The degree Doctor of Laws (honoris causa)
Katharina Renate Susanne Dorothee Boele-Woelki
Prof Katharina Boele-Woelki completed her undergraduate law studies at the Freie Universität Berlin,
Germany, in 1979, and obtained her doctoral degree from the same university in 1982.
Prof Boele-Woelki was a Professor at the University of Utrecht until 2015, whereafter she became Dean of
Bucerius Law School in Hamburg, the top-ranked Law Faculty in Germany.
Prof Boele-Woelki is internationally recognised as a leading scholarly authority in Comparative Law, Family
Law and Private International Law.
She is the first woman to be elected President of the prestigious International Academy of Comparative Law
(IACL). The Academy, which was founded in The Hague in 1924, is built on the firm belief that the comparative
study of legal systems is key to the harmonisation, unification and development of laws and legal institutions.
Furthermore, it is crucial to the peaceful and efficient regulation of human movement, commercial
interaction, environmental issues, sustainability goals and human rights across vast areas of municipal and
international law.
In her inaugural presidential address, Prof Boele-Woelki declared her mission to reach out to and advance
the study of comparative law in South Africa and the greater African continent. To this end, the University of
Pretoria has been nominated to host the 2020 IACL Congress on Diversity and Plurality in Law.
Prof Boele-Woelki also established the Commission on European Family Law (CEFL) in 2001. The Commission
has consistently produced high-quality research on family law matters in a rapidly changing social
environment. Its most recent publication on “De facto unions” responds to empirical data from a vast number
of countries, showing the high incidence of children born into informal unions. The principles formulated by
the Commission set an international benchmark for law reform, also in South Africa.
True to her altruistic and self-effacing nature, Prof Boele-Woelki’s focus is intent on making a positive and
enduring contribution to the comparative study of different legal systems on the African continent and
beyond. She has decided to invest a significant amount of time and effort in Africa, as well as making available
her considerable scholarly expertise and international research networks to the University of Pretoria.

Yash Pal Ghai
Professor Ghai is a Kenyan academic and constitutional lawyer. He has made considerable contributions to
legal scholarship in Africa, especially in the development of constitutions and constitutional law on the
continent.
Born on 20 October 1938, Professor Ghai studied in Kenya and the UK, and he holds an LLM from Harvard
University and a Doctorate from Oxford University. Professor Ghai has had a long and illustrious career,
covering academia, civic engagement, independent commissions and international diplomacy. The academic
positions he has held include that of lecturer, senior lecturer, Professor and Dean at the School of Law,
University of Dar-es-Salaam, Tanzania and positions at Yale University, Warwick University and the University
of Hong Kong.
Professor Ghai has a proud record of intellectual contributions of high academic-scientific merit, making him
an acclaimed champion of scholarship on constitutionalism, the rule of law, and the respect for human rights,
with particular relevance to Africa. His contributions traverse the academic, civic and diplomatic spheres as
illustrated in his distinguished career, making him an outstanding African public intellectual. His defence of
the ideals of democracy, constitutionalism and the rule of law has sometimes been at the risk of his own life
and freedom, as he has had threats on his life and was exiled from Kenya due to his justification of a credible
and democratic constitution-making process.
While his legacy lies in his instrumental role as chair of the Constitution Review Commission in the drafting
of the 2010 Constitution of Kenya and as co-founder in 2011 of the Katiba Institute, in consolidating social
transformation in Kenya through civic engagement, his influence on constitutional thinking and practice has
extended far beyond one country. His broader influence is exemplified in his appointment as Special
Representative on human rights of the UN Secretary-General in Cambodia, his chairpersonship of Fiji's
Constitutional Committee in 1993 to 1994, and his drafting of the Asian Human Rights Charter.
The honorary degree award recognises Professor Ghai's vast contribution to constitutional dialogue,
particularly in the African region. While his scholarship and contributions have previously been honoured
on several occasions, too little of this recognition has come from the African continent, despite him being
African. Honouring Prof Ghai with this award is closely aligned with the University of Pretoria's vision to be
a leading globally relevant university in Africa.

War crimes, crimes against humanity, genocide and the crime of aggression could in many instances not be
perpetrated without those who finance them. In this thesis, Individual criminal responsibility for the
financing of entities involved in core crimes, the promovenda examined the basis for criminal liability in
international criminal law for persons who financed entities that perpetrated core crimes. Despite the need
for clear rules, there is no agreement upon whether liability exists for these individuals; and if so, the
circumstances under which such liability exists. To determine the minimum standard of liability of these
individuals, the study analysed the legal rules relating to complicity in international criminal law. It relied on
an assessment of general principles sourced from twenty selected jurisdictions. The aim of this assessment
was to determine whether there were general principles of law recognised by the community of states on
the minimum standard of liability for aiders and abettors.

Ndumiso Dladla
In his thesis, Not yet ubu-ntu: Towards an African critical philosophy of race, the promovendus conducts an
in-depth philosophical critique of the his-story, commonly known as history, of conqueror South Africa in
relation to the race aspect of its constitutional evolution. This his-story is tested against the principle of
recoverability according to the just war doctrine. The result is that it is not yet ubu-ntu despite the
widespread appeal and abuse of ubuntu. The attainment of ubu-ntu lies in the ultimate construction and
constitution of a post-colonial conquest country with a new name. The thesis is an original and challenging
contribution to the perennial question of justice and peace in conqueror South Africa.

Johannes Esterhuizen Erasmus
In his thesis, A suitable regulatory regime for bargaining council funds as independent retirement funds,
the promovendus's research evaluated whether bargaining council retirement funds were being considered
with a focus on the consequences which statutory development had on bargaining council funds as well as
the regulatory regime which became applicable to these types of retirement funds. In his thesis, the impact
of the legislative changes was considered with specific reference to the impact it has had on constitutionally
protected rights, particularly the right to collective bargaining and freedom of association. In addition to this
and from a regulatory perspective, the oversight of retirement systems was considered to establish the
effect on the recommendation of having bargaining council funds revert to the position it found itself in
before the statutory amendments were promulgated. This was done with regard to the fact that South Africa
recently moved to a Twin Peaks system of financial regulation and the main driver behind this move was to
create a safer financial services industry.

In her thesis, Regulatory framework for psycho-legal assessments in South Africa, the promovenda examined
the shortcomings of the regulatory framework for psycho-legal assessments in South Africa, focussing on
psycho-legal work conducted by psychiatrists and psychologists. The research demonstrated that psycho-
legal assessments played a pivotal role in assisting courts. However, the lack of regulation contributed to
the various challenges faced, including unethical behaviour and inadequate performance. The research
included a comparative study of the regulatory mechanisms in England and the United States of America.
The unique contribution of the study lies in the recommendations that emphasise the importance of an
integrated approach to the formulation and application of ethical and legal principles, and the importance
of a harmonised regulatory framework.

In his thesis, The effectiveness of adopted OECD transfer pricing dispute resolution mechanism in an African
context, the promovendus investigated the challenges uniquely faced by African countries that militate
against the effective use of the OECD transfer pricing dispute resolution mechanisms, namely the mutual
agreement procedure, the advance pricing agreement and the mandatory binding arbitration. The research
discussed transfer pricing manipulation by multinationals and its effect on revenue collection. It investigated
challenges that caused delays in resolving transfer pricing disputes by analysing the domestic frameworks
that exist in four African countries, namely, South Africa, Kenya, Uganda and Ghana. The thesis proves that
the absence of an adequate tax treaty network and lack of commitment from many African countries to
subscribe to and ratify multilateral conventions negatively impact the effective usage of OECD transfer
pricing disputes resolution mechanisms in Africa. The thesis creates a viable platform for the effective
resolution of transfer pricing disputes in Africa by making a series of recommendations and suggestions
that are tailored for African conditions.

In the thesis, Infrastructure for development: The use of human rights impact assessment in public-private
partnerships, the promovendus contributes to our understanding of sustainable and inclusive development.
He used public-private partnerships in infrastructure projects to demonstrate that a holistic approach to
development that incorporates human rights considerations is needed to achieve sustainable and inclusive
development outcomes. His thesis explored how different notions of development influenced the
regulatory frameworks for and the structuring of infrastructure projects. The researcher demonstrated that
public-private partnerships increase both the complexity of infrastructure financing, planning and
implementation and the risk that they will not produce their intended developmental outcomes. The
promovendus proposes that governments and other project sponsors use human rights impact
assessments to address the challenges created by these complexities and shows that they increase the
possibility of achieving the intended sustainable development outcomes. After analysing various established
human rights impact assessment methodologies, the thesis proposes a new approach that is specifically
designed for public-private partnerships in infrastructure projects.

In the thesis, Establishing a legal framework of special and differential treatment under the World Trade
Organization: Definitive rights for developing countries, the promovendus assessed the Special and
Differential Treatment (S&DT) provisions in the World Trade Organization (WTO) agreements. He
demonstrated that these provisions did not achieve their intended developmental purposes because they
were imprecise, non-binding and unenforceable. To address this problem, the author developed a
conceptual framework for promoting S&DT provisions in multilateral trade agreements that offered
developing countries precise, effective, operational and enforceable rights. The author then tested the
feasibility of the framework by applying it to the SADC-EU Economic Partnership Agreement. The conceptual
framework developed in the thesis is an innovative contribution to the development of International
Economic Law. It offers a solution to the current problems with S&DT provisions in multilateral trade
agreements. In so doing, the thesis contributes to the development of a coherent and effective Global South
approach to international trade law, which has hitherto been dominated by the views of the Global North.

In the thesis, An African perspective on reforming sovereign debt restructuring of privately held debt, the
promovenda critically assessed the current legal and policy issues arising in the restructuring of privately
held sovereign bonds. In making its contribution to the discourse on the sovereign debt restructuring
process (SoDR), this study sought to address both the legal and policy issues raised in this process. The
novelty of the study’s approach is that it adds an African perspective to recent efforts in the international
literature to address developmental and human rights considerations in SoDR. In order to contextualise
this approach to SoDR, the study assessed the history of SoDR, described the current challenges facing
contemporary approaches to SoDR and evaluated the corresponding proposals for reform. It maintains that
the current contractual approach to SoDR cannot ensure a fair, transparent and prompt restructuring for
African sovereign debtors. The study concludes with some proposals for reforming SoDR to make it more
responsive to African developmental and human rights concerns.

In her thesis, A critical analysis of the right to the city for women refugees and asylum-seekers in Tshwane,
the promovenda used the notion of the right to the city, as propounded by Henri Lefebvre. She examined
the plight of women refugees and asylum seekers in the City of Tshwane against the backdrop of
international and domestic laws. The notion of the right to the city connotes a bundle of rights, including
access to the city, equal opportunities for the use of resources in the city and a host of other political, moral
and socioeconomic rights. Although many of the rights embedded in the right to the city have been codified
in various laws these women still find themselves vulnerable and not fully protected. Relying on the concept
of intersectionality the promovenda explored their case, showing that they do no enjoy equal opportunities
for the use of resources in the City of Tshwane. The promovenda made a number of recommendations that
could alleviate the plight of women refugees and asylum seekers.

In his thesis, Advocacy, social control, and the criminalisation of same-sex relationships in Nigeria, the
promovendus argued that the evolution and enforcement of Nigerian laws criminalising same-sex
relationships and non-heteronormative sexuality and gender identity were part of a system of wider social
control leveraged by the political elite to perpetuate its hegemonic power. While advocacy for the protection
of sexual and gender minorities in Nigeria has grown rapidly since the enactment of Nigeria’s Same Sex
(Marriage) Prohibition Act of 2013, political rhetoric and public opinion continue to be antagonistic to
advocacy efforts. Using doctrinal and empirical research, the thesis shows that the evolution of laws that
criminalise same-sex relationships in Nigeria is based on the use by the political elite of political homophobia
as a tool of social exclusion. The thesis also identified social control linkages between the laws criminalising
same-sex relationships and the existence of wider social exclusion in Nigeria.

In his thesis, State recognition of customary land rights in the Kenyan Rift Valley, the promovendus examined
the struggles of four communities inhabiting the Kenyan Rift Valley - the Maasai, Nandi, Kipsigis and Kikuyu
- to assert their customary land rights against colonial and post-liberation state incursion. Using systems
theory and critical understandings of legal pluralism, he explored the four communities’ resilience and
resistance against different phases of state disruption of their land rights. Drawing on South African,
Tanzanian, Australian and Canadian examples, he evaluated the new regime of regulation of customary land
rights that emanated from Kenya’s new (2010) constitution. The researcher makes various suggestions for
the effective implementation of this new regime, in order to recognise and enforce the customary land
rights of communities inhabiting the Kenyan Rift Valley.

In his thesis, The role of state institutions in preventing violent conflict in Angola, the promovendus examined
how the nature of Angolan State institutions created conditions under which individual rights and liberties
were undermined, enhanced by an overly centralised State with a strong command culture. The thesis
argues that to prevent violence and ensure democratic governance there is an urgent need to decentralise
State power by limiting executive power, while at the same time further emphasising the role of provinces.
Government and civil society should work towards designing a State which is inclusive and safeguards
individual participation in the process of governance.

In his thesis, The role of civil society organisations in litigating the right to basic education in South
Africa: Lessons for Nigeria, the promovendus examined civil society organisations’ use of public interest
litigation as a tool to promote and protect the right to basic education of children in South Africa, and
considered what knowledge can be extrapolated for possible application in Nigeria. The thesis undertook a
comparative analysis of the constitutional and legal environment that enables or impedes strategic litigation
in the selected countries, and determined optimal conditions for such work to be undertaken. It also
demonstrated that for public interest litigation to be successful, it needs to be complemented by other
strategies such as engaging the media and mobilising stakeholders. The thesis illustrates the effectiveness
of civil society activism through strategic litigation in South Africa, and indicates opportunities for its use in
Nigeria to advance the struggle for equal access to quality basic education for every child.
