1 ContacttheBuildingDepartmentandspeakwithaBuildingInspectortoobtainaBuildingPermit(singlefamily/owneroccupiedhomeofficesareexcluded).Theminimumfeeis$100forCommercial($50forResidential).
2 Present the scope ofwork to the Inspector to determinewhether a set of professionallydrawnplansandConstructionControlDocumentarerequiredbeforeissuanceofCertificateofOccupancy.
3 Afteranyconstructionhasbeencompleted,scheduleasitevisitwithInspectortodeterminethatbusinessspaceissafeandmeetsproperBuildingCode.
4 Upon meeting all Building Code requirements (Health and Fire Codes too if applicable)InspectorwillissueaCertificateofOccupancy.Thefeeis$100.
5 AtthispointyoucanapplyforaBusinessCertificatewiththeBuildingInspector.*6 PresentsignoffforBusinessCertificate,issuedbyBuildingInspector,toCityClerk’sOfficeto
obtainyourcertificate.Thefilingfeeis$20.*TheStateofMassachusetts(inconformitywiththeprovisionsofChapteronehundredandten,SectionfiveoftheGeneral laws, as amended) requires that every business obtain a certificate to register theirDBA (doingbusinessas)name.Homeofficemustbesinglefamily/owneroccupied.FREQUENTLYASKEDQUESTIONS:Whenisabuildingpermitrequired?
Anyoneseekingtoconstruct,alter,ordemolishastructureorinstallasignmustfirstobtainabuildingpermitfromabuildinginspectorattheInspectionalServicesDepartment.Thebuildingpermitmustbeobtainedbeforethestartofanyworkandmustbeprominentlypostedatthejobsite.
Whocanbeissuedabuildingpermit?BuildingpermitsareissuedtoconstructionsupervisorslicensedbytheStateofMassachusetts.TheStatelicenseisonlyvalidforworkinvolvingstructuresoflessthan35,000cu.Ft.Asanexceptiontothisrequirement,buildingpermitsarealsoissuedtohomeownersdoingworkononeortwounitdwellings where they reside or intend to reside.It is noted that when homeowners are issuedbuildingpermits, theymaybe liable forcontractorsworkingon theirpropertyand theyarenoteligibleforprotectionundertheprovisionsoftheHomeownersImprovementContractorLaw.Forthesereasons,BuildingDepartmentencourageshomeownerstohavethebuildingpermittakenoutbyaproperlylicensedcontractor
Whatabouttheissuanceofplumbing,gas,orwiringpermits?ThesepermitsareissuedtoMassachusettslicensedplumbers,gasfitters,orelectricians.PermitsareissuedinaccordancewithMassachusettsGeneralLaw(MGLs);MGL143-3LinthecaseofwiringpermitsandMGL142-13inthecaseofplumbingandgaspermits.

Whenmustworkbestartedunderthebuildingpermit?Workmustbestartedwithinsix(6)monthsofthedatethepermitisissued.Oncestarted,theworkmust be progressed continuously to completion. The City Noise Ordinance does not permitconstructionactivitiespriorto7:00a.m.(9:00a.m.onSaturdaysandholidays)andafter6:00p.m.Sundayworkisnotpermitted.
IsthereatimelimitationonaBuildingpermit?
Yes.Thepermitshellbedeemedtohavebeenabandonedsixmonthsafterthedateoffiling,unlesssuchapplicationhasbeendiligentlyprosecutedorapermitshallhavebeenissued;exceptthatthebuildingofficialshallgrantoneormoreextensionsoftimeforadditionalperiodsnotexceeding90dayseachifthereisreasonablecauseanduponwrittenrequestbytheowner.

B. Variances.Tohearanddecideapetitionwithrespecttoparticularlandorstructuresforavariancefromtermsofthisordinance,wheretheboardspecificallyfindsthatowingtocircumstancesrelatingtosoilconditions,shapeortopographyofsuchlandorstructuresandespeciallyaffectingsuchlandorstructuresbutnotaffectinggenerallythezoning district in which it is located, a literal enforcement of the provisions of this ordinance would involvesubstantialhardshipconsistentwith theprovisionsofMGLChapter40Ato thepetitionerorappellant,and thatdesirable relief may be granted without substantial detriment to the public good and without nullifying orsubstantiallyderogatingfromtheintentorpurposeofthisordinance.Theboardofappealsmayimposeconditions,safeguardsandlimitationsinrespecttobothtimeandanypermitteduse,includingthecontinuedexistenceofanyparticularstructuresbutexcludinganycondition,safeguardorlimitationbaseduponthecontinuedownershipofthelandorstructuretowhichthevariancepertainsbytheapplicant,petitioneroranyowner.Iftherightsauthorizedbyavariancearenotexercisedwithinoneyearofthedateofauthorization,theyshalllapseandmaybereestablishedonlyafteranewnoticeandhearing.Novariancemayauthorizeauseoractivitynototherwisepermittedinthedistrictinwhichthelandorstructureislocated.
