J u d g e F r e e d m a n . o f t h e S u p r e m e C o u r t . has dismissed the action brought by Mr*. Leila e . Henriques and Mary A. Mason to partition tba real estate of their sister, Mrs. Miriam Osborn, mother of Howell Osborn, as if she had left no valid will.

M-~ Osbom was the widow of Charles J. Osborn. She died on March 14, 1891. She was tb*» mother of Howell Osborn, who died pn February «. 1896. Mr*. Henriques is the wife • f William H. Henriques, for an assault upon whom Frank Ellison was sent to Sin* Sing Prison, and the mother of Leila O. Neame. on whose account the assault was provoked.
