Mootingcanbestbedescribedasanactivitythatcomesclosesttobeingalawyerwhilestill

studyingatlawschool.Itinvolvesidentifyinglegalissuesoutofacomplexfactualscenario,

doingexhaustiveresearchonthoseissuestoadvanceargumentswithauthorities,followed

bydraftingextensivewrittensubmissionsand�inallythegruellingoralsbeforeabenchof

eminent judges.Inanutshell, it iseverythinga lawyerisexpectedtodooncehestarts

practisinglaw.

Theexerciseofmootingisoneofthehighlightsofeverylawcurriculum.Itteachesstudents

skillsquintessentialforsolvinglegalproblems.TheBILSMootCourtcommitteeisfounded

to develop the interests of students in the activity of mooting, facilitate students to

understandintricaciesoflegalresearch,acquiresuf�icientstrongholdovertheutilization

ofonlinelegaldatabases,organizeresearchtocrispandclearlegalpropositionsonthe

issuespresentedinamootpropositionwhich�inallyculminatesintoaclinchingargument

inamootcourtcompetition.BILShostssessionsthroughouttheacademicyearonvarious

aspectsofmootingwhichrangefromintroductiontomooting,useofresearchoperators,

tenets of legal reading and research, interpretation of statutes, moot demonstrations,

drafting a moot problem, drafting a memorandum, formatting a memorandum and

mechanicsoforaladvocacy.

Variousfunctionsandresponsibilitiesofthecommitteeareasfollows:-

· TheCommitteeselectsthestudentsforrepresentingtheCollegeinvariousnational

· CollegereimbursesalltheexpensesupRs.10,000/-(RupeesTenThousandOnly)

Theplacementcommitteeconsistsofstudentselectedbythebatchtobetheinterfaceofthecollege,i.e.toactasaliaisonbetweentheindustryandthestudentcommunity.ThebasicpurposeofthePlacementCommitteeistomanagealltheplacementactivitiesatBangaloreInstituteofLegalStudies.Italsoensuresthereadinessofthefellowparticipantsforthelegalworld.

ThePlacementCommitteeofthecollegeplaysavitalroleinmeasuringasmooth&ef�icientplacement process, co-ordinates all the efforts and activities directed towards ensuringutmostsatisfactiontotheneedystudentsfortheirplacement.

The chief guest of the functionwas Shri. Phaneendar.B.N,who is a forensic expert,

advocateandalsoamanagingdirectorofClue4(aforensiclabinBengaluru).Theother

dignitaries presentwere Dr. R.V. Prabhakara, Joint secretary BHS HES, the guest of

honour,Shri.N.B.Bhat, IPS(Retd.)SecretaryBHSHES,Dean,BILSandProf.Preeti.S.

thTheceremonycommencedwithaninvocationbyApekshafrom5 yearandPoojafromth4 yearfollowedbyawelcomeaddressbyProf.Preeti.S.Desai.ThenMs.DurgaDevi,

Assistant Professor, BILS invited Shri. Pavan V, Assistant Professor, BILS to give an

ways forensic science assists in a case, the provisions concerning the same and he

highlighted its necessity in the present world. He concluded the lecture after an

thIndiaandvariousotherhighCourts.On4 ,May1986hedesignatedasSeniorAdvocateofSupremeCourt.HethenservedasAdditionalSolicitorGeneralofIndiafromSeptember1996toMay1998.HerepresentedBhagwanShriRamintheAyodhyacasebeforeLucknowHighCourt.

ShriK.N.Bhat�irsttalkedabouttheaccessionofstateofJammu&Kashmirandthereasonbehind it receiving special status.He then talkedabout Indiagaining Independence fromBritishduetolackofresourcesonthepartoftheBritishpostSecondWorldWar.Also,intheyear1946hetalkedabouttheCabinetMissionwhichsuggestedindividingIndiaintoIndiaandPakistanasaHindumajorityandMuslimMajoritynationrespectively.Hefurtherspokeabouttheunionofprincelystates,whenindependencewasgiventoIndiatherewerearound500princelystatesexistinginIndiaandifallofthemweretoremainstandalonestatesitwouldresultinaweakersovereign.Therefore,SardarVallabhaBhaiPatelnegotiatedwithalltheprincelystatesandconvincedthemtoaccedetoIndia.Healsorecommendedtoreadabook titled the “Integrationof IndianStates”whichwouldhelpusbetterunderstand theaftermathofthesaidevent.

ThenexttopicthatwasdiscussedwasaboutthewayJammuandKashmirendedupbecomingapartoftheIndianPolity.TheKingofJammuandKashmirHariSingh,requestedtroopsinorder to defend the state he in turn had to join the Indian country. He highlighted thatbeforehandKashmirpreferredbeingacountrybyitself. ThesaidstatewasagainmiredincontroversywhentheParliamentdecidedtograntspecialstatustothestateofJammuandKashmir,henotedthatShriBRAmbedkarwasnotpresentonthatdayinordertoprotestsuchadecision.

Thespeaker'sknowledgeinhistoryandhismasteryovertheartofteachingheldthestudentsingoodstead.Bytheendofthelecturethestudentshadafairunderstandingofthetopic.Upontheconclusionofthelecture,therewasaquestion-and-answersession.ThevoteofthankswasrenderedbySmt.ChayaBV,AssistantProfessor,BILS.

On24thAugust,2019,BILSconductedaNationalSeminaronDraftingSkillsinassociationwiththeBarCouncilofIndiaandAIRLawAcademy.Theeventwasinitiatedwiththelightingofthelampinordertoinvoketheblessingsofthealmighty.Thedignitariespresentonthestagewerethe keynote speaker Shri. Ashish Dixit, Advocate, Supreme Court, Shri. Atul Singh, GeneralManagerofAIR,Prof.PreetiS.Desai,PrincipalBILSandShri.N.B.Bhat,IPS(Retd.),Secretary,BHSHES,Dean,BILS.

ThekeynotespeakerShriAshishDixit,anexemplaryinhisownright,hislecturewasinsightfuland facilitated the students in grasping the art of drafting. Furthermore, he drew from hisexperiencesandexplainedwhichmadeiteasierforthestudentstocomprehend.Thelearningcurve required in terms of drafting was highlighted. Womenempowermentreferstomakingwomenpowerful.Tomakethemcapableofdeciding

forthemselves.Womenhavesufferedalotthroughtheyearsatthehandsofmen.Inearlier

centuries,theyweretreatedasalmostnon-existent.Asifalltherightsbelongedtomeneven

somethingasbasicasvoting.Asthetimesevolved,womenrealizedtheirpower.Thereon,

begantherevolutionforwomenempowerment.

Aswomenwerenotallowedtomakedecisionsforthem,womenempowermentcameinlikea

breathoffreshair.Itmadethemawareoftheirrightsandhowtheymustmaketheirownplace

insocietyratherthandependingonaman.Itrecognizedthefactthat,thingscannotsimply

workinsomeone'sfavourbecauseoftheirgender.However,westillhavealongwaytogo

whenwetalkaboutthereasonswhyweneedit.

NeedforWomenEmpowerment

Almosteverycountry,nomatterhowprogressivehasahistoryofill-treatingwomen.In

otherwords,womenfromallovertheworldhavebeenrebellioustoreachthestatusthey

havetoday.Whilethewesterncountriesarestillmakingprogress,thirdworldcountries

likeIndiastilllackbehindinWomenEmpowermentcomparedtoothercountries.

InIndia,Womenempowermentisneededmorethanever.Indiaisamongstthecountries

whicharenotsafeforwomen.Therearevariousreasonsforthis.Firstly,womeninIndia

areindangerofhonourkillings.Theirfamilythinksitsrighttotaketheirlivesifthey

bringshametothereputationoftheirlegacy.

Moreover,theeducationandfreedomscenarioisveryregressivehere.Womenarenot

allowedtopursuehighereducation,theyaremarriedattheearlyage.Themenarestill

dominatingwomeninsomeregionslikeit'sthewoman'sdutytoworkforhimendlessly.

Theydonotletthemgooutorhavefreedomofanykind.

Inaddition,domesticviolenceisamajorprobleminIndia.Menbeatuptheirwifeand

abusethemastheythinkwomenaretheirproperty.Moreso,becausewomenareafraid

tospeakup.Similarly,thewomenwhodoactuallyworkgetpaidlessthantheirmale

counterparts.Itisdownrightunfairandsexisttopaysomeonelessforthesamework

becauseoftheirgender.Thus,weseehowwomenempowermentistheneedofthehour.

Weneedtoempowerthesewomentospeakupforthemselvesandneverbeavictimof

injustice.

Therearevariouswaysinhowonecanempowerwomen.Theindividualsandgovernment

mustbothcometogethertomakeithappen.

Educationforgirlsmustbemadecompulsorysothatwomencanbecomeliteratetomake

alifeforthemselves.

Women must be given equal opportunities in every �ield, irrespective of gender.

Moreover,theymustalsobegivenequalpay.

Wecanempowerwomenbyabolishingchildmarriage.Variousprogramsmustbeheld

wheretheycanbetaughtskillstofendforthemselves,incasetheyface�inancialcrisis.

Mostimportantly,theshameofdivorceandabusemustbethrownoutofthewindow.

Manywomenstayinabusiverelationshipsbecauseofthefearofsociety.Parentsmust

teachtheirdaughtersitisokaytocomehomedivorcedratherthaninacof�in.

Conclusion

WomenempowermentisonebigissuefacingbyIndia.Itismostimportanttocreate

awarenessandunderstandingtheproblemofwomenemploymentinalltoppolicy

anddecisionmaking.Myanalysisexplainsfewwaystoempowerwomen.Toachieve

this,atthesametimetheyhavetostrugglealottogainthispowerandgettheirvoice

#Metoomovementwasintroducedintheyear2006byTaranaBurke.Asocialactivistand

communityorganizerwhostartedthetrendonmyspacesocialnetworktopromoteEmpower

throughEmpathy, to call out thewomenvictimsof sexual abuse.Themovementbecame

trendingonsocialmediaallovertheglobeintheyear2017-18whenmanywomencameout,

backlashingHarveyWeinsteinaHollywoodmovieproducerofsexuallymisconductingthem.

ThesamemovementwastrendinginIndiaas#metooIndiawherealotofwomenincluding

Bollywoodactresses,topjournalists,Famouswomenofthecountrycameoutnarratingtheir

storiesasbeingavictim.

#Metoowasachangeoverforalotofwomeninthecountry.Manycameoutofthefearand

shamethatwasdeep-rootedforadecadeormoreandstartedsharingtheirstoriesonsocial

mediaplatforms.

Anincidentmentionhereafterwillelaboratemypoint,

PriyaRamani,ajournalist,withtheongoing#metoomovementsharedanincidentrelatingto

sexualharassment.Shewroteanarticleinvoguemagazineintheyear2017titled“ToThe

Harvey Weinstein's of the world” where she describes how her so-called interview

(moreofthedate)went.Itwasintheyear1997whenPriyawasa23-year-oldjournalist,

excitedtotaketheinterviewofafamousman.Sheexplainshowweird,disgustingandscaryit

wastointerviewafamousmaninahotelroomalone.Shedidn'tmentionthenameofthe

abuseranywhereinthearticlebuthadusedtermslike“aformerboss,sexualpredators”etc.

After20yearsofkeeping,ittoherself,i.e.in2018PriyaRamanidecidedtodisclosethename

andinoneofhertweetsmentionedM.JAkbarandcallingoutallotherwomenwhohavebeen

victimsofhisabuse.Inthesameyear,M.JAkbar�iledacriminaldefamationcaseagainsther

callingoutbefalseaccusationsthatareaffectinghisstellarreputation.“Anactwherebyfalse

claimsaboutapersonharmsthereputationofthepersonisDefamation.”Onecandefame

anotherpersoninwritingcalledslenderororallycalledlibel.ItcanbeCivilwhereonecan

demand compensation from the court or it can be criminal where one can demand

punishmentfromthecourt.Provisionregardingthede�initionofDefamationcanbefoundin

Section499oftheIndianpenalcodeandprovisionregardingthepunishmentsofdefamation

canbefoundinsection500oftheIndianpenalcode

The case stretched for two years andmore. Soon in 2021, TheDelhi District Court gave

judgementinfavourofPriyaRamanistatingfewimportantpoints,

2. Therightofreputationcannotbeprotectedatthecostoftherightofdignityandtheright

ofwomen

3. Awomanhasarighttoputhergrievanceatanyplatformofherchoiceandevenafter

decades.

ThevictoryofPriyaRamaniisawinfortheentirewomenfolkinthecountry.Shestoodupand

representedeverywomanwhospokeagainstwomencrimes.Thisincidentencouragedevery

womantostand,speakand�ightforthemselvesagainstsexualabuse.

Gone are those days, wherein the unimpeachable audience would �ill the theatres with

laughteronseeingacomedianportrayinganaiveandincompetentadvocategettingassaulted

byhisclientinthecourtcomplexorhe'stryingtoescapefromthebackyardclimbingoffthe

walltoavoidgettingbeatenupbytheaggrieved.Recently,theBarCouncilofIndia,neverlater

thanever,dauntlesslynotedthatfrequentandoftenviolentcastigationofthemembersofthe

Advocate'sfraternityisundoubtedlyamatterthatcausesextremedistresswhichisasevere

threatandattackontheindependenceoftheBar!

The secondday of July 2021witnessed theBar Council of India being applaudedby the

membersofthelegalcircleandthelawenthusiastsfortheirprudencetoreleasetheDraftof

theAdvocate's(Protection)Bill,2021whichwasde�initelyacryingneedofthehour.The

relentlesseffortsofaseven-membercommitteebecamefruitfulindevelopingaregulatory

frameworkwithanobjectiveofprotecting theAdvocates;with thebona-�ide intentionof

removingunwarrantedobstructionsinthedischargeoftheirduties.WhiletheAdvocatesAct,

1961wasalreadyinpicturewhichlaidoutdirectivestobefollowedbytheprofessionalsin

this �ield, the requirementof anef�icacious legislation to regulate theetiquetteof clients

towardstheirsaviourshasnowbeenlookedupto.ItisworthmentioningthatthisBillisan

efforttoimplementcertainguidelinesincorporatedwithin'TheBasicPrinciplesonRoleof

Lawyers'adoptedinthe'8thUnitedNationsCongressonPreventionofCrimeandTreatment

ofOffenders(1990)'towhichIndiaisasignatory.Thismovebythebodythatisresponsibleto

ensurethewelfareofthelawyersisgettingintotheopinioncolumnsforitstiming,wherein

theAdvocateswere�indingitdif�iculttograpplewiththehostileenvironmentprevailingin

oursociety.ThenewsofalawyernamedVamanRaoalongwithhiswifegettingstabbedto

death by goondas in the neighbour-hood of Telangana for him showcasing commitment

towardsthisprofessionby�ilinggenuinecasesagainsttwolocalleaderstopreventthemfrom

encroachingonpubliclandisde�initelynotanisolatedincident.Suchincidentshaven'talways

goneunnoticed;yetunattendedindifferentpartsofthecountry.Inthistechnologicallywell-

equippedera,whereintheprospectiveclientstendtoratetheinformationobtainedfromthe

e-sourcestobemorereliableandauthentic,tendtodevaluethepotentialofaprofessional

leftunaddressedsinceages.

Itgoeswithoutsaying,justicedeliverydispensationisdependentonthreeimportantfacets–

Police,JudiciaryandLawyers.Whereas,judgesandpolicepersonnelwereadequatelysafe

guardedbytheexistinglegalframeworkandstatutorysheathing,thelawyerwhoisthecrucial

linkbetweenthetwowasnotgrantedampleprotectionandsecuritywhichhasbeenthebone

ofcontentionsincedecadesthatledtotheintroductionofthisBill.

ThestrikingpartoftheBillistheprogressivethinkingoftheCommitteetoincorporatethreats

andattacksbelongingtobothpsychologicalandemotionaldomainstooinadditiontothe

coherentphysicalabuse,within thede�initionof 'ActsofViolence'underSection2of the

legislation.Inclusionofthestringentpunitiveprovisions,theformatofinvestigationcoupled

with the decision to provide police protection to the agitating Advocate and the idea to

constitute a three-member committee for 'Redressal of Grievances of Advocates andBar

Associations'etc.istrulyappreciable.Internalizationof'NoSuit'arrangementtosecurethe

actionsoftheAdvocatewhoactedingoodfaithandthesterlingdirectiveprovisionproposing

theappropriategovernmenttoguaranteethe'SocialSecurity'tothehaplessmembersofthis

professionduringthetryingtimesthrougheffectivepoliciesetc.deservesappreciation.

Itwon'tbewrongtostatethatthepresentresolution,followingthefootstepsofEuropean

nationsandtheHumanRightsCounciloftheUnitedNationswhowerewayaheadtointroduce

suchaconcepttoensurethesafetyoftheAdvocates;isawelcomestep.

However,thecommitteeshouldmakeanefforttocommunicateandtakenecessaryinputs

fromeveryDistrictandStateBarAssociationsbeforearticulating the �inalversionof the

legislation.Aprofoundthreatanalysisthroughaneffectivecomparisonwithotherforeign

jurisdictionsisalsoadvisable.

andyetwomanhasnofreedomnorequalityinthenation.

IPCsection304Bdowrymeansanypropertyorvaluablesecuritygivenoragreedtobegiven

eitherdirectlyorindirectlybyonepartytoanother,duringorthetimemarriage.

Dowry deaths are deaths of married women who are murdered or drives to suicide by

continuousharassmentortorturebyhusbandandin-laws.Thisishorrifyingthatthewomen's

homesarethemostdangerousplaceforthemtobe.

Itisashame,onIndiaasitsetshighesttotalnumberofdowrydeathsintheworld.Accordingto

Indian National Crime Record Bureau in 2012; 8,233 dowry death cases were reported

according to India. Thismeans a bridewas burned every 90mins or dowry issues cause

1.4deathperyearper1,00,000womeninIndia.

Most interesting fact is thatdowrydeath in Indiaarenot limited toanyspeci�ic religion.

EspeciallyKeralasetsahighestofallstatesandhasain�lationindowrycases.

Dowryprohibitionactof1961prohibitstherequest,paymentoracceptanceofadowry,gift

demandedorgivenasapreconditionarenotconsidereddowryandarelegal.Askingorgiving

ofdowrycanbepunishedbyanimprisonmentofuptosixmonthsora�ineofupto5000.

Underthe“ProtectionofWomenfromDomesticViolenceAct2005(PWDVA),awomencanput

a stop to the dowry harassment by approaching a domestic violence protection of�icer.

However,effectivenessoftheselawshasbeenquestioned”.

AlthoughIndianlawsagainstdowrieshavebeenineffectfordecades,theyhavebeenlargely

criticizeasbeingineffective.Thepracticeofdowrydeathsandmurderscontinuestotake

place unchecked in many parts of India and this has further added the concerns of

there,ifsuchacaseismadeout.Ifthecaseisestablished,therecanbeaconvictionunderboth

thesections.
