The Responsibilities of the 'Responsible Person'A 'responsible person' is legally required to produce a fire riskassessment to identify fire hazards i.e. sources of potential ignition.There is a duty to take action to eliminate, or, at the very least, to minimise any threat to the safety of employees and buildingoccupants. Failure to have carried out a fire risk assessment will result in criminal prosecution of the 'responsible person' in the event of a fire causing injury or death.

A Summary of Fire Law Changes

■ Fire certificates will be abolished.■ Fire risk assessments must be produced. The “responsible person or

persons” must be appointed.■ “Responsible person” to ensure safety of building occupants by

eliminating or minimising fire hazards identified in Fire Risk Assessment.■ In multiple occupation premises, the landlord or managing agents

have responsibility.■ Fire Authorities will be enforcing Authorities with power to ensure

responsibility is met and, if it is not, to penalise the offender, either financially or by imprisonment.

■ Failure to meet responsibilities can result in personal liability action against the “responsible person”.

building which contains catering facilities will almost invariablyhave one major source of fire risk which must be included inthe fire risk assessment - the grease extract system beyond

the kitchen canopies. Grease from the cooking operation passescanopy filters and accumulates in ducting to provide a high risk ignition source. The 'responsible person' must take steps to ensurethis fire risk is eliminated.

This will assist you in preparing the fire risk assessment and describewhat action needs to be taken to eliminate any identified fire risks. And remember, if you do not comply with the law and there is a fireyou could find insurance claims being disputed and renewal difficult, if not impossible, to obtain.

Cautionary Note

There have been instances where property owners have thought theirgrease extract systems had been cleaned only to find, usually as a resultof a fire, that grease deposits had not been fully removed. Remember,unless the grease extract is fully cleaned, grease accumulation willremain as a potential fire risk and you could be criminally liable in theevent of a fire causing injury to building occupants. Deep cleaning shouldbe carried out in accordance with the Heating & Ventilating Contractors'Association's UK and European Standard TR19 and only contractorswho comply with this specification should be retained.
