Q I applied for a newapartment and wasrefused because I

have an eviction on mycredit report. To myknowledge, I’ve neverbeen evicted from any-where. A long time ago Ilived with a friend whowas evicted but I neverwas part of the agree-ment. Even though I was paying rent to hershe wasn’t paying the landlord. I moved outimmediately once I learned that she was be-hind with the rent. What can I do?

A If you were an adult living in a rentalunit in which the tenant named on therental agreement was evicted, you can

be joined as an additional defendant in aneviction case, called an Unlawful Detainer.This is true even if you didn’t sign the rentalagreement. Landlords often include the oth-

er adults residing in aunit so that the evictionorder can be used to re-move everyone.

Since you have beendenied a tenancy you areentitled to a free creditreport within 60 days ofthe rejection from thecredit bureau that the prospective landlordused. The landlord is obligated to inform youof the credit bureau he or she used. You canenter a 100-word explanation into your cred-it report to explain the eviction, or you can at-tempt to have it removed by working with theproperty owner or attorney that filed the Un-lawful Detainer.

You can explain that you were not the ten-ant actually obligated to pay the rent and thatyou were named because you just happenedto be living in the unit at that time. If need-ed, contact your local housing mediation pro-gram or HUD-certified counseling agency

for assistance.

Q There are several vacancies in theapartment complex I own and I amhaving a short-term cash-flow prob-

lem. I asked my tenants to pay the rent ear-ly but some have refused. Don’t I have theright to ask for early payment for a shorttime?

A Unless a tenant agrees voluntarily tohonor your verbal request, there is nostate law that allows for changing the

rent due date on an uneven or unpredictablebasis. The only way you can change the dateis with a written 30-Day Change of TermsNotice that details the new due date. The ef-fort of pro-rating the current month’s rent toa lesser amount and waiting 30 days to enactthe new due date may not be worth the effortfor a short-term problem. If you still want toaffect this change, contact your local housingmediation program for more assistance.

Q A current tenant now has a small childliving with her. Can I ask the tenant tocomplete an application so I can ob-

tain information and references about thechild?

A A landlord certainly has the right toknow who is living in his or her prop-erty, but you need to ask yourself,

“What is my business justification for seek-ing this information?” If it is your practice torequire all your tenants’ applications listeveryone who is living in the unit as well asthe information you are now requiring re-garding this child, you can probably ask thatapplication forms be updated when new chil-dren are added to a current household.

However, if you don’t have a credible jus-tification for seeking additional informationabout this child, you will create the impres-sion that you are trying to burden this tenantbecause she has a child. Such an unreason-able burden would constitute discriminationbased on family status. Contact your localfair housing program for more information.

Q I rent a cottage that has a small yardand garden. The property owner comesinto the yard almost daily to do yard

work and water the garden. She is also usingchemical sprays, which affect a lung condi-tion I have. What can I do to keep her out ofmy yard?

The Issue:Properties in the East Meadow Circle Area(see map on back) are individually redevel-oping from light manufacturing to multi-family residential without cohesive designguidelines. Comprehensive Plan Policy L-47identifies the East Meadow Circle Area as apotential site for higher density housing thatprovides a transition between existing hous-ing and nearby industrial development. Ifhousing development occurs in this area,including a component of neighborhoodcommercial uses would benefit residents ofexisting homes in the area as well as the newhomes.

The Charrette Process: Representatives from neighborhood organi-zations will be matched with architects todevelop illustrated concepts and ideas forfuture development in the area, which willform the basis for area design guidelines.Specific design issues for the East MeadowCircle/Fabian Way area include effectiveintegration of new multi-family developmentwith the surrounding single-family develop-ment, provision of retail services, infrastruc-ture constraints and connectivity to sur-rounding areas. The public is encouraged toattend and observe the charrette. There willbe several opportunities for public participa-tion throughout the one and half day event.

Schedule:Friday, 8:00 – 12:15 pm, Room H-1The morning session will begin with a "vir-tual tour" of the study area, followed bystakeholder statements, responses by a panelof experts, and public comments.

Friday, 1:00 – 6:30 pm, Room H-5Design charrette with five teams led by AIASanta Clara Valley Chapter. Public is invitedto observe the discussions at all times.

Saturday, 8:30 – 1:00 pm, Room H-6Presentation of individual table results, pub-lic comments and selection of preferreddesign concepts.
