov-ernment will provide free WiFi in all government andprivate colleges within one year, as part of the first phase.

Speaking on 'Wireless Broadband Vision Forum' atFICCI Federation House here, Khetan said that in secondand third phases, public WiFi will be provided in ruralareas and unauthorised colonies respectively.

"The minimum speed of the WiFi that we are propos-ing is 1 Mbps for good user experience and each usershould get 1 GB of downloads for a month free."

"In the first phase, which should not take more thanone year to complete, free WiFi will be available in bothprivate and government colleges in Delhi," he said.

There are roughly 275 rural and urban villages whichdon't have access of Internet in the capital. "We are alsoproposing that government should not own infrastructureand the payment module should be an opex (operationalexpenditure) module based on total data consumption. Itwill ensure that government only pays according to actu-al usage," Khetan said. The DDC vice-chairman notedthat the Delhi government would like to have rights ofadvertisements of public interest campaigns and thosepromoting the policies of the government of Delhi duringthe free-usage of the service.

Gupta on Thursday movedthe Delhi High Court alleg-ing that the Aam AadmiParty (AAP) governmenthad not consulted him onappointing the Lokayukta(anti-corruptin ombuds-man) even though he wasthe leader of the oppositionin Delhi assembly.

Gupta has contended thatas per Delhi Lokayuktaand UpLokayukta Act,1995, the appointment pro-cedure provides that theleader of the oppositionhas to be consulted.

He has alleged that Delhigovernment's affidavit,claiming that it has initiat-ed the process of consulta-tion by submitting its sug-gestion for filling up thepost of Lokayukta to theDelhi High Court ChiefJustice, was "false andmisleading" as "no consul-tation process" has beeninitiated with him.

Gupta has made the alle-gations in an applicationseeking intervention in themain petition filed by BJPleader Sat Prakash Ranafor appointment to thevacant post of Lokayukta.

Apart from seeking tointervene in the petition, he

has also prayed for direc-tions to Delhi governmentto withdraw its affidavit, tocomply with statutory pro-visions and to start consul-tation with him.

In his application filedthrough advocate SushilKumar Pandey, Gupta has

also alleged that theprocess that Delhi govern-ment has stated to havebegun was "nothing but adelaying tactic".

Delhi government had onJuly 24 filed an affidavit inthe court stating that it hasinitiated the process toappoint Lokayukta, a postwhich has remained vacantsince November 2013.

It said that in compliancewith the statuary mandates,it has "initiated the processof consultation by submit-ting its suggestion for fill-ing in the vacant post ofLokayukta in a sealedcover, by a letter date July10, 2015, to the Delhi HighCourt Chief Justice."

"It is, therefore, mostrespectfully submitted thatthe process of appointmentof Lokayukta has been ini-tiated and is in process.The present petition maybe kindly dismissed asinfructuous," it had added.

today agreed to hear indetail the appeals filed bythe victims of 1987Hashimpura massacre andthe Uttar Pradesh govern-ment against acquittal of16 policemen in the caseby a trial court, saying itrequires serious considera-tion and cannot be brushedaside. "The issue requiresserious consideration and itcannot be just brushedaside. We will hear the par-ties in detail," a benchcomprising justices SanjivKhanna and R K Gaubasaid.

After perusing therecords, the bench saidoccurrence of the incidentis not in dispute and even

the trial court had said thisin its judgement whileacquitting the policemen.

"There are three issues,first that the occurrence isnot disputed, second thatthe .303 bullets were foundwhich are primarily frompolice rifles and the thirdpoint is the truck which theFSL said it was washed.These are some of thepoints which require seri-ous consideration," thebench said to the counselof victims of massacre.

Meanwhile, NationalHuman RightsCommission (NHRC) alsofiled an intervener applica-tion seeking further inquiryinto the incident and fram-ing of guidelines for casesof custodial crimes.

"Owing to the malafidenature of investigation, thepolice as well as the CB-CID have deliberately sup-pressed and concealed cer-tain material evidences, inorder to screen the accusedProvincial ArmedConstabulary (PAC) per-sonnel and to shield themfrom punishment.

"There is reason tobelieve that, facts and doc-uments within the knowl-edge of the PAC were sup-pressed or not brought onrecord before the trialcourt," NHRC said in itsplea.

The plea further said thatgiven the "scale and gravi-ty of custodial crimes",their is urgent need forissuance of guidelines for

redressal and prevention ofsuch offences.

The court issued noticeto all 16 policemen on theNHRC's plea and soughttheir response before thenext date of hearing onOctober 20.

It also asked the victims'counsel as how can DelhiLegal Service Authority(DLSA) be made to paythe compensation to theaffected families as per thetrial court order and whatquantity of compensationcould be granted and bywhom.

Earlier, on May 29, thecourt had sought responsefrom the 16 policemen onthe appeal filed by UP gov-ernment against the trialcourt verdict.

Justice Suresh Kaitsent the matter to the high court's medi-ation centre after both sides agreed withthe court's suggestion to sit together andsettle the dispute. The matter will betaken up by the mediation centre onAugust 25 and, if they fail to arrive at asettlement, the court would take up thematter on October 14, 2015, JusticeKait said. The court passed the orderwhile hearing the plea of Irani who hassought quashing of the summons issuedto her by a trial court on June 6, 2014,on a complaint filed by Nirupam. Shehas also sought quashing of the com-

plaint. In the present case, Nirupam, aformer Congress MP, had filed thecomplaint against Irani alleging that onDecember 20, 2012, when assemblyelection results of Gujarat wereannounced, the BJP leader had made"defamatory and scurrilous comments"against him during a TV debate "bymaking direct aspersions on the charac-ter of the complainant (Nirupam)."Nirupam had said that he had sent alegal notice to Irani through his counselon July 25 last year asking her to tenderan "unconditional public apology" forallegedly making defamatory com-ments but she did not reply to it. "Don't play fool with us. We are used tocounsel. We are used with the jugglery of

words," it said at the fag end of the dayand asked the counsel for accused to showone "good" ground for recall of witnessesincluding the girl.

The bench may also lay down guidelinesas to whether an accused has right to getwitnesses recalled for re-examination in acriminal trial. Referring to trial courtrecords, the bench said, "You are askingtotally irrelevant and nonsense questionsin the cross-examination."

"So far as the occurrence of crime isconcerned, in the three days of the cross-examination, there was no relevant ques-tions were asked by you," the bench, alsocomprising Justice Adarsh Kumar Goel,said. The prosecutrix gave a "perfectanswer" to question asked about the cab'spicture taken by her and "For three daysyou only embarrassed her. You onlyinsulted her," it said.

"The `Outline of the

12th Five Year Plan forNational Economic andSocial Development of thePeople`s Republic ofChina` indicates that threemore hydropower projectson the main stream of theBrahmaputra river in TibetAutonomous Region havebeen approved for imple-mentation by the Chineseauthorities," she said.

"As these projects areconsidered to be run ofriver (RoR) hydro-electricprojects, any significantchange in water level ofriver Brahmaputra is notexpected," the ministeradded.

monitoring all develop-ments with regard toBrahmaputra river, shesaid India has conveyedits views and concerns tothe Chinese authorities.

"India has conveyed itsviews and concerns to theChinese authorities at thehighest levels. It has urgedChina to ensure that theinterests of downstreamstates are not harmed byany activities in upstreamareas," the minister stated.

session, the BJP leader said theopposition did not have any validreason to disrupt the house.

"This was a disruption without acause," he said, adding that theCongress never wanted power togo out of the Gandhi family`shands. Jaitley said the NDA wouldtake the issue among the people."We will send different teams ofour leaders in all 44 constituenciesof the Congress and nine of thoseLeft parties to tell people thetruth." General Mukul Rohatgi,the bench also heard exten-sively two amicus curiae --K Parasaran and T RAndhyarujina-- on theissue. The pleas had soughtsetting aside of sections499 and 500 of the IPC andsuggested that there is aneed to decriminalise penalprovision for offence ofdefamation.

Pitching for their reten-tion in the statute book, theCentre had strongly battedfor the laws on groundsincluding that they havestood the test of time.

Alternatively, it hadsought the petitions be sentto a larger constitutionbench.

Rohatgi had said that set-ting aside the penal

defamation laws wouldlead to "anarchy" and no"orderly society" can havea situation where every-body can say anythingagainst anybody.

"Does the freedom ofspeech and expression nec-essarily mean that one cansay anything about any-body? Can any orderlysociety have this kind ofbehavioural norms?

"If yes, then you willhave nothing but the anar-chy," Rohatgi had told thecourt.

"There is no great pointin striking down the penalprovisions...Nobody canbe allowed to damage thereputation of others by say-ing something defamato-ry," he had said.

"We wish to focus atten-tion on some issues thathave grave implicationsfor national security, andmerit your attention, notonly as the supreme com-mander of the armedforces but also as the firstcitizen of India," the for-mer chiefs said in an"open letter" to PresidentPranab Mukherjee, addingthat it was "with a sense ofdeep anguish" that theywere drawing his attention"to the dismal spectacle ofour veteran soldiers, driv-en to undertake public

protests and demonstra-tions to press theirdemand".

The first of issues wasthat "denial of OROP ismerely the last straw thathas exhausted the veter-ans` patience", said thesignatories, former IndianNavy chiefs Admiral ArunPrakash, Admiral L.Ramdas and AdmiralSureesh Mehta, and for-mer Indian Army chiefGeneral S.F. Rodrigues.They are the senior-mostofficers to associate withthe agitation, underwayfor two months now atJantar Mantar in the heartof the national capital.

The agitation "appearsto be the culmination of aprocess by which succes-sive Pay Commissionshave been used to whittledown the financial andprotocol status of the mil-itary over the years vis-à-vis their civilian counter-

On 29 March, 2015, whenSingapore bade farewellto Lee Kuan Yew, its first

and longest-serving PrimeMinister, India participated inthe event in both top-down andbottom-up ways. Prime MinisterNarendra Modi attended thestate funeral, the Indian flag flewat half-mast; and in Tamil Nadu,which shares a cultural affinitywith Singapore’s Tamil popula-tion and sends many migrantworkers there, gatherings wereorganised to watch the funeral.

LKY, as he is informallyknown, led the Little Red Dotrepublic from the third world tothe first in a generation, and hasbeen hailed as one of the leadingAsian statesmen of the twentiethcentury. Singapore recently cele-brated 50 years of independence.This is an opportune moment toexamine what India can takefrom this island nation’s incredi-ble half-century.

Public sector pay

Much of Singapore’s successis attributed to a clean and effi-cient government. LKY believedthat competitive salaries wererequired to attract the society’sbest people into public serviceand bring out their best. In 1996,he argued, “Low salaries will notattract able men who are or canbe successful in their professionsor business. Low salaries willdraw in the hypocrites whosweet talk their way into powerin the name of public services,but once in charge, will showtheir true colour, and ruin thecountry...”

Of course, pay should never bethe sole reason people aspire tojoin politics or the civil services.But low pay should also notdeter capable and public-spiritedpeople from government service.Singapore has a unique systemof setting bureaucrats’ pay —public sector salaries are linkedvia a formula to comparable pri-vate sector jobs. This approach

reflects the choices and trade-offs individuals face whileselecting careers.

By contrast, in India, succes-sive Central Pay Commissionshave restructured the salaries ofgovernment officers just sixtimes in the past 68 years.Adjustments often take the formof applying a multiple to existingsalaries, which do not take intoaccount changes in the marketprice for certain skills due todevelopments in the wider

labour market. Carefullydesigned indexation can addressthis issue.

For public service jobs with noobvious comparison group —like police officers or adminis-trators — the government canaim for a person with a certaincalibre to be recruited and setsalaries based on what a personwith these qualifications couldearn in the best private sectorjobs. In Singapore senior admin-istrative service officers (andMinisters) receive few non-mon-etary benefits, but have theirsalaries indexed — with reason-able discounts applied — tosalaries of private sector execu-tives.

Singapore was one of the

fastest-growing economies in theworld during the post-war periodlargely due to interventions byan activist state. The countryheavily invested in infrastructureand institutions — transportationnetworks, labour skilling, anattractive tax regime — to attractForeign Direct Investment (FDI)in sectors that created low-skilled manufacturing jobs in thelate 1960s. The share of manu-facturing in Singapore’s GrossDomestic Product (GDP) almostdoubled from below 16 per cent

in 1960 to 28 per cent by 1980.

The government also investedheavily in primary education,which enabled a larger share ofthe population to participate inthe economic growth that was tofollow. And as its own demo-graphics and cost structureschanged, Singapore’s industrialpolicy evolved, moving up thequality ladder to attract indus-tries that would create jobs tomatch the skill levels of itsincreasingly educated popula-tion.

What lessons does this hold forIndia? India’s growth has beenfuelled by services that are skill-intensive and do not readilyabsorb (unskilled) labour andresources from other sectors.

This, as the Economic Survey2014-15 highlighted, has ham-pered the potential of these sec-tors (especially organised manu-facturing) to spread the benefitsof growth across the economy.

Fortunately, the two flagshipcampaigns of the present gov-ernment — Make in India andSkill India — seem to recogniseLKY’s prescient advice, deliv-ered in the 2005 NehruMemorial Lecture, that, “Sincethe industrial revolution, no

country has become a majoreconomy without becoming anindustrial power.”

Women’s participation

When Singapore became inde-pendent in 1965, few womenworked — only about a thirdwere in the labour force — andthe labour force participation(LFP) of Indian women inSingapore was particularly low.The government embarked on acampaign to encourage womento join the workforce by makingit safer for women to travel atnight and publicly discussing thebenefits of a dual-income family.This campaign helped shift cul-tural norms, and, coupled withrising female educational attain-ments and greater availability of

domestic help, explains theincrease in participation ofwomen in Singapore’s work-force from below 30 per cent in1970 to above 51 per cent in1996.

Research by leading growtheconomists such as AlwynYoung suggests that improvingfemale LFP was a key reason,along with high savings ratesand investment in primaryschooling, for Singapore’s rapidgrowth of nearly 8 per cent perannum in the post-war period.What can India learn fromSingapore’s experience?Economists Stephan Klasen andJanneke Pieters document thatdespite fertility declines in urbanIndia, low levels of female LFPpersist, especially amongwomen with medium educationlevels.

The Singapore experiencedemonstrates that political back-ing and dedicated efforts by thestate to reduce costs for womento join the workforce can yieldmeasurable change. Given thebewildering differences in sizeand history between India andSingapore, is not an attempt todraw specific lessons, especiallyfor India, a futile exercise? Wedo not think so.

In two specific areas — publicsector pay and industrial policy— the points highlighted aboutboosting economic efficiencyand strengthening governancehave little to do with size. Andwith regard to women’s role inthe workplace, Singapore inher-ited many of the cultural barriersprevalent in Asian societies. Thelegacy of Singapore’s astonish-ingly successful half-century,above all, is that transformativechange is possible.

Emulating Singapore’s success

The Chairman of theRajya Sabha, Vice-President Hamid Ansari

and the Deputy Chairman, Prof.P.J. Kurien, reportedlyexpressed their concern recent-ly on attempts being made towhittle away the legislativepowers of the Rajya Sabha andmake it a redundant legislativeHouse. Sitaram Yechury, leaderof the Communist Party ofIndia (Marxist) in the RajyaSabha, and other Oppositionleaders have protested againstwhat they called a move toerode the role and power of theHouse in making laws.

This controversy arose froma statement by Union FinanceMinister Arun Jaitley aboutmoney bills. Mr. Jaitley isreported to have said thatmoney bills, over which theRajya Sabha has limited pow-ers, are the answer to theobstructionist ways of theOpposition in that House. Thisstatement by the FinanceMinister came to be interpretedas an attempt to classify mostof the crucial bills which go tothe Rajya Sabha as money billsto prevent them from beingrejected by that House.

Defining a money bill

At the centre of this contro-versy is the money bill — atechnical term in theConstitution and the Houserules referring to a certain classof bills which contain taxationproposals and proposals relat-ing to money matters etc.Under Article 110, a money billonly contains matters such asimposition, abolition, remis-sion, alteration or regulation ofany tax. It also includes regula-tions related to borrowing ofmoney or giving guarantee bythe Government of India; thecustody of the ConsolidatedFund of India (CFI) or the

Contingency Fund of India, andpayment of moneys into orwithdrawal of moneys fromsuch funds; and the appropria-tion of moneys out of theConsolidated Fund of India.

Besides the above, it includescharged expenditures likethe salary of thePresident, Vice-P r e s i d e n t ,S p e a k e r ,j u d g e setc.; ther e c e i p to fm o n e yo naccount oft h eC o n s o l i d a t e dFund or the publicaccount, its custody etc.; andmatters incidental to any ofthese. Article 109 says a moneybill can be introduced only inthe Lok Sabha. After it ispassed by the Lok Sabha, theBill is transmitted to the RajyaSabha for its recommendationsonly. The Rajya Sabha cannotdisapprove the money bill butcan recommend amendments,which the Lok Sabha can rejectin toto. Even then, the bill willbe deemed to have been passedby both Houses.

Thus, the Lok Sabha alonehas the power to accept orreject money bills. The powerto certify a bill as a money billis vested by Article 110 of theConstitution in the Speaker ofthe Lok Sabha, whose decisionis final. Some Rajya SabhaMembers have raised concernsabout the finality of the Article.Their uneasiness arises fromthe fact that the Rajya Sabhacan’t question the decision ofthe Speaker even when theyfeel that they have a strong casefor contesting the decision ofthe Speaker.

Parliamentary convention

It must be mentioned that inall the countries where the par-liamentary system of govern-ment exists, the directly electedHouse alone has the final say infinancial matters. This primacyo f

the people’s House is enshrinedin the Indian Constitution. Thesuperiority of the Lok Sabha inbudgetary sanctions is securedin two ways. One, the demandsfor grants — the estimate ofexpenditure of individual min-istries and departments of thegovernment — are presentedbefore and passed only by theLok Sabha. Two, theAppropriation Bills, authoris-ing the government to with-draw money from theConsolidated Fund of India,being money bills, cannot bedisapproved by the RajyaSabha. This constitutional posi-tion is well known.

But here the problem is notthe primacy of the Lok Sabhain money matters. The appre-hension among the Members isthat the government may bringbills with financial provisionsand push them through asmoney bills in order to circum-vent the situation in the RajyaSabha. The Constitution makesit abundantly clear that moneybills should contain only theabove mentioned matters and

nothing else. If a bill is a com-bination of any of the aboveand some other provisions notincidental to those matters, itcannot be called a money bill.Such a bill needs to be passedby both the Houses of

Parliament.

At firstblush, the appre-

hension of the Members of theOpposition seems out of placebecause the Speaker of the LokSabha is required to apply hermind to the true character of thebill objectively. TheConstitution clearly defines themoney bill and the Speakercannot circumvent it. The word“only” used in article 110 (1)strictly limits the scope of amoney bill and rules out anyliberal or politically convenientinterpretation of this term.

Nevertheless, the possibilityof non-money bills being certi-fied as money bills and thepower of the Rajya Sabha beingcurtailed cannot be ruled out. Itis rather incongruous that theChairman of the Rajya Sabha— the Vice- President — isplaced in the position of havingto accept the decision of theSpeaker on the money billsissue unquestioningly. TheConstitution has vested thispower in the Speaker in con-formity with the traditions in allparliamentary democracies.Neither the Constitution nor theHouse rules lay down any pro-

cedure with regard to certifyinga money bill. This situation israther unsatisfactory.

The Rajya Sabha is theCouncil of States and hasplayed a crucial role instrengthening the Indian feder-ation. The Constitution hasassigned special roles to thiselders’ chamber of the IndianParliament. For example:

• When the Parliamentwants to make a law onan item in the State list, itcan do so only if theRajya Sabha passes a res-

olution by a two-thirdsmajority.• The creation of an All

India Service follows a two-thirds majority resolution in theRajya Sabha.

Moreover, the Vice-Presidentof India, the number two in theorder of precedence, is theChairman of this House.

Precedents show that thefinality of the Speaker’s deci-sion has been accepted by theRajya Sabha. As early as 1953,Prime Minister JawaharlalNehru, while commenting onthe authority of the Speaker tocertify a money bill, said, “It isnow clear and beyond possibil-ity of dispute that the Speaker’sauthority is final in declaringthat a bill is a money bill. Whenthe Speaker gives a certificateto this effect, this cannot bechallenged. The Speaker has noobligation to consult anyone incoming to a decision or in giv-ing his certificate.”

Constitutional conundrum

A caveat is in order here. TheSpeaker, while certifying a billas money bill, is in effectdepriving the Rajya Sabha ofits legislative power to disap-prove a bill. If it is said that theSpeaker has absolute power

and she does not have to con-sult anyoneit is tantamount toaccepting even a wrong deci-sion by her, maybe even a malafide decision. The Constitutionof India does not confer suchabsolute power on any authori-ty.

The question is whether thereis no remedy if a wrong deci-sion actuated by political con-siderations is taken by aSpeaker — not an impossibili-ty. It may be a bona fide mis-take but it renders the RajyaSabha helpless. An examplecan be cited from this year’sFinance Bill, which contains achapter amending the MoneyLaundering Act. By no stretchof imagination can it be said toconform to the stipulations laiddown in Article 110 regarding amoney bill or related to theimposition or regulation of anytax; or regulation of the bor-rowing of money by the gov-ernment; or giving guaranteeby the government; or under-taking any financial obligationsby the government; or relatingto the custody of theConsolidated Fund of India orthe Contingency Fund; or relat-ing to the appropriation ofmoneys from the CFI; orreceipt of money on account ofCFI. Therefore, it cannot be apart of the Finance Bill.

The case of the SeniorCitizens Welfare Fund is simi-lar. This fund, which consists ofunclaimed money from variousstatutory funds, does not comewithin the scope of “Regulationof borrowing of money or thegiving of any guarantee by thegovernment” under Article110(1)(b). Chapter seven of theFinance Bill contains provi-sions relating to this fund. As amatter of fact, if such non-money bill provisions areincorporated in the FinanceBill, it will cease to be a moneybill.

“It must also be stated herethat the Finance Bill can con-tain only proposals for oneyear. It cannot contain any pro-posal of a permanent nature asArticle 112 limits the timeframe of a budget to one year. ”

The Finance Bill gives effectto taxation proposals which area part of the statement of esti-mated receipts “for that year”.If proposals of a permanentnature are made a part of theFinance Bill and certified asmoney bills, the move comeinto conflict with Articles 110and 112 of the Constitution.

It is therefore necessary toevolve a proper procedure forthe Speaker to arrive at a deci-sion. A committee of the secre-taries-general of both Housesmay examine in detail the givenbill and submit their views tothe Speaker before she takes afinal decision.

There may or may not be anytruth in the OppositionMembers’ contention that allthe non-money bill provisionswere put in the Finance Bill toavoid the Rajya Sabha obstruct-ing the passage of these bills.The only matter of importancehere is that the Rajya Sabhashould not be deprived of itslegitimate rights through leg-islative strategems.

It may be remembered thatArticle 122 provides immunityagainst challenges to the pro-ceedings only on the grounds ofprocedural irregularities. Awrong decision taken underArticle 110(3) is not a proce-dural irregularity and hencedoes not grant any immunity.

The Supreme Court has once again made it clear thatthe government cannot insist on the possession ofan ‘Aadhaar’ card or number as a precondition for

citizens to avail of specified benefits and services. Thecourt has been forced to reiterate its earlier order to thiseffect as more and more entities are trying to link theirservices with Aadhaar. From the beginning it was clearthat making Aadhaar a mandatory requirement wouldevoke resentment and cause hardship to various sections.Some authorities caused alarm by indicating that peoplewould stand to lose benefits or be denied routine servicesunless they enrolled themselves. There were even reportsthat some police stations asked for Aadhaar numbersbefore registering first information reports, and that cer-tain educational institutions tried to make it a priorrequirement to apply for some courses. By making it clearthat no person should be in a position of disadvantage onaccount of not possessing an Aadhaar number, the courthas protected the right of the people to make their ownchoice in the matter. It, however, has not brushed aside therelevance of the Unique Identification Number pro-gramme. It has allowed the authorities to link the supply ofgoods under the Public Distribution System and cookinggas cylinders with Aadhaar numbers. For all its exertions,the government must be relieved that to this extent itsidentification programme has obtained the court’sapproval. However, the question arising out of the schemeis not limited to whether it should be voluntary or manda-tory. In its pursuit of better management of and greaterefficiency in the delivery of services, it is natural that thegovernment would want an identification mechanism toauthenticate beneficiaries and consumers of its servicesand welfare measures. Previously, such a mechanismwould have posed a technological challenge. It has nowbecome a political and moral question. Can a governmentforce citizens to enrol in an identification programme thatinvolves submitting personal information and biometricdata? The question, which involves determining the veryvalidity of the scheme, has now been referred to aConstitution Bench. The reference will also cover the issueof the citizens’ right to privacy. One of the key points inthe legal challenge is that collecting biometric data with-out enabling legal provisions and without clear norms toprotect the data from misuse and theft may violate consti-tutional rights. Recently, the Attorney General caused con-siderable disquiet by arguing in the same matter that priva-cy is not a fundamental right. What the country needs isnot only a safe means of digitising citizens’ identity partic-ulars but also a comprehensive law to protect their priva-cy and personal data from unauthorised surveillance andmisuse. Anything short of that will leave the citizen short-changed.

General Sheikh Mohamed bin Zayed AlNahyan, crown prince of Abu Dhabi anddeputy supreme commander of the UAEArmed Forces. Terrorism will be high on thetalks agenda.

On the first day, Modi will hold officialtalks with the leadership of Abu Dhabi andlater visit Masdar City, a city project in AbuDhabi where he is expected to spend timewatching presentatios, the external affairsministry said.

Later, he will meet business people andfocus on investments.

The following day, he will first visit theSheikh Zayed Grand Mosque in Abu Dhabiand then travel to Dubai where, after meetingDubai`s ruler, he will attend a grand publicreception hosted for him at the Dubai CricketGrounds.

The public reception, which begins at 7.30p.m., is expected to draw 50,000 Indian expa-triates.

Ahead of the visit, Modi on Thursday saidin a statement that the UAE was "a valuedpartner and the extent of our ties indicate thevibrant relations India and the UAE enjoy.

"India is UAE`s second largest trading part-ner and the UAE is India`s third largest tradepartner."

He said the over 2.5 million Indians whohad made the UAE their home had "con-tributed immensely to the progress of theUAE and also given back to India at everyoccasion.

"India and the UAE are fantastically con-nected, be it via air or through the sea."

He praised the economic progress made bythe UAE.

Modi said during his visit, he will seek toenhance cooperation in energy and trade andtalk to investors on why India is an attractivedestination to invest.

"I am certain my visit will boost people-to-people ties between our nations. I speciallylook forward to meeting the large communityof Indian workers based in the UAE.

"No words will be enough to appreciatetheir hard work and sweat over the last manyyears," he said.

He said he will hold extensive talks withCrown Prince Sheikh Mohamed bin Zayed AlNahyan and meet Sheikh Mohammed binRashid Al Maktoum, the vice president andprime minister of the UAE.

Dubai Police are coordinating with Indianauthorities vis-a-vis the security arrange-ments for Modi`s visit.

Major General Abdulla Ali Al Ghaithi,director of the Department of ProtectiveSecurity and Emergency, told the KhaleejTimes that they had put in place a compre-hensive security plan for the visit.

The department has formed three teamswhich include officers for the VIP protectionunit and an emergency unit.

Meanwhile, organisers of the Indian com-munity event have arranged 200 buses toferry passengers from nearby metro stations.

More than 45,000 people have registered sofar for the event, despite the limited seatingcapacity at the stadium and the oppressiveheat, to hear Modi.

Members of the Indian organising commit-tee said they were making maximum effortsto ensure that the event is held smoothly.

A focus area in the bilateral talks is likely tobe the Gulf country`s estimated $800 billionsovereign wealth fund that India will seek totap for infrastructure projects.

The Abu Dhabi Investment Authority(ADIA) sovereign wealth fund is said to bethe world`s second largest sovereign wealthfund.

The India-UAE trade crossed $59 billion in2014-15, making the country India`s thirdlargest trading partner after China and theUS.

India was the UAE`s largest non-oil tradingpartner in 2014.

The new service,which offers high-fideli-ty music, would be avail-able via the company'sown LG SmartWorldapp. In addition, the serv-ice for now is limited toonly 70 regions includingthe United States, India,Australia, Brazil, China,France, Italy, Russia andthe United Kingdom. LGhas further caged theservice by stating thatonly users of those LGsmartphones that support24bit music playbackwould be able to enjoythe high-fidelity music,such as the LG G Flex2,LG G2, and LG G3, aswell as this year's flagshipmodel, the LG G4. Theservice is also accessiblevia the LG World website.

As per the smartphonemaker, the hi-fi music itwill be providing, is "veryclose to the original sound"with a playback of

24bit/192KHz, which issaid to be six times theaudio clarity offered in atypical CD -

16bit/44.1kHz. The quali-fying LG users, as a part ofthe service, would be ableto download two free hi-fitracks and would also havethe option to purchasesongs at 50 percent off theregular price.

AppleMusic is currently onlyavailable to iOS mobileusers, but can be
