Pensioners of P&T and Telecom departmentare entitled to CGHS benefits
The applicants who are Central Government
pensioners the following main reliefs in this O.A.
To call for the records leading to the issue of A-4
and A-S and quash the same :
( i ) To declare that all Central Government
Pensioners are eligible for CGHS facilities
irrespective of the Department from which
they retired; and
(ii) To direct the respondents to grant CGHS
facility to all Central Government Pensioners
irrespective of the Department from which they
retired.
The submissions made on behalf of the
applicants are follows : The first applicant who
retired from the Department of Telecom was
issued a CGHS card. However he was denied
CGHS facility since 20.7.2004 without notice. The
second and third applicants who retired from the
Department of Posts were informed that the
CGHS Card is valid up to 31.12.2O04. The 4th
applicant is the General Secretary of All India
Organization of Pensioners, Kerala Unit. He
submitted a memorandum to the first respondent
requesting extension of CGHS facility to
pensioners of Posts & Telegraph Department.
This was reiterated in memoranda dated
19.1.2004 and 19.6.2OO4 to the respondents.
The denial of CGHS facility to the pensioners of
P&T Departments has violated their fundamental
rights. Chandigarh Bench and Bangalore Benches
of this Tribunal in order date 13.11.2003 and
5.2.2004 respectively sustained the plea of the
applicants for extension of CGHS facility to the
pensioners who retired from P&T Department.
3. The contentions of the respondents
advanced in the reply statement are in short as
follows: The first applicant was denied CGHS
benefit in compliance with the order at ft-4 . The
cards of the 2nd ana 3rd applicants were renewed
due to oversight till 31.12.20O4. The CGHS
“facility is not admissible to pensioner’s of P&T
except in Delhi as the P&T has its own
departments. The extension of CGHS facility to
P&T pensioners will create huge burden on
CGHS in terms of the man power and budgetary
resources and infrastructure.
4. We heard both sides and perused the pleadings
and material on record. The excerpts of the
communication of the Ministry of Personnel,
Public Grievancs and Pensions. Which is nodal
Ministry on CGHS facilities for civilian Central
Government Pensioners are reproduced below :
“ I. AlI Central Government pensioners (except
Railway pensioners and armed Forces
pensioners) who were eligible for availing CGHS
facilities while in service are eligible for availing
CGHS facilities after retirement. The scheme is
also applicable to Central Government employees
who retired with Contributory Provident Fund
benefits. Similarly f amilies of Central Government
employees in receipt of Central Government
Employees in receipt of family pension are also
eligible to avail of these facilities, if the deceased
Government servant was eligible for these facilities
while in service.
1.2 It is not that only those Central Government
employees who were actually availing of CGHS
facility duri ng service are eligible to enjoy them
after retirement. All retired ‘personnel of Ministries/
Departments. offices which are eligible to enjoy
CGHS facility while in service are eligible to enjoy
them after retirement, even if immediately prior to
their retirement, they were not actually availing or
never availed the facilities on account of their
posting to a station where CGHS facilities were
not available.
1.3 Pensioners/family pensioners /CPF retires
whose rchildren are serving Central Government
employees and are eligible for CGHS facilities
can avail of the CGHS facilities as a member of
the family of the said nerving employee ‘provided
a member of the family of the said serving
employee provided their pension/family pension
does not exceed Rs 500 on pension/family
pension sanctioned after average CPI 608 is not
taken into account. As far as Contributory
Provident Fund retires are concerned their
monthly income is worked out w.e.f. the pension
equivalent of employees contribution to the

Contributory Provident Fund along with interest
thereon received by them at the time of retirement.
1.4 Even though CGHS facilities are at present-
available only at specified places and it may not
be possible for Central Gcvernment Pensioners
living away from these places to avail of the CGHS
facilities on day-to-day basis as in the case of
persons living at these places. it: may be in
the interest of the pensioners to enroll
themselves as beneficiaries of the CGHS scheme,
so that at least in thee case of major ailments/
major surgery they will be able to come to the
CGHS station to avail of these facilities if and
when such a need should arise.
This communication makes it amply clear that
all Central Government pensioners except the
Railway and Armed Forces Pensioners are
eligible for CGHS facilities after retirement. That
being so, the 3 applicants who are retired
employees of P&T Telecom departments are
eligible for CGHS benefit, in keeping the aforesaid
communication.
5. This apart Chandigarh Bench of this Tribunal in
order dated 13.11.2OO3 in 0.A.955/CH/2003 and
O.A.974/CH/20O3 quashed A-4 order and
directed continuance of membership under CGHS
to the applicants who are retired employees of
the Department of Telecom and Department of
Posts. The Bangalore Bench of the Tribunal in
order dated 20.11.2OO in O.A.704/2001 quashed
the impugned Letter dated 1.8.96 with
consequential benefits.In its order dated 5.2.2O04,
the Bangalore Bench of the Tribunal, in O.A.392/
2OO3 and connected cases, directed extension
of CGHS benefit to retired employees of
departments of Posts and Telecom. We are in
agreement with the aforesaid orders of Chandigarh
and Bangalore Benches of this TribunaI.
6. In view of this facts, we are of the opinion that
all Central Government pensioners except
pensioners of Armed Forces and Railways are
entitled to CGHS facility subject to the payment
of subscription for this purpose. Accordingly the
pensioners of P&T and Telecom Departments are
entitled to CGHS benefit.
7. On consideration of the facts and
circumstances of the case, the impugned orders
at A-4 and A-5 are quashed. The respondents
are directed to continue CGHS benefit to
applicants 1 to 3 subject to the payment of
requisite subscription for this benefit as par rules.
All Central Government pensioners (except
RaiIway and Armed forces Pensioners) including
pensioners who retired from P&T and Telecom
departments are entitled to CGHS facility subject
to the payment of subscription for availing
themselves of this as par rules. The respondents
are directed’to extend CGHS facility to Central
Government Pensioners except Railway and
Armed Forces pensioners subject to payment of
requisite subscriptions accordingly. The A. is
accordingly disposed of No costs.

Bench - OA No 589/2004 - Date of Judgment

Employee in pensionable service, having putin more than 10 years of service includingtemporary status service, entitled for pensionand family to family pension on his demise
Facts: The husband of the petitioner who a TRS
khalasi was granted temporary status by
railways, the Respondents, with effect from
01.01.1984 and regularized with effect from
25.02.1997. He was medically decategorised for
all services with effect from 26.07.1998 and he
expired on 14.04.1999.
The applicant submits that her husband had put
in 14 years of service and is therefore eligible for
pension and family pension to her after his death.
All other pensionary benefits due to the ex-
employee had already been paid to him when he
was medically decategorised .
The respondents in their reply state that only
50% of the temporary Status service can be taken
for calculating the quantum of service.As per that,
the total period for granting pension falls short of
10 years which make the applicant and her late
husband to become ineligible for pension and
family pension . the respondents also contend
that this OA is not admissible as per limitation
clause.

The facts and dates of the case as mentioned
above are noted. As per those details, the ex-
employee had put 14 years of service , i.e. more
than 10 years. In that circumstances it wad held:
“That is no scope for the respondents to contend
that the husband of the applicant was not entitled
to pension or his job was not pensionable job or
that he did not complete the eligibility period of
10 years for grant of pension under the relevant
rules’’.
The Condonation of Delay Petition No. 2020/07
was allowed as pension is a recurring cause every
month. Further the applicant is an illiterate lady
and wife of a group ‘D’ employee. Coming to the
merits of the case , the ex-employee had put
in14 years of service before he was declared
medically unfit. Therefore the respondents are
duty bound to pay pension and pensionary
benefits to the husband of the applicant thereafter.
That view is strengthed by the judgment of the
High Court of Gujarat in the case of Eukhiben
Rupabhai vs Union of India and others,
[2006(2)AT01]. In that case in Para 39 of the
judgment, the Court categorically held that casual
labourer after putting in certain years of service
continuously is entitled to temporary status and
this has been considered as incidence of
statutory provision and the petitioner in that case
was given benefit in view of that decision . In the
result, the OA is allowed directing the
respondents to calculate pension and other
pensionary benefits from 25.07.1998 to
14.04.1999 and family pension to the applicant
from that date onwards, the calculated arrears
are to be paid within 3 months from the date of
receipt of this order.
Thus the OA is allowed.

31.01.2008]
2nd, cash;When the respondents Nos.1 ‘to 3 were denied
the benefit arising out of CGHS Scheme on the
ground that they being retired employees of the
P&T Department, were not entitled to that benefit/
they approached the Central Administrative
Tribunal seeking appropriate direction. The tribunal
below as per Exz.P1 directed the petitioners
herein to continue CGHS benefit to the
respondents 1 to 3 herein subject to payment of
the ‘prescribed subscriptions. Aggrieved by the
direction the Union of India and its officers, have
approached this court with this writ petition
impugning the decision of the Central
Administrative Tribunal.
2. The only ground advanced before us is that the
applicants before the tribunal below, namely
respondents 1 to 3 had never availed of CGHS
benefit while they were in service. The scheme
as contained in Annexure-A1 in the original
application Ext. P2 is to the effect that only
those who were entitled to the benefit of CGHS
while in service can avail the same after their
retirement. Therefore the tribunal was not justified
in issuing the direction as aforesaid.
3. It is contended by the counsel for the
respondents that the CGHS was introduced in
Thiruvananthapuram only with effect from 1.4.96 ,
Respondents I to 3 retired from service long before
that date. Therefore there was ro possibility for
them to avail the CGHS benefits because they
were employed in a station where CGHS facility
was not available. Therefore, they could not have
availed it. Had they been posted in appropriate
places where it was available they could have
availed the benefit. Therefore going by clause (3.2)
of Annexure-Al marked in Ext.P2 application they
are entitled the benefits as it is introduced now in
Thiruvananthauram. The tribunal was therefore
justified in issuing a direction to the writ petitioners
as aforesaid.
4. The eligibility clause in para 1.1 of Ext.Al
marked before the tribunal below makes it clear
that “all Central Government pensioners (except
Railway pensioners and Armed Forced
pensioners) who were eligible for availing CGHS
facilities while in service are eligible for availing
CGHS facilities after retirement.” The only
exceptions going by the scheme, are the Railway
pensioners and Armed Forced pensioners. It is

also relevant here to take note of para 1.2 of the
said scheme which reads as under.
“It is not that only those Central Government
employees who were actually availing of CGHS
facility during service are eligible to enjoy them
after retirement. All retired personnel of Ministries/
Departments, offices which are eligible to enjoy
CGHS facility while in service are eligible to enjoy
them after retirement, even if immediately prior
to their retirement, they were not actually availing
or never availed these facilities on account of their
posting to a station where CGHS facilities were
not available.”
5. The aforesaid stipulation makes it clear that
the eligibility for CGHS scheme after retirement
has to be determined not with respect to the
actual availing of the same while in service, but
the eligibility to avail it while in service. The
aforequoted paragraph in the scheme make it
clear that if an employee by reason of a posting
in an area where CGHS facility was not
implemented/ he will not be disentitled to claim
CGHS facility after retirement, if the same is
implemented in the area where he was residing.
The view taken by the tribunal is well justified
and in tune with the scheme. Therefore there is

Extract of Law Minister’s Speech in the AllIndia Conference of C.A.T on 1.11.09
As the Tribunal is dealing with service matters of
Government employees, it is needed that their
grievances are settled in time bound manner so
that their career may not jeopardized. There is
another aspect. If the employee is concentrating
on his case which is pending before the Tribunal,
he may not deliver his services effectively. It would
affect Government working. Therefore, efforts
should be made so that cases of employees are
disposed of as quickly as possible. I am not
blaming the Tribunal for delay. Some time delay
is due to inaction :of the concerned Government
department in replying and arguing the case, You
must be aware that we are progressing towards
bringing judicial reforms. One of the agenda before
the Government is that we want to remove the tag
of ‘biggest litigant’. We are formalizing the policy
of the Government litigation. We are collecting
data from all the Departments of the Government
regarding cases pending in the Courts and
Tribunals. We will analyze those cases and take
necessary corrective steps. Our efforts are that
Government should go in litigation only where it
is necessary. Unnecessary appeals should not
be filed on behalf of Government. Soon we will
formalize our policy. Service jurisprudence has
become very complex now. Our idea is that
grievances of an employee are to be effectively
addressed by the grievance cell of the concerned
department.
WHY No more social audits in Rajasthan ?
The Rajasthan government withdrew its members
nominated in the social audit teams and asked
gram sabha (village bodies) not to cooperate with
civil society groups. Different civil society groups
had been conducting social audits of different
schemes, especially the National Rural
Employment Guarantee Scheme, for the many
years. The audits conducted to show many of the
works marked as ‘complete’ in the government
files were never started, resulting in action against
some of these officials.

The undersigned is directed to say that inpursuance of Government’s decision on therecommendations of Sixth Central PayCommission, orders were issued vide thisDepartment’s O.M. No. 38/37/08-P&PW(A} dated2.9.2008 for introducing modifications in the rulesregulating pension, Retirement/Death/ServiceGratuity/Family Pension/ disability pension andex-gratia lump-sum compensation. In accordancewith para 5.2 and para 5.3 of that OM,” once aGovernment servant becomes entitled to pensionon completion of 20 years/10 years of qualifyingservice, he shall be paid pension at 50% of theemoluments or average emoluments receivedduring the last 10 months, whichever is morebeneficial to him. In terms of para 5.4 of the OM,these revised provisions have come into forcew.e.f. 2,9.2008 and shall be applicable toGovernment servants retiring on or after that date.Subsequently, it was clarified vide O.M. No. 38/37/08-P&PW(AJ dated 11.12.2008 that pensionof Government servant retiring on or after 1.1.2006will also be calculated based on the emolumentsor average emoluments received during the last10 months, whichever is more beneficial to himbut his pension would continue to be proportionateto the pension on completion of 33 years ofqualifying service. Para 5.4 of this Department’sO.M. No. 38/37/08-P&PW(A) dated 2.9.2008 wasmodified to that extent.
2. This matter has been reconsidered by theGovernment. In partial modification of theinstructions/order issued in this respect, it hasnow been decided that linkage of full pension with33 years of qualifying service shall be dispensedwith, with effect from 1.1.2006 instead of
2.9.2008. The revised provisions for calculationof pension in para 5.2 and 5.3 of the OM No.38/37/08-P&PW(A) dated 2.9.2008 shall come intoforce with effect from 1.1.2006 and shall beapplicable to the Government servants retired/retiring after that date. Para 5.4 will further standmodified to that extent.
3. Consequent upon the above revised provisions,in partial modification of para 7.1 of the OM No.38/37/01-P&PW(A)-P&PW(A) dated 2.9,08, theextant benefit of adding years of qualifying servicefor the purpose of computation of pension andgratuity shall stand withdrawn with effect from1.1.2006.
4. The overall calculation may take into accountrevised gratuity and revised pension, includingarrears up to date of revision based on theseinstructions. However, no recoveries would bemade in the cases already settled.
5. It is impressed upon all the Ministries/Departments of the Government of India to keepin view the above modifications/clarifications whiledisposing of the cases of revision of pension. Theyare also advised to dispose of the representationsreceived by them from pensioners on the aboveissues without referring the same to thisDepartment.
6. This, issues with the concurrence of Ministryof Finance (Department of Expenditure) vide theirU.O. No.375/EV/2009 dated 19.11.2009.
7. In their application to the employees of theIndian Audit and Accounts Departments, theseorders issue in consultation with the Comptroller& Auditor General of India.

1. Those who are in receipt of provisional pensionor pension in the .pre revised scales of 5th CPCare entitled to Dearness Relief @ 73% w.e.f1.7.2009.
2. The surviving CPF beneficiaries who haveretired from service between the period 18. 11.1960 to 31.12.1985 and are in receipt of ex-gratia@ Rs. 600/ p.m. w.e.f. 1.11.1997 under thisDepartment’s OM No. 45/52/97-P&PW (E) dated16.12.1997 are entitled to Dearness Relief @ 73%w.e.f. 1.7.2009.
2. The following categories of CPF beneficiarieswho are in receipt of ex-gratia payment in termsof this Department’s OM No. 45/52/97-P&PW(E)dated 16.12.1997 are entitled to DR @ 65% w.e.f.1.7,2009.
(i) The widows and dependent children of thedeceased CPF beneficiary who had retired fromservice prior to 1.1.1986 or who had died while inservice prior to 1.1.1986 and are in receipt of Ex-gratla payment of Rs. 605/- p.m.
(ii) Central Government employees who hadretired on CPF benefits before 8.11.1960 and arein receipt of Ex-gratia payment of Rs. 6S4/-, Rs.659/-, Rs. 703/- and Rs. 965/-.
3. This issues with the concurrence of Ministryof Finance, Department of Expenditure vide theirUO No. 363/EV/09, dated 23.10.2009 and UONo. 373/EV/2009 dated 16.11.2009.

SPS Vains Hon’bleSupreme Court has directed that the pay of ailpensioners in the rank of Major General and itsequivalent rank in the two other Wings of theDefence Services be notionally fixed at the rate
given to similar officers of the same rank after therevision of pay scales with effect from 1.1.1996,and, thereafter, to compute their pensionarybenefits on such basis with prospective effect fromthe date of filing of the writ petition.
2. Some representations have been received inthis Department pensioners/pensioners’associations suggesting that the pension ofpensioners who retired from the civ/I departmentsand who, before their retirement, were governedby the CCS(Pension) Rules, 1972 may be revisedby applying the ratio of the aforesaid judgementof the Apex Court. These representations/references have been examined in consultationwith Ministry of Finance and Ministry of Law.
3. The undersigned is directed to say that thejudgement dated 9.9.2008 in CA No. 5566 of 2008(SLP (Civil) No. 12357 of 2006) - UOI vs. Maj.Gen.SPS Vains wiil not apply in (he case ofpensioners who retired from (he civil departmentsand who, before their retirement, were governedby the CCS(Pension) RuJes, 1972.

Subject : Grant of the revised pay structure ofgrade pay of Rs.4600 in the pay band PB-2 toposts that existed in the pre-revised scale ofRs.6500-10500 as on 1.1.2006 and which weregranted the normal replacement pay structure ofgrade pay of Rs.4200 in the pay band PB-2
Sixth Pay Commission recommended merger ofthe three pre-revised scales of Rs.5000-8000,Rs.5500-9000 and Rs.6500-10500 and replacedthem by the revised pay structure of grade pay ofRs.4200 in the pay band PB-2. Vide para 2.2.21(v) of its Report, the Commission recommendedthat on account of the merger of these 3 scales,some posts which constituted feeder andpromotion grades would come to lie in an identicalgrade. The Commission gave specificrecommendations in its Report granting highergrade pay of Rs.4600 to some categories of theseposts. As regards the other posts, theCommission recommended that it should first be.

seen if. the posts in these 3 scales can be mergedwithout any functional disturbance and if possible,the same should be done. Further, theCommission recommended that in case it is notfeasible to merge the posts in these pay scaleson functional consideration, the posts in the scaleof Rs.5000-8000 and Rs.5500-9000 should bemerged with the posts in the scale of Rs.6500-10500 being upgraded to the next higher grade inthe pay band PB-2 with grade pay of Rs.4600corresponding to the pre-revised scale of Rs.7450-11500. In case a post already exists in the scaleof Rs.7450-11500, the post being upgraded fromthe scale of Rs.6500-10500 should be mergedwith the post in the scale of Rs.7450-11500.
2. The above recommendation of the Sixth PayCommission were notified vide para (ii), Section Iin Parts B and C of the First Schedule to theCCS (RP) Rules, 2008. While Part B of the FirstSchedule to the CCS (RP) Rules relates to revisedpay scales for common categories of staff, PartC notifies revised pay structure for certain postsin Ministries, Departments and Union Territories.The above provisions of the Rules specificallymentioned that upgradations in terms of para (ii)Section I may be done in consultation withDepartment of Expenditure, Ministry of Finance.
3. Consequent upon the Notification of CCS (RP)Rules, 2008, Department of Expenditure hasreceived a large number of references fromadministrative ministries/ departments proposingupgradation of the posts which were in the pre-revised scale of Rs.6500-10500 as on 1.1.2006by granting them grade pay of Rs.4600 in the payband PB-2. The matter has been considered andit has now been decided that the posts whichwere in the pre-revised scale of Rs.6500-10500as on 1.1.2006 and which were granted the normalreplacement pay structure of grade pay of Rs.4200in the pay band PB-2, will be granted grade payof Rs.4600 in the pay band PB-2 correspondingto the pre-revised scale of Rs.7450-11500 w.e.f.1,1.2006. Further, in terms of the -aforementionedprovisions of CCS (RP) Rules, 2008, in case apost already existed in the pre-revised scale ofRs.7450-11500, the posts being upgraded fromthe scale of Rs.6500-1 0500 should be mergedwith the post in the scale of Rs.7450-11500.
4. Accordingly, in terms of Rule 6 of CCS (RP)
Rules, 2008, revised pay of Government servantsin the pre-revised scale of Rs.6500-10500 whowere earlier granted grade pay of Rs.4200 andwho have already exercised their option for drawalof pay in the revised pay structure in the formatprescribed in the Second Schedule to the Rules,will be fixed again in accordance with illustration4A annexed to CCS (RP) Rules, 2008.
5. In case of all such Government servants inthe pre-revised scale of Rs.6500-10500 who wereearlier granted grade pay of Rs.4200 and who hadopted to have their pay fixed under CCS (RP)Rules, 2008, action as prescribed in thisDepartment’s O.M. of even number dated 30th
August, 2008 will be taken. In case a Governmentservant desires to revise his earlier option forcoming over to the revised pay structure, he maybe permitted to do so without making anyreference to this Department.
6. On account of pay fixation in the revised paystructure of grade pay of Rs.4600 in the pay bandPB-2, arrears of pay will be recalculated anddifference of arrears in respect of the entire amountwill be paid immediately. The manner of drawal ofarrears has already been indicated in thisDepartment’s O.M. of even number dated30.8,2008.

(1) Whether the rate of double the amount of revised
basic pension under VJ CPC or the last Basic Pay i.e.
(Pay in the pay Bend plus Grade pay ) will be the rate
of contribution towards RELHS in respect of theemployee who retired /died in harness on or after
1.1.2006 and had not exercised option for joining the
RELHS Scheme -97at the time of retirement or theirfamily members did not opt for joining within three
months from the date of death and now exercise
option to join the RELHS-97 Te employee who haveretired on or after 1.1.2006 and exercised option for
joining RELHS at the time of retirement are required
to deposit one months pay equivalent to the revisedlast basic pay (pay in the pay Band plus Grade pay )
under CPC Award.
(2) In terms of Para 5 of aforesaid Boards letter , joiningRELHS may be mandatory for all retired Railway
employees . Board are, therefore requested to kindly
confirm as to whether joining of RELHS-97 may alsobe mandatory to the railway servant rending lass than
20 years of qualifying service at the time of
retirement . Board has also been requested to clarifyas to whether family member of railways servant who
died in harness rendering less than 20 yearsqualifying service at the time of death are also
eligible for joining RELHS.
(3) Permanent absorbees ,where 1/3rd of full pension interms of Honorable Courts order has been restored
have now appealed to allow them for joining RELHS.
Now their 1/3rd restorable pension will be updatedunder VJ CPC vide Boards letter No.F(E)III//2005/PNI/
23 dated 22.9.2008 (RBE No.120/2008)(F(B)Board has
been requested to clarify as to whether these permanentabsorbees will be entitled to exercise option for joining
RELHS-97 if so, what will be their rate of contribution .
(4) It is seen that railway pensioners/family pensioner whocross the age of 80 years and above are entitled for
additional pensioner/family pension at the rates
applicable to their ages crossing the age of 80 yearsand above on addition to the revised pension/family
pension under VJ CPC.Award. Now, some of these
pensioners / family pensioner are applying to join theRELHS -97 . It has been requested to clarify as to
whether a sum equivalent to double the amount of
additional pension/family pension will be the rate ofcontribution for joining RELHS-97 in respect of such
pensioners/family pensioners.
The instructions given in Para 6 of
the Boards letter dated 16.3.09 are
very clear regarding amount to be
deposited for joining RELHS 97
hence no further clarification is
required.
The terms for joining RELHS have
not been changed . Hence the
qualifying service remains 20 years
. Family members of railway servant
who died in harness reducing less
than 20 years qualifying service at
the time of death are also eligible
for joining RELHS.

ORDER:
The Government in their order first read above had
constituted a fund called, “Tamil Nadu Government
Pensioners’ Health Fund” to provide financial
assistance to pensioners for undergoing
specialized treatments / surgeries if they are
affected by major ailments. In the Government
Order fourth read above, revised consolidated
orders were issued showing list of diseases and
list of accredited private hospitals for availing
assistance by the pensioners under this scheme.
In the Government Order fifth, sixth and eighth
read above, some new hospitals have been
approved for availing assistance for certain
specialities under this scheme.
2) In the Government Order ninth read above,
orders were issued enhancing the assistance
under this scheme to Rs.1,00,000/- or 75% of
the actual cost of the treatment whichever is less
and the contribution payable by the pensioners
to RS.50/- per month.
3) In the Budget Speech for the year 2009-2010,
the Hon’ble Minister for Finance had announced
that the benefits of the Tamil Nadu Government
Pensioners’Health Fund Scheme will be extended
to the spouse of the pensioners.
4) Though the scheme, was introduced as a
financially self sustaining scheme, the receipt of
funds under the scheme by way of subscription
collected from the pensioners is not sufficient to
meet the claims received from the pensioners,
resulting in a backlog of pending applications for
sanction of assistance under the scheme. To meet
the deficit in the fund, Government had to sanction
grants from time to time, in order to clear the
pending claims. In case of extension of this
scheme to the spouse of the pensioners, the
expenditure and deficit of the fund is expected to
increase further. In order to meet the increased
expenditure, the Government has decided to
enhance the contribution payable by the
pensioners towards the Tamil Nadu Government
Pensioners’ Health Fund so as to continue the
scheme on self-financing basis to the possible
extent.

5) Accordingly, the following orders are issued
under Tamil Nadu Government Pensioners’Health
Fund Scheme :-
(i) The scheme of Tamil Nadu Government
Pensioners’ Health Fund 1995 shall apply to the
spouse of the pensioners with effect from
17.2.2009.
(ii) However, there is no change in the maximum
ceiling limit of Rs. 1,00,0007- (i.e) assistance
under the scheme shall be sanctioned to the
maximum extent of Rs. 1,00,0007- or 75% of the
actual cost of treatment, whichever is less, for
both the pensioner and spouse, combined
together.
(iii) The contribution recoverable from the
pensioners’ monthly pension towards the Tamil
Nadu Government Pensioners’ Health Fund
Scheme shall be increased from RS.50/- to
RS.100/- with effect from 01.09.2009, i.e. the
pension payable for the month of September 2009.
6) There shall be no change in other existing rules
and conditions for sanction of assistance under
the scheme.
7) The Director of Pension is empowered to
sanction financial assistance under the scheme
to the spouse of the pensioners also subject to
eligibility. The Director of Pension is requested to
quote the correct name of the specialized
advanced surgery / treatment as in the approved
list and the name of the private hospital with its
serial number in the proceedings for expeditious
settlement of claims.
8) The Government also direct that in respect of
the treatments/surgeries taken from 17.02.2009
till the date of issue of these orders, the assistance
shall be allowed, if otherwise, the other conditions
for sanction of assistance are fulfilled.

ORDER:
The Government in their order first read above had
constituted a fund called, “Tamil Nadu Government
Pensioners’ Health Fund” to provide financial
assistance to pensioners for undergoing
specialised treatment / surgery, if they are affected
by major ailments. In the Government Order third
read above, revised consolidated orders were
issued showing list of diseases and list of
accredited private hospitals for availing assistance
by the pensioners under this scheme. In the
Government Order fourth, fifth and seventh read
above, some new hospitals have been accredited
for availing assistance for certain specialties under
this scheme. In the Government Order eighth read
above, the assistance under this scheme was
enhanced to Rs.1,00,000/-or 75% of the actual
cost of the treatment whichever is less and the
Subscription towards the scheme was enhanced
from Rs.10-p.m. to RS.50/- p.m.
2) The Official Committee on Pay Revision
constituted for revision of pay and pension to the
employees / pensioners of State Government,
among others has recommended that the family
pensioners who are willing to contribute a sum of
Rs.50/-p.m. shall also be enrolled under the Tamil
Nadu Government Pensioners Health Fund
Scheme. Government, after careful consideration
of the above recommendation, decided to fix the
monthly contribution from the Family Pensioners
as RS.75/- considering the fact that the monthly
contribution from the pensioners has been
enhanced in the Government Order ninth read
above from RS.50/- to Rs.1 OO/- effect from 1.9.09.
3) Accordingly, the Government issues the
following orders:-
(i) The Tamil Nadu Government Pensioners’ Health
Fund Scheme 1995 shall also apply to all family
pensioners including teacher family pensioners
(who draw family pension either directly from the
Pension Pay Office / Treasury / Sub Treasury
under Pension Pilot Scheme or through banks
under Public Sector Bank Scheme) with effect
from 1st September 2009 subject to the condition
stipulated under item (iii) below;
(ii) A sum of RS.75/- p.m. shall be recovered from
the family pension of those who are willing to join
and avail assistance under the scheme.
(iii) All family pensioners including teacher family
pensioners who are Willing to contribute a sum
of RS.75/- per month to the fund which will be
deducted from their monthly family pension from
September 2009 till their death /till the payment
of Family Pension ceases, shall exercise option
to the Pension Pay Office/Treasury Officer/Sub
Treasury Officer/Manager, Public Sector Banks
within three months from the date of issue of this
order, to deduct a sum of RS.75/- from their family
pension towards contribution to Tamil Nadu
Government Pensioners’ Health Fund Scheme.
(iv) They shall be eligible for an assistance of RS.1
,00,0007- or 75% of the actual cost of surgery
/ treatment, whichever is less, under the above
scheme, from the date after first deduction of
RS.75/- is made from the family pension.
(v) If no such option is received from the existing
family pensioners on or before the completion of
three months from the date of issue of this order,
it shall be construed that they are not willing to
enroll themselves under the Tamil Nadu
Government Pensioners’ Health Fund Scheme.
(vi) The option once exercised shall be final.
(vii) Alt existing orders in force and those issued

from time to time in regard to accredition of
hospitals and diseases and procedures conditions
guidelines for sanction of assistance to the
pensioners under the scheme is applicable to the
family pensioners also.
(viii) The Director of Pension is empowered to
sanction financial assistance under this scheme
to the family pensioners as per the orders in force.
(ix) These orders shall not be applicable to
employed family pensioners and to those family
pensioners who are in receipt’ of pension under
the State Government.
4) These orders shall take effect from 1st
September 2009.
5) The Government also direct that in respect of
the treatment taken from 1.9.2009 till the date of
issue of orders, the assistance shall be allowed,
if otherwise the other conditions for sanction of
assistance under the scheme are fulfilled.

District Medical Officer concerned in the Districts
/ Director of Medical Education, as the case may
be, regarding the existence of facilities and
infrastructure for the treatment / surgery in the
hospital.
3. The Director of Pension has stated that the
pensioners who have taken treatment in
unaccredited private hospitals or who have taken
treatment for the diseases other than those given
in the approved list or who have taken treatment
in unaccredited institutions of other States are
moving Court and get favourable orders to consider
such cases for sanction by Government. In order
to implement the Court orders, Government
issues relaxation orders, sanctioning the claims
and permitting the Director of Pension to admit
such claims of unapproved treatments and
unaccredited institutions in the case of respective
pensioners who won cases and payment is made
by Director of Pension accordingly.
4. The Director of Pension has also stated that
the Hon’ble High Court has observed in various
judgements that “mode of treatment is at the
discretion of the Doctors and the departments
cannot insist particular mode of treatment alone
can be taken by the patient” and that “the
pensioners cannot be imposed any condition that
a particular type of treatment alone should be
taken or the treatment should be taken in a
particular hospital”.
5. The Director of Pension has therefore requested
for delegation of powers to him for sanction of
assistance under Tamil Nadu Government
Pensioners’ Health Fund Scheme towards
treatments not approved and not listed in the G.O.
(Ms) No. 378, Finance (Pension) Department,
dated 13.10,2005 and also for treatments taken
in institutions of other States in order to reduce
hardship to the pensioners from moving Court often
(on rejection of the proposals).
6. The Government, after careful consideration of
the request of the Director of Pension in paragraph
5 above, pass the following orders:-
.The Director of Pension is delegated with powers
to sanction pending claims as well as future
claims for medical assistance from the pensioners
in respect of ineligible treatments as well as
eligible treatments taken in unaccredited
institutions, both within the State as well as
outside the State, subject to the following
procedure: -
In respect of treatments taken in
unaccredited hospitals within the State
Proceedure prescribed in para 4 (i) (a) of the G.O.
sixth read above shall be continued, In respect
of treatments taken in unaccredited hospitals
outside the State
The Pension Pay Officer / District Treasury.
‘Officer/ Sub-Treasury Officer / Branch Manager
of Public Sector Banks after satisfying about the
details furnished in the application received in his
office shall send the claim direct to the Director
of Pension within a week. However, certification
from the District Medical Officer / Director of
Medical Education need not be insisted in respect
of Hospitals outside the State.
8. The other terms and conditions of the scheme
shall remain unchanged

The Kumars haven’t moved into town yet, but
Delhiites are hoping that they do so soon. Mr
Thu-Thu Kumar (who spits), Mr Su-Su Kumar
(who pees in public) and Mr Kuda Kumar (the
litterbug) — characters of the Municipal
Corporation of Delhi’s proposed ad campaign —
will soon be seen on bus kiosks, hoardings,
television and radio. The idea is to embarrass
offenders and to raise awareness against spitting,
urinating and littering in public places.
Dilli wallas couldn’t be happier. “Public
embarrassment is the only option that works with
people here,” says writer Priya Sharma. “This is
the coolest thing MCD has done. These
characters will become a part of pop-culture
soon,” says engineering student Swati Gupta.
Youngsters also have a few, suggestions. “Draw
cool caricatures to represent each character, like
the Zoozoos,” says Sidharth Raheja, a BPO
employee.
CENTRAL GOVERNMENT HEALTH SCHEME
The “Central Government Health Scheme” (CGHS)
provides comprehensive health care facilities for
the Central Govt. employees and pensioners and
their dependents residing in CGHS covered cities.
Started in New Delhi in 1954, Central Govt. Health
Scheme is now in operation in Allahabad
,Ahemdabad ,Bangalore , Bhubhaneshwar
,Bhopal ,Chandigarh , Chennai ,Delhi , Dehradun
,Guwahati , Hyderabad , Jaipur , Jabalpur , Kanpur
, Kolkatta , Lucknow , Meerut , Mumbai , Nagpur
, Patna , Pune , Ranchi , Shillong , Trivandrum
and Jammu.
The Central Govt. Health Scheme provides
comprehensive health care to the CGHS
Beneficiaries in India. The medical facilities are
provided through Wellness Centres(previously
referred to as CGHS Dispensaries) /polyclinics
under Allopathic, Ayurveda, Yoga, Unani, Sidha
and Homeopathic systems of medicines.

CGHS Cards: DEFINITION OF FAMILY
In accordance with the initial instructions, the
term of Family for the purposes of the Scheme
shall consist of the Government servant’s wife or
husband, as the case may be children and
stepchildren and parents who are mainly
dependent on and residing with the Government
servant concerned. Subsequently in pursuance
of the recommendations of the Sixth Central Pay
Commission, it has been decided that for availing
the medical facilities under the scheme, parents,
sisters, widowed sisters, widowed daughters,
minor brothers and children will be deemed
dependent on the Government employee if they
are residing - with him and their income from all
sources including pension and pension
equivalent of DCRG benefit is less than Rs. 3500+ DA per month.
ENTITLEMENT OF THE SCHEME :All Central Govt. Servants paid from Civil
Estimates (other than those employed in Railway
Services and those employed under Delhi
Administration except members of Delhi Police
Force) having their head quarters in cities where
the Scheme is functioning and members of their
families, are entitled for the CGHS medical
facilities.
TRANSFERIn case the. Central Govt. Employees is
transferred to uncovered city leaving behind his
family, the Government Employee is not entitled
for the medical benefits either for himself or for
his family under the Scheme but will be governed
under CS(MA) Rule. In the event of the posting
of the Central Govt.Employee to North Eastern
Region Andaman and Nicobar Is-lands &
Lakshadweep and his family members continue
to stay in an area covered by the Scheme
temporary family permit for availing CGHS
benefits will be issued to the family members by
depositing advance usual contribution. But in

will be governed under CS(MA) Rule.
TEMPORARY VISIT IN COVERED CITYCentral Govt. employees and dependent family
members who are beneficiaries of the CGHS.
and who may be visiting other cities where the
scheme is operating and stay in the areas covered
by the Scheme are entitled for free medical
attendance / treatment under the said scheme.
(Necessary authority/ temporary cards for
medical treatment in any of those cities, should
be issued by the respective departments in case
of serving employees.) Medical facilities should
be restricted to period not exceeding six months
after which fresh authorities may be issued, if
necessary. Similar facilities are also available to
pensioners and the dependent family members
if holding. CGHS Cards and permission shall be
granted by CGHS of the city visiting.
PRODUCTION OF CGHS CARDThe production of CGHS Card is obligatory at
every visit to enable correct identification of the
patient and to prevent misuse of card.The misuse
of card is a cognizable offence. However, in view
of humanitarian service, essential and immediate
treatment should not be denied to the patient
but the beneficiary should be advised to bring
the CGHS Card at the time of subsequent Visits
and if considered necessary, a note may be made
in OPD ticket of the patient. The production of
CGHS Index Card in the dispensary will enroll
the card holder as a member of the said
dispensary. The renewal of Pensioners’ cardshall be done in the dispensary. The Indian Postal
Order should be sent to Pensioner Cell, Nirman
Bhavan/DDO Office outside Delhi, regularly on
Or before 6th day of the following month. Before
accepting the I.P.Os the Chief Medical Office!r
Incharge must see the date of issue of I.P.O/
DDs which should be within one month of issue
from the Post Office. The Chief Medical Officer
incharge will obtain a certificate from each
pensioner for any rise of pay/pension due to
incrementel rise after every two years for
calculation of rate of pension or the fact may he
verified from his pension payment order before
revalidation of card.The Chief Medical Officer
Incharge may therefore re-fix the rate of
contribution accordingly. In case of Pensioner
the transfer of card from one dispensary to another
shall be) done by the Chief Medical Incharge of
the dispensary.
REGISTRATION OF CGHS CARD INDISPENSARYCard Holder must deposit the Index Card in the
dispensary and obtain receipt from the receiving
clerk. The receiving clerk, will initial the token
card in confirmation. Until he deposits the Index
Card. he is not entitled for treatment in the said
dispensary. On transfer to another dispensary
the Card Holder must collect the index card from
the dispensarv and deposit the same along with
necessary forms (in duplicate) to the new
dispensary which has been allotted to him. It is
only after the deposition of Index Card in the
dispensary that the members mentioned in the
token card are entitled to obtain CGHS facilities.
SURRENDER OF CGHS CARDThe CGHS Identity Card held by the beneficiary
other than Pensioner, General Public, Ex- MPs
etc. must be surrendered to the issuing authority
in the following events:-
(a) Retirement /Resignation
(b) Death of Government Servant.
(c) Transfer of Govt. Servant to another office.
The Govt. servant if transferred to another office
where he/ she is again entitled far CGHS benefits
must apply and obtain a new Identity Card.
Pensioners, EX-M.Ps Member of General Public
etc. are also required to surrender their Identity
Cards to the issuing authority on its expiry in
case they no longer desire to avail CGHS
facilities.
MISUSE OF CGHS CARDIf the Medical Officer detects a case of misuse
of CGHS Token Card by unauthorized person,
he will bring to the notice of Chief Medical Officer
Incharge and / or the matter reported to the Zonal
HQ/ ete. for further necessary action.
LOSS OF IDENTITY CARDAs a lost card is likely to be misused the card

holder must inform immediately to the Police and
inform the following with a, copy of F.I.R.
(i) Issuing authority.

realising penalty of Rs. 5!- for 1st instance. 2nd...

Rs. 10/- . In case of individual Plastic Cards in
Delhi – the procedure is same but , the penalty
is Rs.50/-
DEPENDENCE CERTIFICATEEvery Card Holder must certify that the parents /
Dependents whose names have been included
in the token card, normally reside with him. Such
a certificate must be furnished at the time of issue
of Token Card and renewed every January.
Otherwise the parents shall be treated as non
entitled persons. The certificate must also state
that the income from all sources does not exceed
Rs. 3500 + DA p.m.

For General InformationCentre plans to revamp CGHS soon
Online reports, low-cost dialysis proposed In a
bid to make the Central Government Health
Scheme more accessible to Central Government
employees, the Ministry of Health; and Family
Welfare is ready with a slew of measures to revamp
the scheme. The Government has not only
proposed that sample collection services for
various tests be available at the doorsteps of the
beneficiaries but that reports may also be viewed
online Hindustan Lever Limited will provide sample
collection services. Alongwith their card numbers,
the beneficiaries will be given a password which
will help them in viewing their reports online sitting
at home,” said Dr S. Bhattacharjee, Additional
Director, CGHS.
The (ministry has also recently got the nod from
the Cabinet to empanel any state-of-the-art
hospitals located outside the cities covered by
CGHS. “The ministry of Health is going to float
another tender to empennal more hospitals. The
last tender wasfloated in to 2006. There are no
specialised hospitals for diseases Iike cancer,
which will be taken care of this time even if they
are outside the CGHS cities. Health Secretary,
Naresh Dayal told the Indian Express.
The Government is also planning to do away with
the time-consuming “referral letter” system where
the patient is required to obtain a referral letter
from the Chief Medical Officer (CMO) before^ being
able to avail of services at CGHS-empanelled
hospitals.
The alarming rise in lifestyle diseases has
prompted the Ministry into looking at introducing
free prevention health check-ups for all the
beneficiaries aged 40 years and above. The
dispensaries will also be equipped with dialysis
units, ultrasound machines and X-ray machines.
We are entering into a Public Private Partnership
(PPP) with Apollo hospitals which will provide
instruments for dialysis. The dialysis will . be
done at as low a rate as Rs. 1500, added Dr.
Bhattacharjee.
Moreover, since CGHS dispensaries are currently
restricted to 25 cities, the Government has begun
work on a health insurance scheme for Central
Government employees after the Sixth Pay
Commission recommendation last year. While,
the Union Health ministry says that it is practically
not possible to provide CGHS dispensaries in other
cities, keeping in view the shortage of
infrastructure, it has decided to make available
the option of health insurance for government
employees in non-CGHS areas.

RREWA website is a boon to pensioners

WHERE CAN a government pensioner get all
the info he needs, provided he is a computer
literate? Just one source – RREWA website is
enough.
Retired Railway Employees Welfare Association
(RREWA), located in Gurgaon, was established
in 1998 and their website was launched in 2007.
The website has all the circulars, guidelines,
rules, regulations and other details that a
pensioner may look for. Especially after the
revision of salaries and pension by the sixth pay
commission, its usage has shot up. On the home
page, there is ticker reminding the user, say,
that it is time to file life certificate. Nearly 480
documents are filed under some 22 categories
neatly indexed. It would be useful if the scope of
each category is described somewhere.
There is separate section for senior citizens –
who need not be pensioners. Useful info on
health, travel, concessions and housing are
given. Useful links, though just a few (20) are
highly relevant. I found link to Indian newspapers
on the web very comprehensive as it enumerates
more than 320 media sites. There is a discussion
forum but it is merely a blog site with a few blog
posts and comments thereon. Difference
between ‘what is new’ and ‘current issues’ is not
clear. Links to government websites are most
useful. There is even a facility for learning basics
of Internet online! As far as state government
pensioners are concerned links to local
departments (AG’s office) are provided via a map.
Serious users need to register and pay a
subscription fee – one time, nominal amount.
Within a matter of two years the number of
visitors has crossed 66000, which is a creditable
achievement considering that visitors need to be
senior citizens who are net savvy. Credit goes
to SC Maheshwari for his undaunted efforts in
reaching out to customers and for his support
staff who keep the site regularly updated such
that frequent visitors do not go disappointed. The
site is advertisement supported (hospitals,
colleges, job sites etc) which again confirms that
sponsors find it worth advertising here.

THE FOURTEENTH annual issue of the
Pensioners Journal, published by the Retired
Railway Employee’s Welfare Association
(RREWA), Gurgaon, for the year 2009, was
released recently.
It provides lot of useful information to pensioners.
Circulars of the government departments
affecting all pensioners, articles on Health
(obesity, sleep disorders, Ageing issues) and
even legal matters (wills, court verdicts) are given.
Eight court verdicts are briefly summarised with
pointers to full text in the RREWA website.
Particularly, it has a section with an exhaustive
article on current budget and personal taxation
written from a senior citizen’s point of view. The
impact of the new Direct taxes code is also
reviewed.
The editorial by S C Maheswari, gives out a
clarion call to all pensioners to get united and
force the government to listen to their demands.

A Report: A unique case of Administrative
Efficiency of DRM / KIR / N.F. Railway Office -
Issuing P.P.O. In the name of wife ( widow ) of A
Living Pensioner, Mentioning As “Late” ! . Sri
Khoka Paul, Sr. Trackman, under SSE / P-WAY
/ S / NJP, was ordered to retire from Railway
Service W.E.F 30. 12. 2008, On being declared
as ‘’Medically UNFIT” for all-category of Railway
Services by the Medical department ( CMS / NJP).
Accordingly, all the F.S. Papers of 5n Khoka Paul
was prepared and sent to DRM (P ) KIR’s office.
Based on the above F.S. Papers, Cheques for
some of the F.S. items were aiso released
bearing the name of Sri Khoka Paul. But. on 21-
10-2009 when Sri Khoka Paul approached the
Central Bank of India, New Jalpaiguri Branch for
payment of monthly pension, he was informed
by the Bank that they have received a P.P.O No.
0206090144 dt. 11.08.2009 in the name of Smt.
Tara Devi, widow of Late Khoka Paul and hence,
the Bank Management were not in a position to
arrange payment of monthly pension to Sri Khoka
Paul, who is supposed to be “Dead”, though
physically alive. Incidentally, the P.P.O Book was
bearing the Account No. of Sri Khoka Paul alone
and there was no separate Account No. in tne
name of Smt. Tara Devi. It was a shocking affair
for Sri Khoka Paul, who was living from hand to
mouth because of non receipt of Salary for a long
time while in service, due to prolonq sickness.
Our organization directed Sri. Paul to meet Sr.
DPO/KIR with a copy of above PRO requesting
him to arrange release of his due pension.
Subsequently, the Sr. Divisional Finance
Manager. N. F. Rly, Katihar, admitting the mistake
committed by the Railway, issued a letter vide
no. KSR/PN/o206090144. Dt. 22-10-2009 to the
Manager, Central Bank of India, Jalpaiguri/ New
Jalpaiguri Branch, to return the Disburser’s and
Pensioner’s copy of the said PPo for preparing a
fresh copy of the same.
Obviously, the Bank will take its own time for
sending the above PPO and in return, the Railway
will also take a long time, as we know, for
reprocess and re-issue of the same to the Bank
concerned, as a result of which the party will
continue to suffer at a no fault of him. It is expected
that the Rly. Administration should apologize to
Sri. Khoka Paul, for causing him so many
sufferings, providing with adequate compensation

Members urged immediate finalization of pre-2006
& post-2006 cases as per SCPC award, sanction
of life-time pension for unmarried/widowed/
divorced daughters of Ex- Pensioners, withdrawal
of 25 years bar for handicapped & mentally
challenged dependents of pensioners, control of
abnormal prices of food items and strengthening
of PDS. A delegation met Sr. DPO who gave an
assurance that all pending cases will be settled
in 2009 itself.
MOHALI: Defence A/cs Pensioners Welfare
Assn – Monthly meeting was held on 01.11.09.
It was resolved to demand addl pension at 5%,
10%, and 15% for pensioners of 65, 70, and 75
years of age respectively and an increase in FMA
from Rs 100 to Rs 1000/- pm w.e.f. 01.01.06.
The State Govt was requested to reconsider
abnormal increase in Domestic Water & Sewage
charges and also to re-introduce Chief
Commissioner System scrapped 20 years ago
when militancy was high in Punjab.
NELLORE: A P State Govt R E A – Meeting
was held on 20.09.09. The meeting condoled the
death of D S Nakra, Pension Rathna and 3 other
members of the Assn. Members were informed
about the Addl Dearness Relief released by the
State Govt at 8.478% for pensioners. President
urged all members to file their Life Certificates
before the due date. Secy briefed the members
about the activities of the unit during the month.
Birth Day Greetings were extended along with
gifts to those members born in September.
PATIALA: Sr Citizens Assn – Monthly meeting
was held on 02.11.09 under the chairmanship of
newly elected President A L Sharma. (The latter
was elected in a special AGM held on 01.09.09
in the place of Ram Singh Tuli who expired on
21.08.09. Earlier the meeting condoled the death
of R S Tuli and 2 minutes silence was observed
for the peace of departed soul. In the same
meeting, Gurmukh Singh was elected as V P).
In the meeting held on 02.11.09, the Gl Secy
read out the activities of the unit. The President
read out important orders from ‘Bharat Pensioner’
– (Sep & Oct’09 issues). The Treasurer presented
Annual Financial Report. Birth Day Greetings
were extended to two members along with gifts.
SRI GANGANAGAR: C G P A – In the meeting
held on 01.01.09, the decision of Hon’ble
Supreme Court, the report of ‘Committee of
Secretaries’ and various resolutions of
Pensioners Associations in India regarding the
extension of full parity of pre 1996 & post 1996
pensioners was discussed. The report of
‘Committee of Secretaries’ laid down that the gap
of pension of pre-1996 and post-01.01.06
pensioners should be removed. It was decided
to send letters to the Hon’ble Minister of Health
to issue immediate orders enhancing the FMA
from Rs. 100/- to Rs. 1000/- p m w.e.f. 01.01.06
and the Hon’ble Minister of State for Personnel.
PG & Pension – to bring parity in pension of pre
1996 & post 1996 pensioners, increase in FMA
to Rs. 1000 with DA thereon, to drop the proposal
compulsory Health Insurance Scheme and
extend pensioners benefits to BSNL Pensioner
at par with Central Govt Pensioners including
merger of 50% IDA to BSNL Pensioners who
retired prior to 01.01.07. Accordingly separate
letters were sent to the Hon’ble Ministers by
CGPA Sriganganagar on 12.11.09.

Paper notified on 12-8-09.
While appreciating the principles laid down in
Paras 3..2; 3.4; 3.5 and 4.1 of Discussion Paper
.Bharat Pensioners’ Samaj on behalf of Senior
Citizens & Pensioners of India would like to bring
out the followings for your personal consideration:
1. In our country, Income of Senior Citizens &
pensioners gets reduced day by day due to
deteriorating interest rates and unbearable price
rise for food items and medical facilities due to
which ,many a time their consumption is more
than the income. As compared to younger citizens
They can not enjoy to the same extent, the Public
Goods and Services provided by Government for
citizens (Para 4.1 of Discussion Paper) due to
immobility and many other factors. Their ability
to pay Tax (Para 3.2) gets reduced year to year
after retirement due to less income, more
expenditure on food & medicines. Their Net Worth
(Para 3.4) gets reduced considerably as compared
with the beginning of the year and goes on
reducing year by year. There are many other
factors, which also require to be considered .All
Senior Citizens should be completely exempted
from paying Income Tax. They have paid a lot of
Tax for 30-40 years during their earning period
and have worked hard for achieving Independence
as well as present Economic Growth.. Still if
complete exemption can not be allowed,
exemption up to 5 lakhs instead of only 2.40 may
be allowed.
2. As per Para 12.4 of Discussion Paper, some
incentives have been given for savings with the
hope that people will be encouraged to save. In
view of EET proposal and permitting the savings
in only 4 Savings Intermediaries, how it is
expected that any Sr citizen at the fag end of life
would like to invest willingly? All contributions in
all kinds of P.F. will also be taxed at the time of
withdrawal. Keeping savings in P.F. till retirement
is otherwise also compulsory, as they have no
other alternative. Now keeping Retirement benefit
in specified instruments to save tax will be a big
burden on retiring person (due to EET), who has
to use his savings for marriage of daughters,
education of children, acquisition of house or for
medical treatment etc. EET and restriction of 4
Saving Intermediaries shall kill the incentive to
savings and they may find paying tax in the
current year to be more beneficial than paying it
at the time of their need in future years. People
will try their best to show less income and hoard
money instead saving for productive progress of
the Country. Senior Citizens, whose income is
getting reduced from year to year due to reduction
in rates of interest, prevailing and expected rate
of rise in cost of living and medical treatment, will
be at a very great disadvantage by EET rule.
Though, limit of savings is proposed to be
increased to 3 lakhs, Senior Citizens will be
discouraged to save anything due to EET and
only 4 saving intermediaries ,thus will loose
present incentive of getting rebate for saving of
Rs 1 lakh and will have to pay more . Keeping in
view their deteriorating financial and physical
condition from year to year , their capability to
pay tax and to ensure that their Net Worth does
not get reduced, as provided in Paras 3.2 and 3.4
of Discussion Paper, EET may not be applied to
Senior Citizens.
Senior Citizens need medical treatment as a
natural consequence to ageing and travel for
pilgrimage or for compulsory social obligations
and as such, they should be exempted from tax
on such facilities, keeping in view their reduced
financial capacity.
3. As per Para 7.3 of Discussion Paper, some
deductions are allowed to serving employees from

their income. In absence of any employment and
utilization of Senior Citizens by Government, it is
necessary for Senior Citizens to go somewhere
or other compulsorily to pass their time usefully
like going to temples, associations, pilgrimage,
doctors, hospitals etc. They should also be given
some annual allowance.
4. As per Para 7.7 of discussion paper Under the
Code, the salary will now include, inter-alia, the
following:-
a. The value of Rent free or concessional
accommodation:-
7.7(a) The value of rent free, or concessional,
accommodation provided by the employer
Irrespective of whether the employer is a
Government or any other person :- Besides helping
the employee, provision of concessional
accommodation is in the interest of the
establishment being served by such an employee,
as he/she when resides in the vicinity of work
place, is able to lend more time & concentration
to work and is always at the back & call of the
employer. More so it is counted against his/her
pay package, such employees loose HRA. In
several essential categories of employment (as
in Railways ) employees are normally compelled
to live in inferior & poorly maintained official
accommodation. Thus taxing such a facility will
not be fare ,will cause wide spread discontentment
affecting efficiency
b. The worth of any leave travel concession;
7.7 (b) The free or concessional travel is one of
the service conditions in Railways ,Air lines &
the Army .During the service period most of the
employees due to official & domestic
responsibilities are unable to make full use of
the facility .After retirement when an employee
finds time for seeing the country/pilgrimage or
visiting near & dear ones in distant places this
facility is reduced to less than the half .Taxing
even this reduced facility which is part of service
condition will be against the social structure of
the country & will deprive middle class elderly
pensioners of the opportunity of pilgrimage,
meeting relatives & seeing their beautiful country
with diverse culture .It will be a rude blow to poor
pensioners & should not be resorted to .
7.7(c) The amount received on encashment of
unavailed earned leave on retirement or otherwise:-
Earned leave remain unavailed due to (1.)
Employee is not spared on leave by the employer
due to the exigencies of services.
(2).Near retirement employee sacrifices the
privilege to save leave for encashment as a part
of retirement planning to fulfill social obligations
like children education, daughter’s marriage ,
acquisition of a residence for self & dependents,
which should in fact be encouraged in a socialistic
State. Taxing it will not be fare & cause
resentment. Which will reflect in work culture.
(d) Medical reimbursement; and (e) The value of
free or concessional medical treatment paid for,
or provided by, the employer.:-
7.7 (d) & (e)As has been ruled by the Honourable
Supreme Court also. Medical attendance &
Treatment from the employer is a fundamental
right of present & past employee .Moreover,
beneficiaries of RELHS,CGHS & ECHS have
already paid life time contribution to the
government . Senior Citizens need more medical
attendance & treatment as a natural
consequence to ageing which is beyond their
control .Taxing this Fundamental right of elderly
at the fag end of their lives will be against social
justice & the concept of the constitution, besides
it will make a big hole in the pocket of already
over stressed (due spiraling prices) middle class
Pensioner who will hardly be able to bear it , will
brew discontent & anti govt. feelings.
5. Para 12.13 provides rebate up to Rs 60000 for
treatment for prescribed diseases. Prescribed
diseases are not mentioned in Code or Discussion
Paper. This may be done. As all Senior Citizens
are suffering from some ailment or other due to
ageing, this provision should apply to all medical
expenses of Sr citizen and not restricted to

prescribed diseases only. As medical treatment
is very costly, this limit of 60000 should
separately apply to self and dependent spouse.
As ailments due to ageing is beyond control of
Senior Citizens, this is a disability and provisions
of Para 12.14 as handicapped may also be
applied to Senior Citizens.
6. Para 12.18 gives rebate to self employed
persons for rent in excess of 10%. Similar rebate
may be given to Senior Citizens staying in rented
houses.
7. Sec 67 of the Code allows deduction for fees
of 2 children. There are certain families in which
children are not earning much and depend upon
their better placed parents. In such cases, if any
Senior Citizens pay such fees for 2 grand children,
they should be allowed this deduction. Similar
deduction for payment of Insurance Premium in
Sec 69(3) by Senior Citizens for their children or
grand children may also be allowed to them.
8. Sec 200 of the Code makes it compulsory for
deduction of Tax at source above Rs 10000 from
one source.As major source of income of sr
citizens after retirement is from interest on their
life’s savings,they will be worst affected by this
section It will be difficult & cumbersome for Senior
Citizens due to their old age ailments & lack of
support , to obtain certificate for exemption from
Assessment Officer every year. The provision will
encourage illegal Suvidha Tax . Present
practice or similar practice as Form 15 H etc
may be continued for Senior Citizens.

BUREAUCRATS TO CONTINUE

NEW DELHI: Corrupt government officials don’tneed to worry. The government has decided toreject demands for diluting the constitutionalprotection accorded to bureaucrats against theirremoval, a demand reiterated just two monthsback by Law Minister M. Veerappa Moily.
The constitutional protection to bureaucrats wasaimed at ensuring that they could actindependently and honestly but it often stands inthe way of the government proceeding againstthe corrupt.
Moily had told a seminar on corruption inSeptember that he had taken up the need to“revisit” the constitutional provision (Article 311}with Prime Minister Manmohan Sihgh.
But the government told Parliament this week thatthere was no proposal to amend the Constitution.
“There is no proposal with the Government toamend Article 311 of the Constitution of India,which provides for certain protection toGovernment employees,” Prithviraj Chavan,Minister of State in the Ministry of Personnel —the Prime Minister is the cabinet minister incharge— told Rajya Sabha on Thursday.
Ghavan also rejected suggestions that thegovernment had proposed a new legislation forseizure of illegal assets of officials in corruptioncases.
The Second Administrative Reforms Commissionhad also made similar recommendations.

Time has now come for pensioners to ACT for implementation of our just demandsarising out of the unsatifactory implementation of 6th CPC recommendations, like non-grant of Modified parity, what to speak of full parity, introduction of the anti - employee, anti-pensioner Central Health Insurance Scheme, and non-grant of increased FMA @Rs 1,000wef 01.01.06 even though the recommendations were made as early as on 16.03.08.
The AGM of Bharat Pensioners Samaj held at New Delhi on 01.11.09 gave an urgentcall for taking all necessary steps, to achieve our goals, like Mass Petitions to Parliament,Mass Meetings, Dharnas, Pradarshans, Deputations, campaign of Post Cards to the PensionMinister, Shri Prithviraj Chavan, Minister of State in PMO, North Block, New Delhi 110 001.The urgent demands for the Post Card campaign are listed below:
