  • STATUTES OF MOUNT ST. MARY'S SEMINARY

    ARTICLE I

    ESTABLISHMENT

    1.1 Mount St. Mary's Seminary (the "Seminary") 1s a diocesan seminary of the Archdiocese of Baltimore.

    1.2 The Seminary possesses public non-collegial juridic personality ipso iure according to the Code of Canon Law of the Roman Catholic Church. 1

    1.3 In civil law, the Seminary is a 509(a)(3) Type 1 supporting organization to Mount St. Mary's University (the "University").

    1.4 The Seminary is to be under the patronage of the Immaculate Conception, St. John Vianney, St. Elizabeth Ann Seton, and Blessed Stanley Rother.

    ARTICLE II

    GOVERNANCE

    2.1 The attributes of the Seminary as an ecclesiastical public juridic person are set forth in the Code of Canon Law and in these Statutes. The attributes of the Seminary as a civil corporation are set forth in the articles of incorporation in civil law. The attributes of the Seminary as both a non-collegial ecclesiastical public juridic person and as a civil corporation shall be consistent and consonant with one another. The attributes of the Seminary as a non-collegial ecclesiastical public juridic person in canon law shall be set forth explicitly or by reference in all relevant civil documents in a manner that they will be protected and given full force and effect in civil law as well as in canon law.

    2.2 All relevant civil documents, including Articles of Incorporation and Bylaws of the Seminary, shall be consistent and consonant with these Statutes. Where necessary to accomplish this end specific provisions of these Statutes shall be explicitly set forth or incorporated by reference in relevant civil documents.

    2.3 Governance of the Seminary shall always be in accordance with the Code of Canon Law, the current edition of the Program of Priestly Formation of the United States Conference of Catholic Bishops, and any and all other norms pertaining to the governance and administration of Roman Catholic seminaries issued by canonically competent ecclesiastical authority.
