We represent the Blue Ribbon Panel on Transparency, Accountability, and
Fairness
in
Law Enforcement C'Panel").
We
submitted a Public Records Act request to the San
Francisco Police Department ("SFPD") on behalf of the Panel
on
December 16, 2015. On
December 24,2015, the SFPD invoked Government Code§ 6253(c) and agreed to respond by
January 8, 2016. On January 8, 2016, the SFPD sent me a three page letter in response to
my
request. My request along with the two responses from the SFPD are attached.
The SFPD's January 8, 2016 response to my request fails to comply with the
provisions
of
the Sunshine Ordinance. The SFPD provided no response to twenty-two
of
the
thirty requests made. This lack of response does not comport with the time limits set out in
Administrative
Code§
67.2l(b) and Government
Code§
6253(c). The SFPD stated it will
endeavor to continue to produce public records on a "rolling" basis but has not given an estimate
as to when it might comply with its public records obligations,
or
any commitment to do so.
Of the seven requests to which it did respond, the SFPD declined to respond to
three
of
them citing various statutory provisions. The SFPD did not explain why these
prohibitions apply or why, per departmental policy and Administrative
Code§
67.27, such
