CofA

Provisions for Certificate of Airworthiness (CofA) are contained in Annex (part-21) to regulation (EC) 1702/2003

The CofA is issued:

for an unlimited duration

by the competent authority.

ARC

M.A.901 requires a periodical airworthiness review to ensure the validity of the CofA.

After a satisfactory airworthiness review an airworthiness review certificate (ARC) is issued:

either by a CAMO or the competent authority.

With a duration of 12 months

M.A.710 Airworthiness Review

Describes HOW to perform an airworthiness review. It is applicable to airworthiness reviews performed by a CAMO, by independent certifying staff and by the Competent Authority.

It includes:documental review of the aircraft records; and,

physical survey of the aircraft.

Both documental and physical review must be performed by an only ARS.

Airworthiness review tasks shall not be sub-contracted.

M.A.710 Airworthiness review

Review of the aircraft records

in order to be satisfied that:

1. airframe, engine and propeller flight hours and cycles areproperly recorded.

2. the flight manual is applicable to the aircraft configuration and reflects the latest revision status;

3. all the maintenance due on the aircraft according to the approved maintenance programme has been carried out;

4. all known defects have been corrected or, when applicable, carried forward in a controlled manner;

5. all applicable AD have been applied and registered;

6. all modifications and repairs applied to the aircraft have been registered and are approved according to Part-21,

7. all LLP are properly identified, registered and have not exceeded their approved service life limit;

8. all maintenance has been released in accordance with Part-M;

9. the current mass and balance statement reflects the configuration of the aircraft and is valid;

10. the aircraft complies with the latest revision of its type design approved by the Agency;

11. if required, the aircraft holds a noise certificate.

M.A.710 Airworthiness review

The records review should include the following categories

of documents:

� registration papers

� M.A.305 aircraft continuing airworthiness record system

� M.A.306 operator’s technical log system

� list of deferred defects,

� aircraft flight manual including aircraft configuration

� aircraft maintenance programme

� relevant work packages

� AD status, mod/ SB status, repair approval sheets

� list of LLPs and relevant EASA Form 1 or equivalent

� mass and balance report and equipment list

� aircraft, engine and propeller TC Data Sheets

M.A.710 Airworthiness review

The physical survey of the aircraft shall ensure

that:

1. all required markings and placards are properly installed;

2. the aircraft complies with its approved flight manual;

3. the aircraft configuration complies with the approved documentation;

4. no evident defect can be found that has not been properly addressed;

5. no inconsistencies can be found between the aircraft and the records.

For the physical survey the airworthiness review staff (ARS) may be assisted by part-66 certifying staff.

M.A.710 Airworthiness review

After a satisfactory airworthiness review the ARS may issue:

the ARC (EASA Form 15b)

A recommendation to the competent authority to issue the ARC

The airworthiness review can be anticipated by a maximum of 90 days without loss of continuity of the airworthiness review pattern, to allow the physical review to take place during a maintenance check.

Aircraft used in CAT and all aircraft with MTOM>2730 kg (except balloons)

• 5 years experience in continuing airworthiness,

• formal aeronautical maintenance training,

Aircraft <2730 Kg MTOM not used in CAT and for balloons

• 3 years experience in continuing airworthiness,

• appropriate aeronautical maintenance training,

• appropriate Part-66 licence or aeronautical degree or equivalent,

• a position with the appropriate responsibilities

M.A.707 Airworthiness review staff

Position with appropriate responsibilities means:

independent from the continuing airworthiness management process:

person has not participated in the management/ maintenance of the aircraft

personnel from the Quality Department

or

overall authority on the airworthiness management process:

Accountable Manager or the Maintenance Postholder

Being authorised only for those aircraft for which the person has overall authority

M.A.707 Airworthiness Review Staff

The ARS shall be nominated using EASA Form 4 and accepted by the competent authority after performing an airworthiness review under supervision.

“under supervision” means under the supervision of the competent authority, or if described in a procedure acceptable to the competent authority under supervision of already authorized ARS.

After acceptance by the competent authority the CAMO must issue them an authorisation and list them in the CAME.

M.A.707 Airworthiness Review Staff

In order to keep the validity of the ARS authorisation, the staff should have either:

been involved in continuing airworthiness management activities for at least 6 months in every 2 year period, or

conducted at least one airworthiness review in the last 12 month period.

M.A.901 Aircraft airworthiness review

An ARC has to be issued after a satisfactory airworthiness review with a validity of 1 year in order to ensure the validity of the CofA.

The airworthiness review is performed by approved persons or organisations and only in very few cases by the competent authority.

An ARC may be issued by:

a CAMO: EASA form 15b

the competent authority: EASA form 15b

Controlled environment means in the last 12 months with respect to the day when you intend to do the review:

Aircraft managed by a unique CAMO, andMaintained only by approved organisations (except for pilot owner maintenance, when performed by the pilot or by independent certifying staff)

M.A.901 Aircraft airworthiness review

For aircraft used in CAT and aircraft >2730 Kg MTOM (except balloons) if the aircraft is:

in a controlled environment and,

managed by a CAMO with airworthiness review privileges,

The CAMO can issue the ARC after performing an airworthiness review in accordance with M.A.710.

M.A.901 Aircraft airworthiness review

For aircraft used in CAT and aircraft >2730 Kg MTOM (except balloons), if the aircraft is:

NOT in a controlled environment or

managed by a CAMO without airworthiness review privileges,

The ARC will be issued by the competent authority based on a recommendation issued by a CAMO with airworthiness review privileges. The recommendation shall be issued after the CAMO performs a full airworthiness review in accordance with M.A.710.

Any CAMO with airworthiness review privileges can issue the ARC after performing an airworthiness review. Regardless of whether the aircraft is in a controlled environment

M.A.901 Aircraft airworthiness review

For ELA1 aircraft not used in CAT:

The airworthiness review may be performed by independent certifying staff approved by the competent authority of the Member State of Registry.

The ARC may be issued by the Competent Authority based on a recommendation issued by the independent certifying staff.

The recommendation sent to the competent authority should contain the following items:

(a) General information: CAMO, owner/lessee, date and place where review was carried out

(b) Aircraft information: registration, type, serial number, AFM, weight and centre of gravity data, maintenance programme reference

(c) Documents: copy of registration papers, copy of the owners request for a new ARC

(d) Aircraft status: FH/FC, maintenance status

(e) Aircraft survey

(f) Findings and corrective action

(g) Statement from the ARS

M.A.901 Aircraft airworthiness review

If there is a potential safety threat, the authority shall perform the airworthiness review and issue the ARC themselves.

The authority may also perform the airworthiness review and issue the ARC themselves in the following cases:

For the import of aircraft if there is no CAMO approved for the specific aircraft type available. (AMC M.A.904 (a))

When the owner requests it for balloons and aircraft <2730Kg MTOM.

M.A.901 Aircraft airworthiness Review

Extension of the ARC

The CAMO managing the aircraft may, if the aircraft is in a controlled environment, extend twice (1 year each time) an ARC which has been issued by another CAMO or by the Competent Authority.

There is no need for the CAMO to have airworthiness review privileges since the ARC is extended without performing an airworthiness review.

M.A.901 Aircraft airworthiness Review

It is acceptable to anticipate the extension of the ARC by a max. of 30 days without a loss of continuity of the airworthiness review pattern, the new expiration date is set up one year after the previous expiration date.

The aircraft is still considered as being in a controlled environment if it has been continuously managed by a single organisation and maintained by appropriately approved organisations from the date when the last ARC was issued until the date when the extension is performed (this can be up to 30 days less than 12 months).

M.A.904 Airworthiness review of imported aircraft into the EU

When importing an aircraft into a Member State register from a third country, requires:

A recommendation following a satisfactory airworthiness review

All maintenance carried out to comply with the approved maintenance programme
