As you know, ICLV previously received City Council approvals on the followingapplications:
- SDR - 37942- VAC - 30622- VAR – 37943
The International Church of Las Vegas operates its main ministry of worship services, pastoral
care, day care, K-8 education, bible and ministry training, and ministry events on a 15-acrecampus located at 8100 Westcliff Dr. in the City of Las Vegas. Through its main campus and 3other smaller campuses in the Las Vegas Valley, ICLV regularly provides the same services asits main campus and in addition serves the homeless community, provides food and clothing tothose in need, and a variety of ministerial services to the community through its outreach
programs.The City Council had previously approved and granted extensions of time for the SDR

/VAR/VAC based on the extraordinary length of time it took to work through neighborhoodissues and through the planning process. From that time until 2013, the crash of the real estatemarket in Las Vegas and the local economy has taken a severe toll on the church as well as
business and residents of Clark County. Other conditions impacted the ability to move forwardwith development.
As the 2012 EOT has expired, we would like to formally request a review and approval ofour project for:1) A Site Development Review – same as previously approved SDR- 37942 with related
waivers of the Lone Mountain West Wall and Landscape Standards to allow retainingwalls up to 16 feet in height and zero-foot landscape buffers along portions of the
North, South, East, and West perimeters of the property,2) ) Related parking variance – same as previous approved VAR-37943, and3) Related vacation request to vacate 63-ft. of government patent easements- same as
previously approved VAC 30622.
4) Note 1: The church is NOT requesting any changes to the previously approvedSite Development Review, Vacation, and Variance. Plans and documents remainthe same. All the conditions previously imposed by the Planning Department,Public works, and City Council are accepted by the church in submitting thisapplication.
Note: 2: Conditions in the area relative to new buildings have not changed since the most
recent EOT in 2012. No new building has occurred.
CLV Crite ria for Site De velopment Plans:The City of Las Vegas has established criteria that must be met to gain approval.
Note: This appli cation and accompanying drawi ngs and documents for Site De velopmentPlans are identical to the previous approvals by the City Council. It accomplishes thefollowing:
1. The proposed development is compatible with adjacent development and development in the
area;2. The proposed development is consistent with the General Plan, the Design S tandards Manual,the Landscape, Wall and Buffer Standards, and other duly adopted city plans, policies andstandards;
3. Site access and circulation do not negatively impact adjacent roadways or neighborhoodtraffic;

4. Building and landscape materials are appropriate for the area and for the City;
5. Building elevations, design characteristics and other architectural and aesthetic features are notunsightly, undesirable or obnoxious in appearance; create an orderly and aesthetically pleasing
environment; and are harmonious and compatible with development in the area.
Green Init iati ves:This project has not been fully engaged with the architectural design and drawings. However,the church has already identified several areas where it fits into the City of Las Vegas adoptedsustainability policies.
City of Las Vegas Gree n Building ProgramTo the degree that funds are available to make participation a reality, the church plans to
participate in the city’s Green Building Program.
1.
Sustainability – Trails. The City of Las Vegas has installed a trail along part of the property, which is the subject of these applications. The church cooperated with theCity of Las Vegas in granting an easement to the city on one of the church parcels toallow for a trail on either side of the church’s property owed by the BLM and/or underlease agreement with the city. This allows for continuous con nectivity between adjacent
parcels and creates access to the adjacent equestrian park and to the trail systemcurrently under construction throughout the Cliff Shadows/Cheyenne corridor. Thechurch desires to contribute to making the area a “walkable community”.
2. Bike racks and storage will be made available for cyclists.
3. Water saving measures will be part of the engineering and design of the site. Xeriscapefeatures will be installed where possible.
4. It is the church’s intent to construct the facilities using sustainable and environmentally safematerials; i.e. plumbing and water system will be engineered to result in significantconservation measures. Lighting systems will include LED low voltage fixtures and bulbsand/or CFL lighting wherever allowed.
5. LEED standards or equivalent standards are intended for portions of the facilities. Use ofsolar powered equipment and materials are desired where applicable. Parking, roof systems,
plumbing.
6. Buildings will be situated with a building footprint location (N-S-E-W) with energy andcost savings in mind;
A couple issues worthy of noting are as follows: 1. Pulte Homes – Termination / Reinstatement of the "Reverence" project.
ICLV has had several recent meetings and discussions with representatives from Pulte
oject.

Homes relating to its “Reverence Project” The church had spent thousands ofdollars on engineering and design fees on the road project for what was at one time themain entrance for Pulte's project. After approximately 12 - 15 months of executing ouroriginal DDA, Pulte stopped all work on the project , leaving the roadway and associatedengineering and design issues in limbo. It also created unanswered financial issues for
the church. We are now in discussions with Pulte and they suggest that the project is backon track and they may be at least 18 months to 2 years in a new planning and acquisition process for its Reverence Project. ICLV’s infrastructure along Desert Hope Drive is
dependent on what Pulte is doing, hence the delay in getting to this point.
2. Moving Forward The result of Pulte’s reinstatement of the Reverence Project means that the church can
begin planning activities associated with architectural design an d financial plann ing in procuring the necessary funding for the project. Going forward, this will require close

2. The proposed design meets the seating and other requirements for the use.
3. The use is similar to existing uses in the same center.
4. The use is typical for this applicant (The Cheesecake Factory) which has operated at numerousother locations with no reported issues.
The Cheesecake Factory is a successful sit down restaurant located in many malls throughout the nation
and has complemented the success of the mall establishment it has been part of. Liquor service isnecessary in order to compete with other facilities within the Las Vegas Premium Outlet North.
The Cheesecake Factory restaurant is an upscale casual dining concept first created in 1978. The
Company operates 182 full-service, casual dining restaurants throughout the U.S. and Puerto Rico,
including 170 restaurants und er The Cheesecake Factory® mark; 11 restaurants under the Grand Lux
Cafe® mark; and one restaurant under the RockSugar Pan Asian Kitchen® mark.
The anticipated hours of operation for the restaurant are as follows:

We would like to apply for a Variance to allow a 16-foot and 37-foot tallaccessory structure where Title 19.06.060 limits the height to that of the maindwelling unit.
The purpose of our variance ‘Backyard Toys’. We use our 37’ apparatusfor training purposes with our horses. This allows us to safely train for thetrick riding we do. This is intended for personal use and there will be no
public event taking place at this property where we invite people to watchat any time. There is also a 10’ tall structure, which is a seating structurefor us to watch the training. There is also a 20’ structure, which is a polewith a light on it (the light does not work or have power to it).
We believe the variance should be approved because it is not affectinganyone in a negative way. It is not obstructing any view, as most of thesurrounding properties are vacant lots. There are already 6 telephone polesof similar hight existing on the property that were put up by NV Energy.Several of our neighbors also have light poles that exceed the height oftheir homes as well. There is no reason we should be treated differently.The apparatus is over 100’ from the house and over 50’ from the closest
property line. This ensures it has no way of causing any damage to anystructure on the property. We have collected 44 signatures from our closestneighbors stating that they are not effected by these apparatuses in anynegative way. In addition to that, we speak to many of them on a daily
basis and they enjoy walking by and seeing us train our horses.

Dear Mark;
An existing (approximately 2,800 sf) Animal Hospital located a t 11 17 N. Decatur Blvd (LasVegas, NV 89108) is seeking to upgrade their facility on the same site. The existingbuilding is very outdated and does not meet the size requirements necessary to functionproperly. In hopes of remaining open during construction, a new building is beingproposed on the opposite end of the site.
The .34 acre property is located between N. Yale S treet and N. Decatur Blvd., adjacentto Apawana Ln. It is currently platted as three separate parcels that will be requested to
be combined to only one. There are also two separate zones on the property that wewould like to combine to one (C 91). The existing animal hospital is currently located onthe south end of the property and parking is on the north side. The proposed site planincludes demolishing the existing facility and constructing a new animal hospital on thenorth end of the property with parking to the south, essentially flipping the two. This willrequire relocating two curb cuts slightly south in order to align with the new parkinglayout.
The proposed two story facility will maintain the same use and is approximately 5,459 sf(3,772 first floor, 1,687 second floor). It will provide animal exam and treatment rooms aswell as doctor’s offices, employee break room, conference room and a waiting area. Itwill seek to operate on the same hours as the currently facility (Monday 9Friday 8:00AM 96:00PM, Saturday 8:00AM 94:00PM and closed Sunday).
This project is requesting two variances. All other site requirements appear to have beenmet per the pre 9planning conference held on August 19, 201 4. An outdoor area foranimal walking only is loca ted on the west end of the property. There will be no petboarding outside and animals will be accompanied by employees at all times. A SpecialUse permit is not being requested for this area due to this use. A 20’ rear yard buildingsetback is required. This is the west end of the property. Due to the narrow site, avariance is being requested to bring this setback to 10’ . There is also an 85’ residentialadjacency setback above 15’ . The second floor of the building is approximately 65’ fromthe residential property to the west. A variance is being requested to allow for this. Wefeel that these requests are justified as the commercial strip center to the north is alongthe west property and provides no buffer to the residential neighborhood.

We have been engaged by Quest Preparatory Academy, a State of Nevada-chartered school, toprovide feasibility and design services for the property located a t 4500 N. Tenaya Way (APN 138-03-601-003). Quest would like to improve the existing facility to use as a K-8 school with 2,076students. The facility will also have some Pre-K (Individual Care) for fewer than 60 children.
The property is currently zoned C-1 (Limited Commercial). Use as a primary or secondary public orprivate school is allowed with a special use permitspecial use permitspecial use permitspecial use permit. The property is bound on the east side by the I-95 freeway, by a commercial development (also C-1) to the south, by a compact lot residentia lsubdivision to the north (zoned R-CL), and by N. Tenaya Way on the west side. Across N. TenayaWay is a compact lot residential subdivision (also zoned R-CL).
Within 1000 feet of the property also exists a CCSD elementary school (Deskin Elementary, C-V),
a large retail commercial development (Craig Marketplace, C-1), an office use (Chase Bank, O),multiple resident ial developments (R-1, R-PD3, and R-PD8), a cemetery (Bunker’s MemoryGardens), and a pet cemetery (C.R.P.C. Pet Cemetery). The ne arest CCSD public high schools areCimarron Memorial (2.6 miles), Cheyenne High School (3.6 miles), and Centennial High School(4.3 miles).
Quest Preparatory Academy, which is in the process of acquiring 4500 N. Tenaya Way, currentlyoperates 4 campuses in Las Vegas and is opening another in the Fall of 2014 in anotherunderserved area. They currently serve over 1000 students with a faculty andadministration/staff of 111. Ques t is a public charter school currently offering K-8 education.
Since the property’s original development in 1995 as a building materials retail supply andlumber yard by now-defunct Payless Cashways, Inc., the property at 4500 N. Tenaya Way hascontinuously struggled as a commercial retail location. Multiple tenants have occupied the 9.88acres, and each ultimately have failed to es tablish a sustainable retail commercial operation.While the current and past owners have endeavored to keep the 74,000 sq. ft. building occupied,the existing building, parking lot and “lumber yard” have been severely underutilized. We believethis underutilization has contributed in part to regular incidences of vanda lism and graffiti,despite the owner’s efforts to maintain the appearance of the property.
Many factors contribute to making this site ideal as an adaptive re adaptive readaptive readaptive re- ---useuseuseuse charter school. Thosefactors include: the size, configuration and construction type of the existing main building(submitted originally under the 1991 Uniform Building Code as a Type IIN), the size and

configuration of the “lumber yard” for re-use as protected sports and play areas, the height of theexisting lumber yard wall and storage canopy surrounding the western portion of the si te for re-use as a shade canopy, the existing parking capacity on the eas t side of the property, the site’sadjacency to the Interstate-95 freeway, access to Craig Road (120’ Parkway Arterial St reet) and toN. Tenaya Way (60’ Collector). The benefits of developing this site as a charter school include: re-using a site that has his torically been vacant or underutilized, beautification of the existingproperty through the addi tion of architecture, upgrading the landscaping to current CLVDevelopment Code standards, offering a Pre-K and K-8 educational experience for those familiesseeking this option, and making available these facilities to other approved community-orientedorganizations and events.
Adequate pick-up and d rop-off will easily be provided with all vehicle stacking remaining onsite.Each morning before school and each afternoon, teachers and other faculty members will bedirecting students and parents in the pick-up and d rop-off zone in order to maintain a safeenvironment for all. Minimum parking requirements (3 spaces per primary classroom and 9spaces per secondary classroom) have been satisfied through relocating some land scapingislands and restriping. Egress from the site to Craig Road will occur to the south thru a commoneasement.
Currently this site does not provide an access ible route from the public right of way to thebuilding. As part of the improvements to this site we are proposing a new pedes trian accessible
route from Tenaya to the building entrance. The new route will allow pedestrian access onto thesite from the southwest corner. The accessible route will be shad ed by the existing canopystructure. Some of the existing ti lt-up wall panels at the south of the canopy structure will beremoved to improve visibility and security.

As a follow up to our phone conversation, please withdraw the applications without prejudice on the Quest Tenayaproject [PRJ 55262 (SDR 55724 & SUP 55733)]. Sadly, we will not be moving forward with this project at this time. As Istated, the director for charter schools at the state is not allowing Quest to expand this year as they had planned. I havebeen told that he may allow the school to expand in two years. We hope to pick up where we left off, but know thatmany things can change between now and then.
