S.O.372(E) - In exercise of the powers, conferred by paragraphs 9 and11 of the Drugs (Prices Control) order, 1995 read with S.O. 637(E) dt. the 4th September 1997 issued by the Government of India, Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority hereby notifies that any formulation/composition not covered in the table of standing orders issued by the NPPA that has any scheduled drug as one of its ingredients, shall be subject to the price ceiling mentioned at the respective serial number of the respective notification, as the case may be, unless the manufacturer has subsequently got a specific price fixed by the NPPA for that formulation/composition.
The manufacturer or marketing company not complying with the ceiling prices and the condition specified in the respective notification shall be liable to deposit the overcharged amount along with interest under the provision of Drug Price Control Order, 1995 read with the Essential Commodities Act, 1995.

A. NPPA launches Centre for Information Facilitation and Grievances Project at Chennai and Mumbai (NPPA-CIFG)-
As a part of Consumer Awareness for dissemination of information regarding drug pricing and availability and also to create an online facility for lodging complaints
with NPPA on the above issues, a scheme for setting up internet based centre for information, facilitation and grievances has been started at Chennai and Mumbai. The objective is to disseminate information on the availability and notified price of Scheduled Drugs and Formulations and to create consumer awareness and facilitate speedy Complaint Redressal on:-
1. Overcharging in [price of] Scheduled Formulations.2. Non-availability or shortage of any medicine.3. Sale of Scheduled Formulations without prior price approval of NPPA.

Sub. : Reduction in prices of non-scheduled formulations packs consequent to reduction in excise duty from 8% to 4% notified by Ministry of Finance (Department of Revenue) on 07.12.2008.
Consequent upon the reduction in the rate of Excise duty on medicines from 8% to 4% notified by the Ministry of Finance, Department of Revenue vide notification no. 58/2008-Central Excise dated 07.12.08, all manufacturers and marketing companies of formulations packs are advised to ensure that the benefit of this excise duty reduction and the reduced rate of abatement is passed on to the consumers through reduced Maximum Retail Price (MRP). Prices
of all non-scheduled packs must accordingly be reduced downwards by 2.84% except in those categories of non-scheduled formulation packs where no excise duty has been actually paid to the Government and, therefore, no excise duty shall be chargeable in the MRP of such non-scheduled packs. The National Pharmaceutical Pricing Authority (NPPA) expects that the above reduction in MRP would be complied with by way of reduced MRP and that necessary revised price lists would be submitted to NPPA forthwith.
2. NPPA shall accordingly monitor the limit of 10% increase in prices per annum of non-scheduled packs based on the reduced MRP for all such packs where the batch of the formulation pack has been cleared by the manufacturer through the competent excise authorities on or after 7th December, 2008 in terms of abovementioned notification of the Ministry of Finance (Department of Revenue) dated 07.12.2008

ORDER
S.O. 2856(E) :- The Government of India in the Ministry of Finance (Department. of Revenue), Vide Notification No. 58/2008 -CE dated 7th December 2008 has reduced the excise duty on drugs and pharmaceuticals from 8% to 4%.
2. Now, therefore, in exercise of the powers conferred by Paragraphs 8, 9 and 11 of the Drugs Price Control Order,1995, read with S.O. No.637(E) dated the 4th September 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority hereby and in supersession of the Order No. S.O. 418(E), dated 3rd March, 2008, by way of this general notification, revises the Equivalent Maximum Retail price (MRP) (inclusive of all taxes) of all Scheduled formulation packs downward, consequent to these changes. All manufacturers are required to reduce the Equivalent Maximum Retail Price (MRP) (inclusive of Excise duty & all taxes) by 2.84%.
[For example: For an existing equivalent MRP of Rs. 100, the revised Equivalent MRP (inclusive of all taxes) shall be Rs.97.16]
3. The above reduction in the Equivalent MRP (inclusive of Excise duty and all taxes) shall take effect immediately in terms of above mentioned notification dated the 7th December 2008 of the Ministry of Finance (Department of Revenue).
4. The reduction in prices of such scheduled packs shall, however, not apply on those categories of scheduled formulation packs where no excise duty has been actually paid to the Government and therefore no excise duty shall be chargeable in the MRP of these scheduled formulation packs.

O. 539(E):- In exercise of the powers, conferred by sub-paragraph (1) of paragraph 3 of the Drugs (Prices Control) Order, 1995 read with the notification of the Ministry of Chemicals and Fertilizers number S.O. 637 (E), dated the September 4, 1997 and in supersession of the order of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority) number 412 (E) dated 21st March, 2007, in so far as it relates to Cefedroxyl Monohydrate, except as respects things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority hereby fixes the price specified in column (4) of the Table given below as the maximum sale price (exclusive of excise duty and local taxes) at which the bulk drug specified in the corresponding entry in column (2) thereof shall be sold.

Revised Guidelines for monitoring of prices of Non Scheduled formulations.
In pursuance of Resolution No. 33/7/97-PI.I, dated 29.08.1997 issued as per the provisions of the Drugs (Prices Control) Order, 1995 read with Essential Commodities Act, 1955, the National Pharmaceutical Pricing Authority (NPPA) has decided to revise the guidelines for monitoring of prices of non-scheduled formulations as follows:-
1. The monitoring of prices of non-scheduled formulations will continue to be on the bases of regular data from ORG IMS.
2. Companies will be short listed on the basis of the ORG data, where there is an increase in prices of a non-scheduled formulation by more than 10% during a period of 12 months and the annual turnover of the formulation pack exceeds Rs. 1 crore. Further, the share of the formulator in that segment of the formulation is required to be at least 20% of the market or the medicine is one of the first 3 top medicines of that group.
3. The concerned manufacturer will be asked to furnish reasons for such price increases or to bring down the prices voluntarily and to thereafter maintain the price level.
4. NPPA will initiate action against those who do not comply with the internal guidelines or directions of NPPA for monitoring of prices of non-scheduled formations and will be liable for action in “public interest” under para 10(b) of DPCO,
5. The aforesaid dispensation in respect of the above has been adopted w.e.f. 1 st
April 2007.
