Dear Ms. Strunk:

This letter serves as a statement of justification for Proffered Condition Amendment ("PCA") and Special Exception Amendment ("SEA") applications (together, the "Applications") for property on Gallows Road in the Tysons area of Fairfax County. The PCA Application seeks to amend the proffered Generalized Development Plan ("GDP") to replace an approved hotel with an athletic field. The SEA Application proposes to delete the hotel use from the approved special exception and' to add a containment structure associated with the field. P.S. Business Parks, L.P. owns the property. P.S. Business Parks, L.P. is also the applicant in pending application RZ 2017-PR-015, known as The Mile, which requests rezoning of 38.83 acres in the North Central District of Tysons to the PTC District. The proposed athletic field will meet the athletic field expectations associated with RZ 2017-PR-015.

The subject property is located in the Providence Magisterial District, on the south side of Boone Boulevard, approximately 500 feet west of its intersection with Gallows Road. It is zoned to the C-3, HC and SC Districts. An athletic field is a permitted use in the C-3 Districts. The total site area of the original proffered rezoning is 8.9 acres but this PCA Application Property includes only the 2.499 acres that will be affected by the proposed field, part of Parcel 69A. The SEA Application Property is 4.94 acres in size and includes all of Parcel 69A.

Property to the east is developed with an office building and an associated parking structure. The parking structure is sited adjacent to the PCA/SEA Application Property boundary. Land to the south is developed with low rise office condominiums with surface

parking. To the north, across Boone Boulevard, is a vacant automobile dealership that was recently rezoned to permit and a residential and retail mixed use building known as International Place.

Prior Approvals

The property was rezoned on October 6, 1975 with the approval of RZ C-597, which included 4.95 acres of land along Boone Boulevard. At the time, this included Tax Map Parcels 39 -1 ((6)) 69A, 71, 73, 75, 77 and 79. It was rezoned from the RE-1 District to the C-0 District. The proffered GDP for this rezoning included a single eight-story office building with 112,000 square feet.

PCA C-597 was approved on March 26, 1979. The PCA relocated the 8-story office building, changed its shape, and redesigned the parking layout, among other changes. It was constructed in 1979, and is known as the Tycon III building. PCA C-597-2 added Parcel 39-1 ((6)) 69B1, the site of Tycon II, which increased the size of the land subject to the proffers to 8.9 acres. This approval also allowed the construction of a third building, initially planned as an office building or a telecommunications facility. PCA C-597-3 was approved concurrently with SE 2004-PR-019 to allow a drive-in bank window to be added to Tycon II. SE 2004-PR-019 subsequently expired.

PCA C-597-4 and SE 2007-PR-014 replaced the approved but unbuilt third building with a hotel. SE 2007-PR-014 was required both to approve the hotel use in the C-3 District and to approve additional height for the Tycon III building, which was built to a height of 91 feet, in excess of the 90-foot maximum in the C-3 District.

Proposed Amendments

• Partial Proffered Condition Amendment. The Applicant proposes to amend the Generalized Development Plan and proffers for RZ C-597 to replace the hotel approved in PCA C-597-4 with an athletic field. The 173 room hotel was originally proposed to be located on the southeastern corner of the Application Property with frontage on Boone Boulevard and a swimming pool and structured parking at the rear of the site. The proposed athletic field will be in approximately the same location, replacing a portion of the existing parking lot. It will be a U-13 field measuring 330 feet by 180 feet, including the overrun areas. It will include synthetic turf, field lighting, bleachers, an equipment storage shed, and a containment structure/fencing meeting Fairfax County Park Authority standards.

Parking for the athletic field will be shared with the adjacent Tycon II and Tycon III office buildings. There are currently 880 parking spaces serving both buildings. With construction of the field, parking will be reduced to 647 spaces. The approved proffers (#5) state that parking shall be provided in accordance with the parking requirements of

Article 11 of the Zoning Ordinance. The Zoning Ordinance requires 727 parking spaces to support the Tycon II and Tycon III office buildings, based on the standard rate of 2.6 spaces per 1,000 SF of office GFA. Article 11 also permits existing uses in Tysons to opt into the lower parking rates associated with the Planned Tysons Corner (PTC) District regulations. The required parking for Tycon II and Tycon III office buildings based on the PTC regulations of 2.0 spaces per 1,000 SF of GFA is 560 spaces. The Application proposes a total of 647 parking spaces, exceeding the PTC requirements. Parking spaces will be available to users of the athletic field after 5:00 p.m. on weekdays and during all normal operating hours of the athletic field on weekends.

• Special Exception Amendment. The Applicant also proposes to amend SE 2007-PR-019 to forgo the approved hotel use and to seek approval for a containment structure around the proposed athletic field. The containment structure will be useful in preventing balls from landing in Boone Boulevard and the parking area serving the office and field. The containment structure is proposed along the north, west and south boundaries of the field. The solid wall of the parking structure on property to the east will act to contain balls on the eastern side of the field. The containment structure will be a maximum of 24 feet in height

The approved special exception also permitted additional height for the Tycon III building, which was built at a height of 91 feet, as 90 feet is the maximum height in the C-3 District. The Applicant seeks no change to the building height portion of the special exception.

Comprehensive Plan Guidance

The PCA and SEA Application Properties are located in Subarea 3 of the Northwest Old Courthouse Subdistrict of the Old Courthouse District. Subarea 3 is comprised of approximately 20 acres and is bounded by Boone Boulevard on the north, Gallows Road on the east, Old Courthouse Road on the south, and Howard Avenue on the west. Under the Base Plan, property in Subarea 3 is planned for and developed with office use at existing intensities.

The Comprehensive Plan also provides guidance with regard to parks and recreational facilities to support the redevelopment of Tysons. The Plan sets a goal of twenty new athletic fields to serve Tysons. The map below, taken from the Comprehensive Plan, shows the proposed Conceptual Parks and Open Space Network and identifies potential locations for various types of park facilities. The map indicates that a recreation-focused park would be appropriate along Boone Boulevard in Subarea 3. Thus, the proposed U-13 field is consistent with Plan recommendations.

Special Exception Information

Section 9-624 of the Zoning Ordinance allows the Board of Supervisors, in conjunction with a proffered rezoning, to approve modification of the height and locational regulations of Section 10-104 for containment structures when such structure is designed to preclude the flight of any ball of other sports equipment into adjacent right-of-way. This application meets the standards of the modification as outlined below:

1. Detailed information relating to the anticipated trajectory of balls and other sports equipment and the need for a containment structure to keep such equipment on the property shall be submitted with the application In the event the containment structure is associated with a new playing field/court or golf course, the playing field/court or golf course shall be oriented and designed in such a manner as to minimize the height needed for such containment structure.

The Applicant has contacted the FCPA staff who recommended a height of 24 feet to

adequately contain typical soccer ball trajectories.

2. The height, location, color and materials of the proposed containment structure, including the size of mesh for any netting, shall be identified in the application.

The height of the containment structure is shown on the plans. A special exception

condition will be proposed committing to work with the FCPA on color, materials and

size of mesh.

3. The material for the containment structure shall be limited to support structures, netting that is at least seventy-five (75) percent open in an evenly distributed pattern, and/or guy wires.

The containment structure will meet these specifications.

4. Wherever practical, the containment structure shall be designed in such a manner that, in the event of collapse, the structure will not fall onto adjacent property or right-of-way.

The containment structure will be designed to avoid collapse affecting the right-of-way.

5. Signs shall not be permitted on any containment structures.

No signs are proposed at this time. The Applicant will work with FCPA staff to

determine if they propose park signage on the containment structure.

6. Wherever practical, the containment netting shall be removed when the outdoor sports facility is not in use due to seasonal changes or other factors.

It is anticipated that the field will be used year round and the containment structure will

be permanent.

7. A containment structure may be located on an adjacent lot to an outdoor recreation/sports facility playing field/court or golf course, whether or not such lot contains a principal structure or use.

The containment fence will be on the same lot as the field.

8. Such containment structure shall not be allowed in association with a privately used playing field/court on a lot containing a single family dwelling.

The containment fence surrounds an athletic field designed for public use. A public

access easement will be recorded for the field.

Below is a description of the proposed special exception use in keeping with Paragraph 7 of Section 9-011(7):

• Estimated number of patrons/clients/patients/pupils: 40 at any one time

• Proposed number of employees: None.

• Estimate of traffic impact: The fencing will generate no traffic.

• Vicinity of general area to be served: Tysons

• Description of building façade and architecture: The SEA plat shows the location and type of fencing/containment. The fencing/containment will meet FCPA standards.

• Listing of hazardous or toxic substances to be generated, stored, utilized and disposed of

on-site: None

• Statement that proposed use conforms to all applicable ordinances, regulations and

adopted standards: All applicable ordinances, regulations and adopted standards are met with the exceptions of those waivers and modifications listed on the GDPA/SEA Plat.

Conclusion

The proposed athletic field will serve the growing needs of the Tysons community. It is consistent with the Comprehensive Plan, which calls for developers to provide athletic fields in Tysons when rezoning to the PTC District. The proposed soccer field will satisfy the field expectation associated with the rezoning and development of The Mile, a residential mixed use development in the North Central District. Shared parking with the adjacent office building also contributes to the reduction of parking in Tysons.

This partial PCA will not have an adverse impact on the remainder of the property in the terms of the approved use, fulfillment of proffered conditions, landscaping and streetscape, and the approved density or intensity. By replacing an approved hotel with an athletic field, it will reduce the intensity of the approved development. Though the construction of the field will require the elimination of some surface parking, the remaining office buildings will satisfy Zoning Ordinance parking requirements.
