The course begins with an in-depth review of the Landlord and Tenant Act 1954, which is fundamental to the management of commercial property, and from which much of the bread and butter work of the commercial property litigator flows. The 1954 Act is a highly technical piece of legislation, with many traps for the unwary.
It goes on to consider law and procedure where the landlord opposes lease renewal on each of the statutory grounds and will examine the other common areas in which disputes arise – dilapidations, service charges, enforcement of leasehold covenants following assignments, and break options.

Stephen Allinson Stephen has specialised in credit, debt and insolvency work since 1987, and has extensive experience in dealing with the full range of these procedures. Prior to setting up his own consultancy, he was a Business Recovery and Insolvency partner at a major law firm. As well as acting as a Consultant to the legal profession, he also pursues many other projects in the legal, insolvency and credit fields and is a Visiting Lecturer at the University of Law.
Philip Barlow Philip is a qualified doctor, barrister and solicitor. He was a partner at Kennedys, managing a team of lawyers specialising in clinical negligence, and then set up his own firm. He is now a fee paid judge of the mental health tribunal, an assistant coroner, and a legal assessor at the General Medical Council and Nursing and Midwifery Council.

Linda LeeLinda spent 12 years as a clinical negligence specialist before working in house at AvMA. Linda is currently President of the Medico-Legal Society. She is a Law Society Council Member, Chair of the Regulatory Affairs Board of the Law Society and a member of the Access to Justice Committee.
Vicky Ling Vicky is a specialist legal aid consultant, member of the Low Commission and formerly managed a CAB, a law centre and a housing advice centre, as well as implementing the then Legal Aid Board’s quality assurance standard.
Andrew McAulayAndrew is a Costs Lawyer and Chair of the education committee for the Association of Costs Lawyers (ACL). Andrew leads the costs and funding team at Clarion Solicitors and acted and advised on the reported Court of Appeal Case of Troy v Manton.

Sheriff Payne Sheriff retired as HM Senior Coroner for the County of Dorset in March 2017 and has many years of coronial experience having previously been appointed Deputy Coroner in 1983. He also has had litigation experience in a busy private practice.
Darryl Royce Darryl is a member of Atkin Chambers and has practised in the field of construction law for over 35 years. He was one of the original 12 Founder Members of the Society of Construction Law in 1983 and is a contributing editor to various specialist publications including Atkin’s Court Forms and the Encyclopedia of Forms & Precedents.
Mark Shelton Mark is a freelance legal trainer, having practised in major commercial law firms for 30 years. He qualified with Linklaters and has always specialised in property litigation.
