under the W.B.L.R. Act, 1955. One of the most important points to be considered in connection with the disposal of a 14T proceeding is the determination whether the lands of the big raiyat against whom the proceeding has been started are situated in irrigated area or not.

For the purpose of determination of irrigated area in terms of S.14K(d) of the WBLR Act, it is immaterial whether particular plots actually get irrigation water or not. All agricultural plots and orchards included in the Notifications issued by the State Govt. under Section 14K(d) ibid specifying irrigated area will have to be taken as situated in irrigated area irrespective of whether such plots get irrigation water or not.

So, for deciding 14T proceedings, the Notifications issued by the State Government u/s. 14K(d) specifying irrigated area in respect of State Canal Irrigation Project, State Deep & Shallow tube-wells, State River Lift Irrigation Project and other State Irrigation Projects are essential.

Unfortunately, it is noticed during inspection that most of the offices which are concerned with disposal of 14T proceedings are not equipped with the notifications on irrigated areas. It is unthinkable how 14T proceedings can be disposed of without looking into the notifications. There is every reason to believe that due to non-availability of the notifications, 14T proceedings have been disposed of without consulting the same and that in the process irrigated area has been wrongly identified as non-irrigated resulting in lands in excess of the ceiling being allowed to the riayats, much to the detriment of the public interest. It is apprehended that due to wrong identification of irrigated area, a large area of land which could have vested has been allowed to be retained by the raiyats.

In this connection, what is most reprehensible is that the Superior Officers have not at all bothered about the notifications. Resultantly, few petitioners are going away with some divertion of lands like in Bankura District. The matter should have come to their notice during inspection of the office and particularly during examination of the 14T proceedings already disposed of. The fact that the matter has remained unnoticed reveals that either there have been very few inspections of the offices, or the 14T proceedings disposed of have not been examined, which is an essential part of an inspection of office, or the Officers are ignorant of the provisions of law. Nothing can be more sad than this.

Not that the notifications are not available in all the offices. In some of the offices, though the number is very few, some of the notifications are available. This means that the erstwhile Circle Offices were duly supplied with copies of the notifications. The tragedy, however, lies in the fact that such important documents as the notifications have not been scientifically and methodically maintained and preserved due to carelessness of the officers and staff. Since, with the amendment of the WBLR Act by the WBLR (Amendment) Act’81 and WBLR (Third Amendment) Act, 1986, the importance of vesting of ceiling surplus land has vastly increased and Govt. is attaching greater urgency and importance to this aspect of land reforms, a time has now come when it is absolutely necessary to trace out the notifications and preserve them properly.

A thorough search may be made in the BLLRO’s Offices to find out the notifications. The search may be completed and copies of all notifications traced out may


be sent to the DLLRO’s office within a month. Simultaneously similar search may also be undertaken in the office of the DLLRO where the notifications must be available. The notifications collected from the BLLRO’s Offices and traced out by the DLLRO’s office itself should be carefully examined and a register of all the available notifications to be named “Register of Notifications on Irrigated Area under the WBLR Act” should be prepared and maintained in the DLLRO’s Office. Sufficient number of the register may be prepared by xeroxing or cyclostyling the notifications and at least one register may be supplied to each SDLLRO’s Office and BLLRO’s Office.

According to S.14K(d) of the WBLR Act’55, an area irrigated or capable of being irrigated from State Canal Irrigation Project or State Power Driven Deep Tube-well or Shallow Tube-well or any other State Irrigation project or State River Lift Irrigation Project may be specified by notification by the State Govt. as irrigated area.

It will not, therefore, be enough to prepare a register of notifications of irrigated area in respect of State Canal Irrigation Projects only. Notifications of irrigated area in respect of State Power Driven, Deep and Shallow Tube-wells, State River Lift Irrigation, other semi-state Irrigation Project, will also have to be collected and included in the register.

In order to ensure that notifications in respect of all these projects are collected and included in the register, BLLROs may report to the DLLRO the particulars of all such projects in his Block along with a copy of the command area map and notification issued by the Irrigation & Waterways Deptt., Corporations like Damodar Valley Corporation, specific Area Projects like CADCs or renowned Irrigation Projects, autonomous bodies like Kansawati Projects, Teesta Project or Agriculture (Minor Irrigation) Department. The particulars of the projects and copy of the map and notification may be collected from the office of the Asstt. Engineer, Executive Engineer or Superintending Engineer concerned of the Irrigation & Waterways Deptt. or the Agriculture (Minor Irrigation) Deptt. A copy of the notification issued by the L & L.R.Deptt. u/s. 14K(d) may also be collected, if available with them. The DLLRO’s office will examine the particulars with reference to the notifications available. If no notifications u/s 14K(d) in respect of any of the Project is found, it should be presumed that such notification has not yet been issued. Necessary particulars of the Project along with a copy of the command area map and notification and a Schedule of lands included in the command area map may be sent to the Directorate for onward transmission to the L & L.R.Department for issue of necessary notifications U/s. 14K(d). Meanwhile, 14T proceedings relating to the area may be disposed of on the basis of the command area map and notification issued by the Irrigation and Waterways Deptt. or Agriculture (Minor Irrigation) Deptt. taking the area include therein to be irrigated area. Help of District Collector may be taken to procure notifications from D.V.C. Irrigation Deptt., R.L.Is. Deep Tube wells or Minor Irrigation from Irrigation Deptt. or C.A.D.C. Projects & Other renowned Irrigation Projects.

On receipt of the register of notifications on irrigated area under the WBLR Act from the office of the DLLRO, each BLLROs’ Office will prepare a mouzawise register of irrigated area in respect of the mouzas within its jurisdiction on the basis of the notifications. The names of the mouzas may be shown in the mouzawise register serially according to J.L. No. Sufficient blank pages may be kept for each mouza so that particulars in respect of notifications traced out, collected or received subsequently may be incorporated. The mouzawise particulars may be maintained in the following proforma :-

The register of Notifications of Irrigated Area under the WBLR Act received by the BLLRO’s office should be carefully maintained and should be kept under the custody of the Officer–in–Charge of the Vesting Cell. The register should be updated by incorporation of copies of notifications subsequently received from the DLLRO’s office. Whenever there is any change, by transfer or otherwise, of the Officer-in-Charge of the Vesting Cell, the outgoing officer must hand over the Register to the new incumbent.

The responsibility of tracing out the notifications issued by the L&LR Deptt., preparation of the list of Irrigation Projects in the Block, Collection of particulars, command area map and notifications issued by the Irrigation and Water-ways Deptt. and Agriculture (Minor Irrigation) Deptt. may be entrusted to the Vesting Cell formed in each BLLRO’s office. The progress of work may, however, be monitored by the BLLRO and Superior Officers regularly.

The entire work of tracing out, collection of notifications and preparation of the register must be completed within 3 (three) months and the report of completion may be sent to this office by 15th March, 1993, positively.

14T proceedings already disposed of may be re-examined with reference to the notifications. Any mistake detected in determination of irrigated area may be corrected by reviewing the proceedings by taking recourse to section 14T(3A) and 57 of the WBLR Act.

Sub : Determination of irrigated area – Clarification thereof. The undersigned is directed to refer to his memo. No.491/2849/CS/96 dated 26.12.2000 on the above subject and to say that there is specific provision in determination of irrigated area under the West Bengal Land Reforms Act, 1955. Due to non-observance of the prescribed procedure in some cases it is found that Court cases are instituted and the proceedings of the Revenue Officers concerned are quashed by the Court. In determining if a land is irrigated or not the necessary condition is that it is within the notified area as per notifications issued by the State Govt. under Section 14K(d) of the W.B.L.R. Act. 1955 but the said notification is not the sole basis and in specific cases wherever the question is raised before the Revenue Officer concerned that the land is not within the irrigated area then the Revenue Officer has to hold an inquiry and come to decision whether the land, in question is within the irrigated area as defined in Section 14 K(d) of the W.B.L.R. Act, 1955 and in doing so, he must give hearing to the concerned raiyat as well as prepare a memorandum of such inquiry held by him.

The undersigned is, therefore, directed to state that in determining if any land is irrigated or not, it should first be ascertained if it is within the notified area under Section 14K(d) and thereafter the Revenue Officer should enquire under Section 14N of


the W.B.L.R. Act, if the raiyat so applies, on giving opportunity of being heard to the raiyat and decision that the land is irrigated should be taken on the basis of finding of such enquiry.

In this connection, the memo. No.1385(18)-LR dt. 14.11.83 is hereby withdrawn.

A Specimen order of ‘Water’ rate

NOTIFICATION

No. 28-I, 3rd September 1977, - In exercise of the power conferred by section 6 of the West Bengal Irrigation (Imposition of Water Rate) Act, 1974 (West Bengal Act XLVI of 1974), the Governor is pleased hereby to revise, with effect from the 1st day of July 1977, the Water rate imposed under this department notification No.9-I, dated the 12th February 1975, published in the “Calcutta Gazette, Extraordinary”, dated the 12th February 1975, Part I, page 189, in the area included within the boundaries specified in the schedule below, which has been deemed to be a notified area, with effect from the 1st day of July 1974 under this Department Notification No.17-I, dated the 9th October 1974, and to specify the rate of rupees fifteen only for each 0.4047 of a hectare of land as the revised water-rate in the said area for the Kharif season every year, with effect from the 1st day of July 1977.

THE SCHEDULE Boundaries of the area deemed to be a notified area

Starting from the Barrage in the river Karatowa at Mouza Kamarvita (Jurisdiction list No.17), Police Station Rajganj, district Jalpaiguri at about 4,000 ft. down stream of the Siliguri – Haldibari Railway Line crossing of the river Karatowa, the boundary line goes eastward up to the River Talma at northern boundary of Mouza Panikouri (Jurisdiction list No.15) of the same police station through the mouza Kamarvita (jurisdiction list No.17) and Panikouri (jurisdiction list No.15) of same police station and then turns down stream of the River Talma along the right bank up to southern boundary of Mouza Sukani (jurisdiction list No.28) of same police station and then turns Westward up to the River Karatowa at Mouza Sukani (jurisdiction list No.28) of same police station through mouza Sukani (jurisdiction list No.28) of same police station and then turns up-streams of the river Karatowa along its left bank and then turns west up to River Sahu at Rajganj Gadra Road crossing along the above mentioned road and then turns upstream of the River Sahu along its left bank up to Siliguri – Jalpaiguri State Highway crossing at Mouza Jugivita (Jurisdiction list No.19) of same police station and then turns towards north-east meeting the Barrage in the River Karatowa at Mouza Kamarvita (jurisdiction List No.17) passing through mouzas Jugivita (jurisdiction list No.19) and Gadheaganja (jurisdiction list No.18) and Kamarvita (jurisdiction list No.17) of Police Station Rajganj.
