Jananeethi, started in1991, was registered as
charitable society in 1992 underTravancore Cochin Literary,Scientific and CharitableSocieties Act XII, 1955. Women’sDesk at Jananeethi wasestablished in 1993 to promotewomen empowerment andgender justice. Jananeethistarted a monthly publication inMalayalam in 1994 for theadvancement of legal literacyand also to bridge between thebench and the public. It ’senvironmental advocacyprogrammes were launched in1995 with it ’s Save Earthinitiative. Psycho-legalcounseling was introduced in2000 as part of its mediation andsettlement of disputes. Helpline
for women and children indistress was added to its servicesin 2005. Jananeethi introducedClinical Legal Education as anenabling process in settlementof disputes through assistednegotiation. In 2016 Jananeethihas launched Business & HumanRights with a view ofconstructive engagementsfor value addedbusiness.

Intendedand designed for the defence of
life, dignity, liberty and otherfundamental rights of thedefenseless, Jananeethi is asecular collective of humanrights defenders, eminent jurists,retired judges, lawyers,academics, writers, thinkers,artists, social workers, and
activists in the spheres of culture,creativity, health, education andresearch.
The activities of Jananeethiinclude legal aid and assistance,psycho-legal counseling,
support to victims of domesticand sexual violence, negotiatedsettlement of disputes, clinicallegal education, human rightsinterventions, public interestlitigation, environmentaladvocacy, women’sempowerment, care andprotection to women andchildren in distress, andprogrammes for democracy andgood governance. The strategiesare advocacy, research, training,networking and publication.
Jananeethi uses law andlegal system as therapeuticagents. Justice means healing. Itis a right based, victim-centeredapproach for total healingthrough legal, social,psychological and emotionalreparation. It’s domains includedemocracy, rule of law,secularism, human rights,diversity, livelihood and goodgovernance.

Jananeethi believes that thepoor should be granted equalaccess to civil, administrative orconstitutional bodies, tribunalsand other dispute resolutionmechanisms free of charge as aremedy and an effective meansof reparation. Through our freelegal aid service, Jananeethistrives to ensure thatconstitutional pledge is fulfilledin its letter and spirit and equaljustice is made available to thepoor, downtrodden and weakersections of the society. Theultimate aim and purpose ofJananeethi is to create a conflictfree society and to enablepeople to resolve their disputesand conflicts peacefullyupholding the dignity andfreedom of all concerned. Theunique contribution Jananeethias recorded in history was thecreation of the First Litigation-free Village in India in the year
2000. This has given impetus toseveral groups andorganizations in subsequentyears to strive to create furthermore zones litigation-free. In2002 Jananeethi launchedanother experiment in creatinga crime-free zone. Though therewas significant progress, it had tobe dropped midway due to wantof resources. Among severalservices of Jananeethi, itspsycho-legal therapeuticservices for holistic healing standsingular and innovative.
Jananeethi is accredited bythe State Legal ServicesAuthority for helping the courtsto resolve pending casesthrough alternate disputeredressal (ADR) system. It is alsoan approved Service Providerunder provisions of Protection toWomen from Domestic Violence,Act 2005.

Introduction to reporting year
Attacks on Dalits/minorities/
women were headlines in the year under report.
Streets in the country were flooded with agitating
crowds that invariably belonged to low castes, minority
communities or women. There have been consistent
and organized attacks all over the country on indepen-
dent thinkers, authors, artists and social activists who
represented dissenting voices. Democratic institutions
in the country, cultural & academic, were brought
under communally charged ideologies. Democratic
and secular fabric of the nation was under great threat.
Naturally civil society movements, non-governmental
organizations, civil liberty groups, student unions and
such other groups and organizations that believe in
democracy, secularism and diversity, guaranteed and
protected in the Constitution, revolted against fascist
tendencies endangering the pluralistic and composite
culture of our nation.

We find ourselves at thatepoch in history when
we are compelled to look overour shoulders and recall thevision and sagacity of pastleaders. President FranklinDelano Roosevelt quoting HenryDavid Thoreau spoke on his firstaddress to the nation, “This ispre-eminently the time to speakthe truth, the whole truth,frankly and boldly”. Andspeaking truth to power hasnever been so timely as today.According to ProphetMohammed, “when injustice islaw, resistance is duty”. Thehighest ethical duty of everyhuman being, therefore, is toresist injustice everywhere.
Elie Wiesel, a Holocaustsurvivor keeps reminding us that“the opposite of love is not hate,it is indifference”. George Orwellwas emphatic when he said,“during times of universal deceit,
telling truth becomes arevolutionary act”. Truth istreason in the empire of lies. Ibelieve that the paramount dutyof a human rights defender is tospeak truth to power, howsoeverharsh the consequences are.
The Government of India, thecustodian of the largest andmost vibrant democracies in theworld, often using nationalisticrhetoric, has been systematicallymuffling genuine dissent andindependent monitoring ofgovernment’s rights violations. Ithas enacted broad legislations torein in activists and undermineindependent group’s ability tooperate. A vigorous civil societyis an essential part of anydemocracy worth its name.“Political democracy cannotsucceed without social andeconomic equality” saidDr.B.R.Ambedkar, the architect ofIndian Constitution. When the
State wants to hide truth, it triesto suppress civic voices. For eachoffender there are failures ofgovernance that they do notwant to be discussed, a record ofmisconduct they want to be keptin shadows. Every repressivemeasure to silence their criticsmanifests their deepest fears.Seeking legitimacy for theirpolitical disengagements andsocial disintegration, they keeppromising people rapideconomic growth andenhancement of personal gains.The politics of fear issymptomatic of the pervasivesense of helplessness and deepfrustration that looms large incivic society against people’slong standing quest forresponsive and accountablegovernment.
‘Manushya Sangamam’, a massinitiative against growing fascisttendencies in the country, wasorganized in Kochi and Thrissur.Scientist Dr P M Bhargava, whoinaugurated the event in Kochi,said that democracy was dyingin the country and efforts weregoing on to implement theHindutwa agenda.Satchidanandan, LeenaManimekalai, Anand and severaleminent personalities fromsocial and cultural fields aretaking part in the programme. Aspart of ‘Manushya Sangamam’, amass dance programme to chasefascism away led by actor RimaKalingal was held in the evening.The public meeting thatfollowed was inaugurated byAbhay Sahu, a leader of thepeople’s agitation against MNCPosco in Odisha.

Life for India’s women isas savage as ever
Kerala is no more a safe zone
for women. It is too early to
forget Soumya, 23years, who
was brutally assaulted and
murdered while traveling in a
train on February 1, 2011. The
gruesome sexual assault and
murder of Jisha, 29 years, a law
student in Perumbavoor in
Kerala was another bolt and
shame on our civilized society.
With the notorious Nirbhaya case
in Delhi in 2012, the
nation has taken serious
steps to ensure
protection of women
and girl children from
gender based and
sexual violence. Despite
of these national policies
and legal frame works,
our women live under
constant threat of being
attacked, just because
they are women. In India, it is
reported that 93 women are
sexually assaulted every day. The
louder we shout, the more we
demand attention and justice for
these brutal, inexcusable crimes,
the closer we get to making sure
they can never happen again.
With this motive and intention,
Jananeethi was a frontline
campaigner and protestor
against
crimes against women and
fascist tendencies in the country
in the year under report.

Legal Aid & Access to Justice
Among all complaintsreceived in Jananeethi
during the report year, instancesof domestic violence constitutethe highest in number (33%).Matters regarding civil disputescomes to the second position(27%) followed by familydisputes (26%). Only 1 percent ofcases came under criminal
jurisdiction. All other casestogether amounted to 13percent of the total complaintsreceived.
Jananeethi received 70complaints on file after the initialscrutiny andexamination ofrelevant records forfurther action. Of themthirty five complaintswere amicably resolvedbetween partiesthrough assistednegotiation andmediation. As thesettlement was arrived afterproper mediation and the termsand conditions of settlementwere agreed upon by partiesconcerned, there is finality in thematter. Ten cases were directedto adjudication in the court asmediation did not work

Combat Domestic Violence
An accredited Voluntary

Government and Central Social
Welfare Board, Jananeethi has
been approved as Service
Provider for victims of domestic
and gender based violence
from the year 2008. The focus
at Jananeethi is to mend
conjugal relationship of spouses
who find difficulties to get along
with. Filing of DIR is the last
option when all attempts for
amicable settlement of disputes
are irrevocably failed. There were
23 cases of domestic violence
reported at Jananeethi during
this period of which 14 were
settled by parties in response to
mediation steps under taken by
Jananeethi. Proceedings in 4
cases were dropped due to non-
cooperation of parties
concerned. DIRs were filed in 4
cases and legal proceedings
have been initiated against
erring parties. Jananeethi stall at

Psycho-legal Therapeutic Services
Multi-disciplinary approach
in combating domestic
violence and sexual assaults on
women and children has
successfully been experimented
in several developed nations.
Jananeethi has been following
this method since 2002 having
been realized most of the
complaints received in
Jananeethi office were of
complex nature and could not
be resolved through legal
process alone. Working with
victims of domestic and sexual
violence has made us aware of
the link between domestic
violence and child abuse. Even if
children are not witnesses to acts
of violence and not the intended
targets, they can be affected in
the same way as children who
are physically and sexually
abused. Since domestic violence
is a pattern of behavior, not a
single event, episode may
become more severe and more
frequent over time, resulting in
an increased likelihood that the
children eventually become
victims.
Each case of domestic and
gender based violence,
therefore, is handled at
Jananeethi office together by a
law officer and a clinical
psychologist. Psycho-legal
therapeutic services are been
offered to direct victims, and
children, parents, dependents,
close kith and kin as well.
Domestic violence and child
abuse proliferate in an
environment that accepts the
lesser status of women and
children. Educating the public
about the extent of the problem,
gender equality before law and
legal remedies available for
victims of violence establishes a
foundation that permits the
victims to come forward.

Environmental Advocacy
High hills, deep valleys,mountain grasslands,
dense and rain forests togetherconstitute the Western Ghats,the existence of which has beenunder threat for quite some time.Prof. Madhav Gadgil Committeereport to preserve and to protectthe 1600 km long majesticmountains of Western Ghats,one of the eight hottestbiological diversity hotspots inthe world was brutally opposedby encroachers and invaders
supported by politicalleadership. Environmental
groups and civils o c i e t yo r g a n i z a t i o n sand individualshave relentlesslycampaigned forthe preservationof Western Ghats,one of the
UNESCO World Heritage Site inIndia and a paradise of variousspecies of Flora and Fauna , mostof which are endemic to theregion. Jananeethi, from thebeginning of the campaign hastaken significant role inpromoting the ecologicaluniqueness of the region.
Jananeethi was represented byits Executive Director George
Pulikuthiyil, his colleaguesAdv.Rasmi Sabalima andSebastian K Jose joinedthousands of supporters in theFreedom Walk organized on theday of Global Climate March on29th November 2015. The Marchstarted from Vazhachal toAthirappilly demanding theGovernment to pull out of theproposed hydro-electricalproject in Athiarappilly area.
When the Jewish families leftMala in 1948 following theformation of Israel, they hadentrusted their burial placeunder the protection of Mala
Grama Panchayat. But in recentyears the Panchayat authoritiesat the behest of politicalmanipulators encroached theburial land of the Jewishcommunity, monument of thecultural heritage of Mala, andstarted construction of shoppingmall and sports complex. Thiswas resisted by social activistswho formed people’s actioncouncil of which Jananeethi is anactive sympathizer. Jananeethialso has supported Adivasiprotest at Thiruvananthapuram(Nilpusamaram) for restorationof their land rights

Protection of Democratic &Secular Values
India is a land of diversities.It is a country with at least
28 major languages and over400 important dialects. It is asociety with over 4000 ethniccommunities or castes orendogamous groups. India isthus multi-religious, multi-linguistic, multi-ethnic andmulti-regional civilizationwithout a parallel. Secularism isthe only way that the countrycan hold its people despite itsdifferences in faith and practice.
However there have been
cases of violence on minoritycommunities, attack ondemocratic and secular fabric ofthe nation, suppression offreedom of speech andexpression, and a systemic andorchestrated imposition ofcommunal agenda in almost alleducational, cultural andadministrative institutions in thecountry.
The brutal and barbarickilling of great thinkers whostrongly criticized idol worship,religious superstitions Narendra
Dabholkar, Govind Pansare andMM Kalburgi was only a warning.Numerous instances ofintolerance and fascisttendencies spread across thecountry in a short span, onlybecause of the support andencouragement from the rulingpolitical front in the country andtheir controlling masters behindthe scene. Attacks on PerumalMurukan, Dr.K.S.Bhagavan,Girish Karnad, MM Bhasheer,Kovan the folk singer are just fewexamples.
Jananeethi joined thedemocratic and secular forces inthe State and across the nationprotesting the highlyobjectionable fascist tendencies
explicitly expressed in severalsteps taken by the UnionGovernment. The attempts totake control of the educationaland cultural institutions likePune Film Institute, JawaharlalNehru University, HyderabadNational University, KendraSahitya Academy, National BookTrust, Central Censor Board werestrongly opposed by those whobelieve in democratic andsecular values.

organized at different parts of
the district for formation of
volunteers as para-legal activists.
54 of such programmes were
exclusively for women who are
increasingly been assaulted and
abused at home and in society.
Women need to be empowered
by knowledge and skill

women were enlightened and
empowered with respect to
women’s rights and legal
remedies available in law. There
were 9 training programmes for
young women and adolescents
giving them special training in
developing their inherent skills
and talents.

Helpline to Elderly in Distress& Desertion
Jananeethi started Helpline topeople who live in distress
and desertion in the year 2005as a follow up to our earliersuicide prevention services tomentally distressed. Jananeethiadmits on file petitions andcomplaints regarding illtreatment or neglect of elderlyby children, family members orrelatives. The normal process insimilar situation is to initiatemediation talks for amicablyresolving the problem. If thereis no cooperation from theconcerned parties, we takerecourse to law in defense ofthe rights of the senior citizens.Jananeethi has not failed in anycase taken up in this regard.
