We and the EB-5 investors ARE the de facto Bank in this

Our EB-5 investors are first position beneficiaries when the
loan is paid back. Before the loan is paid back, investors
possess the legal title to all land, buildings and fixtures as
collateral. In case of loan default, investors retain the right to
auction the property to recoup their investment
We are the fund manager, not the developer! We supervise
the development process, including the secure and gradual
disbursement of funds from a third-party escrow account to
the developer
X In equity projects, developer uses EB-5 investment as down
payment to borrow money from the bank. EB-5 investors are
the only risk-bearer
X Any bank involved in the project is the first position
beneficiary, not the EB-5 investors! It will auction all the
collateral to pay itself back in case of default, and the
remainder (if there is any) then goes to pay back the investor
X No matter what, whether the project succeeds or fails,
developer can still profit from his fee earned by financing the
EB-5 investment
Source of Funds
• The Department of Homeland Security requires that
EB-5 investors must prove that their $500,000 EB-5
investment capital is from a legal source
• Legal sources of funds include employment income,
investments, sales of property, cash gifts and
inheritance. The funds can come from one or several
sources combined

document requirements set by USCIS
