Production, Market Value and Economic Impact

New York State natural gas production in 2013 was 23.4 billion cubic feet (bcf), down 11% from the previous year. Trenton-Black River production declined 16% to 10.2 bcf, accounting for 44% of 2013 gas production. Gas production from the Herkimer decreased 23% from the previous year to 1.5 bcf in 2013, while gas production from the Medina decreased by 7% to 8.5 bcf. Oil production decreased 5% from the previous year to 375,571 barrels (bbls) in 2013.

The oil and gas produced in New York State in 2013 is valued at an estimated $136.14 million. Approximately $4.08 million was generated for local government taxes. Approximately $17.02 million was generated in royalties for landowners. Oil and gas development occurs in the most western parts of the State and the Finger Lakes region.

Wells

In 2013, New York well owners reported 13,903 wells (all regulated well types). Most of these wells were drilled to explore for and/or produce oil or natural gas. Other well types reported in the 2013 total include underground gas storage, solution salt mining, geothermal, brine disposal and stratigraphic. The total number of wells completed decreased 3% to 176 in 2013.

In 2013 a total of 268 operators reported 2,622 wells with zero production. This is in addition to over 3,500 orphaned and inactive wells in the Department's records.

In 2013, New York held $25.3 million to guarantee well plugging and site reclamation.

Regulatory Activity

Drilling permits issued decreased 5% to 167 in 2013. Total drilled depth of the wells for the year was approximately 371,714 feet (or 70.4 miles).

No compulsory integration hearings were conducted in 2013, although 4 finalized orders from hearings held in 2012 were issued during the 2013 calendar year.

In 2013, DMN's Oil and Gas staff performed 3,185 inspections and traveled 76,293 miles. Staff inspect well sites:

· during permit application review; · during drilling and plugging work, with emphasis on cementing operations; · to ensure regulatory requirements are followed and that violations, if any, are remediated; · during production and prior to ownership transfers to ensure compliance; · to ensure that reclamation meets requirements; and · to investigate complaints.

Permits and Completions

Drilling Permits

DEC issued 167 drilling permits in 2013, down 5% from the previous year:

· 140 oil · 3 natural gas · 8 stratigraphic · 14 brine · 1 storage · 1 geothermal.

In 2013 DEC issued permits for wells in 12 counties; the top 3 based on total permits were Cattaraugus (110), Allegany (27), and Wyoming (13).

· Oil well drilling permits were issued for Cattaraugus (110), Allegany (26), and Steuben (4) Counties.

· Gas well drilling permits were issued for Chenango (2) and Erie (1), Counties.

Well Spuds and Completions

· The number of wells spud (started) in 2013 was 149. · The total number of completions decreased 3% from 182 in 2012 to 176 in 2013. · Gas well completions decreased 8% from 12 in 2012 to 11 in 2013. · Oil well completions decreased 7% from 138 in 2012 to 129 in 2013. · Completions for other regulated well types in 2013 totaled 36.

State Land Oil and Gas Leasing

In 2013, DEC administered 79 leases on 44,464 acres of state land in Allegany, Cattaraugus, Cayuga, Chautauqua, Chemung, Erie, Ontario, Schuyler, Seneca, and Steuben Counties. There were 237 wells located on and/or unitized with state land associated with 65 of these leases paying production royalties.

The 44,464 leased acres are unchanged from 2012.

Revenues from oil and gas leases on state lands totaled $402,640 in 2013, an increase of $84,031 from 2012. The higher leasing revenues paid to the state can be attributed primarily to the rise in oil and natural gas prices during 2013. The average price of oil increased from $96.91/bbl in 2012 to $98.45/bbl in 2013, while the average wellhead price of natural gas increased from $2.63/mcf in 2012 to $3.52/mcf in 2013.

Although nearly 59,000 acres of state land have been leased since 1999, only 37 (0.06%) of these acres have been disturbed by well drilling, access road and pipeline construction.

Underground Gas Storage

Natural gas and liquefied petroleum gas (LPG) are stored underground to help meet seasonal and peak demand for gas while providing a relatively stable market for produced gas. Generally, gas is injected into wells when consumer demand is low and withdrawn when demand increases during times of peak usage over days or seasons. Natural gas is stored in New York in depleted gas reservoirs and salt caverns while LPG is stored in salt caverns and a mined underground cavern.

There are 26 natural gas storage facilities and 3 LPG storage facilities in New York, concentrated in the central and western regions near both gas production fields and gas transmission facilities.

Natural Gas Storage

· Natural gas injection/withdrawal and monitoring/observation wells: 957 · Total storage capacity: 244.8 bcf · Utilization: 69.7 bcf injected, 80.6 bcf withdrawn · Maximum daily deliverability: 2.76 bcf · Working gas capacity: 130.1 bcf · Storage at year-end: 190.5 bcf · Storage capacity in use at year-end: 78%

Seven different companies operate the 26 underground natural gas storage fields in New York State, with over half of the storage fields owned by National Fuel Gas Supply. Depleted natural gas reservoirs in the Onondaga, Oriskany and Medina Formations are used by 25 of the facilities, and the remaining one uses a solution-mined cavern in the Syracuse Formation. These formations range in depth from 1,500 to 5,000 feet below the earth's surface.

Liquefied Petroleum Gas Storage

· LPG injection/withdrawal wells: 15 · Total Storage Capacity: 166.2 million gallons · Utilization: 210.4 million gallons injected, 240.3 million gallons withdrawn

New York's three LPG underground storage facilities are located in Cortland, Steuben, and Schuyler Counties. Finger Lakes LPG Storage, LLC is the owner of the facility in Steuben County and Enterprise Products Operating, LLC is the owner of the facilities in Cortland and Schuyler Counties.

Solution Salt Mining

Salt and How it is Mined

Approximately 8,500 square miles of New York State are underlain by rock salt beds of potential commercial thickness. Salt is mined in New York via two methods: underground rock salt mining and solution mining. New York typically ranks third in total salt mined among the salt-producing states in the United States.

Where the Salt Is Found

New York's salt deposits occur layered with shale, dolomite, and anhydrite in the lower part of the Silurian-aged Salina group. The Salina group outcrops in an east-west band from near Buffalo and Rochester through Syracuse to Herkimer County. The salt is approximately 4,000 feet deep at the New York/Pennsylvania border.

Where Solution Mining Occurs

Solution mining operations for salt recovery currently take place at two fields in Schuyler County and three fields in Wyoming County. The solution mining method has also been used and is planned for future use to create underground caverns for storing natural gas and LPG. This use is not included in the well and production statistics compiled below.

How Solution Mining Works

Fresh water is injected into the salt beds, through wells which are similar in construction to oil and gas wells, to dissolve the salt. The resultant brine is then pumped to the surface.

How the Salt Is Used

Brine is brought to the surface for evaporation or chemical manufacturing. Salt mined in New York State is used for chlorine and soda ash production as well as for food products and for a

wide range of market segments, including agricultural, water conditioning, industrial and chemical, and packaged ice control. Customers range from home improvement, hardware, grocery and convenience store retailers, to food makers/processors, water conditioning dealers, and food service and general wholesale distribution.

The Department estimates that the annual value of salt production from solution mining in New York is approximately $100 million.

Well Plugging

At the end of their economic life, wells must be plugged in accordance with statutory and regulatory requirements. To ensure the sufficiency of funds for well plugging, the DEC holds financial security in amounts statutorily determined based on an operator's number of wells and their depths. At year-end 2013, DEC held $25.32 million in financial security to guarantee well plugging and well site reclamation. This represents an increase of $1.44 million from the amount held at year-end 2012.

In 2013, operators plugged 274 wells in accordance with requirements in DEC-issued plugging permits. Of the 274 wells plugged in 2013:

· 222 (81%) of the plugged wells were oil and secondary recovery wells in the old oilfields of western New York;

· 32 (12%) were gas wells; and · 20 (7%) were comprised of a mix of other regulated well types.

Plugging occurred in 19 counties with 51% of the plugging jobs in Cattaraugus County and 28% in Allegany County. As noted above, the vast majority of plugging jobs involved old oil wells, particularly in the Richburg and Bradford Fields.

Abandoned Well Plugging

Orphaned wells have been abandoned by their original owners and the majority of these wells were drilled prior to the existence of a regulatory framework in New York. There are over 3,500 orphaned and inactive wells in the Department's records. The DEC's Oil and Gas Account (originally called the Oil and Gas Fund) is dedicated to the plugging of orphaned and abandoned oil and gas wells. The account receives $100 from every ECL 23 Permit to Drill issued by the DEC. At year-end 2013, this account held $105,591.

The 2013-14 FY budget included $2 million for the plugging of abandoned oil and gas wells in the state. This much-needed allocation is part of the New York Works II program, and is referenced as the New York Works Well Plugging Initiative (NYWWPI). In 2013, two contracts were awarded under the NYWWPI for the plugging of nine abandoned gas wells in the City of Rome. The Division continued to inspect and evaluate well sites to support the development of additional well plugging projects.

Additionally, DEC staff continued working with the U.S. Environmental Protection Agency (USEPA) and the U.S. Coast Guard to plug oil wells with federal funds from the Oil Pollution Act of 1990. As a direct result of DEC staff efforts, USEPA has undertaken several plugging projects in New York State.

In 2013 USEPA plugged a total of 26 wells in two counties, as follows:

· Allegany County – 12 wells on the Adrian Oil Lease in the Town of Alma; and · Cattaraugus County – 14 wells on the Crooks Oil Lease in the Town of Carrollton

In conjunction with the well plugging efforts, the well sites were reclaimed.

Mineral Production, Market Value and Economic Impact

Mining occurs in every region of New York State except the New York City area, as shown on the map entitled “Mines in New York” (see link below). The U.S. Geological Survey estimated the annual value of New York's mineral production in 2009 at $1.37 billion. The estimated economic impact from mining in New York in 2011 (the most recent year for which this data is available) is $4.98 billion.

Production of the State's major mined commodities remains relatively constant from year to year. New York ranks sixteenth nationally in terms of overall nonfuel mineral production. Typically, New York ranks second in industrial garnet production, third in salt, sixth in construction sand and gravel, common clays and dimension stone, and fourteenth in crushed stone. New York remains the sole domestic producer of wollastonite. New York is also a significant producer of masonry cement, portland cement, and peat.

The Center for Governmental Research, Inc. (CGR) document entitled “The Economic Impact of the New York State Mining and Construction Materials Industry, October 2011” prepared for the New York State Geological Survey/New York State Museum states that the majority of mining in New York is for construction materials used to build and maintain the State's infrastructure. The mined commodities, in addition to the hot mixed asphalt, ready mix concrete and cement industries, were responsible for generating $1.2 to $1.3 billion in wages and 28,000 to 30,000 jobs in New York State. CGR estimates the mining and construction materials industry contributes about $100 million in public sector revenues (sales tax, personal income tax, motor fuel tax, corporate franchise tax and Mined Land Reclamation Law fees). The Division assessed $4.15 million in regulatory program fees in 2013, which is slightly higher than the amount assessed in 2012.

Types of Mines and Mineral Usage

The most common mine types in 2013 were sand and gravel (1,578), limestone (86), and bluestone (75). In 2013, New York had 1,983 active mines, a decrease of 40 mines from 2012. The vast majority of these mines produced sand and gravel or other surficial deposits such as glacial till, clay or topsoil. Sand and gravel mines account for over 80% of DEC-regulated mines and 19 of the new mining permits issued in 2013, or 56%, were for sand and gravel.

There were 320 hardrock mines producing material ranging from bluestone, limestone, shale and salt, to less common products such as wollastonite. Most of New York's hardrock mines are surface quarries, but there are several permitted underground mines.

The Mineral Information Institute reports that “every American born will consume 3.0 million pounds of minerals, metals and fuels in their lifetime”. In addition to recycled materials, nearly 38,212 pounds of new minerals must be provided every year for the things that every person in the United States uses.

Permitting and Reclamation Statistics

The number of permitted mines has declined for 15 consecutive years. Mine operators continued to replace production by expanding current mines, rather than opening new ones. This trend held true for both sand and gravel mines and hardrock quarries. Only 34 of the 459 mined land reclamation permits issued in 2013 were for new facilities.

A total of 47,142 acres were affected by mining in 2013 out of a total approved life-of-mine area of 125,147 acres. All affected acreage must be reclaimed at the conclusion of mining operations. Concurrent reclamation can be accomplished immediately upon completion of a portion or "phase" of a mine while mining occurs elsewhere within the life of mine area, or reclamation of the entire affected area can occur when mining has stopped, known as final reclamation. The Division of Mineral Resources continues to have success promoting concurrent reclamation with 907 acres reclaimed at 104 operating mines. Final reclamation of 380 acres occurred at 64 closed mines bringing the 2013 total to 1,287 acres. Roughly 35,643 acres of land affected by mining have been reclaimed since 1975.

In 2013 New York held $246.1 million in financial security to guarantee mine site reclamation.

Inspections

In 2013 Mined Land staff performed 2,199 mine inspections and traveled 118,686 miles. Staff inspect mine sites:

· during permit application review; · during operation for general compliance; · to ensure that violations are remediated; · to ensure that reclamation meets requirements; and · to investigate complaints.

Permits and New Mines

The Division issued 34 permits for new mines and 425 renewals or modifications, for a total of 459 permits. Sand and gravel mines were the most common type of newly-permitted mines in 2013.

Mined land reclamation permits are issued for terms of five years or less and may be renewed. A renewal permit allows continued operation of the mine within approved limits. A modification permit authorizes changes, such as addition of processing equipment or expansion of the mine's surface area or depth beyond the original approved limits.

Mines in New York

Owner Type

There are 1,983 active mines as shown on the following map. In 2013, industry operated 1,580 mines or almost 80% of the mines in New York State. Towns, villages and other small local government entities operated 356 mines, and 40 mines were county-owned and operated. New York State agencies operate 7 mines. Most of the government mines belong to highway departments which use the material for road maintenance.

Trends in Mine Size and Number

Mine renewal and modification permits issued in 2013 ranged in life-of-mine acreage from 1 to 710 acres. However, new mines tend to be smaller; about 44.1% of new mines permitted in 2013 were 10 acres or less in size. The largest new mine was the 120.8-acre Seneca Meadows Inc. Seneca View Surface Mine in Seneca County.

The following tables give 2009-2013 size range information for all active mines, including detailed information on mined land and reclamation permits by county. While the number of mines has been decreasing over time, the rate of decline has been greater for mines under 10 acres in size than those greater than 10 acres. This was due to many operators expanding or combining existing mines rather than seeking permits for new sites combined with final reclamation of mines. This trend began to change, in 2009, when the required regulatory fees were increased for sites with greater than 20 acres affected by mining.

The minor projects in the first row of the below table are always less than 5 acres in size. They are subject to a simpler review process, but must comply with very strict criteria to be considered minor: minimum setbacks from homes and surface waters; a maximum 20-foot mine depth; no mining below water table; no hardrock (consolidated material) mining; and no on-site processing equipment, such as washing or crushing machines.

Reclamation

Every mine must be reclaimed at the end of its productive life and the Department holds significant financial security to ensure that reclamation occurs. The Department also encourages concurrent reclamation as a means to minimize potential negative environmental impacts and to return lands affected by mining back to other productive uses. The permittee benefits from conducting concurrent reclamation in the form of reduced financial security and lower annual regulatory fees. Examples of significant reclamation projects for 2013 include:

Concurrent Reclamation – Region 3: Whortlekill Rod & Gun Club Mine

Town of East Fishkill, Dutchess County (30092)

The permittee has reclaimed the 23-acre sand & gravel mine to a small canoeing area and public beach. While currently no land is affected by mining, the permittee has reserves left and may affect up to 2 acres at any one time.

Final Reclamation in Progress – Region 3: Tilcon New York-Suffern Quarry

Town of Ramapo, Rockland County (30036)

Tilcon is in the process of actively reclaiming the 38-acre Suffern Quarry. The previous operator mined basalt for use in aggregate for decades prior to Tilcon taking over the mine in the early 2000s. The site has been largely inactive over the last several years and Tilcon has worked with Mined Land staff on completing reclamation at the site. Final reclamation should be completed in 2014.

Reclamation of the 5-acre Vly Resources sand and gravel mine was completed in July 2013. The permittee successfully returned the site to meadow.

Town of Ghent, Columbia County (40766)

Final reclamation of the 23-acre peat mine operated by Gro Max was completed in September 2013. The site was reclaimed to a pond surrounded by wildlife habitat.

Concurrent Reclamation – Region 5: Tracy Materials-Windy Hills Bank

Town of Easton, Washington County (50297)

Tracy Materials pursued a course of concurrent reclamation for several years at the 136.9-acre life of mine sand & gravel operation. Final reclamation of the mine was accomplished by the end of 2013. Tracy Materials reduced the area affected by mining from 54 acres in 2004 to 7.9 acres in 2008 to 2.5 acres in 2012. The site was reclaimed to agricultural cropland.
