Consider the adoption of Resolution No. 16-032 confirming the approval of a CollectiveBargaining Agreement with the Amalgamated Transit Union, Local 192 ("ATU") through June30, 2019 and approve the necessary adjustments to the FY 2016-17 operating Budget.
BACKGROUND/RATIONALE
The District and ATU negotiated a tentative agreement, for a collective bargaining agreementfor the period of July 1, 2016 through June 30, 2019. The membership of ATU ratified thetentative agreement on July 7, 2016. Board action is now required to formally adopt thetentative agreement, and staff is recommending the adoption of Resolution No. 16-032
BUDGETARY/FISCAL IMPACT
A $3.2 million increase to wages and benefits will be reflected in the FY 2016-2017 adoptedbudget. All other adjustments to the budget from the agreement will be reflected in the Mid-year Budget Review.
ADVANTAGES/DISADVANTAGES
Approval of this tentative agreement will complete the process of establishing a laboragreement between the District and ATU, Local 192 for the next three years. There are nodisadvantages to approving this agreement.
ALTERNATIVES ANALYSIS
There are no alternatives to either approving or disapproving the tentative agreement
PRIOR RELEVANT BOARD ACTION/POLICIES
The most recent prior resolution approving a labor contract with ATU was Resolution No. 14003, approved by the Board of Directors on January 8, 2014.

RESOLUTION NO. 16-032
A RESOLUTION CONFIRMING THE APPROVAL OF A COLLECTIVE BARGAININGAGREEMENT WITH THE AMALGAMATED TRANSIT UNION, LOCAL 192 THROUGH JUNE 30,
2019, AND APPROVE THE NECESSARY ADJUSTMENTS TO THE FY 2016-17 OPERATING BUDGET
WHEREAS, in accordance with Public Utilities Code Section 25051, authorizedrepresentatives of the Alameda-Contra Costa Transit District (the District) and AmalgamatedTransit Union (ATU), Local 192, (the Union) engaged in good faith collective bargaining tonegotiate a labor agreement; and
WHEREAS, the parties reached tentative agreement on various changes, includingwages and work rules on June 28, 2016; and
WHEREAS, the tentative agreement was ratified by the Union's membership on July 7,2016
NOW THEREFORE, the Board of Directors of the Alameda-Contra Costa Transit Districtdoes resolve as follows:
Section 1. Confirms its approval of the tentative agreement negotiated in good faithbetween the representatives for the District and the Union, which covers the period of July 1,2016 through June 30, 2019. The terms of the tentative agreement are contained in Exhibit A,attached hereto and incorporated by reference.
Section 2. Directs staff to promptly prepare in cooperation with ATU, Local 192, anupdated Collective Bargaining Agreement containing aloof the agreed upon terms, causing thesame to be published and made available to the workforce and the public.
Section 3. Approves a $3.2 million increase to wages and benefits in the FY 2016-17Operating Budget. All other adjustments to the budget resulting from the agreement shall bereflected in the mid-year budget review.
Section 4. This resolution shall become effective immediately upon its passage byfour affirmative votes of the Board of Directors.

3.14 Time Extension for Sexual Harassment and Discrimination Cases: in cases involving allegationsof sexual harassment and/or discrimination, an investigation will be conducted by the AffirmativeAction/Equal Employment Opportunity(AA/EEO) Unit prior to any disciplinary letter being issued.
A determination sha]] be made by AA/EEO within #tt:ee-(3} ten r].0) working days of the notice ofthe alleged harassment/discrimination, whether the facts of the incident require investigation.

The panics understand that Kaiser On the Job occupational health facilities are not located at every Kaisermedical center, and that employees who are not on Kaiser health plans may also elect to have theirDOTlrDMV physical examinations perforated at a Kaiser On the Job occupational health facility.
AC Transit willrevise its Authorization Form to reflect the addition of Kaiser On the Job as an authorizedfacility for employee DOT/DMV physical examinations.

MEDICAL TRUST
The Union and the District have established and jointly administer a trust fund intended for use
by retirees for postretirement medical. In (1997) the District contributed $1,000,000 to the trust.
Effective November 1, 2005, the District contributed S1.00 per hour per employee for all hoursworked. Effective July 1, 2008 the District contributed $1.30 per hour per employee for allhoursworked. Effective November 5, 2010, the District's contribution will be $1.10 per hour per
employee for allhours worked. The District contribution of $1.10 per hour to the Retiree MedicalTrust will increase to $1.30 per hour if the Trust Fund falls below$2 million in assets.

SIDELE'ITER AGREEMENTRE. OPERATOR COACHING/MENTORSHIP PROGRAM
'His is a Sideletter Agreement between AC Transit District and ATU Local 192. This
agreement between the parties is pursuant to Section 31.04 of the parties' Memorandum ofUnderstanding (MOU) which establishes the joint Operator Coaching/Mentorship Program.
The purpose of this program is to provide new bus Operators continued support, coaching,
and mentorship flom veteran Operators. The goal of this program is to develop a professional
Operator workforce with excellent safety and customer service skills. to improve Operatorretention, and to reduce Operator work-related stress, illness and injury.
To eHectuate the agreements set out in MOU Section 3 1 .04, the parties agree as follows:

A Joint Labor Management Committee (JLMC) will be established consisting of3 Unionrepresentatives and 3 District representatives with authority to implement the OperatorCoaching/Mentorship Program .
'He JLMC will design and implement the Operator Coaching/Mentorship Program.
The primary purpose of the Operator Coaching/Mentorship program is to provide ongoing
support for new and current bus Operators and that the program will be open to all new and
current bus Operators, upon their consent.
A mutually agreed outside neutral facilitation agency will be retained to oversee the design
and implementation of the Operator Coaching/Mentorship Program

SECTION 40.0
40.22 in advance of the System or Division sign-up the Scheduling Department will provide the runcut to the Drivers' Committee for review and comment. The Drivers' Committee will be released for
two working days to review, comment and identify any contractual violations. The SchedulingDepartment will consider the comments submitted by the Drivers' Committee before preparing thefinal run cut.
40.23 Acer the final run cut is prepared, the District will roster the work by computer and provide acopy of the roster to the Drivers' Committee. The Drivers' Committee members will be released fortwo !1llgg.days to review the roster with the Scheduling department and provide any feedback and/orsuggested changes to the roster. If as a result of comments received by the Driver's Committee a newroster is prepared, the Drivers' Committee will be provided with a copy of the updated roster reflectingthe changes suggested by the Drivers' Committee.

48.01 Recognizingthat regular rest periods throughout the work day are essential to the health
and safety of transit workers, and .that on time performance is essential to good service, the
Parties agree to provide both rest periods and recovery/layover time in the runcut. But, since
spot or layoveidgfgg€11y time is intended for the District to insure on time operation of theservice, it is intended that bus drivers should start each trip at the time scheduled.
48.02 For purposes of this section, Recovery/Layover time is understood to mean that timewhich is used to adjust the runningtime of the schedule. It is used to keep the published scheduleand allow for delays on the road.e'48.03 operator Meal/Rest Periods are distinctly different from recovery/layover time, and areset aside for the specific purpose of allowing the Operator time for a short rest break, meals, and
other personal needs.
48.04 Straight RunsOperator Meal/Rest Periods shallequala minimum of 50 minutes in an eight hour day excludingpoint time. However, straight runs with splits of 59 minutes or less shallonly be required to have
20 minutes for mea]/rest periods. There must be a m/n/mum of ]5 m/mules on one un/nterruptedmeal break period scheduled approximately midway in the shift. The designated meal period and

This is a Sideletter Agreement between AC Transit District and A'rU Local 1 92. This
agreement between the parties is pursuant to Section 75.03 of the parties' Memorandum ofUnderstanding (MOU) which establishes the Mechanic Career Ladder Training Program(MCLTP) and the Mechanic Helper Classification.
The purpose of this program is to provide employees, and in particular Service Employees,
the opportunity 6or career advancement within the Maintenance Department at AC Transit, and to
provide a pool of District employees who are prepared to enter into the District's maintenance
apprenticeship programs.
To effutuate the agreements set out in MOU Section 75.03, the parties agree as follow:

The JAC will design and implement the MCLTP and the Mechanic Helper Program.
The primary purpose of the Mechanic Flelper Progmm is to provide Service Employees
with a career ladder within the Maintenance Department. However, if there is aninsufficient number of Service Employee candidates to fill the program's positions, the
program will be made available to employees who have demonstrated basic mechanical
aptitude, and will be provided first to other Maintenance Department employees and
then to other bargaining unit employees outside of the Maintenance Department.
A mutually agreed outside neutral facilitation agency will be retained to oversee thedesign and implementation of the MCLTP and the Mechanic Helper Program.
The JAC will meet to begin development and implementation of the MCLTP and the
Mechanic Helper Program within 90 days of the ratification of the MOU.
The District and Union agree to joint responsibility for the costs associated with theMCLTP and Mechanic l-helper Program, by the Union exploring funding for trainingthrough joint applications for Federal and State funding and through other untappedresources.

SIDELETTER AGREEMENT
RE. CONVERSION OF EQ SERVICE EMPLOYEES AND JANITORSl
1. Any District employee who is classified as an "Extra Qualified Temporary ServiceEmployee" as of the date of ratification of the MOU shall be converted to the "ServiceEmployee" classification as of the date of ratification. Such employees shall retain theirDistrict and Maintenance Department seniority.
2. Subsequent to ratification, all Service Employee sign-ups may include up to 7 floaterpositions. The purpose of the floater positions is to nell temporary vacancies. All ServiceEmployees who bid floater positions shall fill those temporary vacancies in seniority order.
Any unfilled vacancies will be assigned by the Union in inverse seniority order.

DIVISIONAL AND SYSTEM SENIORI'lY SIGN-UPS
The following procedures shallbe used for developing a pilot BidWeb program for DivisionalandSystem Seniority sign-ups. The Division and System Seniority sign-ups will take place overmultiple days, excluding Saturday, Sunday, or District holidays. BidWeb will begin with a Pilotprogram on a date mutually agreed to by the parties, and at one Division only. The followingprocedures shallbe followed for the BidWeb Pilot program.
The BidWeb Pilot program will provide for a parallel process where employees can select theirassignment preferences using the BidWeb system or manual sign-up procedures outlined inSection 40.0 System Seniority Sign-Ups. The manualsign-up process willoccur on the same datesand times as the BidWeb sign up.
fDuring the initial phase of the BidWeb rollout, management and a Union Representative willverify the work assignment preferences submitted by operators in the BidWeb system and onchoice slips. In seniority order, division office staff will review the BidWeb system and identifythe work assignment preference of each operator in the current group, and the ATU Local ].92member will enter the work assignment into the HASTUS system. If an operator has notsubmitted a work assignment preference in BidWeb, the operator will be allowed to select theirwork assignment in person, and their work assignment will be entered into the HASTUS system.If an operator has not submitted work assignment preferences into BidWeb and is not present atthe sign-up, the work assignment for the operator will be determined by their choice slippreferences, or the Union representative will make the selection if the operator has notsubmitted a choice slip, and the work assignment will be entered into the HASTUS system.Management and the Union willcontinue this selection process in seniority order untilallgroupmembers' work assignments have been entered into HASTUS. The BidWeb system will also beupdated with operator in-person, choice slip, or Union selected work assignments.
The HASTUS and BidWeb systems will be updated with the assignments for each group prior tothe next scheduled group sign-up period. The initial sign-ups using the new BidWeb system willInclude a paper trail for analysis. Operators will only be relieved from their assignment toparticipate in person for all time which he/she is necessarily required to be off his/her run to be

After the mutually agreed upon sign-up utilizing the BidWeb Pilot, the parties shall meet tocompare the BidWeb system record with the HASTUS system record and paper trail to identifyany issues with the new sign up process and make any mutually agreed adjustments to theprocedure(s).
PHASE ll
After verification that the BidWeb, HASTUS, and paper trail records are consistent, the manualtransfer of the operator work assignment preferences from the BidWeb system into the HASTUSsystem willbe discontinued; however, the operator in-person, choice slip, or union selected workassignments will continue to be entered manually into the HASTUS system.
The procedures outlined in Section 40.0 System Seniority Sign-Ups shall be followed at all other
operating Divisions where the BidWeb Pilot procedure is not followed. The parties may thenmutually agree to expand the use of the BidWeb program to all divisions and to the SystemSeniority sign-ups, or conduct another Pilot demonstration at one or more divisions. Until suchtime that both parties agree to the use of the BidWeb program at each of the divisions forDivisional and System sign-ups, Section 40.0 System Seniority Sign-up and Division Sign-up shallbe followed at the divisions.
P TRAINING
Operators will receive paid training in accordance with the ATU Local 192 collective bargainingagreement on the BidWeb process at their assigned division prior to the initial BidWeb Pilotprogram. BidWeb informationalhandbooks willbe made available to Operators, by hardcopy andonline. Video demonstrations of the BidWeb procedures will loop continuously on the GilleyRoom Monitors. Prior to the BidWeb Pilot Sign-up, a test environment at all Divisions will becreated to allow operators on their own time to familiarize themselves with the program.
During the initialimplementation at each division, ATU 192 BidWeb Committee members willbeassigned to the divisions in two (2), eight (8) hour shifts Monday through Friday to assistoperators during the sign-up period. Operator issues and system problems will be provided tothe ATU 192 BidWeb Committee members, who will be responsible for reporting any systemrelated problems to the IT Department to troubleshoot and provide technical support for theOperators. The IT Department will provide online and phone support to ATU 192 BidWebCommittee members Monday through Friday during regular business hours during initialimplementation at each division to troubleshoot any technicalissues with the BidWeb system.

The BidWeb passwords will be made available to Operators at least 30 days prior to the initialsign-up using the new system. The BidWeb program will be accessible online by an Operator'spersonal computer or at six(6) workstations located at each Division.
Operators will be assigned to Groups for their bid schedule based on seniority order. TheOperators will be able to access assignments in the system to research and select workpreferences ten (lO) calendar days prior to first day of the BidWeb sign-up on the initial rolloutat each division and seven(7) calendar days for allsubsequent bids, and operators willcontinueto be able to research, select and change work preferences in BidWeb up to the start time oftheir assigned group.
Divisional Sign Up - Eight (8) groups will sign each day with a maximum of six (6) Operatorsassigned to each group based on seniority, with the expectation that each Operator will submitan appropriate number of selections to be guaranteed the availability of a run selection, but aminimum of 10 preferences, before their scheduled sign-up period in the BidWeb system. Thegroups will sign-up each hour, on the hour, with AM groups signing from 8 am to 12 pm and thePM groups signing from lpm to 5 pm. The cutoff time for selecting preferences online for eachmember of the group will be at the start of the posted hour for their group to bid.
General/System Seniority Sign Up - After successful implementation at Divisional sign-ups, the
parties may then mutually agree to expand the use of the BidWeb program to the SystemSeniority sign-ups. The System Seniority sign-ups utilizing the BidWeb program willbe conducted
following the same processes as the Divisional sign-ups; however, the number of operatorssigning each hour and timeframes for the sign-ups willneed to be established by mutualconsentof both parties.

Operators who elect not to participate in the BidWeb process may submit choice slips with anappropriate number of selections to be guaranteed the availability of a run selection, but aminimum of 10 preferences, for divisionalsign-ups in order to provide for the same opportunitiesas selecting an assignment in the BidWeb system. Paper choice slips must also be submitted bythe beginning of the posted hour for the Operator's group to bid.
Operator paper choice slip selections will be entered into HASTUS at the beginning of the starttime for each group. If an Operator has not selected an assignment in the BidWeb system and no
paper choice slips were provided by the Operator, or if the Operator's choices are unavailable,the Union will select an assignment on behalf of the Operator based on the Operator's currentassignment. Such selections will be final. The selection provided by the Union will be manuallyentered into the HASTUS system by the ATU Local 192 member. Then the process will continuewith the automated BidWeb selection of assignments.

f' The BidWeb system provides operators with more information on work assignment availabilitywhen operators select their assignment in a timely manner; therefore, operators selecting theirassignment in person must select their assignment in a timely manner to allow other operatorsadequate time to research open assignments and make their work assignment selections. TheUnion representative willassist the Operators in making timely assignment selections.
The ATU Local 192 member will provide all updates in the HASTUS system as quickly as possibleeach hour to allow Operators selecting work assignments in the following groups to be aware ofthe work assignments that are still available for selection. The available work assignments will
also be posted on video monitors at each division. Operators will be able to log into the BidWebsystem for up to 5 days to verify their new assignment. Thereafter, new assignment verificationwillbe available at their divisions.
The BidWeb and manual sign-up procedures will run in parallel during the initial sign-ups usingthe new BidWeb system and willinclude a paper trailfor analysis as outlined above. The manualsign-up process may be discontinued by mutual agreement between the District and Union.
PILOT FLOATING HOLIDAY AND VACATION SIGN-UPS
Upon mutual agreement, the BidWeb Pilot Program may include a Floating Holiday sign-up anda Vacation sign-up for all Operators. The manual sign-up procedures outlined in Sections 17 and18 willrun parallelduringthe initialVacation and Floating Holiday sign-ups using the new BidWebsystem and will include a paper trail for analysis. After the conclusion of the Pilot, the BidWebFloating Holiday and Vacation sign-up process will continue in future sign-ups and replace thecurrent Vacation and Floating Holiday sign-up processes outlined in Section 17 and Section 18 ofthis collective bargaining agreement. Operators willreceive training on the BidWeb process priorto the initialimplementation at their assigned division.

BIDWEB VACATION AND FLOATING HOLIDAY SIGN UP
The BidWeb Vacation sign-up will consist of two (2) rounds and take place over multiple days,excluding Saturday, Sunday, or District holidays. Operators willbe assigned into Groups fortheirvacation bid schedule based on seniority order. The Operators willbe able to select their vacationpreferences in the BidWeb system up to the time that bidding closes for their group.
Operators who elect not to participate in the Vacation BidWeb process willbe allowed to submita Vacation Selection choice slip listing their multiple preferences. Vacation Selection choice slipsmust also be submitted prior to the time of their Vacation Group closing.
The BidWeb Floating Holiday sign-up will take place over multiple days, excluding Saturday,Sunday, or District holidays. Operators will be assigned to Groups for their Floating Holiday bidschedule based on seniority order. The Operators will be able to select their Floating Holidaypreferences in the BidWeb system up to the time that bidding closes.

f Operators who elect not to participate in the Floating Holiday BidWeb process will be allowed tosubmit a Floating Holiday Choice slip listing their First Five {5) Date Choices; and their Second FiveIS) Date Choices. Floating Holiday choice slips must also be submitted prior to the closing of theirfloating Holiday Group.
The paper choice slip selections will be recorded immediately upon the time that bidding closes.The BidWeb system will select the assignments in seniority order for all operators submittingpreferences in the BidWeb system.
The Division office staff will provide all updates in the HASTUS system as quickly as possible toallow Operators selecting Vacation and Floating Holiday preferences in the following groups tobe aware of the Vacation and Floating Holiday slots that are stillavailable for selection.
A hard copy of all Vacation selections will be posted at the division by the I't of December.Operators willbe able to log into the BidWeb system for up to 5 days to verify their vacation andfloating holiday awards. Thereafter, vacation and floating holiday assignments will be availableat the divisions.

SIDELE'ITER AGREEMENT BETWEEN AC TRANSIT AND ATU LOCAL 192RE. CAD/AVL 'lURN-BY-TURN NAVIGATION
The District intends to implement CAD/AVL tum-by-tum navigation on District buses during theterm of this Agreement. After full implementation of the CAD/AVL tum-by-tum navigation, the partiesagree to evaluate whether the new system has the capability to provide some training to Operators. Anychanges in DisUict-provided training require mutual agreement of the District and the Union. (See Section40. 17.)
