NOTICE OF TRUSTEE’S SALEUnder authority of that certain Deed of Trust dated August 1, 2007, from Joshua L. McComas and Jamie McComas to Dennis White, Trustee, of record in the office of the Clerk ofthe County Commission of Lincoln County, West Virginia in Trust Deed Book No. 198, at page 136, securing a promissory note in the principal amount of $62,223.12, payable toVanderbilt Mortgage and Finance, Inc., and default having been made pursuant to the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgageand Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Lincoln County Courthouse on May 7, 2012 at 2:00 p.m. subject to all reservations, excep-tions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the following described real estate, together with the improvements thereon andappurtenances thereunto belonging:

And also conveying to the party of the second part a 1970 12 x 60 mobile home situate on said property.PARCEL 2 - All that certain piece or parcel of land situate on the waters of Nine Mile Creek, Laurel Hill District, Lincoln County, West Virginia, to-wit:Beginning at an iron stake in the right of way line of the Nine Mile Public road; thence running down the said right of way of said road the distance of thirty (30) feet to another iron

stake; thence turning to the left and running towards the hill the distance of two hundred (200) feet to an iron stake; thence turning and running around the hill to another iron stake thedistance of thirty (30) feet, to another iron stake; thence again turning to the left and running down the hill to the beginning stake in the right of way line of said Nine Mile Road, the dis-tance of two hundred (200) feet, the beginning point, being a lot 30 x 200 feet.

Being the same property conveyed from James M. Frazier and Patricia Frazier, his wife, to Joshua L. McComas by Deed dated July 25, 2007, of record in the aforesaid Clerk’soffice in Deed Book No. 319, at page 440.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be amatter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitaryand sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the taxstamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property tovacate said property.

If we are going todevelop a comprehen-sive plan to address oureconomic future in thestate of West Virginia,higher education mustbe near the top of the listof priorities. With thatin mind during the 2012Regular Session theLegislature passed andthe Governor signed SB436 that created theSelect Committee onOutcomes BasedFunding Models inHigher Education. Itwas my honor to havethe Speaker of the Houseappoint to this vitalcommittee.

Directed by statute,the select committeewill have a two-fold pur-pose of making a “…aspecific and detailedanalysis of outcomes-based funding modelsused in higher educationand providing recom-mendations to theLegislature on incorpo-rating one or more ofthese models as an effec-tive piece of the state’sfinancing policy.”Some of the charges thecommittee will addressthroughout the year arethe following; 1).Identify the top three tofive public policy objec-tives that will be the

focus of the financingpolicy, 2). Review exist-ing outcomes-basedfunding models, studythe funding modelsimplemented in othersstates, including andevaluation of the degreeto which these policieshave succeeded in influ-encing institutional andsystem behavior, 3).Recommend methods tobalance the unique needsof the individual institu-tions with the demandsof the state for servicesand success for students.

It is my sincere hopethat we as a state willbegin to implementsome of the potentialrecommendations. Ifwe are going to continueto build and promoteWest Virginia our highereducation institutionsare going to play a keyrole. They educate ourworkforce, which in turnattract business. Thehigher education systemprovides us with intel-lectual capital that canpotentially expand ourresearch and develop-ment system. This inturn can produce newproducts, jobs, and bet-ter our quality of life. Isincerely believe thatthis is a solid step in theright direction.
