CASE ON NEGOTIABLE INSTRUMENTS

• OnA Bill of Exchange for Rs. 10,000, X’s acceptance to the Bill is forged. ‘A’ takes the Bill from his customer for value and in good faith before’ the Bill becomes payable. State with reasons whether ‘A’ can b considered asA ‘Holder in due course’ and whether he (A) can receive the amount of the Bill from ‘X’?


Solution

• N0 – because it isA forged document – no forged document can give any right


Question on guarantee

• ‘B’ owes ‘C’A debt guaranteed by ‘A’. The debt becomes payable. But ‘C’ does not sue forA year after the debt becomes payable. Is ‘A’ discharged from his suretyship.

• X offers to sellA factory in Delhi to V for Rs. 2,00,000. The offer is communicated to V in Jaipur by an express letter. The letter is delayed in post office. Before X’s letter reaches V, V receivesA telegram from x revoking his offer. Advise V.
