NEW DELHI, Feb 16:

Delhi High Court todayreserved its verdict on appealsfiled by the Centre against sin-gle judge order which had saidthat Attorney General of India's(AGI) office is a public author-ity falling under the ambit ofthe Right to Information Act.

A bench of Chief Justice GRohini and Justice Jayant Nathreserved the order after the par-ties concluded their argumentson the appeals filed by theMinistry of Law and Justice.

During the arguments,advocate Prashant Bhushan,who appeared for RTI activistSubhash Chandra Agarwal,said the Supreme Court hasheld in various judgements thatcitizens have a right to knowwhat their representatives aredoing.

"Are people of the countrynot entitled to know whetherthe government has acted onthe aid and advice of the

Attorney General," Bhushantold the bench.

He argued that AGI's officeis created by the Constitutionand it is vested with variousstatutory powers and functions.

Additional Solicitor GeneralSanjay Jain argued on the legalaspects in support of theappeals filed by the ministry.

The ministry had filed theappeals against a March 10 lastyear order of the single judgebench bringing the AGI's officeunder the ambit of RTI Act asthe top law officer performedpublic functions and hisappointment was governed bythe Constitution. In its order,the single judge bench haddeclared AGI's office as a pub-lic authority, saying he per-forms the functions as arerequired by virtue of Article76(2) of the Constitution andhad set aside a December 2012CIC order that AGI is not apublic authority.

The court had also refusedto consider the government'sargument that there was practi-cal difficulty in providinginformation under the RTI Actas the office of the AGI doesnot have the requisite infra-structure.

The court had remandedback to the Central InformationCommission (CIC), the pleasof RTI activists Agarwal and RK Jain, who had sought that theAGI's office be declared a pub-lic authority under the trans-parency law. The court haddirected the AGI to reconsiderthe RTI application of Jain ashis plea for information wasdenied on the basis of the CICorder that the office of AGI isnot a public authority.

The CIC, in its 2012 order,had expressed the opinion thatthe AGI was only a person andcould not be considered as an"authority" and, therefore, felloutside sweep of section 2(h)of the RTI Act. Section 2(h) ofthe Act defines 'public authori-ty'. (PTI)

As per police sources, onspecific information, a teamfrom Bishnah police stationconducted a raid and arrestedan absconder, who was at largesince long.

The accused has been iden-tified as Zakir Hussain, son ofHussain Din of Laswara,Tehsil Bishnah.

He was wanted in variouscases registered with differentpolice stations includingBishnah, Gangyal, GandhiNagar, Channi Himmat andNoorpur Himachal Pradesh.
