Owners’ Corporations have until 13 March 2018 to ensure that their building is compliant with the legislation or face the risk of fines, and liability if a child falls from a window. COMPLYING WITH THE LEGISLATION You must install a compliant window safety device on any openable window where the floor is 2 metres or more from the exterior ground and the window is 1.7 metres or less from the interior floor. A compliant device is able to restrict a window so that a 12.5cms or more sphere cannot pass through the opening, and resist an outward horizontal action of 250 newtons (25.5kg of force). The device must have a child resistant release mechanism if it can be removed, over ridden or unlocked to allow the window to be fully opened. A child resistant release mechanism requires a key to unlock it, a coordinated two handed operation to release it, or a screwdriver, spanner or Allen key to remove the window safety device. This window needs a safety device If the sill of an openable window is less than 1.7m above the floor, and the floor is 2m or more above the outside ground, a safety device must be installed. This window does not need a safety device Where the sill of an openable window is more than 1.7m above the floor, a window safety device is not required.
