    Chicago Conventionarticle 31:Certificates of airworthinessEvery aircraft engaged in international navigation shall be providedwith a certificate of airworthiness issued or rendered valid by theState in which it is registered.

    Article 33Recognition of certificates and licensesCertificates of airworthiness . issued or rendered valid by thecontracting State in which the aircraft is registered, shall berecognized as valid by the other contracting States, provided thatthe requirements under which such certificates were issued orrendered valid are equal to or above the minimum standards whichmay be established from time to time pursuant to this Convention.

    Basic Regulation

    Regulation 216/2008 article 5 Airworthiness

    2.(c) Aircraft registered in a MS shall have aCoA based on a TC

    4. By derogation from 2.:(a) A permit to fly may be issued

    (b) A restricted CoA may be issued

    (c) in case of more aircraft on R-CoA of samedesign: R-TC may be issued

    Basic Regulation

    This means:

    There are three possible airworthinesscertificates for aircraft:

    CoA: the normal case: compliance withessential requirements (ER)

    Permit to fly: if the aircraft can performsafely a basic flight

    R-CoA: deviations from ER still ensureadequate safety with regard to thepurpose

    TC: the normal case: compliance withessential requirements (ER)

    Issued to aircraft that

    conform to a TC; and

    Are in a conditions for safe operation

    CoA is valid if aircraft is maintained inaccordance with continuingairworthiness requirements

    Permit to fly

    Issued when aircraft is capable ofperforming safely a basic flight

    Issued with appropriate limitations

    Issued to aircraft for which no TC wasissued

    Deviations from the ER shall ensure

    adequate safetyEligibility and limitations for use definedin IR (Part-21)

    Recognition of certificates(Within EU)

    BR article 11

    Member States shall, without furthertechnical requirements or evaluation,

    recognise certificates issued inaccordance with this Regulation

    Acceptance of third countrycertification

    BR Article 12

    By derogation from BR and its IR, theAgency and NAA may issue certificates

    on the basis of certificates issued by AAof third countries i.a.w recognitionagreements between EU and the thirdcountry
