PGA’s Update: FCC
FCC (Federal Communications Commission)
• What is changing
• FCC 740 will be suspended July 1
• FCC may decide in the future to collect data again at time of
import
– If so they will develop a PGA message set
• Impact
• Importers remain responsible to ensure imported product is
compliant with FCC standards
• While FCC reporting remains in place, importers need to be
aware of products requiring FCC data transmission despite
limited tariff flagging by FCC

• Will the implementation of ACE change the duty claims process when an
incorrect tariff number was used upon entry?
• Yes. The ACE environment transitions the paper post entry amendment process to an electronic post
summary correction process
• Has there been any more talk about allowing Non-Filers (Importers) to file a post
summary correction in hard copy or via the ACE portal?
• Currently only ABI filers will be able to file this information
• Our ACE submission got denied because we were missing two-three items. Do
we need to resubmit or can we just email/call someone and give them the data?
• Where an entry has been rejected because of missing data a new entry will need to be submitted with
the correct information

• Will Customs require a FED TAX ID# for all buyers/consignees regardless of
value?
• Yes, with the exception of shipments below $2,500 in value
• When will FTZ entries (type 06) be accepted in ACE?
• FTZ entries are currently accepted in ACE but are not mandatory
• They will become mandatory May 28th (if they don’t contain PGA data)

• Will ISF be a part of ACE?
– Yes. ISF is part of the automated commercial environment
• Will full name and address be required for manufacturers for all import entries
through ACE? Why?
– Yes. Instead of the MID code, ACE will follow the ISF process where manufacturers’
and other parties’ full address information will need to be received
– CBP is using full name and address cargo release information for targeting
purposes
• I have heard that in general MID requirements, outside of the FDA changes,
are going to be more stringent; do you have any information relating to those
changes?
– To date we are not aware of any additional MID changes

• Do current regulations require importers to provide all of these new extra data
elements in ACE?
• Yes. The rule is that when ACE becomes mandatory for a particular PGA, the PGA’s
dataset also becomes mandatory
• Will we still be getting separate releases from Customs and FDA?
• No. Just like in ACS you get a customs release and a separate FDA “may proceed”
• Regarding the “may proceed" will this be a default answer from the FDA once
the information is submitted?
• No. It will remain a two step process where acknowledgement of submission takes
place and then “may proceed” status is transmitted
• Where can we find the FDA Intended Use code for specific commodities?
